Abstract

The right to control the state over land should be able to achieve the greatest prosperity of the people as mandated by Article 33 paragraph (3) of the 1945 Constitution of the Unitary State of the Republic of Indonesia. It is important to discuss the problem of the meaning of the substance of the right to control land by the State based on the 1945 Constitution. and what is the right to control land by the state based on regulations in the framework of constitutional law so that land for the greatest prosperity of the people can be achieved. The research method used is the normative juridical legal research method. The results show that the right to control land by the state within the framework of constitutional law is still very far from being burned, so that the prosperity of the people, one of which can be achieved through proper management of land controlled by the state, has not been able to achieve people's happiness as adhered to by the theory of utilitarianism law and more. continued as stated in the 1945 Constitution and the Basic Agrarian Law applicable in Indonesia.

Abstract

Officially, the government has banned the people going home on Eid al-Fitr this year. based on Circular (SE) Number 13 of 2021 concerning the End of Idul Fitri 1442 Hijriah Homecoming and Endeavors to Control the Spread of Crown Infection Illness 2019 (Covid-19) Amid the Heavenly Month of Ramadan 1442 Hijri. The Circular Letter is intended to regulate restrictions on community mobility and optimize the functions of the Covid-19 Command Post in Villages / Kelurahan during the holy months of Ramadan and Eid al-Fitr in 1442 Hijriah. The purpose of this circular letter is to prevent an increase in the spread of Covid-19 during the holy months of Ramadan and Eid al-Fitr in 1442 Hijriah. The period of eliminating Eid al-Fitr homecoming in 1442 Hijriah is May 6-17, 2021 and efforts to control Covid-19 are during the holy month of Ramadan and Idul Fitri 1442 Hijriah. Analysis of legal materials is carried out using the content analysis method (centent analysis method) which is carried out by describing the material of legal events or legal products in detail in order to facilitate interpretation in the discussion. The provisions stipulated in the Circular include protocols for eliminating homecoming, prevention and control of COVID-19; socialization; monitoring, control and evaluation; up to sanctions. Based on Circular (SE) Number 13 of 2021 concerning the Elimination of the Idul Fitri 1442 Hijriah Homecoming Day and Efforts to Control the Spread of Corona Virus Disease 2019 (Covid-19) During the Holy Month of Ramadan 1442 Hijriah that the Protocol Provisions for the Elimination of Homecoming, Prevention and Control of COVID -19.

Abstract

Wakaf is a philanthropic institution that is quite old in Islamic history. The purpose of the existence of wakaf is not only just taqarrub to Allah SWT, but also gives the economic impact of wakaf objects. Wakaf is one of the solutions given by Allah to eliminate the gap between rich and poor people. Indeed wakaf has a very high economic potential in the welfare of the people. Through cash wakaf or wakaf cash investment in wakaf property in the form of plantations and others indicates that Islam does not leave its people in poverty. Based on this, the wakaf should no longer be oriented towards mosques, madrassah, burial ground, but rather towards a more productive direction producing new economic resources intended for the welfare of the people.

Abstract

Democracy in the life of the state, one of which is reflected in the existence and implementation of elections. Elections are a manifestation of sovereignty held by the people. Elections held in Indonesia aim to be a means of democracy, maintain the establishment of the Unitary State of the Republic of Indonesia (NKRI), realize national goals, elect members of the legislature, elect the president and vice president. Legislative members who are elected through elections are representatives of the people in the legislature. This means that members of the legislature are representatives of the people who vote. They as representatives must have the ability or obligation to speak and act on behalf of a larger group being represented. Elections to elect representatives of the people are called legislative elections which are held to elect members of the People's Representative Council (DPR), Regional Representatives Council (DPD), and Regional People's Representative Council (DPRD). Based on Article 18 paragraph (3) of the 1945 Constitution, it is stated that provincial, district, and city regional governments have Regional People's Representative Councils whose members are elected through general elections. In a democratic country, the existence of the People's Representative Council (hereinafter abbreviated as DPR) and the Regional People's Representative Council (hereinafter abbreviated as DPRD) is a must. DPRD is a regional people's representative institution that carries out regional government functions as an equal partner to regional governments. In the structure of regional government, DPRD is located at two levels, namely at the provincial level called the Provincial DPRD and at the regency/city level it is called the Regency/Municipal DPRD. Members of the DPRD are directly elected to occupy/serve legislative positions within one period (five years). based on procedures, the purpose of this research is to find out the process of changing the leadership of the DPRD and the process of appointing the chairman of the DPRD according to the perspective of national law. In article 327 paragraphs 2 and 3 it is emphasized that in essence it is stated that the leadership of the DPRD and the chairman of the DPRD comes from the number of political parties that are counted as getting the first most seats in the Provincial DPRD, so that this also causes several pros and cons, for example taken from the example in 2015 members The East Nusa Tenggara DPRD conducted a judicial review to the Constitutional Court because they felt that their constitutional rights had been violated by the enactment of the a quo article. The Petitioner explained that the process of filling out and appointing the DPRD's equipment had eliminated his constitutional rights, then he said that as a result of this provision, the Petitioner had lost the opportunity to participate in the process of selecting the DPR's apparatus

