Abstract

This study aims to examine the implications of the fifth amendment to the 1945 Constitution and the re-enactment of the Basic Principles of State Policy (PPHN) as a substitute for the GBHN on the constitutional system. The research method used is normative by placing primary and secondary legal materials as a reference. The results of the study indicate that a limited amendment to the 1945 Constitution is not yet necessary, including in the case of restoring the MPR's authority to determine the PPHN (Points of State Policy) because the position of the MPR is no longer the highest state institution.
