Abstract

Tulisan ini mengkaji Undang-Undang Republik Indonesia Nomor 23 Tahun 2004 tentang Perubahan atas Undang-Undang Republik Indonesia Nomor 10 Tahun 1998 tentang Bank Indonesia, yang berlaku umum. Sedangkan Undang-Undang Republik Indonesia Nomor 21 Tahun 2008 tentang Perbankan Syariah, berlaku khusus. Penerapan asas lex specialis derogat legi generali menegaskan bahwa Undang-Undang Republik Indonesia Nomor 21 Tahun 2008 memiliki kedudukan lebih kuat dibandingkan Undang-Undang Republik Indonesia Nomor 23 Tahun 2004 yang berlaku umum. Keberlakuan Undang-Undang Republik Indonesia Nomor 21 Tahun 2008 mengokohkan eksistensi perbankan syariah untuk leluasa menjalankan aktivitas dan produk-produknya. Di samping itu, apabila merujuk kepada Undang-Undang Republik Indonesia Nomor 30 Tahun 1999, maka penyelesaian sengketa perbankan syariah dapat ditempuh melalui dua cara yaitu, pengadilan negeri dan badan arbitrase. Namun setelah berlakunya Undang-Undang Republik Indonesia Nomor 21 Tahun 2008 Pasal 55, dengan jelas disebutkan bahwa pengadilan yang berwenang melaksanakan putusan Badan Arbitrase Syariah Nasional (Basyarnas) dan menyelesaikan sengketa perbankan syariah adalah pengadilan agama.(This paper reviews the Act of the Republic of Indonesia Number 23/2004 regarding Amendment to the Act Number 10/1998 concerning Indonesia Bank, which is in effect generally. On the other hand, the Act number 21/2008 regarding sharia banking applies more specifically. The application of lex specialis derogat legi generali principle confirms that the Law of the Republic of Indonesia Number 21/2008 has a stronger position than the Law Number 23/2004, which is generally in effect. The enforcement of the Law of the Republic of Indonesia Number 21/2008 affirms the existence of sharia banking to freely run its activities and products. In addition, when referring to the Law of the Republic of Indonesia Number 30/1999, the resolution of Islamic banking disputes can be done through two ways, namely, the district court and the arbitration body. However, after the Law of the Republic of Indonesia Number 21/2008, Article 55 comes into effect, it is clearly stated that the court authorized to enforce the decision of the National Sharia Arbitration Board (Basyarnas) and settle the disputes over sharia banking is a religious court)

Abstract

This research about Islamic law is as the applicable and acceptable law in Indonesian society. Islamic law placed inheritance law to regulated directly with the problems of socio-cultural in community, using the theological normative, yuridical and sociological approach. However, the Islamic inheritance lawstill regulated in the Instruction President Number 1, 1991 on KHI. The enforcement of KHI has not given satisfaction among Muslims including Islamic jurists. It caused the existence of KHI was not placed in the hierarchy of legislation Indonesia. Nowdays, the spirit of Islamic Indonesian society in order that the Islamic inheritance law will be legislated as well as marriage law. Even though, when the application of the Islamic inheritance law in the form of legislation as national law, the principle of justice should be Implemented in human life, family and society, even nation life.

Abstract

The issues raised include the concept of juvenile criminal law from the perspective of fiqh jinayah and positive law, differences in the concept of juvenile crime from the perspective of fiqh jinayah and positive law, the correlation of the concept of juvenile crime to the fiqh perspective and positive law. To study and answer the problem, a multidisciplinary approach is used, namely the normative theological approach (syar'i), juridical/legislative (statue approach), historical (historical approach), sociological (sociological approach), psychology (psychological approach). This research is classified as library research. The results of the study indicate that perpetrators of sexual abuse with child victims, in positive law and fiqh jinayah, sanctions are deterrent so that the perpetrator does not do it again. The laws governing this matter, namely the Republic of Indonesia Law Number 3 of 1997, Law Number 23 of 2002 concerning Child Protection and Law no. 4 of 1979 concerning Child Welfare. In contrast to Islamic law (fiqh), children's perceptions and forms of accountability make criminal acts of children not subject to Uqubah (punishment), but takzir (warning) and ta'dibiyyah (coaching) only. The correlations between the two are: (1) The principle of respect for children. (2) The process of applying punishment for a child who is a criminal act in positive law that is different from a criminal act other than a child. If viewed from the mashlahah rules, giving takzir and ta'dibiyah to children who commit crimes is mashlahah hajiyat (secondary) and mashlahah mulgah.