Abstract

The Provincial Government has a Governor, the Regency Regional Government has a Regent and Regency DPRD, and the City Regional Government has a Mayor and City DPRD. More specifically, Article 18 Paragraph (3) of the 1945 Constitution which states "Provincial, Regency and City Regional Governments shall have a Regional People's Representative Council whose members are elected through general elections". That is, in every Regional Government, Regency and City has a Government that is accompanied by the Regional People's Representative Council. The appointment of the chairman of the DPRD is based on the rules that have been set, namely based on the votes obtained and based on that it can be said that the appointment based on the procedure also has an opponent, namely the dismissal that is carried out based on the procedure. The purpose of this study was to find out the legal arrangements regarding the Regional People's Representative Council, to find out the legal basis for the replacement of the Chair of the South Labuhan Batu Regional People's Representative Council, and to find out the process of implementing the replacement of the Chair of the South Labuhan Batu Regional People's Representative Council. Regarding the legal arrangements regarding the Regional People's Representative Council, it is regulated in Article 18 Paragraph (1) of the 1945 Constitution and the provisions regarding Regional Heads and Deputy Regional Heads can be found in Law Number 23 of 2014 concerning Regional Government. As has been amended several times, most recently by Law Number 9 of 2015, Substitution of the Chairperson of the Labuhan Batu Selatan Regional People's Representative Council through the results of a meeting held in the meeting room of the Labuhan Batu Selatan Regional People's Representative Council and on the basis of a letter submitted by the Regional Leadership Council National Mandate Party and answered by the Central Executive Board of the National Mandate Party to approve the replacement of the Chairman of the Regional People's Representative Council of South Labuhan Batu with Letter Number: PAN/A/KU-SJ/100/VIII/2016 dated August 16, 2016 Regarding Approval of the Name of the Chairman of the DPRD Labusel Regency From the DPP PAN and even then addressed to the Chairman of the DPD PAN Labusel, the process of replacing the Chairman of the Regional House of Representatives for the South Labuhan Batu Region is carried out in accordance with the applicable laws and regulations

Abstract

Decisions of State and Government administration, namely decisions made by Government Agencies, either regulating (regression) or beschikking. Making judgments is a legal act. This research uses normative juridical legal research methods (normative research) with descriptive analytical research specifications that use secondary data. The data collection procedure is in the form of documentation of notes or quotations, tracing legal literature, books and others related to identification of problems both offline and online which are then analyzed through the content analysis method (centent analysis method) with a focus on the problem of how the factors inhibiting the implementation of the injunction of state administrative court decisions and how the responsibility of state administrative officials to the implementation of administrative court decisions state effort. That the factors inhibiting the implementation of court decisions that are legally enforceable include: The absence of a special executorial institution or sanction institution that functions to implement decisions. The low level of awareness of State Administration officials in obeying the decisions of the State Administrative Court. There is no stricter regulation regarding the implementation of the decision of the State Administrative Court

Abstract

Tindak pidana perdagangan anak yang semakin meningkat mengakibatkan keresahan dan berkurangnya rasa aman di kalangan masyarakat.Apalagi saat ini diketahui bahwa tidak sedikit dari pelaku tindak pidana perdagangan orang selalu mengincar anak dan perempuan untuk dijadikan korbannya. Permasalahannya adalah anggota masyarakat belum memahami sepenuhnya tentang tindak pidana perdagangan anak dan perempuan, motif dan dampak dari tindak pidana perdagangan anak dan perempuan, belum memahami sepenuhnya tentang pentingnya melakukan  upaya pencegahan tindak pidana perdagangan anak dan perempuan serta kurangnya kemampuan anggota masyarakat dalam memecahkan masalah yang berkaitan dengan  upaya pencegahan tindak pidana perdagangan anak dan perempuan.Kata kunci: kemampuan, masyarakat, mencegah, TPP, anak, perempuan

