Abstract

Narcotics crime has reached all circles, not only ordinary people who have become victims of narcotics abuse, even police officers who are law enforcers are also involved. The results of this study indicate the role of the police in the investigation and investigation of narcotics crimes carried out by members of the police at the Bengkulu Regional Police based on reports by the public, the results of routine urine tests and the results of investigations as well as the development of cases being investigated, but there is also a role for the Provos and Paminal Units to carry out the investigation. the preliminary examination (investigation) and the process of investigating the violation of the code of ethics and the Ditresnarkoba continue to the investigation process of criminal acts that have occurred in accordance with those stipulated in the Criminal Procedure Code and Government Regulation Number 3 of 2003 concerning the Technical Implementation of General Courts for the Police. The member concerned is immediately suspended from his post at the police service, from the time the investigation is carried out until a court ruling has permanent legal force.

Abstract

Drug trafficking is an extraordinary crime. Circulation of narcotics is not only carried out by international, national scale networks, but is also carried out by prisoners in the Correctional Institution as perpetrators of trafficking. This study will measure the effectiveness of punishment against inmates who are perpetrators of narcotics trafficking in the Correctional Institution network in Bengkulu City. The results of this study indicate that the punishment of inmates who commit narcotics trafficking in the prison network has not been effective. Many factors have caused it to be ineffective, the most important of which is the number of inmates who are perpetrators of narcotics trafficking, the prison network continues to grow, while special prisons for narcotics cases are not yet available. Then, from the aspect of implementation and supervision of punishment in the Correctional Institution, it has not been carried out optimally due to limited human resources, both in quality and quantity. Convicts become perpetrators of narcotics trafficking in Correctional Institutions due to various things. For example, there is an influence from the environment of fellow prisoners who are perpetrators of narcotics trafficking in the Correctional Institution, as well as due to the economic factors of the prisoners.

Abstract

Salah satu produk dari era revolusi industri 4.0 adalah Internet. Internet sudah banyak penggunaannya diberbagai bidang kehidupan dan menembus tidak hanya di perkotaan bahkan hingga ke pedesaan. Penggunaan internet dengan segala isi dan kemudahannya mempercepat mendapatkan informasi. Fasilitas yang disediakan internet memberikan banyak informasi yang dibutuhkan, permasalahan internet banyaknya informasi yang tidak cocok untuk penggunaanya, adanya informasi yang belum tentu kebenaran dan sumbernya, permainan game online hingga tindak kejahatan penipuan dan cybercrime. Desa Tanjung Agung Palik merupakan salah satu desa yang warganya menikmati akses internet, baik orang tua, anak muda hingga anak-anak. Internet sehat adalah sesuatu metode dalam penggunaan internet dengan baik dan bijak, sesuai dengan kebutuhan. Permasalahan warga Desa Tanjung Agung Palik, adalah banyak nya anak-anak muda dan pemuda desa yang kurang pengetahuan bagaimana penggunaan internet secara sehat sehingga terhindar dari dampak konten-konten negatif penggunaan internet. Upaya pemecahan masalah tersebut dengan memberikan sosialisasi kepada warga, dengan kegiatan sosialisasi memberikan informasi kepada warga bagaimana mendapatkan informasi di internet yang baik dan sehat. Sosialisasi dilakukan dengan Forum Grup Discussion, serta pelatihan kepada warga. Hasil sosialisasi warga paham dan mengerti penggunaan internet, media sosial, media komunikasi, warga mampu memberikan arahan kepada keluarga untuk berlaku bijak dalam penggunaan internet sehari-hari.Kata Kunci: Internet, Media Sosial, Sosialisasi. Abstract

Dalam mengelola dan mempertanggungjawabkan keuangan negara, hendaknya mengutamakan asas transparansi dan akuntabilitas. Hal tersebut dikarenakan pengelolaan keuangan negara memang cukup rentan dengan pelanggaran bahkan menjurus pada penyalahgunaan wewenang, terutama ketika dalam proses pemeriksaan, pertanggungjawaban maupun setelahnya. Karena kerentanan itu pula, perlu berbagai upaya agar dapat menanggulangi pelanggaran atau penyalahgunaan wewenang tersebut, salah satunya melalui sarana penal. Penulis menganalisa kebijakan kriminalisasi penyalahgunaan wewenang dalam pengelolaan dan pertanggungjawaban keuangan negara yang dilakukan oleh pemeriksa keuangan, yang memang mempunyai kewenangan cukup besar dalam memeriksa pengelolaan dan pertanggungjawaban keuangan negara. Maka dari itu untuk menanggulangi penyalahgunaan wewenang tersebut, perlu keterlibatan dari masyarakat luas sebagai fungsi kontrol agar tercipta sistem pengelolaan dan pertanggungjawaban keuangan negara yang baik dan transparan.AbstractIn managing and taking responsibility for state finance should accentuate transparency and accountability principles. Because it is vulnerable with a violation that even it can lead to abuse of authority, especially when examining the process, accountability and after. So, it is necessary to prevent the violation or its abuse through court proceedings (penal). The writer analyzes criminalization policy of authority abuse in managing and taking accountability of state finance conducted by finance auditor whose big authority in examining of state finance. To prevent its abuse, it is needed the involvement of society as control function in order to create a good and transparency of management and accountability of state finance system.

