Abstract

Among the main objectives of the marriage discourse is to obtain offspring and maintain the survival of Adam's children. Ideally, in every household, every parent is present and can match the child's growth and development. But in reality, there are children who are forced to be sent to an orphanage to be cared for and cared for and fulfilled their needs in order to avoid stranded child victims. This situation is often triggered due to children born into orphans, or orphans, or even orphans who grow up without ever seeing even the faces of both parents, or because of economic factors that make the sianak family decide to place them in care. This situation results in the many we find orphanages and social communities as an extension of the government in protecting and protecting every child abandoned by his parents who are then protected, cared for and cared for. One of them is by the Siti Aisyah Orphanage in Mandailing Natal Regency. The protection offered by Siti Aisyah Orphanage includes; safeguarded and protected by the minds of every child, guarded and guaranteed continuity of education, protected nasab from children who are abandoned by their own parents with good guidance and care, guarded the position of each treasure by managing various kinds of assistance that is fully used to meet all the needs of every child . This paper presents whether the Siti Aisyah Orphanage has carried out child protection in accordance with the review of maqasid ash-shari'ah which has five main main elements: Protection of religion (hifzun ad-din), protection of the soul (hifzun nafs), protection of reason (hifz al-'aql), protection and preservation of offspring (hifz an-nasl) and guarding and protecting property (hifz al-mal)

Abstract

For the Angkola Batak Muslim community, the clan is one of the identities used in traditional events. People who share the same ancestor are considered the same ancestor and are still blood relatives. Therefore, clan marriage is a very taboo and sensitive matter in society. This study aims to reveal clan marriages in the Angkola Batak Muslim community and analyze changes in sanctions through maqāsid sharī`a. This study uses a qualitative method with the type of field research. The data was collected through observation, interviews, documentation and tracing several other references relevant to the research theme. Furthermore, the data were analyzed using descriptive analysis. The study results explain that customary holders and the community provide sanctions for everyone who performs clan marriages. Namely, expelled from his hometown and not permitted to live in society. However, along with the changing times, the expulsion was changed by paying a fine in money. Furthermore, in implementing the practice of fines containing hifẓ an-nasl and efforts to preserve local wisdom in the community structure. Because clan marriages can damage the system of dalihan na tolu as a social philosophy of the Angkola Batak tribe.

Abstract

Kewarisan islam mengatur semua proses peralihan kepemilikan dari pewaris kepada ahli waris dengan cara yang sangat detail. Ahli waris yang mempunyai hak untuk menerima warisan hanya kelompok yang tidak terhalang saja. Karena para ahli waris mempunyai hubungan kekerabatan yang berbeda kepada si pewaris. Penelitian ini bertujuan untuk mendeskripsikan teori dan praktek terkait hijab-mahjub atau proses halang menghalangi dalam kewarisan islam. Metode penelitian yang digunakan adalah bentuk kualitatif dengan jenis kepustakaan. Semua data-data dikumpulkan melalui penelusuran sejumlah kitab, buku-buku, jurnal dan karya ilmiah lainnya yang mempunyai hubungan dengan topik penelitian. Selanjutnya data-data dianalisis dengan menggunakan content analysis. Sebagai hasil dalam penelitian bahwa hijab dan mahjub merupakan proses terhalangnya seseorang untuk mendapatkan warisan atau mendapatkan bagian yang lebih banyak karena adanya seseorang yang mempunyai kedekatan hubungan dengan pewaris. Kemudian, dalam prakteknya ahli waris yang terhijab bisa antara dua kemungkinan, nuqson, yaitu ahli waris tetap mendapatkan warisan namun bagiannya berkurang. Hirman, yaitu ahli waris tidak mendapatkan bagian sama sekali.Kata Kunci: hijab-mahjub, nuqson, hirman, kewarisan islam.ABSTRACTIslamic inheritance regulates all processes of transfer of ownership from the heir to the heirs in a very detailed way. The heirs who have the right to receive inheritance are only those who are not hindered. Because the heirs have a different kinship to the heir. This study aims to describe the theory and practice related to hijab-mahjub or the process of hindering Islamic inheritance. The research method used is a qualitative form with the type of literature. All data were collected through a search of some books, books, journals, and other scientific works related to the research topic. Furthermore, the data were analyzed using content analysis. As a result in the research that hijab and mahjub are a process of preventing someone from getting an inheritance or getting a larger share because of someone who has a close relationship with the heir. Then, in practice the heirs who are veiled can be between two possibilities, nuqson, namely the heirs still get the inheritance but their share is reduced. Hirman, namely the heirs does not get a share at all.

