Abstract

AbstractNotary is a public official who is authorized to make an authentic act. Law No. 2 of 2014 on the Amendment of Law No. 30 Year 2004 on Notary, explains that, to take a photocopy of a Notary deed minuta and call a Notary in law enforcement, no longer through the Regional Supervisory Council permission. So the question arises, how the basic formation of the Honorary Council of Notaries in Act No. 2 of 2014, and how to call the Notary deed made. Based on research outputs by the author, Honorary Council of Notaries of birth, due to the need of legal protection against a Notary in deed. Notary Honorary Council is indispensable in the implementation of the law enforcement process, where the calling Notary by law enforcement (police, prosecutors, judges) must obtain permission from the Notary Honorary Council. To fill the legal vacuum, because the Honorary Council of Notaries has not been established, the Notary can use the right Dissenters, Indonesian Notary Association urged the government to establish a Notary Honorary Council Implementing Regulation.Keywords: Notary Public; Law Enforcement; Law Notary.IntisariNotaris merupakan seorang Pejabat Publik yang berwenang untuk membuat sebuah akta otentik.Undang Undang Nomor 2 Tahun 2014 Tentang Perubahan Atas Undang-Undang Nomor 30 Tahun 2004 Tentang Jabatan Notaris, menjelaskan bahwa, untuk mengambil fotokopi minuta akta seorang Notaris dan memanggil seorangNotaris dalam penegakan hukum, tidak lagi melalui izin Majelis Pengawas Daerah. Maka timbul pertanyaan, bagaimana dasar pembentukan Majelis Kehormatan Notaris dalam Undang-Undang Nomor 2 Tahun 2014, dan bagaimana memanggil Notaris yang membuatkan akta, Paska Perubahan Undang-Undang Jabatan Notaris Nomor 30 Tahun 2004. Berdasarkan hasil penelitian yang penulis lakukan, Majelis Kehormatan Notaris lahir, akibat kebutuhan perlindungan hukum terhadap seorang Notaris dalam pembuatan akta. Majelis Kehormatan Notaris sangat diperlukan didalam pelaksanaan proses penegakan hukum, dimana pemanggilan Notaris oleh para penegak hukum (polisi, jaksa, hakim) harus mendapat izin dari Majelis Kehormatan Notaris. Untuk mengisi kekosongan hukum, karena Majelis Kehormatan Notaris belum terbentuk, maka Notaris bisa menggunakan hak Ingkar, Ikatan Notaris Indonesia mendesak pemerintah untuk membentuk Peraturan Pelaksana Majelis Kehormatan Notaris.Kata Kunci: Notaris,penegakan hukum, Undang-Undang.

Abstract

ABSTRACTChildren as the nation’s next generation must be respected fulfllment of his rights. We must know that the protection of rights, are part of human rights. Since Indonesia ratifed the Convention on the Rights of the Child (CRC), Indonesia has adopted a child protection in his administration. In 2002 afer Indonesia established the Child Protection Act, it gives birth to the Independent State Institute named Indonesian Child ProtectionCommission (KPAI). KPAI have the same status as other independent state institutions, established through the Act, the Presidential Decree, the Regulation President or the TAP MPR, and can move in the feld of judicial, executive and legislative. KPAI as an auxiliary state institutions in the feld of children’s rights enforcement has been to provide services according to the needs of protection of human rights and amandat in accordance with the Constitution, the Convention on the Rights of the Child (CRC) andthe Law on Child Protection. Efforts could be done by KPAI to realize sustainable child protection are: 1) Control, 2) Prevention, 3) Service and 4) Awareness.Keywords: KPAI; State Auxialiary Bodies; Legal System; State Administration; Indonesia.INTISARIAnak sebagai generasi penerus bangsa harus harus dijunjung tinggi pemenuhan hak nya.Kita harus tahu bahwa perlindungan hak, merupakan bagian dari hak asasi manusia.Sejak Indonesia meratifkasi Kovensi Hak Anak (KHA) maka Indonesia telah mengadopsi perlindungan anak dalam pemerintahannya. Pada tahun 2002 setelah Indonesia membentuk Undang-Undang Perlindungan Anak, maka lahirlah Lembaga Negara Independen yang bernama Komisi Perlindungan Anak Indonesia (KPAI). KPAI memiliki kedudukan yang sama dengan lembaga negara independen lainnya, yang dibentuk melalui Undang-undang, Keputusan Presiden, Peraturan Presiden ataupun berdasarakan Ketetapan Majelis Permusyawaratan Rakyat, dan bisa bergerak di dalam bidang yudikatif, eksekutif, dan legislatif. KPAI sebagai lembaga negara bantu di dalam bidang penegakan hak asasi anak sudah memberikan pelayanan sesuai dengan kebutuhan perlindungan hak asasi manusia dan sesuai dengan amandat Konstitusi, Konvensi Hak Anak (KHA) dan Undang-Undang Perlindungan Anak. Upaya yang bisa dilakukan oleh KPAI untuk mewujudkan perlindungan anak yang berkelanjutan adalah: 1) Pengawasan, 2) Pencegahan, 3) Pelayanan dan 4) Penyadaran.Kata Kunci: KPAI; Lembaga Negara Independen; Sistem Hukum; Ketatanegaraan; Indonesia.