Abstract

The impacts of new criminal acts containing pornography such as the criminal act of live-sex business are very dangerous in the life of a nation and country in general, as well as the young generation in particular. In relation to that, the problem in this research is about the criminal policies as an effort to tackle the criminal act of live-sex business in the present and in the future. This was a legal normative (doctrinal) research. The finding concludes that the criminal policies related to the criminal act of live-sex business are not explicitly governed by Pornography Law. However, there are several articles which are very close to such thing: Article 34 for the subjects and actors of live sex, and Article 35 for the viewers of live sex. The RUU KUHP (the draft of criminal law) accommodates the sanctions of the criminal act of live-sex business, but it does not govern it explicitly. Such thing can be seen in Article 469, Article 473, and Article 475 for the subjects; Article 472 and Article 474 for the viewers of live-sex scenes. In addition, non-penal policies, such as socialization and a good approach, are also necessary in order to make the efforts successful.

Abstract

Buku yang ditulis oleh Mora Dingin ini diangkat dari tesisnya, yang sebelumnya berjudul “Solusi Konflik Kehutanan dan Rasionalitas Masyarakat Hukum Adat (Studi Kasus Hutan Kemasyarakatan sebagai Solusi Konflik Kehutanan antara Pemerintah dengan Kaum Datuk Imbang Langit)”. Dikarenakan buku ini diangkat dari sebuah tesis, maka sistematika penulisannya sedikit banyak menyerupai tesis pada umumnya. Abstract

Absctract: The magnitude of the impact of the operation of the corporation, the corporation implies the operation is necessary and should be managed based on the principles of human rights, which aims to provide guarantees for the respect, protection and fulfillment of human rights. Then through the UN Human Rights Council recommends Framework, which is based on three pillars later called guiding principles of human rights. The regulations governing the operation of the corporation in the plantation sector in Indonesian must also formulate the principles of human rights. Therefore it is necessary to examine how policy-based plantation management law principles applicable human rights in Indonesia and weaknesses. Legislations studied the Law No. 18 Year 2004 on Plantation, Law No. 39 of 1999 on Human Rights (HAM), Law No. 5 of 1960 on the Basic Regulation of Agrarian (BAL), as well as various other legislations. Theoretical study of these regulations resulted in several recommendations, one of which is the holding of a regulatory overhaul needed to accommodate the principles of human rights completely.Keywords: Law Politics, Estates Management, Principles of Human Rights. Intisari: Besarnya dampak dari beroperasinya korporasi, mengimplikasikan beroperasinya korporasi perlu dan sudah seharusnya dikelola berdasarkan prinsip-prinsip HAM, yang bertujuan memberikan jaminan bagi penghormatan, perlindungan dan pemenuhan HAM. Maka PBB melalui Dewan HAM merekomendasikan Kerangka Kerja yang bertumpu pada tiga pilar yang kemudian disebut panduan prinsip-prinsip HAM. Regulasi yang mengatur tentang beroperasinya korporasi di sektor perkebunan di Indonesia haruslah juga merumuskan prinsip-prinsip HAM tersebut. Maka dari itu perlulah dikaji bagaimana kebijakan hukum pengelolaan perkebunan berbasis prinsip-prinsip HAM yang berlaku di Indonesia beserta kelemahannya. Peraturan perundang-undangan yang dikaji yakni Undang-undang Nomor 18 Tahun 2004 tentang Perkebunan, Undang-undang Nomor 39 Tahun 1999 tentang Hak Asasi Manusia (HAM), Undang-undang Nomor 5 Tahun 1960 tentang Peraturan Dasar Pokok-pokok Agraria (UUPA), serta berbagai peraturan perundang-undangan lainnya. Kajian teoritis dari berbagai peraturan ini menghasilkan beberapa rekomendasi, salah satunya ialah perlu diadakannya perbaikan regulasi untuk mengakomodir prinsip-prinsip HAM seutuhnya.Kata Kunci: Politik Hukum, Pengelolaan Perkebunan, Prinsip-prinsip HAM.

