Abstract

Perdagangan secara elektronik (electronic commerce atau e-commerce) saat ini sering dilakukan, sehingga sangat rentan terjadi wanprestasi. Sehingga diperlukan perlindungan hukum, dengan landasan Undang-Undang Nomor 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik dan Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen. Penelitian ini merupakan penelitian hukum normatif dengan menggunakan pendekatan undang-undang dan pendekatan konseptual. Berdasarkan hasil penelitian disimpulkan bahwa UU ITE dan UU PK belum sepenuhnya dapat memberikan perlindungan hukum terhadap konsumen e-commerce, dikarenakan masih terdapat aspek yang kurang mendapat perlindungan dari UU ITE dan UU PK terhadap konsumen e-commerce. Terdapat permasalahan yang timbul dalam perlindungan hukum terhadap konsumen e-commerce yakni permasalahan menyangkut penyelesaian sengketa e-commerce dan permasalahan keamanan dalam bertransaksi. Permasalahan mengenai penyelesaian sengketa e-commerce berkaitan dengan kelemahan dalam jalur penyelesaian sengketanya, baik penyelesaian sengketa melalui jalur pengadilan maupun penyelesaian sengketa melalui jalur non pengadilan.

Abstract

Data on accidents and traffic violations collected by the Riau Regional Police Directorate and from our daily observations illustrates that the level of traffic safety and the level of community compliance with traffic laws / legislation is very alarming, if no strategic steps are taken. in order to increase the level of safety and increase the legal compliance of the community it will cause harm not only to the loss of life and property and psychological but also will cause losses in the economic field. The strategy or effort to increase legal awareness of the community as road users is basically part of orderly traffic. Strategies in increasing community legal awareness include: First, socialization or campaigns to comply with traffic regulations through the installation of banners and socialization. Second, Building the character of discipline. This character building can be started through the teacher's example. Therefore awareness of the instructional teachers is undoubtedly necessary. Security, order, safety and smooth traffic are shared responsibilities. Through this counseling, the character of discipline can be transmitted to all students of Muhammadiyah 3 Vocational School Pekanbaru.

Abstract

Bullying behaviour in a school environment can create a less supportive environment for students self-development, bullying behavior can hurt students, so they feel unwanted and rejected by their environment. This will certainly bring effect to the various activities of the students in the school. Causes of bullying due to family factors, environmental factor, school factors and social environmental factors. Bullying is a student who has a physical or social strength that is more appealing to another friend, has a high temperament, and a sense of empathy is low. Victims of bullying often fight against the perpetrators but some of them are subject to the command of the perpetrator and do not dare to fear. To cope with the well-programed bullying, the current countermeasures only include individual approaches by Walikelas, teacher of study field, as well as BK teachers. Abstract

