Abstract

Contradictions Religious Court jurisprudence absolute competence in resolving disputes sticking Islamic banking since the advent of Law No. 21 of 2008 which includes choice of forum for dispute resolution litigation Islamic economy. This triggers legal uncertainty morning the parties. This contradiction is related to the question of the substantive law and procedural law as well as the politics of government laws as proposer is still influenced by the paradigm of colonial law and New Order. In fact, the legal political government is the policy of the law (legal policy) to be implemented at the national, among others, is in the development of laws that core law-making and reform of legal materials that are considered not relevant or appropriate to the needs of the creation of the law. Thus, the government proposal was passed that has hurt the national consensus, because article 55 (2) of Law No. 21 Year 2008 opened the space to settling disputes resolved under the laws of the colonial Dutch government that no longer fit with the culture of Indonesian culture. In addition, the government proposal was passed it was too much to interfere with the judicial realm, for the settlement of Islamic economy had previously been given to the Religious Courts by Law No. 3 of 2006.Keywords: Jurisprudence, Absolut, Islamic Banking

Abstract

Often the losses experienced by consumers in conducting transactions are the result of ignoring the responsibilities of business actors as stipulated in the Consumer Protection Law Number 8 of 1999 concerning Consumer Protection. The losses also happen because consumers often do not have the courage to defend their rights due to the lack of courage and helplessness due to a one-sided take-or-leave-it contract that gives business actors more authority so that the two parties are not in a balanced and equal position. Therefore, empowering consumers by showing their rights and how to defend their rights is important. Likewise, with the empowerment of business actors which emphasizes the fulfillment of their responsibilities, it is possible that the products and / or services offered have a small possibility of detrimental to consumers. Abstract

Hak-hak konsumen seringkali tidak disadari oleh konsumen itu sendiri,sehingga dalam pelaksanaan transaksi sering mengalami ketidakadilan dan kerugian yang meliputi materi maupun non materi. Tingkat keberdayaan konsumen aliansi Lembaga Perlindungan Konsumen Swadaya Masyarakat masih rendah, sehingga membutuhkan pemberdayaan untuk meningkatkan keberdayaan konsumen. Salah satu hak yang tidak dipenuhi oleh pelaku usaha kepada konsumen adalah hak untuk berpendapat dalam membuat perjanjian, sehingga isi perjanjian cenderung tidak adil. Abstract

Dalam aktifitas keseharian tak bisa dipungkiri selalu berkaitan dengan orang lain terlebih dalam urusan pemenuhan kebutuhan hidup. Dalam upaya pemenuhan kebutuhan inilah kita bersinggungan dengan orang lain dalam bentuk transaksi yang mempunyai akibat hukum pemenuhan hak dan kewajiban bagi para pihak. Implementasi pemenuhan hak dan kewajiban ini termuat dalam bentuk perjanjian, yang mana seringkali dipakai adalah klausul baku. Penggunaan klausul baku ini bertujuan untuk efisiensi waktu dan proses penjualan, memastikan adanya standarisasi layanan bagi seluruh konsumen dan mengurangi potensi pengambilan keputusan yang tidak tepat dengan mengabaikan diskresi dari permintaan negosiasi langsung dengan konsumen. Akan tetapi dalam implementasi klausula baku masih banyak pelaku usaha yang memuat klausul eksonerasi dalam perjanjian baku sehingga dapat merugikan konsumen dan membuat posisi konsumen tidak seimbang. Hal ini tentu menciderai keadilan restoratif bagi konsumen.
