Abstract

Darmajaya Press sebagai salah satu penerbitan di Bandar Lampung yang juga merupakan bagian dari penerbitan perguruan tinggi. Implementasi hak cipta sangat perlu dilakukan untuk menganalisis bagaimana hak cipta dioperasionalkan di dalam tataran penerbitan di perguruan tinggi, dan juga untuk menjawab penerapan hak cipta yang terjadi di penerbit Darmajaya Press. Jenis penelitian adalahpenelitian hukum normatif. Jenis penelitian ini mengkaji implementasi dari ketentuan hukum positif, perjanjian, kontrak secara faktual di dalam peristiwa hukum yang terjadi. Tipe penelitian adalah deskriptif yaitu penelitian ini memiliki tujuan untuk memaparkan secara jelas dan rinci di dalamperistiwa hukum yang terjadi. Hasil penelitian menunjukkan bahwa perjanjian kerjasama antara CV. Aura Publishing dengan IIB Darmajaya adalah sebagai upaya untuk pendirian penerbitan di lingkungan perguruan tinggi, dan sebagai konsultan yang memberikan pendampingan untuk mendirikan dan mengembangkan penerbitan di perguruan tinggi; penerapan hak cipta dilaksanakan melalui keinginanDarmajaya Press untuk menjadi anggota IKAPI, dan di dalam perjanjian yang dilakukan ada klausul harus mencapai 10 terbitan buku, sehingga saat ini yang baru tercapai adalah 7 judul buku ISBN. Kemudian penulis (dosen) yang menerbitkan buku belum dibuatkan perjanjian penerbitan untuk menjamin hak cipta baik itu hak moral dan hak ekonomi yang dimiliki oleh penulisnya.Kata Kunci : Hak Cipta, Perjanjian, Penerbitan Perguruan Tinggi

Abstract

In Indonesia, electronic commerce can be said to be very developed. In 2007 there was a case which can be said to be the first case of electronic commerce. The data can be seen based on studies and suggestion that was carried out by the Business Competition Supervisory Commission (KPPU) on the case of the MoU between the Government of Indonesia and Microsoft (KPPU Report, 2007). This study was written to determine the implementation of the rules of business competition law and the policy of the KPPU in the field of business competition in relation to electronic commerce. In this study two approaches were used, namely the normative approach. The data in this study are mainly obtained from library research, especially on primary legal materials in the field of business competition. The data analysis used is qualitative method. This is closely related to research which can be categorized by normative legal research that approach is more abstract-theoretical. the results of the study show that the e-commerce business sector still does not lead to anti-business competition practices even though it still enters the surveillance radar. This may be due to electronic commerce itself is a new form of trade.Keywords : E-commerce, Business Competition, and Policy

Abstract

Progress and increase in national development in general and the development of economic activities in particular have implications for the development of the business worldand companies. Every company that conducts business activities is required to fulfill businessoperational requirements. The legality management mechanism is very necessary to find outhow the procedures for managing the legality of forms and business activities, and whetherDarmajaya IIB students know the mechanism for managing the legality of forms and businessactivities. The purpose of this research is to carry out mapping related to the procedures formanaging the legality of forms and business activities. In addition, this study would like tolook at the practical level regarding the level of knowledge (in this study, the scope is limitedto Darmajaya IIB students) regarding the procedures for managing the legality of forms andbusiness activities. This type of research is normative-empirical legal research, with theapproach used is the socio-legal approach. The legality of the business activity in questionconsists of a Company Register and a Trade Business License. The results of the studyshowed that from 30 people the authors made the subject as a resource person it could besaid that 15 of them answered that they did not know the answer to the question of how themechanism for managing business legality documents.
