Abstract

The Presence of maid servants in this modern time are needed very much by a lot of people, especially for the cityzenshios. In working the servants sometimes get the unconfortable teatments like the other workers. The maid servants have to be able to de many houses works, no limit times and get the low wages, and very often are treated as the masters like (the hosts of the houses). These bad conditions are very often hidden result of low loegal protections that are given to the maid servants, mainly that related to the fulfilment of normative rights of workers as being valid usually.

Abstract

Sekolah Luar Biasa atau SLB merupakan suatu institusi pendidikan formal yang memfasilitasi pendidikan bagi anak-anak dengan ABK atau Anak Berkebutuhan Khusus. Sekolah Luar Biasa selaku sekolah, dibentuk oleh beberapa entitas yang diarahkan untuk mencapai tujuan pendidikan, yang proses utamanya adalah pembelajaran bagi siswa. Sebagaimana sekolah lainnya, SLB juga sama seperti sekolah pada umumnya yang memerlukan pengelolaan dan manajemen data yang baik, khususnya manajemen data kepala sekolah. Manajemen sekolah oleh kepala sekolah diharapkan mampu memproyeksikan program-program sekolah yang efektif guna peningkatan layanan sekolah di masa mendatang. Namun pada pelaksanaannya ditemui sejumlah permasalahan.  Permasalahannya, pertama, program sekolah belum disusun dengan efektif, terutama program-program jangka pendek dan tentatif waktu pelaksanannya. Kedua, kurangnya sumber daya manusia dalam membantu kepala sekolah dalam manajemen data kepala sekolah. Ketiga, minimnya pengetahuan staf yang ada terhadap manajemen data kepala sekolah. Solusi yang ditawarkan berupa: 1). Melaksanakan program pendampingan manajemen data kepala sekolah terutama pada penyusunan program-program sekolah jangka pendek yang efektif; 2). Menyelenggarakan peningkatan kemampuan staf yang membantu kepala sekolah untuk lebih kompeten dalam melaksanakan manajemen data kepala sekolah. 3). Menambah fasilitas berupa 1 (satu) unit laptop untuk kepentingan sekolah, khususnya untuk mendukung pengelolaan dan penyusunan data sekolah. Adapun target luaran dari kegiatan PKM Pendampingan Manajemen Data Kepala Sekolah di SLB Taman Pendidikan Islam, terdiri dari luaran wajib dan luaran tambahan. Luaran wajib yaitu: 1). terbitnya satu artikel ilmiah yang dipublikasikan melalui Jurnal Pengabdian kepada Masyarakat Progressive, Humanis, Brainstorming (PHB) terindeks SINTA 5; 2). Publikasi pada media massa cetak online Analisa Daily. Adapun luaran tambahan program PKM ini berupa Hak Kekayaan Intelektual artikel; Kegiatan ini telah dilaksanakan pada bulan Juni 2021 sesuai jadwal pelaksanaan PKM Pendampingan Manajemen Data Kepala Sekolah.

Abstract

Permasalahan yang ditemukan pada Sekolah Luar Biasa TPI yang berlokasi di Medan,  terdapat guru-guru yang terhambat proses pengajuan kepangkatan profesi gurunya disebabkan kurang terampil menulis publikasi ilmiah. Padahal, menulis artikel untuk publikasi ilmiah adalah tugas wajib yang harus dilaksanakan dalam rangka pengembangan profesionalisme guru selain membuat karya inovatif. Sebagaimana tertuang di dalam PP No. 19 Tahun 2017 tentang Guru. Adapun solusi  ditawarkan berupa peningkatan pengetahuan para guru dengan menggelar diklat penulisan publikasi ilmiah dengan metode klasikal guna membantu para guru mengoptimalkan penggunaan internet untuk menelusuri sumber referensi ilmiah. Hasil temuan yang diperoleh adalah masih banyaknya guru yang merasa dirinya tidak mampu menulis karya ilmiah karena keterbatasan pengetahuan mengenai akses internet. Simpulannya, acara diklat peningkatan kompetensi guru khususnya dalam penulisan publikasi ilmiah seperti yang telah dilaksanakan sangat membantu mereka dalam menyusun karya ilmiah.

