Abstract

Establishment of Regional Owned Enterprises (BUMD) An effort to reduce the dependence of local governments on balancing funds from the central government. This Regionally Owned Enterprise is mostly or wholly owned by regions of wealthy regions. This BUMD is a government instrument that has a role to develop the regional and even national economy. The existence of BUMD in successful regional economic activities is a new thing, but has been going on for a long time. The obligation to establish BUMD is to carry out regional development through services to the community, implementing public benefits and increasing the level of local government. The purpose of this study is to determine the legal description of BUMD in taking legal actions and what factors are obstacles for BUMD to achieve their orders. The research method used is normative juridical research method.

Abstract

Penelitian ini bertujuan untuk menganalisis penerapan nilai keadilan sebagai dasar pertimbangan Mahkamah Konstitusi No 74/PUU-XVIII/2020 Pengujian Pasal 222 Undang-Undang No 7 Tahun 2017 tentang Pemilihan Umum terkait dengan Legal Standing Pemohon. Penelitian ini merupakan penelitian hukum normatif. Hasil penelitian ini menunjukkan bahwa argumentasi  kerugian  konstitusional  para  pemohon  seharusnya  Mahkamah  Konstitusi  mempertimbangkan  kembali  terkait  kedudukan  hukum  para  pemohon.  Norma ambang batas (presidential threshold) pencalonan  Presiden  dan  Wakil  Presiden  yang  diajukan  oleh  para  pemohon  sangat berpotensi  menimbulkan  kerugian  konstitusional. Para  pemohon  juga  secara  konkret  telah  terjadi  suatu  peristiwa  hukum  dimana  partai-partai  baru  tidak  dapat  mencalonkan  Presiden  dan  Wakil  Presiden  yang  disebabkan  norma  ambang  batas  Pencalonan  Presiden  dan  Wakil  Presiden.  Diperlukan pengaturan  secara  spesifik  terkait  dengan  penentuan  kualifikasi  legal  standing  perkara  abstrak  dan  perkara  konkret  tehadap  pemohon  dua  perkara  tersebut  agar  dapat  terwujudnya  kepastian  hukum  dalam permohonan  judicial  review.

Abstract

The government as a public servant has responsibilities that are not limited by space, time, and circumstances. The government has an obligation to provide services to the community anytime and anywhere and under any circumstances, including disaster emergencies. COVID-19 is a disaster that limits the movement of every human being, including the government. However, government services to the community must still run in order to fulfill the basic needs of the community. One form of the government's responsibility during the Pandemic Period is to provide legal protection to every consumer. The problem in this research is how is the implementation of local government responsibilities to consumers during the Covid-19 Pandemic? This study used several approaches, the data were analyzed qualitatively-quantitatively, and the results were in the form of analytic descriptive. The conclusion of the research is that during the Covid-19 pandemic, the local government has carried out its responsibilities in accordance with laws and regulations, but not optimally according to consumer expectations.
