Abstract

Penulisan ini bertujuan untuk membahas urgensi pendidikan Kewarganegaraan (Civic Education) sebagai pendidikan karakter bangsa Indonesia melalui demokrasi, HAM dan masyarakat madani.  Perubahan Indonesia menuju pada sistem demokrasi merupakan sesuatu yang tidak terelakkan lagi. Pasca jatuhnya rezim Orde Baru di bawah Presiden Soeharto yang lengser pada 21 Mei 1998, Indonesia mengalami proses pembentukan demokrasi meskipun berjalan setelah lebih dari 30 tahun Orde Baru berkuasa.  Transisi Indonesia menaiki demokrasi menimbulkan banyak kecemasan dimana pada saat yang sama masyarakat masih cenderung melakukan penyelesaian konflik melalui cara-cara yang tidak demokratis, main hakim sendiri, memaksakan kehendak, dan praktik money politics sebagai cermin dari perilaku dan sikap yang bertolak belakang dengan demokrasi yang diperjuangkan oleh kalangarn reformis selama ini. Perkembangan ini tentu saja merupakan fenomena yang tidak kondusif bagi transisi Indonesia menuju demokrasi yang berkeadaban (Democratic Civility). Seiring dengan perkembangan gelombang demokrasi ketiga, tuntutan dmokratisasi dalam praktik dan sosial pasca rezim Orde Baru menjadi salah satu agenda kelompok gerakan reformasi yang mana salah satu tuntutannya adalah memperbaharui kembali pendidikan kewarganegaraan (Civic Education) yang selama ini dirasakan tidak relevan dengan semangat reformasi. Di dalam mewujudkan demokrasi yang berkeadaban maka peranan pendidikan kewarganegaraan (Civics Education) dirasa sangat urgen dan mendesak sebagai pendidikan karakter bangsa Indonesia.

Abstract

AbstractGenocide has become one of the most essential issue nowadays in the world since the ethnic conflict on Rohingya occurred in Myanmar. This conflict which has killed thousands of innocence civilians happened over the last century and increasingly heating up in the 21st century. Genocide on the Rohingya constitute a serious international crime which was conducted widespread and systematically, carried out by state actors (state agents or military apparatus) and non- state actors by destruction in whole or in part. This research focuses on the crime of genocide that occurred in the conflict of Rohingya which reviewed based on aspects of international law and human rights. The research results show that genocide on the Rohingya Ethnic has become a crime against humanity and violates the principle of humanity.Abstrak Genosida saat ini menjadi salah satu persoalan yang paling penting di dunia sejak terjadinya insiden konflik sejak konflik etnis Rohingya terjadi di Myanmar. Konflik ini telah membunuh ribuan orang – orang sipil yang tidak bersalah yang terjadi selama berabad-abad yang lalu dan semakin memanas di abad ke-21. Genosida pada etnis Rohingya merupakan kejahatan internasional yang serius yang dilakukan secara meluas dan sistematik, dilakukan oleh aktor-aktor negara (agen-agen negara atau aparat militer) dan aktor-aktor non negara dengan penghancuran secara sebagian atau keseluruhan. Penelitian ini berfokus pada kejahatan genosida yang terjadi pada konflik etnis Rohingya yang dikaji melalui aspek- aspek hukum internasional dan hak asasi manusia. Penelitian ini menunjukkan bahwa genosida pada etnis Rohingya merupakan kejahatan terhadap kemanusiaan dan melanggar prinsip- prinsip kemanusiaan.DOI: https://doi.org/10.22304/pjih.v5n1.a10

Abstract

This study aims to examine how the process of fostering criminal children is carried out by the Special Class Fostering Agency for Children in Medan, what are the obstacles faced in the implementation of fostering of criminal children and how the efforts made to overcome the problems of fostering criminal children in the Class I Special Guidance Institution . This research is normative juridical legal research and also empirical or sociological legal research, which examines library materials relating to the fostering of criminal children in the Class I Special Child Development Institute (LPKA) Medan. It was found that fostering prisoners and students is a heavy and noble task, not everyone is able and interested in the life of prisoners. And there are regulations and the fostering process for criminal children in Class I Special Guidance Institutions in Medan. The obstacles faced in the implementation of coaching activities in the Special Guidance Institution for Class I Children in Medan are originated from the factors of education, coaches, motivation and facilities and infrastructure; While the efforts made to overcome these obstacles include making improvements including aspects of education, coaches, motivation, and facilities and infrastructure.

Abstract

The study was conducted to determine the Supervision of Remission Against Prisoners in Class II A Binjai Penitentiary. The nature of the study is normative juridical. Literature and document study material is used as the main material while field data will be used as supporting or supplementary data. The collected data is sorted and analyzed judicially and qualitative data are interpreted logically systematically by deductive and inductive methods. The results showed that the implementation of remission to prisoners experienced a shift both from the understanding, criteria, and objectives. According to the provisions, the original remission was the right of prisoners, shifted into a kind of gift given by the government, and finally shifted to an arena of buying and selling interests. As a result of this shift, there has been a blurring of the legal rules for granting remissions that automatically impacted their supervision. In addition, the implementation of remission is a prisoner's right and also as a stimulus so that prisoners are willing to undergo coaching to change behavior in accordance with the objectives of the Penal System. The supervisory system for remission in Penitentiary involves Penal Institutions which starts from the Penitentiary Technical Implementation Unit, Regional Office of the Ministry of Justice and Human Rights to be forwarded to the Directorate General of Corrections, also involving Supervising Judges and Observers.