Abstract

Pendanaan merupakan unsur utama dalam setiap aksi terorisme. Penanggulangan tindak pidana pendanaan terorisme merupakan upaya penting dalam pemberantasan tindak pidana terorisme. Saat ini upaya pemerintah hanya terfokus pada penangkapan pelaku dan kurang memperhatikan pendanaan yang merupakan unsur utama dalam setiap aksi teror. Dengan latar belakang tersebut diperlukan kajian dan penelitian terhadap kebijakan hukum pidana dalam upaya penanggulangan tindak pidana pendanaan terorisme pada saat ini dan pada masa yang akan datang. Penelitian ini menggunakan jenis penelitian hukum normatif ( doctrinal) . Dari hasil analisis dapat ditarik kesimpulan bahwa, tepat jika perbuatan pendanaan terorisme merupakan perbuatan kriminal yang harus diatur dengan undang-undang khusus. Kebijakan hukum pidana yang akan datang, melalui rancangan KUHP, telah dirumuskan unsur perbuatan dari tindak pidana pendanaan terorisme. Adanya inkonsistensi perumusan sistem pidana minimal khusus terhadap tindak pidana pendanaan terorisme, sehingga diperlukan pembaharuan melalui perbaikan perumusan tindak pidana tersebut.Financing is a major element in every terrorism act. Countermeasure efforts toward terrorism financing is very important to eradicate terrorism. The government’s efforts currently is still limited to arrest the perpetrators and paid little attention on terrorism financing matters which is the main element of every terror act. This background shows that there is the need for more in-depth study and research on current and future criminal law policy about countermeasure effort against terrorism financing. This research uses normative legal research (doctrinal). From the analysis it can be concluded that terrorism financing is a crime that must be regulated by a particular law. Criminal law policy in the future through Criminal Code Draft (RKUHP) has formulated the elements of terrorism financing act. There are inconsistency in the formulation of special minimum penal system on terrorism financing crime. Hence there it is still need to be reformed through improvement of the crime formulation.

Abstract

 Criminal law policy in the effort to combat crime has 2 (two) main means, namely penal and non-penal. The penal policy is formulated in the regulation to eradicate money laundering. In this provision, the corporation has the same responsibility as individuals (natuur person). Corporations that are suspected of committing the crime of money laundering must first be proven whether the act classified as money laundering was carried out by an individual or on behalf of the management or corporation so that it can be sanctioned according to their respective qualifications. Another problem is that the imposition of imprisonment in lieu of fines in this regulation does not include an explanation regarding the calculation of confiscated corporate assets as a reason for reducing imprisonment in lieu of fines. Therefore, the policy for formulating corporate responsibility should be made by taking into account the extent to which the corporation moves in money laundering crimes, taking into account the consequences of these crimes. In addition, the corporate responsibility formulation policy must comply with the general provisions in the Criminal Code as the main guideline.Keywords: Policy; Criminal Law; Money Laundering; Corporation; Kebijakan hukum pidana dalam upaya penanggulangan kejahatan memiliki 2 (dua) sarana utama, yakni penal dan non-penal. Kebijakan penal dirumuskan dalam regulasi pemberantasan tindak pidana pencucian uang. Didalam ketentuan tersebut, korporasi memiliki pertanggungjawaban yang sama dengan individu (natuur person). Korporasi yang diduga melakukan tindak pidana pencucian uang harus terlebih dahulu dibuktikan apakah perbuatan yang tergolong pencucian uang tersebut dilakukan oleh individu secara pribadi ataukah mengatasnamakan pengurus atau korporasi sehingga dapat dijatuhkan sanksi sesuai dengan kualifikasinya masing-masing. Problem lainnya adalah penjatuhan pidana kurungan pengganti denda dalam regulasi ini tidak mencantumkan penjelasan mengenai perhitungan kekayaan korporasi yang dirampas sebagai alasan pengurangan pidana kurungan pengganti denda. Maka dari itu, kebijakan perumusan pertanggungjawaban korporasi hendaknya dibuat dengan memperhatikan sejauh mana pergerakan korporasi dalam kejahatan pencucian uang, dengan mempertimbangkan akibat yang ditimbulkan dari kejahatan tersebut. Selain itu, kebijakan perumusan pertanggungjawaban korporasi haruslah berkesesuaian dengan ketentuan umum dalam KUHP sebagai pedoman utamanya.Kata Kunci: Kebijakan; Hukum Pidana; Pencucian Uang; Korporasi;