Abstract

Eksistensi Ilmu Falak dan menyebarnya Ilmu Falak menjadi sebab kalibrasi arah kiblat masjid menjadi wajib, begitu juga Masjid Agung A.G.K.H. Abdul Rahman Ambo Dalle Kota Parepare. Kesimpulan awal peneliti berdasarkan pengukuran berbasis Google Earth arah kiblat Masjid Agung A.G.K.H. Abdul Rahman Ambo Dalle Kota Parepare melenceng ke arah selatan. Tujuan Penelitian ini yang pertama mendeskripsikan penggunaan metode arah kiblat Masjid Agung A.G. KH. Abdul Rahman Ambo Dalle Kota Parepare. Kedua, analisis historis dan kalibrasi arah kiblat dengan hisab kontemporer menggunakan alat aplikasi Google Earth, tongkat istiwa dan theodholite. Hasil penelitian ini yang petama bahwa metode pengukuran arah kiblat Masjid Agung Kota Parepare menggunakan metode Kompas. Kedua, Kalibrasi arah kiblat berdasarkan metode Google Earth ditemukan kemelencengan arah kiblat. Adapun hasil kalibrasi dengan metode Tongkat Istiwa ditemukan kemelencengan arah kiblat sebesar 5o 30. Hasil Kalibrasi Arah Kiblat dengan metode theodholite ialah 6o. Berdasarkan tiga metodologi tersebut disimpulkan bahwa arah kiblat masjid agung kota parepare tidak akurat.

Abstract

One of the purpose of protection and maintanance maqasid al-shariah realize lineage (descent), protection lineage based maqasid al-shariah, Allah as the legislator has prescribed any marriage law, a law that can be able to organize ang arrange an orderly nasab and surely, determination maqasid al-shariah in a marriage that is not accounted for by consideration of the principles of benefit for the registrate to uphold justice and the rule of law; the marriage is not registrated that it is too possible to registrated without the necessary repeated marriage, so that the benefits of the more dynamic registration of marriage any one be discriminated againts, so can be easily children and wife get the protection of civil rights. Marriage if it is possible to registrate, but not registrated is actually obscure the values of justice and maslahat in maqasid al-shariah. Saveral regulatory laws that exist in the Republic of Indonesia, is no exception of UU RI No. 1 Tahun 1974 concerning marriage can be applied elasticly, reflecsibly and dynamicly, rather than the reserve applied in staticly, rigidly and descructively that people are not discriminated againts in realizing values of protection, justice and rule of law; children born in marriage unattended or not registrated not seen let alone considered child out of marriage, not in the block to get its civil rights, but the goverment as a law enforcement and legislatory enforcement make registrated that marriage is not registrated.

Abstract

This article describes the problem attempts to dissect the articles in the Compilation of Islamic Law (KHI) in order to identify the principles of family law contained therein. From the identification results, it found the principles of family law, namely the principle of freedom, protection and preventive principles, the principle of monogamy, the principle of responsibility and justice, principles ijbari, bilateral principle, the principle of impartial justice, and the principle of legal certainty. Therefore, it can be affirmed that KHI had to cover the principles of family law. Except that, found some irregularities, inconsistencies and overlap, among others: (1) Lots of articles KHI is a duplication of the Law no. 1 of 1974, which should not speak in procedural areas, but focus on the substance, (2) In the use of the term, several articles in the KHI is less clear, or overlap and seem inconsistent in the use of words or phrases, such as words and qabla mitsaaqan ghaliizhan al-dukhuul, guardian of marriage, and marriage witnesses, (3) remove the authority of the guardian turns KHI mujbir to marry a woman without that person's consent, (4) KHI allow consent granted to a given power law.