Abstract

Before the VOC came, Indonesia used customary law as a positive law in the archipelago, adhered to and implemented as a custom, hereditary respected by society as a nation tradition. The entry of VOC into Indonesia, foreign society began to pay attention to customary law. At this time the Western Law (Dutch) began to be used although initially only used for the central government area of ​​the Company while for areas that have not mastered can use their customary law or for those who want to submit to Dutch law is allowed. Customary Law is used as a synonym of law not written in legeslative regulation, law living as a convention in state legal bodies (Parliament, Provincial Council and so on), laws arising from judges rulings, living laws as customary rules maintained in the association of life, both in cities and in villages. Customary law conditioned as a solution to legal vacuum is required as a law that is not contrary to legislation. Customary law has the same function and purpose as Indonesias positive law, that is for justice, social control, striving for good as a common goal. The customary law of its existence has been officially recognized by the Indonesian government as agreed by all Indonesian people as one of the official laws. And can be used officially in the community, in addition to the use of laws and regulations made by the government.

Abstract

Children are our future and in their own time bear the responsibility to develop their own world. To enable them doing so, they should not be forced to work to earn a living or support their family.  Children should be allowed to grow in the safety of a home, at school and at playgrounds.  In this paper the author will explore children problems related economic exploitations,  what policies are developed by the municipal government of Padang to protect children from economic exploitations and what are the obstacles in implementing these policies. One of the finding is that the Social and Manpower Service and the Family Planning, Women and Community Empowerment Board of the Padang municipal government develops training programs aiming to give exploited children practical skills in helping them to cope.  Factors influencing economic exploitation of children are numerous and complex: lack of education, lessening of people’s adherence to religious norms, societal environment, shift in cultural values, economic problems, etc. Based on the above the author suggests that the municipal government should take cognizance of these factors when attempting to deal with the problem.  Keywords: child, exploitation, economy, protection

Abstract

AbstractThe President as the head of state has a great authority granted by the 1945 Constitution. The President may be dismissed in his term of office if he is treasonous against the state, corruption or bribery, other serious crimes, disgraceful acts, and no longer qualifies as president. This paper discusses the comparison of presidential impeachment in Indonesia and the UK, and the mechanism of presidential impeachment in Indonesia. This Scientificwork employs normative legal research. The process of impeachmrnt in the Uh begins with the articles of impeachment that servs the same as ae indictment of criminal justice. The process of the President’s dismissal mechanis startes from the allegations of law violations conducted by the President submitted by the Parliament.Keywords: Impeachment; President; Vice President.IntisariPresiden sebagai kepala negara memiliki kewenangan yang besar yang diberikan oleh UUD 1945. Presiden dapat diberhentikan pada masa jabatannya apabila melakukan pengkhianatan terhadap negara, korupsi atau penyuapan, tindak pidana berat lainnya, perbuatan tercela, dan tidak lagi memenuhi syarat sebagai presiden. Tulisan ini membahas perbandingan pemakzulan presiden di Indonesia dan Inggris, dan mekanisme pemakzulan presiden di Indonesia. Karya ilmiah menggunakan penelitian hukum normatif. Proses impeachmernt di Inggris dimulai dengan adanya articles ofimpeachment, berfungsi sama dengan surat dakwaan dari suatu peradilan pidana. Proses mekanisme pemberhentian Presiden dimulai dari dugaan atas pelanggaran hukum yang dilakukan oleh Presiden yang diajukan oleh DPR.Kata Kunci: Pemakzulan; Presiden; Wakil Presiden.