Abstract

AbstractJurisprudence is always present and able to balance every state of society with all forms of problems that occur in every situation and time. The flexible fiqh is a strong proof of the perfection of this religion. This study discusses the legal issue of the use of contraceptives in the four schools of jurisprudence. This research is a library research with a qualitative approach. The results of this study can be concluded that contraceptives have existed since ancient times and the scholars of the four schools of thought view that the law is permissible on the condition that it does not violate the provisions of the Shari'ah. If the goal is to terminate pregnancy permanently without a reason accepted by the Shari'ah or because of fear of being poor and unable to provide for it, all madhhab scholars agree on the prohibition.Keywords: Contraceptive Devices;Jurisprudence; Ulama of the Four Schools.AbstrakFikih selalu hadir dan mampu mengimbangi setiap keadaan masyarakat dengan segala bentuk permasalahan yang terjadi dalam setiap keadaan dan waktu. Fikih yang bersifat fleksibel sebagai bukti kuat akan kesempurnaan agama ini. Penelitian ini membahas masalah hukum penggunaan alat kontrasepsi dalam fikih empat mazhab. Penelitian ini merupakan library research dengan pendekatan kualitatif. Hasil dari penelitian ini dapat disimpulkan bahwa alat kontrasepsi sudah ada sejak zaman dahulu dan ulama empat mazhab memandang hukumnya boleh dengan syarat tidak melanggar ketentuan syari’at. Apabila tujuannya untuk memutus kehamilan secara permanen tanpa sebab yang diterima oleh syari’at atau karena alasan takut miskin dan merasa khawatir tidak mampu menafkahi anak keturunan, maka para ulama dari kalangan empat mazhab bersepakat akan keharaman penggunaan alat kontrasepsi.Kata Kunci: Alat Kontrasepsi; Fikih; Ulama Empat Mazhab.

Abstract

Every individual who acts as a Public Figure wants to be able to appear perfectly in front of the public. So that everything needs to be prepared as well as possible so as not to become disabled in the eyes of those who see it. Among the appearances that must always be considered are the appearance of clean, bright teeth and a mouth that smells good and fresh. This research will summarize the virtues of bersiwak using the siwan tree (arac) and other types of siwak made from chemicals from various literatures that are adapted to the scientific and legal perspective of Islam. In addition to using literature review, this analysis is also a descriptive study / research to provide a complete picture of the law and the impact of miswak for social life, seeing that each individual should pay attention to a clean, healthy and worship-worthy lifestyle by Allah Ta'ala.Keywords: Islamic Law, Siwak, Lifestyle

Abstract

This article examines the practices of waqf that manage by the mosque in Siantar by comparing the adat law and Islamic law. This study used a qualitative descriptive method in the form of field research which aimed to find out the management of waqf funds carried out by Nazir of Mosque Jami' Darussalam Siantar city and a review of customary law and Islamic law on these activities. The results of the management of waqf land are intended for renovation and maintenance of mosque facilities and infrastructure while cooperation conducted in form of muzara’ah muthlaqah according to most Islamic jurisprudence scholars is mubah (may) caused by a contract of muzara’ah based on and aimed to help and prosper each other between both parties. In customary review, it showed that this management of rice fields has been for a long time with a system that has not changed even though the management of the mosque has changed. Controlling social that comes from the community makes the mosque function as it should to always be maintained, cared for, and prospered.

Abstract

Abstrak Dalam konteks budaya Mandailing, Markobar dapat diartikan sebagai pembicaraan resmi yang dilaksanakan dalam upacara adat Mandailing; baik dalam acara siriaon (pesta dalam suasana gembira) maupun silulutun (pesta dalam suasana duka cita). Sebagai norma yang diwariskan secara turun-temurun, markobar memiliki tatacara yang sudah merupakan konvensi bersama masyarakat Mandailing. Pada praktiknya, meskipun terdapat beberapa variasi dalam proses penuturan dan isi yang dituturkan. Namun, warisan budaya, yang dianggap sebagai salah satu budaya yang sakral ini masih dilaksanakan dalam upacara adat masyarakat Mandailing. Penelitian ini akan mengungkap keterkaitan antara pandangan adat budaya Mandailing tentang markobar dalam perspektif Hukum Islam dengan pendekatan fisiologi Hukum Islam berupa pendeketan teori al’urf pada daerah tempat penelitian. Abstract

AbstractMaqasid al-Sharia is one of the discourses in the study of fiqh thought, both traditional and contemporary. However, in its development experienced various challenges and problems that surround it. Some of the problems that arise are that ushul fiqh is considered too textual and ignores the purpose of the text. Thus, it makes the purpose of making sharia laws or decisions not in accordance with the context. In this case, Jasser Auda tries to make an effort to criticize this issue. On the other hand, there are some weaknesses in the maqasid theory which does not provide details on certain chapters or problems. So that these conditions are considered unable to provide detailed answers to certain problems. Therefore, in this study, attempts to re-construct and make improvements with various approaches and methodologies initiated by Jasser Auda. Qualitative research methods are used in this study to examine various literatures related to the data that support this research, especially related to the renewal methodology carried out by Jasser Auda in analyzing maqasid al-shariah. This study found that in fact the perspective of the old maqasid concept to the new maqasid, that is, if you look at the classical paradigm, it lies in efforts to protect and guard or preserve. Meanwhile, if you look at the contemporary paradigm, it focuses more on the development and right side.Keywords: Islamic Law; Jasser Auda; Methodology; Maqasid al-Shariah.

