Abstract

Industrial revolution has substantially changed the economy and society. The fusion of technologies and information marked the fourth industrial revolution which brings about new challenges relating to protection of intellectual property, including copyrights. With regard to this, there has been several changes in the law relating to copyrights in Indonesia. The nature of copyright infringement has been changed from ordinary offense to complaint-based offense. This fundamental change undoubtedly affects the enforcement of the copyright law in Indonesia. Thus this paper aims to answer and review the legal reasoning behind the shift in offense in Copyright Law in Indonesia. This normative legal research employed a descriptive-analytic method. The result shows that the complaint-based offense is suitable in copyright protection considering that only the copyright owner knows the details of the object of the creation.

Abstract

Nowadays, in Indonesia, there are so many laws appear after KUHP which regulate about criminal laws, beside providing the rules of material criminal law againts to KUHP, also providing the formal rules which againts to KUHAP (formal criminal laws). In criminal laws that related to financial government, has common law which is regulated by laws itself. And corruption criminal laws which has the regime of law itself, but it is still unclear where could be qualificated as crimnal laws in financial government and which could be qualificated as corruption criminal laws. It is still in the “grey area”

Abstract

Coal and Mineral mining activities have a high risk of ecosystem changesthat affect the environment, let alone the mining is carried out openly. In order torestore the condition of the land in such a way that it can function and to be effectivein line with its allocation, the ex-mining area must be restored. Reclamation andpost-mining activities shall be conducted by every holder of Mining Business Permit(IUP) Exploration and IUP Production. Holders of IUP Exploration must firstlyprepare reclamation and post-mining plans in the permit process. The implementationof reclamation and post-mining activities by holders of IUP Production Operationand Special Mining Business Permit (IUPK) Production Operation must complywith the principles of : (1)protection and management of mining environment; (2)working safety and health; and (3) mineral and coal conservation. To determinethe success of the land that has been reclaimed and the post-mining activities havebeen complied, if an evaluation has been made by the competent officials and it isstated that the reclamation and post-mining activitie shave been performed well inaccordance with prevailing regulations.

Abstract

The arising issues of transnational marriage in Indonesia, that is frequent is related to the land ownership of Indonesian Citizen (WNI). The research method that is used is a normative juridical approach which analyzed based on the jurisprudence. Based on Indonesian positive law, the citizen who in the transnational marriage without prenuptial agreement, the rights status of his/her land in the form of property acquired jointly be equalized to his/her partner is only the rights to use. The partition of land property acquired jointly when divorce occurs in a transnational marriage beyond the specified period time by the Indonesian Positive Law is not applicable based on article 21 paragraph (3) of  UUPA

Abstract

From the Global Intellectual Property Center (GIPC) survey, Indonesia still considered weak in protecting intellectual property. Then the political direction of law began to look at the concept of the omnibus law to promote the ease of doing business (EoDB). Therefore, the purpose of this study is to analyze first, the legal protection issues of famous brand holders in Act No. 20/2016 through political instruments and criminal law policies. Secondly, the concept of the omnibus law as ius constituendum of the Act Related to Indonesian Intellectual Property in the political perspective of criminal law. The normative method was chosen because of the object of the study on the principles of law, theories, and doctrines of jurisprudence. The results of this study show that although Indonesia's IPR index score increased in 2019, it's global ranking declined. This means that despite increases in scores, Indonesia's IPR enforcement tends to be stagnant when compared to other countries. The IPR-related Act can be combined into an omnibus law. The aim is to simplify the laws of Patents, Trademarks, Copyrights, Industrial Designs, Layout Designs of Integrated Circuits, and Communal Investment Credit which greatly affect the economy and investment in Indonesia.

Abstract

Pertambangan minerba dan kehutanan merupakan salah satu sumberdaya alam tak terbarukan (unrenewable) yang harus dapat dikelola dengan baik.Pengelolaan sumber daya alam tersebut harus mengacu pada UUD 1945. Indonesiamerupakan salah satu negara yang menggunakan sarana hukum pidana sebagaiujung tombak penegakan hukum SDA. Penelitian ini bertujuan untuk mengetahuiperan hukum pidana dan kebijakan pidana dalam mencegah dan menanggulangitindak pidana didaldigunakan adalah metode penelitian normatif, yaitu suatu metode penulisan hukumyang bertujuan untuk memperoleh bahan hukum pustaka dengan cara mengumpulkandan menganalisis bahan hukum terkait dengan permasalahan. Hasil dari penelitianini: Pertama, Penggunaan sanksi pidana dalam penegakan aturan sumberdaya alamyang ada merupakan tuntutan sosial mengingat kepentingan hukum yang harusdilindungi. Fungsi hukum pidana tidak hanya sekedar untuk mempertahankan danmelindungi nilai-nilai moral, tetapi telah bergeser ke arah pendekatan kemanfaatan.Kedua, Di Indonesia kebijakan pidana mengenai SDA merupakan administrativepenal law. Hal ini dikarenakan perkembangan kebijakan pidana di bidang SDA telahberkembang secara signifikan, pada awalnya pengaturan pidana hanya digunakansebagai alat bantu dalam penegakan hukum SDA. Kemudian seiring perkembanganhukum pidana memberikan kepastian dengan memperluas ketentuan pemidanaandan pertanggung jawaban pidana sejalan dengan prinsip dan tujuan kebijakanhukum pidana (penal policy)am pengelolaan sumber daya alam.