Abstract

Abstract: This paper is intended to reveal how the mechanism and implementation of bride and groom courses in the Office of Religious Affairs (KUA) Kecamatan Duampanua Pinrang District and the factors inhibiting and supporting the implementation of bride and groom courses in the Office of Religious Affairs (KUA) Duampanua District Pinrang District and how the bride's understanding of the the concept of sakinah family. The effectiveness of the bride and groom course has not been fully run in the community with various inhibiting factors, so the bride and groom have not fully understood the material about the concept of sakinah family that has been poured into the bride's course process.

Abstract

Tradisi mabbolo kuburu’ merupakan kearifan lokal yang di yakini keberadaanya secara turun temurun pada prosesi pasca pernikahan. Tradisi ini merupakan bentuk siturahmi kepada leluhur nenek moyang. Tadisi ini mengkaji mengenai gambaran awalmula tradisi mabbolo kuburu’ bagi pengantin baru di Bulu marante’e, proses pelaksanaan mabbolo kuburu’ bagi pengantin baru di Bulu marante’e dan pandangan hukum Islam terhadap mabbolo kuburu’ bagi pengantin baru di Bulu marante’e. Jenis penelitian ini adalah penelitian kualitatif (field research). Dengan menggunakan pendekatan teologis normatif dan pendekatan filosofis. Penelitian ini menggunakan sumber data primer yaitu observasi dan wawancara kepada toko-toko masyarakat dan sumber data sekunder yaitu buku-buku yang sesuai.Hasil penelitian ini menunjukkan bahwa, 1) sejarah mabbolo kuburu’ bagi pengantin baru di Bulu marante’e bermula dari kisah Puatta Arung Manumpe’ yang merupakan panutan bagi masyarakat hingga meninggal masih terus di kenang jasa-jasanya dan di lakukan dalam bentuk mabbolo kuburu’. 2) prosesi tradisi mabbolo kuburu’ bagi pengantin baru di Bulu marante’e dalam tahap pelaksanaanya perlu persiapan seperti a) mambawa makanan berupa nasi ketan, pisang raja telur ayam dan air b) membaca doa c) mabbolo kuburu d) makan-makan. 3) Tradisi mabbolo kuburu’ bagi pengantin baru di Bulu marante’e tentunya sejalan dengan hukum Islam karena dalam prosesnya masih mengandung nilai-nilai keislaman dan mengandung unsur kemaslahatan bersama.

Abstract

Penegakan Hukum Pidana Lingkungan dalam Perspektif Hukum Pidana Islam. (Studi Kasus Pantai Kupa Kabupaten Barru). (Dibimbing oleh Ibu Muzdalifah Muhammadun., dan Ustadz Budiman). Pokok permasalahan dalam penelitian ini tentang bagaimana bentuk perusakan lingkungan dan faktor apa yang menyebabkan terjadinya perusakan lingkungan serta bagaimana implementasi penegakan hukum terhadap pelaku perusakan lingkungan di Pantai Kupa Kabupaten Barru dalam perspektif hukum pidana dan hukum pidana Islam. Hasil peneliian ini menyatakan bahwa: bentuk perusakan lingkungan di Pantai Kupa adalah dalam bentuk reklamsi pantai, faktor yang menyebabkan terjadinya perusakan lingkungan di Pantai Kupa bermula terdakwa burhaman ingin membangun mushollah dan rest area di Pantai Kupa. penegakan hukum terhadap pelaku perusakan lingkungan di Pantai Kupa Kabupaten Barru dalam perspektif hukum pidana lingkungan sebagaiamana bukti yang terungkap di persidangan Hakim Pengadilan Negeri Barru menjatuhkan hukuman terhadap terdakwa 1 (satu) tahun penjara dan denda Rp 1 (satu) miliar dan 1(satu) bulan kurungan. Dalam hukum pidana islam sanksi terhadap pelaku perusak lingkungan diberi wewenang kepada ulil amri/penguasa yakni Hakim sehingga sesuai amar putusan hakim Pengadilan Negeri Barru dianggap sudah relevan dengan penegakan hukum pidana lingkungan dalam perspektif hukum pidana Islam.