Abstrak Otonomi daerah adalah suatu bentuk demokrasi yang diberikan oleh Pemerintah Pusat kepada Pemerintah Daerah untuk mengelola rumah tangga mereka sendiri dengan berpegang pada hukum dan peraturan yang berlaku. Implementasi otonomi daerah merupakan titik fokus penting dalam rangka meningkatkan kesejahteraan rakyat. Pengembangan suatu daerah dapat disesuaikan oleh pemerintah daerah dengan potensi dan kekhasan masing-masing daerah. Ini adalah kesempatan yang sangat baik bagi pemerintah daerah untuk membuktikan kemampuannya menjalankan wewenang yang merupakan hak daerah. Otonomi daerah adalah salah satu agenda utama reformasi yang bertujuan mengurangi kesenjangan ekonomi-politik antara pemerintah pusat dan daerah. Era reformasi menjadi titik awal pergeseran paradigma terpusat yang diadopsi oleh Orde Baru ke era desentralisasi. Desentralisasi dalam konteks Indonesia diyakini sebagai cara untuk membangun pemerintahan yang efektif, mengembangkan pemerintahan yang demokratis, menghormati keanekaragaman lokal, menghormati dan mengembangkan potensi masyarakat lokal, dan mempertahankan integrasi nasional. Masyarakat menaruh harapan yang besar pada otonomi daerah untuk membawa perubahan dalam sistem negara. Sayangnya desentralisasi telah menyebabkan banyak korupsi di wilayah ini. Inilah yang terjadi pada 2018 lalu. Tahun 2018 tampaknya menjadi tahun yang gelap bagi upaya pencegahan dan pemberantasan korupsi, terutama di daerah. Pada 2018 Komisi Pemberantasan Korupsi (KPK) telah menjerat puluhan kepala daerah dalam sejumlah kasus dugaan korupsi mulai dari gubernur, bupati, walikota, hingga pejabat daerah. Hingga akhir 2018, KPK masih menjerat kepala daerah yang tersandung kasus korupsi yaitu Bupati Jepara Ahmad Marzuqi dan Bupati Cianjur Irvan Rivano Muchtar sebagai tersangka. Daftar panjang kepala daerah yang dijerat oleh KPK selama 2018 menunjukkan bahwa penanganan kejahatan korupsi di Indonesia masih membutuhkan perhatian serius dari banyak pihak. Demikian juga, Indeks Pencapaian Korupsi Indonesia masih jauh dari ideal, yaitu 3,7, seperti yang dikatakan oleh juru bicara KPK Febri Diansyah. Ini menunjukkan bahwa korupsi yang dilakukan oleh sejumlah kepala daerah merupakan salah satu bentuk kegagalan otonomi daerah. Dengan kata lain ada banyak pekerjaan rumah yang harus dilakukan terkait dengan implementasi otonomi daerah. Karena kasus-kasus yang ditangani oleh Komisi Pemberantasan Korupsi menunjukkan bahwa korupsi masih terjadi dan merupakan gejala di banyak lembaga. Kata Kunci: Otonomi Daerah, Korupsi, Kepala Daerah Abstract Regional autonomy is a form of democracy given by the Central Government to the Regional Government to manage their own household by sticking to the applicable laws and regulations. The implementation of regional autonomy is an important focal point in order to improve people's welfare. The development of an area can be adjusted by the regional government with the potential and distinctiveness of each region. This is a very good opportunity for the local government to prove its ability to exercise the authority that is the right of the region. Regional autonomy is one of the main agendas of reform aimed at reducing the economic-political gap between the central and regional governments. The era of reform became the starting point of shifting the centralized paradigm adopted by the New Order to the era of decentralization. Decentralization in the Indonesian context is believed to be a way to build effective governance, develop democratic governance, respect local diversity, respect and develop the potential of local communities, and maintain national integration. The community places considerable expectations on regional autonomy in order to bring about changes in the state system. Unfortunately decentralization has caused a lot of corruption in the region. This is what happened in 2018 ago. The year 2018 seems to be a dark year for efforts to prevent and eradicate corruption, especially in the regions. In 2018 the Corruption Eradication Commission (KPK) has ensnared dozens of regional heads in a number of cases of alleged corruption ranging from governors, regents, mayors, to regional officials. Until the end of 2018, the KPK still ensnared the regional heads who tripped over corruption cases namely Jepara Regent Ahmad Marzuqi and Cianjur Regent Irvan Rivano Muchtar as suspects. The long list of regional heads snared by the KPK during 2018 shows that the handling of corruption crimes in Indonesia still needs serious attention from many parties. Likewise, the Indonesian Corruption Achievement Index is still far from ideal, namely 3.7, as said by KPK spokesman Febri Diansyah. This indicates that corruption committed by a number of regional heads is one form of failure in regional autonomy. In other words there is a lot of homework that must be done related to the implementation of regional autonomy. Because the cases handled by the Corruption Eradication Commission indicate that corruption still occurs and is a symptom in many institutions. Keywords: Regional Autonomy, Corruption, Regional Head