Abstract

Indeed, at an early age, religious values should be instilled in accordance with the beliefs held by their parents. So that children in the future have better morals, accompanied by religious knowledge that is taught from an early age. It should be supported to continuously animate religious knowledge. So that children's lives in the future remain in the goodness that is recommended by the teachings of revelation. In fact, what is currently happening is that teaching religious knowledge from an early age is called by the government as a radical teaching, so the question arises whether teaching and practicing religious activities is included in a radical understanding? When it is said to be radical, it means that all religious people are adherents of radicalism. It is important to examine the existence of forms of radicalism in early childhood education institutions. This study uses empirical legal research methods by taking research locations in two kindergartens. The conclusion of this study is based on the results of our team's analysis, that there are no forms of radicalism from teaching materials, ways of delivering and other matters related to the implementation of early childhood education, which have anything to do with radicalism. Suggestions to the government, to look more fairly and wisely, so that there is no longer the assumption that radicalism is found in early childhood education.

Abstract

Madrasah yang berasal dari bahasa Arab, berarti sekolah, sebenarnya sama saja dengan sekolah umum. Hanya saja secara legalitas operasional, madrasah bernaung di bawah Kementerian Agama dan sekolah berada di bawah pengaturan Kementerian Pendidikan dan Kebudayaan. Modernisasi pendidikan madrasah saat ini dapat dilihat pada kemajuan berbagai komponen pendidikannya, seperti; infrastruktur madrasah yang semestinya semakin elegan, fasilitas dan media pembelajaran yang berbasis IT, tenaga pendidik yang profesional, dan sumber belajar yang relevan dengan kemajuan ilmu pengetahuan terkini, bahkan lahirnya beberapa madrasah unggulan yang bertaraf nasional. Permasalahannya, madrasah setingkat diniyah awaliyah (ibtidaiyah/setara sekolah dasar) dari segi fasilitas dan media pembelajaran yang berbasis IT masih sangat tertinggal. Bahkan ditemukan fakta saat belajar Alquran, kitab suci tersebut dalam keadaan lusuh dan robek di sana-sini. Penyebabnya adalah faktor ekonomi masing-masing wali murid/orang tua siswa sehingga tidak memiliki kemampuan membelikan Alquran yang baru untuk anak-anaknya. Pihak madrasah, dalam hal ini menurut kepala madrasahnya, tidak memiliki anggaran dana untuk menyediakan Alquran baru yang siap sedia di madrasah sehingga tidak perlu dibawa pergi dan pulang oleh para siswa.  Melalui kegiatan PKM MDA Al Muhajirin Alquran ini diharapkan para guru MDA Al Muhajirin akan memiliki peningkatan pengetahuan dan keterampilan dalam penggunaan media pembelajaran berbasis IT. Sehingga diharapkan akan berdampak pada peningkatan kualitas proses pembelajaran siswa-siswa MDA Al Muhajirin secara keseluruhannya. Berdasarkan pertimbangan efektvitas dan keselamatan di tengah pandemi, Tim PKM menyambut positif tawaran merefokus judul PKM dari Pendampingan Implementasi Alquran Digital di MDA Al Muhajirin menjadi PKM Pemberian Bantuan Pencegahan Penularan Covid-19 kepada Mu’allim dan Mu’allimah MDA Al Muhajirin.  Madrasah originating from Arabic, means school, is actually the same as a public school. It's just that legally operational, madrasas are under the Ministry of Religion and schools are under the regulation of the Ministry of Education and Culture. The modernization of madrasa education can now be seen in the progress of various components of education, such as; madrasa infrastructure which should be more elegant, IT-based learning facilities and media, professional teaching staff, and learning resources that are relevant to the latest scientific advances, and even the birth of a number of superior madrassas with national standard. The problem is that madrasas at the level of diniyah awaliyah (ibtidaiyah / elementary school equivalent) in terms of IT-based facilities and learning media are still lagging behind. Even found facts when studying the Koran, the holy book is shabby and torn here and there. The cause is the economic factor of each student's guardian / parents so that they do not have the ability to buy a new Koran for their children. The madrasa, in this case, according to the madrasa head, does not have a financial budget to provide new Korans that are readily available at the madrasas so that students do not need to be carried away and gone home. Through the Al Muhajirin Al Qur'an PKM activity, it is expected that Al Muhajirin MDA teachers will have increased knowledge and skills in the use of IT-based learning media. So that it is expected to have an impact on improving the quality of the learning process of Al Muhajirin MDA students as a whole. Based on effectiveness and safety considerations in the midst of a pandemic, the PKM Team welcomed positively the offer to refocus the PKM title from Assistance to the Implementation of Digital Alquran at MDA Al Muhajirin to PKM Providing Covid-19 Transmission Prevention Transmission Assistance to Mu'allim and Mu'allimah MDA Al Muhajirin.

