Abstract

AbstrakTugas guru bukan sekedar menumpahkan semua ilmu pengetahuan tetapi juga mendidik seseorang menjadi warga Negara yang baik, menjadi seorang yang berpribadi baik dan utuh. Penelitian ini mengajukan permasalahan sebagai berikut. Bagaimana upaya perlindungan hukum bagi guru terkait kasus tindakan pemberian hukuman (punishment) kepada siswanya. Sejauh manakah tanggungjawab Organisasi Profesi Guru PGRI terhadap guru yang dikriminalisasi. Jenis penelitian yang digunakan dalam penelitian ini adalah yuridis empiris. Penelitian yuridis empiris merupakan penelitian lapangan (penelitian terhadap data primer). Hasil penelitian menunjukan Upaya perlindungan hukum bagi guru terkait kasus tindakan pemberian hukuman (punishment) kepada siswanya, bahwa kebijakan perlindungan terhadap praktik mengajar guru dari ancaman kriminalisasi ada nota kesepahaman antara PGRI dan Polri. Yang tertuang pada Pedoman Kerja antara Kepolisian Negara Republik Indonesia dengan Persatuan Guru Republik Indonesia terhadap profesi guru yang bertujuan agar proses perlindungan hukum kepada profesi guru dapat dilaksanakan dengan sebaik-baiknya, dan tanggungjawab organisasi profesi guru PGRI terhadap guru yang dikriminalisasi, Organisasi profesi guru memperjuangkan perlindungan hukum, pembinaan dan perlindungan keselamatan kerja serta menghimpun dan menyalurkan aspirasi anggotanya. Optimalisasi Lembaga Bantuan Hukum (LBH) yang berada dibawah naungan PGRI diharapkan menjadi salah satu solusi dalam memberikan perlindungan terhadap guru yang tengah menghadapi permasalahan hukum. This study poses the following problems. How are legal protection efforts for teachers related to cases of punishment for students. To what extent is the responsibility of the PGRI Teacher Professional Organization towards the criminalized teacher. The type of research used in this research is empirical juridical. Empirical juridical research is field research (research on primary data). The results showed that legal protection efforts for teachers related to cases of punishment for students, that the policy of protecting teachers' teaching practices from the threat of criminalization was a memorandum of understanding between PGRI and the National Police. As stated in the Work Guidelines between the Indonesian National Police and the Indonesian Teachers Association towards the teaching profession, which aims to ensure that the legal protection process for the teaching profession can be carried out as well as possible, and the responsibility of the PGRI teacher professional organization to criminalized teachers. law, fostering and protecting work safety as well as collecting and channeling the aspirations of its members. Optimizing the Legal Aid Institute (LBH) under the auspices of PGRI is expected to be one of the solutions in providing protection for teachers who are facing legal problems.
