Abstract

Abstract: Islam always respect the dignity of a woman when being a wife and a mother when she relates in the marriage. Mutaddah woman (wife who left for dead by her husband) has prescribed period for four (4) months and ten (10) days, during which a woman must wait to not accept the (marriage) proposal and married, but must carry out the obligations and prohibitions, called the ihdad as a tribute to her husband. As for the wisdom of in infected the Iddah is to determine the void womb of a woman in keeping her nasab (descent) and her purity. Sometimes customs and culture affects a law even urf (customs) tends to be a role model. It is understood they are due commonness of a person in a nash (postulate) so it is effected to tasahul (oversimplify) in the implementation of worship and muamalah. The methodology research is used field research (case studies in the field), using a qualitative descriptive approach. However, negligence is still in the corridors of shariah, it means that most of them do not do ihdad (obligations and prohibitions) while doing his Iddah. It takes a real solution to fix and straighten understanding. Through individual approach, religious activities, the involvement of government officials, especially the Religious Courts (PA) and the Religious Affairs Office (KUA) who involved in family law issues directly; marriage, divorce and other cases.

Abstract

Abstract Bawean is an archipelago administratively included in Gresik Regency, where the main occupation of the people is farming and fishing, but not all of the people have land to farm and ships to go to sea, and not a few who work in Malaysia and Singapore have even become citizens of that country. so that the land and rice fields below are unproductive, so there is cooperation between landowners and tenants or cultivators, in agricultural practices, landowners and processors or workers often make contracts and agreements in such cooperation, as well as in the village of Lebak, the agreement sees to the weather, or irrigation used to irrigate rice fields, and the yields obtained during the rainy season in certain months are different, there are at least three cooperation systems in the muzara'ah contract implemented there, in this study the three systems were analyzed to determine which in accordance with Islamic law , of the three, there are two agreements that use the muzara?ah contract, and the other one uses the ijarah agreement or lease agreement. Abstract

There is a debate between the scholars about the status of banknotes, whether he can be sent to Naqdain (gold and silver) or not, or can be given but not completely. If it can be based on gold and silver, What is the legal consequence? What law is accompanying it? Is there any similarity between paper money and silver gold so it can be in the state, how the scholars ' views and opinions on the law of banknotes. In this research, some of the questions above are described and shown in the following scholars in each group, accompanied by arguments from each party. Keywords : qiyas, naqdain. Emas dan Perak