Abstract

Studi ini membahas tentang hukum bekerja pada  Bank Konvensional sebagai upaya pemenuhan nafkah keluarga ditinjau dari pendekatan maqashid syariah. Pada satu sisi dalam memenuhi nafkah keluarga, terkadang seseorang bekerja di bank konvensional, akan tetapi praktik dalam perbankan konvensional tidak terlepas dari riba yang diharamkan dalam Islam, sementara nafkah keluarga harus dipenuhi demi menjaga eksistensi kehidupan. Hasil penelitian menyimpulkan bahwa pada dasarnya bekerja di Bank Konvensional hukumnya adalah diharamkan akan tetapi ketika keadaan terpaksa untuk memenuhi nafkah keluarga dan kemaslahatan untuk menjaga eksistensi kehidupan agar tidak terancam, maka hukumnya makruh dengan syarat tetap berupaya mencari pekerjaan lain yang dibolehkan Islam.

Abstract

ABSTRAKIslam menempatkan posisi perempuan pada sebaik-baik tempat dan  kedudukan. Perempuan dengan segala keistimewaan yang melekat pada dirinya adalah makhluk sosial yang akan berperan sebagai istri, ibu, dan anak bahkan sebagai anggota kemasyarakatan. Keberadaan dan peran perempuan (khususnya perempuan pekerja) baik karena terpaksa sebab ditinggal wafat oleh suaminya atau kedua orang tuanya atau atas kemauan pribadi sudah tidak dapat dipungkiri lagi, mengingat kesetaraan dan kesamaan hak bagi setiap individu telah diatur sedemikian rupa termasuk hak untuk bekerja tanpa memandang gender. Namun Islam memberikan rambu-rambu dan ketentuan mengenai status seorang wanita pekerja terutama di saat keadaan mengharuskan seorang wanita untuk berkabung atas kematian suaminya yang dikenal dengan istilah ihdad. Dilihat dari konteks kacamata agama dan kehidupan masyarakat pada umumnya, jelas akan memicu problematika sosial keagamaan ketika seorang perempuan harus bekerja di luar rumah, hal ini disebabkan oleh faktor internal dan eksternal. Di antara faktor internal adalah keterbatasan pada penciptaan yang dimiliki oleh seorang perempuan yang membedakan mereka dengan laki-laki, baik dari sisi tenaga yang terbatas dan juga daya tahan. Demikian juga faktor eksternal di saat lingkungan tempat kerja dapat menimbulkan fitnah dan rentan dari segi keamanan. Berdasarkan uraian di atas, penulis tertarik untuk melakukan penelitian lebih lanjut terhadap masalah ini dengan tujuan untuk mengetahui bagaimana ketentuan syariat Islam tentang ihdad, dan bagaimana menerapkan ihdad bagi wanita karier sesuai dengan ketentuan syariat Islam dan kearifan lokal dengan kacamata Maqashid Syariah Islamiyah. Kata kunci: Wanita Karir, Ihdad, ‘Urf, Kearifan Lokal ABSTRACT Islam places the position of women in the best of places and positions. Women with all the privileges inherent in themselves are social creatures who will act as wives, mothers, and children even as members of society. The existence and role of women (especially women workers) either because they are forced to die by their husbands or their parents or on their own will cannot be denied anymore, given the equality and equality of rights for each individual has been regulated in such a way including the right to work regardless of gender . But Islam provides signs and provisions regarding the status of a working woman, especially when circumstances require a woman to mourn for the death of her husband, known as ihdad. Viewed from the context of religious perspectives and community life in general, it will obviously trigger social social problems when a woman has to work outside the home, this is caused by internal and external factors. Among the internal factors is the limitations on the creation of a woman that distinguishes them from men, both in terms of limited energy and endurance. Likewise, external factors when the workplace environment can lead to slander and security. Based on the description above, the author is interested in conducting further research on this issue with the aim of finding out how the provisions of Islamic law on ihdad, and how to apply ihdad for career women in accordance with the provisions of Islamic law and local wisdom with the perspective of Maqashid Syariah Islamiyah. Keywords: Career Woman, Ihdad, ‘Urf, Local Wisdom