Abstract

ABSTRAKBadan Kehormatan merupakan alat kelengkapan Dewan Perwakilan Rakyat Daerah yang dibentuk untuk menegakan kode etik Dewan Perwakilan Rakyat Daerah. Pada dasarnya Badan Kehormatan merupakan lembaga pengawasan internal Dewan Perwakilan Rakyat Daerah. Fungsi Badan Kehormatan ada dua, yaitu fungsi aktif dan fungsi pasif. Penulis memilih Badan Kehormatan Dewan Perwakilan Rakyat Daerah Kota Padang untuk diteliti, karena ada beberapa pelanggaran yang telah diterima dan tidak ditindaklanjuti. Metode penelitian ini adalah yuridis sosiologis. Pada dasarnya Badan Kehormatan telah melaksanakan fungsinya dengan baik, namun belum maksimal dalam penegakannya. Badan Kehormatan selama ini masih kurang mengigit karena tindakan-tindakan yang dilakukan Badan Kehormatan dalam menegakkan kode etik belum memberikan efek jera bagi anggota-anggota dewan yang “nakal”. Kendala-kendala yang dihadapi Badan Kehormatan antara lain: Badan Kehormatan dapat menindaklanjuti suatu pelanggaran karena ada pengaduan dari pimpinan Dewan Perwakilan Rakyat Daerah, anggota Dewan Perwakilan Rakyat Daerah dan/atau masyarakat, tetapi sering laporan tidak lengkap. Pengaduan kurang bekerja sama dan unsur kepentingan politik yang masih kental. Penulis memberikan beberapa saran, antara lain: Badan Kehormatan hendaknya melibatkan pihak-pihak lain di luar anggota Badan Kehormatan Dewan Perwakilan Rakyat Daerah sendiri sehingga mekanisme pengawasan yang berbasis etika dapat terwujud lebih independen dan objektif. Selain itu aturan-aturan yang ada, yaitu kode etik dan tata tertib hendaknya lebih dipertegas dan diperbaiki sedemikian rupa agar anggota dewan tidak memiliki celah untuk terhindar dari sanksi-sanksi Badan Kehormatan.Kata kunci: Fungsi, Badan Kehormatan, DPRD Kota PadangABSTRACTHonorary Board is of the fittings of the regional council established to enforce the code of conduct the Regional Representatives Council. Basically the Ethics Council is an internal oversight agencies Regional Representatives Council. Honorary Board function was twofold function of active and passive functions. The author chose the Honorary Board of the Regional Representatives Council of Padang to be checked, because there are some violations that have been accepted and acted upon. This research method is a juridical sociological. Basically the Ethics Council has been carrying out its function properly, but is not maximized in enforcement. Honorary Board for this is still less bite because of the actions undertaken Honorary Board in enforcing the code of conduct has not provided a deterrent effect for the members of the board were “mischievous”. Constraints faced by the Ethics Council, among others: the Ethics Council to act on an infringement complaint because of the leadership of the Regional Representatives Council, members of the Regional Representatives Council, and/or society, but often the report is not complete. Complaints about cooperation, and an element of political interests is still thick. The author gives some suggestions, such as: the Ethics Council should involve other parties outside the Honorary Board member Legislative Council itself so that the monitoring mechanism based ethics can be realized more independent and objective. Abstract

Abstract The indictment has a very important role in examining a criminal case in court by a judge, which is the basis for the judge in deciding a case and examine the case within the limits contained in the indictment. It is like that contained in Article 143 paragraph (1) Code of Criminal Procedure states prosecutor delegate a case to the District Court with a request to immediately try the case along with the indictment. In the Criminal Procedure knowledge there is no explanation of the purpose of this indictment. Keywords: Code of Criminal Procedure, Obstacles, Indictment Abstrak Surat dakwaan mempunyai peranan yang sangat penting dalam memeriksa suatu perkara pidana di persidangan oleh seorang hakim, dimana merupakan dasar bagi hakim dalam memutuskan suatu perkara dan memeriksa perkara dalam batasan-batasan yang termuat di dalam surat dakwaan. Sebagaimana dimuat di dalam Pasal 143 ayat (1) KUHAP, Penuntut Umum melimpahkan perkara ke Pengadilan Negeri dengan permintaan agar segera mengadili perkara tersebut disertai dengan surat dakwaan. Abstract