Abstract

Anak sering menjadi objek kekerasan fisik di rumah, terutama di saat anak melakukan kesalahan, melalaikan kewajibannya, atau tidak mematuhi aturan yang ditetapkan oleh orang tuanya. Orang tua yang seharusnya memberikan perhatian dan kasih sayang, malah melakukan kekerasan fisik dengan alasan untuk mendisiplinkan anak.Permasalahannya adalah anggota masyarakat belum memahami sepenuhnya sepenuhnya tentang pentingnya perlindungan anak dari kekerasan fisik, tanggungjawab masyarakat terhadap perlindungan anak dari kekerasan fisik,serta kurangnya kemampuan masyarakat dalam memecahkan masalah yang berkaitan dengan  perlindungan anak dari kekerasan fisik.Luaran yang akan dihasilkan adalah berupa penyuluhan  guna memberikan perlindungan, pencegahan dan penanggulangan kekerasan fisik terhadap anak serta pelatihan memecahkan permasalahan terkait sehingga masyarakat memiliki kemampuan untuk memecahkan  permasalahan terkait dengan kekerasan fisik terhadap anak. Selain itu pelaksanaan program dan hasilnya akan dimasukkan ke dalam jurnal ilmiah.Khalayak sasaran program adalah 70 orang anggota masyarakat Lingkungan III Pulau Brayan Darat II Medan dan 70 orang anggota masyarakat Kelompok Tani Purnakaryawan Desa Manunggal Deli Serdang. Kegiatan ini diisi dengan pemberian materi berkaitan dengankekerasan fisik terhadap anak, motifnya, dampaknya, upaya pencegahannya serta memberikan pelatihan hukum  bagi masyarakat(anggota perkumpulan) melalui pemberian kasus terkait untuk diselesaikan masalahnya.

Abstract

State and Government administrative decisions, namely decisions made by Government Agencies, both regulating and statutory (beschikking). Making provisions is a legal act. As a legal act the provision gives birth to rights and / or obligations, and the provisions that give birth to rights and / or obligations are called positive terms. This research is categorized in normative type research, where the data sources used are secondary data sources with data obtained through library research (library research) by processing qualitative data analysis. the focus of the problem in this study is how the execution of the cancellation of the building permit letter in the state administration case.

Abstract

Nelayan bagian dari masyarakat Indonesia yang mempunyai hak memperoleh perlindungan hukum. Nelayan dalam menjalankan aktivitasnya mendapat perlindungan di dalam Undang-Undang Nomor 7 Tahun 2016 tentang Perlindungan dan Pemberdayaan Nelayan, Pembudidayaan dan Petambak Garam, Undang-Undang Nomor 1 Tahun 2014 tentang Perubahan Atas Undang-Undang Nomor 27 Tahun 2007 tentang Pengelolaan Wilayah Pesisir dan Pulau-Pulau Kecil, Undang-Undang Nomor 45 Tahun 2009 tentang Perubahan Atas Undang-Undang Nomor 31 Tahun 2004 tentang Perikanan. Namun belum banyak nelayan mengetahui cara mendapatkan dan merasakan perlindungan hukum tersebut. Nelayan yang sebahagian besar tidak mampu (miskin) dan tidak mempunyai akses terhadap keadilan hanya bisa pasrah menghadapi persoalan hukumnya. Nelayan senantiasa berhadapan dengan berbagai tantangan besar. Tantangan besar yang dihadapi adalah perebutan akses di laut, ketersediaan bahan bakar yang cukup, serta kondisi perubahan iklim dan cuaca yang berlangsung secara global. Selain itu kerap terjadi konflik antar nelayan dari satu daerah dengan daerah lainnya mengenai penggunaan alat tangkap dan konflik lainnya yang terjadi di laut. Persoalan hukum tersebut harus diberikan perlindungan atau bantuan hukum, sehingga nelayan mendapatkan hak-hak-nya. Penelitian ini bertujuan untuk memberikan kepastian hukum dan rasa keadilan bagi nelayan tanpa diskriminasi. Karena itu, perlu untuk meneliti faktor penyebab nelayan belum mendapatkan perlindungan hukum melalui Lembaga Bantuan Hukum dan hambatan pemberi bantuan hukum dalam memberikan bantuan hukum kepada nelayan
