Abstract

This article aims to determine the women rights in Islam, in post-divorces and in knowing the analysis of judges’ decision in Palopo Religious Court regarding the women rights after divorcing. The findings showed that the judges decision regarding the rights of women were concluded as follows; 1) the contested or talak divorce cases by verdict judgment did not cover the wives rights in which judges presumption should not decide the case on the outside of the charge materials (ultra-petition). So that, the judge did not have the courage to assign or guarantee legally the women rights after divorcing such as Muta, child custody, property rights if not being the charge materials. 2) The contested divorce cases did not cover any lawsuit regarding the wives rights. Although the judge had the ex officio rights in determining the wives rights whether requested or not, the judges of Palopo Religious Court were just in case of the cause of divorce where the husband and wife were not willing to be divorced. So, the judges utilized their ex officio rights to punish the husbands for providing Muta according to their ability and feasibility. 3) In reconvenes decision, it was clearly mentioned the wives rights in the judges’ decision in which they are Iddah living, Mutah, past living, and the child costs. At the living Iddah costs, it was decided by Palopo Religious Courts Palopo that it is not in the same nominal amount. It is also similar with the Mutah and children costs.

Abstract

Child abuse merupakan kekerasan atau perilaku yang salah pada anak. Bentuk-bentuk child abuse diantaranya kekerasan secara fisik, kekerasan secara psikologis, kekerasan secara seksual dan kekerasan secara sosial. Hukum Islam secara konsisten mendukung upaya perlindungan terhadap anak termasuk hadanah sebagai konsep Islam tentang pemeliharaan anak hingga menjadi dewasa dan baliq, dengan pemenuhan dimensi wiqayah, dimensi Siyanah, dimensi Kafalah, dimensi Ta’lim wa’ at-Tarbiyah pada anak. Adapun Child abuse menurut tinjauan hukum Islam, merupakan perbuatan yang  menyalahi tujuan hukum Islam, maqashid al-syariah al-dharuriyah terutama berkenaan dengan Hifz al-nafs, terlindunginya hak hidup dan jiwa bagi anak, sehingga syariat Islam memberikan konsekuensi hukum qishash, diyat dan ta’zir bagi pelaku child abuse yang telah melakukan kejahatan seperti pembunuhan dan penganiayaan, baik sengaja maupun tidak sengaja.

Abstract

The breakdown of marriage can actually be minimized by peace, as enshrined in the principles of procedural law, namely the principle of religious courts must reconcile the more complete set in Article 65 and 82 of Law No. 7 Year 1989 On the Religious. The process is known and efforts to reconcile with the mediation process. Article 76 of Law Number 7 Year 1989 jo. Law No. 3 of 2006 jo. Act No. 50 of 2009 has established the existence of Hakam in existence similar to divorce mediator. On the other hand, raised the question of imposing a mediation in divorce cases that have dilegalformalkan with Perma No. 1 of 2008 on Mediation Procedures in court, while Hakam as part of the procedural law is legitimized in advance rather than mediation. Writing is how the existence of Hakam and mediation in the judicial review court proceedings religion.

Abstract

This article aim at explaining the inter relation between local wisdomof pela gandongand cultural communications and also cultural communications of pela gandong based on theperspective maqasid syariah. The problem in this article is studied by using maqasid syariah as abasis for theory in studying local wisdom of pel gandong exist in Ambon. The result of thisstudy indicate that pela gandong besides having a meaning of tying also bear communicationspattern from two communities. This matter is shown with the quality of genetic relationshipbetween different citizen of community with call, the naming of greeting basudara (brothers).As cultural communication, pela gandong born from under, local wisdom of pela gandong havelinked relationship of human which in character as a human also and do not limit byvariousrules and normative limitation but as compliance and awareness and respect at ancestorsafter all pela gandong represent maximal masterpieces from all ancestor of Ambon - LeaseMaluku and formed from the way of thinking and behave from society when they respond theproblems of arising around them. Besides, pela gandong is suitable to maqasid syariah. Thismatter can be seen that target of law or declaring of law that was degraded by Allah is for thebenefit of mankind. Of that account, maqasid syariah can be told as benefit ―delivering all kindof benefit or refuse all damage possibility‖. This matter in line with existence of local wisdomof pela gandong recognized to society of Ambon with aim at creating peace in interfaith whichis symbolized with brotherhood (sister and brother). With existence of pela gandong, it appeartolerance in religion to be able to produce well-balanced cooperation among religionpeople insocial activity, economic, defense, security, environment, etc. Besides, demage of which canmeance soul, slan, property and mind can be avoided by the existence of pela gandong.

Abstract

Artikel ini bertujuan untuk mengkaji fatwa mengenai ekonomi syariah di Indonesia yang meliputi metode dan proses penetapan fatwa tentang ekonomi syariah serta fatwa-fatwa mengenai ekonomi syariah yang dikeluarkan oleh lembaga Dewan Syariah Nasional Majelis Ulama Indonesia. Lembaga ini bertugas untuk menggali, mengkaji, merumuskan nilai dan prinsip-prinsip hukum Islam (syari’ah) untuk dijadikan pedoman dalam kegiatan transaksi di lembaga-lembaga keuangan syariah, serta mengawasi pelaksanaan dan implementasinya. Pedoman inilah yang kemudian dituangkan dalam bentuk fatwa dengan memperhatikan kemaslahatan umum dan maqashid syari’ah sehingga fatwa tersebut benar-benar dapat menjawab permasalahan yang timbul di kalangan masyarakat dan benar-benar dapat menjadi alternatif yang dapat dijadikan pedoman dalam menjalankan bisnis ekonomi syariah di Indonesia.

Abstract

This article aims to review the fatwa concerning sharia economics in Indonesia which includes the method and process of establishing a fatwa on sharia economics and fatwa on sharia economics issued by the National Sharia Council of the Indonesian Ulema Council. This institution has the duty to explore, study, formulate the values and principles of Islamic law (syariah) to be used as guidelines in transaction activities in Islamic financial institutions, as well as oversee their implementation and implementation. This guideline is then poured in the form of fatwa by paying attention to the general welfare and maqashid syari'ah so that the fatwa can truly answer the problems that arise in the community and can truly be an alternative that can be used as a guide in running a sharia economic business in Indonesia.