Hak asasi manusia adalah seperangkat hak yang melekat pada hakikat dan keberadaan manusia sebagai makhluk Tuhan Yang Maha Esa dan merupakan anugerah-Nya yang wajib dihormati, dijunjung tinggi dan dilindungi oleh Negara, hukum, pemerintah dan setiap orang demi kehormatan dan perlindungan harkat dan martabat manusia. Perlindungan dan pemenuhan hak konstitusional warga negara harus dilakukan sesuai dengan kondisi warga negara yang beragam.  Atas hal tersebut, kelahiran dari komisi nasional hak asasi manusia sebagai urgensi atas lembaga negara independen di dalam penegakan hak asasi manusia, untuk mewujudkan makna semua manusia wajib dilindungi haknya. Penelitian ini bersifat yuridis normatif, yang akan membahas komisi nasional hak asasi manusia sebagai lembaga negara independen serta tugas dan fungsinya. Dari hasil penelitian ditemukan, bahwa pembentukan komisi nasional hak asasi manusia sebagai lembaga independen, berlandaskan hukum Pasal 28I Ayat (4) Undang-Undang Dasar Negara Republik Indonesia Tahun 1945 yang menegaskan bahwa: perlindungan, pemajuan, penegakan dan pemenuhan hak asasi adalah tanggung jawab negara, terutama pemerintah. Pembentukan komisi nasional hak asasi manusia diawali pada tahun Keputusan Presiden tahun 1993, dan diundangkannya Undang-Undang nomor 39 tahun 1999 tentang Hak Asasi Manusia serta dikeluarkannya Tap MPR Nomor XVII/MPR-RI/1999 tentang Hak Asasi Manusia. Tugas dan fungsinya terhadap pengkajian dan penelitian, penyuluhan, pemantauan, serta mediasi. Human rights are a set of rights attached to nature and human existence as a creature of God Almighty and it is His grace that must be respected, upheld and protected by the State, law, government and anyone for the respect and protection of human dignity. Protection and fulfillment of the rights of citizens konstitusioal be conducted in accordance with the conditions of diverse citizens. Above it, the birth of a national commission for human rights as the urgency of the auxialiary state bodies in the enforcement of human rights, to Realize the significance of all human rights must be protected. This study is normative, who will discuss national human rights commission as auxialiary state bodies as well as their duties and functions. The research found that the formation of a national commission for human rights as an independent agency, based on law Article 28 Paragraph (4) of the Constitution of the Republic of Indonesia Year 1945 the which stipulates that: protection, promotion, enforcement and fulfillment of human rights is the responsibility of the state, especially the government. The formation of a national commission for human rights in Presidential Decree Began in 1993, and the enactment of Law No. 39 of 1999 on Human Rights as well as the issuance of MPR Decree No. XVII / MPR / 1999 on Human Rights. Duties and functions of the study and research, extension, monitoring, and remediation.

Abstract

Children as part of citizens, they have the same rights as other citizens, which must be protected and respected by every citizen and State. Family is the first education in shaping a child's personality. The way of parenting and habits that are often done will be reflected in the child's personality. Rapid technological developments have the potential to make it difficult for people, especially children, to distinguish the real world virtual world. On this matter, this article wishes to discuss: 1) how are the conditions and behavior of children in Indonesia at this time? 2) how is the role of parents in supervising children in the use of internet media to realize the protection of children's rights, 3) and realize sustainable child protection. This study uses normative juridical research with a legislative approach. The current behavior conditions of children in Indonesia according to the latest data, at least 30 million children in Indonesia are internet users, and digital media is currently the main choice of communication channels they use, and many are misdirected in using the internet. When the use of social media and digital media is growing rapidly among young people, parental support and digital media integration in education are still lagging behind. So it's time to catch up with 9 recommendations. Sustainable child protection is the ideal of child protection laws, therefore child protection that is sustainable in accessing internet media should also be monitored.

Abstract

The business development of the economy not only in the field of conventional, Shari'ah economic business now has started mushrooming everywhere. With a population of Indonesia is predominantly Muslim, the more it will attract market share to take part in business economics Shari'ah. Instead of that, the presence of a notary Shari'ah is urgently needed in Indonesia, because the focus of work in the field of economics Shari'ah, so it can ensure law and society in transacting Shari'ah. The research used normative juridical approach, using the theory of legal certainty. So we get Analisia, that the reality is that the people do not feel comfortable in transacting Shari'ah, because of the absence of provisions on rules of shari'a law notary. So the conclusion is obtained, the need for Shari'ah notary very important. *** Perkembangan bisnis ekonomi bukan hanya dibidang konvensional saja, sekarang bisnis ekonomi syari’ah sudah mulai menjamur dimana-mana. Dengan penduduk Indonesia yang mayoritas beragama Islam, maka akan semakin menarik pangsa pasar untuk mengambil bagian dalam bisnis ekonomi syari’ah. Dari pada itu, kehadiran notaris syari’ah sangat dibutuhkan di Indonesia, karena fokus kerjanya pada bidang ekonomi syari’ah, sehingga bisa menjamin kepastian hukum dan masyarakat didalam bertransaksi syari’ah. Penelitian ini menggunakan metode pendekatan secara Yuridis Normatif, dengan menggunakan teori kepastian hukum. Sehingga didapatkan analisia, bahwa dengan kenyataan yang ada, masyarakat belum merasa nyaman dalam bertransaksi syari’ah, karena belum adanya pengaturan tentang aturan hukum notaris syari’ah. Maka kesimpulan yang didapatkan, kebutuhan terhadap notaris syari’ah sangat penting.