Abstract

Abstrak Kemunculan pandemi virus corona di Wuhan, China, pada bulan Desember tahun lalu menjadi ancaman kematian global. Hal ini disebabkan kemampuan virus menyebar dengan cepat dan kemampuannya dalam menimbulkan dampak yang fatal bagi kesehatan. Kekhawatiran akibat dampak yang ditimbulkan virus corona, menyebabkan karantina kesehatan menjadi wacana yang harus segera dilakukan pemerintah Indonesia. Wacana ini berkembang karena termaktub dan tercantum jelas bahwa karantina kesehatan merupakan cara yang efektif memutus mata rantai penyebaran virus di saat terjadi kedaratan bencana seperti wabah virus corona hari ini yang dapat menimbulkan dampak dan kerugian besar bagi negara dan masyarakat Indonesia. Dalam Undang-Undang Nomor 6 Tahun 2018 Tentang Kekarantinaan Kesehatan dengan jelas menerangkan tentang adanya pembatasan mengenai masuk dan keluarnya individu ke suatu daerah yang telah dinyatakan sumber wabah, termasuk mengatur pula tentang adanya perintah untuk melakukan isolasi, karantina wilayah, vaksinasi dan lain sebagainya untuk menghentikan penyebaran wabah yang terjadi di Indonesia. REGIONAL QUARANTINE BASED ON LAW No. 6 OF 2018 CONCERNING HEALTH QUARANTINE Abstract The appearance of the Corona virus pandemic in Wuhan, China, in December last year became a threat of global death. This is due to the rapidly spreading virus ability and its ability to inflict a fatal impact on health. Concerns due to the impact caused by Corona virus, cause health quarantine to be a discourse that the government should immediately do. This discourse develops because it is enlisted and clearly stated that health quarantine is an effective way to break the chain of virus spread in the event of catastrophic emergency such as Corona virus outbreak today that can cause substantial impact and loss for the country and Society of Indonesia. In Law No. 6 of 2018 concerning health's infidelity clearly describes the limitations on entrance and discharge of individuals to an area that has been declared the source of the plague, including also regulating the presence of orders for isolation, territorial quarantine, vaccination, etc. to stop the spread of the outbreak in Indonesia.

Abstract

Forest and Peatland fires that hit several provinces in Indonesia last year. One proof that environmental laws do not go according as it should. As was the case in the province of Riau, South Sumatra, Jambi, West Kalimantan and Central Kalimantan. The case of forest fires and haze become routine every year. Ironically, despite the smoke haze repeated every year with huge losses, the handling remains the same. Reactionary and tend to dwell on purely technical matters outage. The country had neglected its obligations. The fundamental problem of forest fires and land mismanagement of natural resources that have been perpetuated by bad practices, including the monopoly on possession. All these bad practices perpetuated through the legitimacy of such a permit. Disaster fumes resulting from bad practices do corporations with a common pattern. To keep production costs down, the company burned land when land clearing. This is clearly contrary to the Law No. 32/2009 on the Protection and Environmental Management. Companies that obtain permission means subject to the terms and provisions of the law governing how they should be tried, including in it should not be burned, and shall keep the region. If all violations was systematic, it was because there was never any enforcement against corporations in the region found api.Point of views of the repeating pattern of the company which is intentionally doing bad practices that lead to ecological disaster, it can be said that the corporation has done of serious crimes, due to meet the elements of a planned and widespread.

Abstract

Kekerasan seksual pada anak di bawah umur sudah menjadi ancaman di Indonesia, melonjaknya kekerasan seksual di Indonesia membuat semua orang harus waspada karena kekerasan seksual murupakan penyiksaan terhadap anak, dimana orang dewasa atau remaja menggunakan anak sebagai rangsangan seksual. Sebuah penyiksaan jelas merupakan bentuk pelanggaran terhadap Hak Asasi Manusia (HAM). Ada beberapa alasan anak seringkali menjadi target kekerasan seksual, yaitu anak selalu berada pada posisi yang lebih lemah dan tidak berdaya, moralitas masyarakat khususnya pelaku kekerasan seksual pada anak yang rendah, kontrol dan kesadaran orang tua dalam mengantisipasi tindak kejahatan pada anak yang rendah. Di Indonesia kekerasan seksual pada anak dapat dijerat hukum seperti yang tercantum dalam Undang-Undang Nomor 23 Tahun 2002 tentang Perlindungan Anak yang termuat dalam Bab XII yaitu mulai Pasal 77 sampai dengan Pasal 90. Serta Undang-Undang Nomor 39 tahun 1999 tentang HAM Pasal 65 yang mengatur tentang hak anak untuk mendapat perlindungan dari kegiatan eksploitasi dan pelecehan seksual, penculikan, perdagangan anak serta dari berbagai bentuk penyalahgunaan narkotika, psikotropika dan zat adiktif lainnya. Oleh karenanya, pelecehan seksual pada anak perlu mendapatkan perhatian serius mengingat akibat dari kekerasan seksual terhadap anak akan menyebabkan anak akan mengalami trauma yang berkepanjangan.