Abstract

The Yoruba people have lived harmoniously as a kin for as long as the tribe has been in existence without religious strain despite the myriads of choices of beliefs that their traditional religion (Iseese) offered; and also, with the advent of foreign religions, Christian and Muslims have continuously live together in Yoruba land, often in harmony with practitioners of Yoruba traditional religion. In the recent age, there has been a curve of trend as the tribal relationships among the Yoruba people have gradually been eroding due to increasing infiltrations and activism of religion extremists. This research examined the damage religious sectarianism wreaked on the kinship relationship among the Yoruba folks. The research was qualitative, and situated within fundamentalism theory, a religious philosophy which depicts advocacy and strict adherence to a religious doctrine or belief. Data collections which are based on both primary and secondary sources are participatory, observatory and library oriented. It is concluded that religion has done more harm than good, but the situation can be redeemed with good understanding of the intended purpose of religion ingrained in the religious zealots.

Abstract

On Monday, 5 October 2020, the Draft Law on Job Creation was ratified by the House of Representatives of the Republic of Indonesia and the manuscript was signed by the government on November 3, 2020. Therefore, since November 3, 2020, the Draft Law on Job Creation promulgated in Law Number 11 Year 2020 on Job Creation. Based on the existing official text, the researcher intended to compare the rights of female workers as regulated in Law Number 13 of 2003 on Manpower with Law Number 11 of 2020 on Job Creation. The research method used in this study was a normative juridical research, with a statutory and conceptual approach, descriptive analytical research specifications, data collection by literature study, and qualitative data analysis. The protection of female workers as referred to in the previous labor law was still valid and was not discussed at all in Law Number 11 of 2020 on Job Creation. Therefore, it could be ascertained that the refusal of workers during the process of the Draft Law on Job Creation is wrong. The article which was amended related to the protection of female workers did not change the substance of the protection of female workers as previously regulated through Law Number 13 Year 2003 on Manpower. The Qur'an has been explained that people need to provide special rights for female workers. Explicitly, there is no verses in the Qur'an that mentioned the word 'special rights for female workers'. However, implicitly, there were general arguments based on the verses in the Qur'an that could be used as a basis for granting this right. Some of the special rights of female workers were implicitly communicated in Islamic teachings.

Abstract

The number of unemployed nationally is of course influenced by the number of unemployed in the regions, both in urban and rural areas. The availability of relatively limited employment opportunities is unable to absorb job seekers who continue to increase every year in line with the increase in population. The high unemployment rate does not only cause problems in the economic field, but also various problems in the social field, such as poverty and social insecurity. The problem of the availability of employment opportunities in Indonesia has now reached a fairly alarming condition, marked by a large number of unemployed and relatively low incomes. Unemployment can be a burden on families and communities, a major source of poverty, can encourage increased social unrest and crime, and can hinder development in the long term. The bad impact of unemployment is the reduced level of people's income which in turn reduces the level of prosperity/welfare. The procedure used to collect data in this study is documentation, namely the guidelines used in the form of notes or quotes, searching legal literature, books and others related to the identification of problems in this study both offline and online. Analysis of legal materials is carried out using the content analysis method (centent analysis method) which is carried out by describing the material of legal events or legal products in detail to facilitate interpretation in the discussion. The concept of labor itself is defined as a population of working age who is ready to do work, namely 15-65 years of age. According to Law No. 13 of 2003, labor is anyone who is able to do work to produce goods and services, both to meet their own needs and those of others or the community. In this case, the workforce is grouped into Educated Workers, namely workers who require a high level of education. For example, doctors, teachers, engineers, etc., trained workforce is a workforce that requires training and experience. For example, drivers, mechanics, etc., uneducated and trained workers are workers who do not require prior education or training in their work. For example, sweepers, garbage collectors, etc. Based on Article 150 of Law Number 13 of 2003 concerning Manpower, it is stated that "The provisions regarding termination of employment in this law include termination of employment that occurs in business entities that are legal entities or not, owned by individuals, owned by partnerships or owned by legal entities. , both privately owned and state owned, as well as social enterprises and other businesses that have management and employ other people by paying wages or other forms of remuneration.

