Abstract

Penelitaian ini bertujuan untuk mengetahui bentuk tanggung jawab dan pengawasan yang dilakukan oleh pemerintah Daerah berdasarkan Undang-Undang Republik Indonesia Nomor 18 Tahun 2017 Tentang Perlindungan Pekerja Migran Indonesia. Jenis penelitian yang digunakan adalah penelitian hukum normatif, dan menggunakan dua metode pendekatan, yaitu Pendekatan perundang-undangan dan Pendekatan konseptual. berdasarkan penelitian, tanggung jawab pemerintah daerah dilaksanakan berdasarkan pasal 40,41, dan 42 Undang-Undang Republik Indonesia Nomor 18 Tahun 2017 Tentang Perlindungan Pekerja Migran Indonesia dan pengawasan pemerintah daerah dilaksanakan berdasarkan amanat pasal 90 Peraturan Pemerintah Republik Indonesia Nomer 59 Tahun 2021 Tentang Pelaksanaan Perlindungan Pekerja Migran Indonesia.

Abstract

This research’ purposes are to know and to analyze implementation of implemented P3K by the company in their workers as the form PT. Alfaria Trijaya’s responsibilities in the work accident. This study was empirical legal research. Research’s result shows that implementation of P3K in PT. Alfaria Trijaya Tbk, can be said has been done according to the Ministry of Manpower Regulation Number 15 /MEN /VIII/2008 on the first assistance during work accident in workplace. It start with the first assistance officers, rooms, first aid cabinet or box and its contain, evacuation tools and transportation. However, the first aid implementation of company has not meets the standard according to the ministry regulation. The liability of PT Alfaria Trijaya Tbk in the event of a work accident in the workplace, as for the forms of liability including: Such as the provision of first aid for work accidents in the workplace (P3K), and the Employment Social Security Administration Agency (BPJS) covering transportation costs; Temporary compensation for being unable to work (STMB); Disability compensation; Compensation for death, funeral expenses and periodic compensation at once; Rehabilitation costs in the form of replacement of assistive devices (orthoses) and/or replacement devices (protheses); Reimbursement of dentures, hearing aids and glasses; Education Scholarship.

Abstract

This study aims to determine the responsibilities of online transportation service companies to partners exposed to risk in terms of Law Number 13 of 2003 concerning Employment and Law Number 11 of 2020 concerning Job Creation and the factors that affect the responsibility of transportation service companies online to partners. This research uses conceptual, legislation, and sociological approaches to normative-empirical law. In contrast, the data collection techniques used in this study were library materials and interviews. The study results show that the company provides an alternative in the form of insurance to partners as a form of concern for the company. And the factors that affect the responsibility of the company with the driver are the non-fulfilment of the elements of the working relationship because the company's relationship with the driver is only a partnership relationship.

Abstract

The Job Creation Act (Ciptaker) protects the interests of employers (corporations) by omitting the heterogeneous Legal terms that are integrated (coherent) into the State and the workers expect to provide protection for workers in the context of determining and providing decent wages for workers. These legal circumstances demonstrate that, under the Job Creation Act, the application of autonomous legal norms predominates over the application of heteronomous legal principles. Such a situation affects the obscure presence of the State in providing decent employment for workers and upsets the tripartite ecosystem. It is employed to restore the degradation of the quality of the relationship between the two parties within the Job Creation Act. Therefore, it is necessary to make legal reconstruction efforts related to matters associated with the determination and payment of wages for workers in the Job Creation Act that emerge uncertainty and injustice for workers, to produce a formulation of a decent and fair wage legal policy to establish a relationship between the state, workers, and decent employers (Tripart ides). This research uses normative legal research methods, the type of research used in juridical normative research is descriptive. As for the approaches used in this research, there are several methods found in normative law research, among others: conceptual approaches, and philosophical approaches.

Abstract

Penelitian ini bertujuan untuk mengetahui Implementasi Perlindungan Pekerja Migran Indonesia Pasca Penempatan di Luar Negeri menurut PP No.59 Tahun 2021 di Kabupaten Lombok Tengah, yang membahas tentang bagaimana pengaturan Pekerja Migran Indonesia Pasca Penempatan di Luar Negeri menurut PP No.59 Tahun 2021 Tentang Pelaksanaan Perlindungan Pekerja Migran Indonesia. Serta faktor apa saja yang menjadi hambatan atau kendala perlindungan pasca penempatan buruh Migran Indonesia di kabupaten Lombok Tengah. Jenis penelitian yang digunakan adalah penelitian hukum Normatif–Empiris. Berdasarkan hasil penelitian di ketahui bahwa Pelaksanaan Perlindungan Pekerja Migran Indonesia pasca penempatan menurut Peraturan Pemerintah Nomor 59 Tahun 2021 Tentang Pelaksanaan Perlindungan Pekerja Migran Indonesia telah dilaksanakan secara maksimal sesuai dengan yang diamanatkan oleh Peraturan Pemerintah Nomor 59 Tahun 2021. Adapun faktor yang menjadi hambatan atau kendala dalam pelaksanaan perlindungan pasca penempatan buruh Migran Indonesia yaitu kurangnya sosialisasi dari perangkat yang terkait, status Pekerja Migran Indonesia yang ilegal, dan rendahnya pengetahuan pekerja Migran Indonesia sehingga mereka dapat ditipu oleh pihak lain.