Abstract

Film is one of medium of mass communication that brings message to be delivered to target audience. Film is not a value-free entity because it is the result of some people's thinking process until it becomes a cultural product. Hanung  Bramantyo's  Kartini  emphasizes  the  critical  attitude  of  a  woman  who  broke  the  injustice  in  the  era  of colonization  in  Indonesia.  She  can  be  regarded  as  the  early  struggle  of  feminist  figure  in  Indonesia  who  have brought  today’s  Indonesian  women  no  longer  experience  discrimination  in  education.  Nevertheless,  the interpretation of feminism has not been fully accepted because most of Indonesia territories adhere to patriarchal system.  The  specific  objective  of  this  research  is  to  find  out  the  reception  of  Pekanbaru  moviegoers  towards Kartini  in  regard  of  feminism  issue.  The  long-term  goal  of  this  research  is  to  provide  feedback  for  filmmakers about  Indonesian  audience  acceptance  towards  gender  equality  issues,  and  serve  as  a  reference  for  further research  on  gender  messages  in  the  media.  The  study  used  a  qualitative  research  method  with  the  reception analysis  approach  of  the  Stuart  Hall  Encoding  /  Decoding  model  which  observed  assimilation  process  between media discourse and audience culture discourse. Different understanding on emancipation and feminism causes different  interpretation.  Informants  who  have  a  strong  background  in  life,  interpret  feminism  as  a  struggle  to break injustice. Informants  who  were in the Dominant Hegemonic Position  group  were individuals  with a  high school  education  background  and  idolized  the  figure  of  Kartini.  Informants  who  are  in  Negotiated  Position  are individual  observers  and  film  practitioners.  Oppositional  Position  Informants  are  PhD  holder  individuals  and religious persons.  Keywords: Feminism, Reception Analysis, Kartini Movie

Abstract

ABSTRACT This research is motivated by the increasing number of people doing electronic trade. One of them is trading women's products electronically in Pekanbaru City. Electronic trading often creates obstacles such as payment procedures, legal protection, electronic signatures, and dispute resolution mechanisms that occur in the future. Electronic trading must also comply with positive law. Even though there are a number of obstacles in trading electronically, this type of trade still has an interest. Besides that ignoring technological developments will have a negative impact in the future, so that openness and proactive and anticipatory nature are alternatives that can be chosen in facing the dynamics of technological development including trade developments such as electronic commerce or commonly referred to as electronic commerce or e-commerce. This is because Indonesia has become part of the global e-commerce market. The focus of this research is 1). What is the legal protection of consumers in the trade of women's products in Pekanbaru City? 2.) What is the legal settlement if a dispute arises by the parties in the electronic trade in women's products in Pekanbaru City? The purpose of this study is to find out how the legal protection of consumers in the trade of women's products electronically in Pekanbaru City and to find out how to resolve their laws in the event of a dispute by parties in the trade of women's products electronically in Pekanbaru City. The results showed that legal instruments in Indonesia have provided legal protection to consumers even though they are not yet fully like the UUPK and the ITE Law, but there are still consumers who do not understand the UUPK and the ITE Law. And there are still consumers who do not understand their rights and obligations as consumers. The dispute resolution mechanism available is either through justice or outside the court.