Abstract

Tenaga kerja asing (TKA) juga mendapat tempat yang diatur dalam Rancangan UU Cipta Kerja. Banyak dari masyarakat khususnya para buruh menentang adanya regulasi yang dianggap mempermudah tenaga kerja asing untuk bekerja di Indonesia. Masyarakat menganggap seharusnya tenaga kerja asing jika ingin bekerja di Indonesia maka harus menaati UU Ketenaga Kerjaan buka UU Cipta Kerja. Pada Pasal 42 UU Ketenaga Kerjaan menyebutkan bahwa setiap pemberi kerja yang mempekerjakan tenaga kerja asing wajib memiliki izin tertulis dari Menteri atau Pejabat yang ditunjuk, sedangankan pada Rancangan UU Cipta Kerja menyatakan izin tertulis tenaga kerja asing diganti dengan pengesahan rencana penggunaan tenaga kerja asing.Jenis penelitian yang digunakan dalam penulisan ini adalah penelitian pustaka (library research). Library research berarti penelitian yang menggunakan dokumen tertulis sebagai data, dan sumber data yang digunakan dalam penelitian ini mencakup bahan hukum primer, bahan hukum sekunder dan bahan tersier.Keluarnya Pasal 42 UU Cipta Kerja secara otomatis mengamandemen Pasal 42 UU Ketenagakerjaan Nomor 13 Tahun 2003 yang mewajibkan TKA mendapatkan izin tertulis dari menteri atau pejabat lain yang ditunjuk Dalam Perpres Nomor 20 tahun 2018, TKA yang masuk ke Indonesia harus mengantongi sejumlah izin antara lain Visa Tinggal Terbatas (VITAS), Rencana Penggunaan Tenaga Kerja Asing (RPTKA), dan Izin Menggunakan Tenaga Kerja Asing (IMTA). Dengan berlakunya UU Cipta Kerja, maka TKA hanya perlu membutuhkan RPTKA saja karena tak lagi membutuhkan izin tertulis dari menteri atau pejabat yang ditunjuk. Izin masuk TKA dipangkas dan kini hanya membutuhkan RPTKA saja. Kemudian di Pasal 46 UU Ketenagakerjaan, TKA dilarang menduduki jabatan yang mengurusi personalia dan jabatan tertentu yang rinciannya diatur Keputusan Menteri. Di UU Cipta Kerja, pembatasan jabatan bagi TKA di perusahaan Indonesia sebagaimana diatur dalam Pasal 46 UU Ketenagakerjaan dihapus

Abstract

Many legal cases and other cases experienced by Indonesian Migrant Workers (TKI) abroad which are detrimental to these migrant workers. Based on these facts, the State should play a role and be fully responsible for the safety and welfare of TKI. The role and responsibility of the state is not only contained in the contents of the law solely, but must be implemented in an effort to protect the law against migrant workers who work abroad. Based on the facts, it turns out that the various regulations related to the protection of TKIs abroad, there is overlap between one institution and another, the other problem is that agreements between the Government of the Republic of Indonesia and the destination countries for migrant workers must be frequently reviewed, due to state regulations objectives often change so that many migrant workers are harmed by the policy
