Abstract

As the nations that have ratified the Declaration of Human Rights and both have established constitutional rights for citizens in the Constitution of each country, Indonesia and Korea have been conforming the Code /Act to the Convention. This paper is an account of  comparing the Law about Act/Code on Adultery, in Korea and in Indonesia. The method is a comparative analysis of the Law, employing normative perspective. The finding of the account is that the Article 241 paragraph (1) and (2) of Law No. 293 of 1963, of Korea (the last amendment on April 5th, 2013 by the Law No. 11731) has in common with the contents of the Article 284 paragraph (1) and (2) of the Indonesian Penal Code or Wetboek van Strafrecht. The Indonesian Penal Code on adultery has been emanated mostly by Pancasila’s ideology in which  the principle of Islamic morality and the morality of customary people appear in it; the adultery and fornication are quite contrary to the values of customary law, customs, also quite contrary to the moral values of religions.  Keywords: Article 241 Korean Criminal Act,  Article 284 Indonesian Criminal Code, Adultery, Sharing The Act/Code. Abstract

Islam in the realm of culture has shown its unique dynamics. Besides being a cultural force, Islam, for example, has emerged as a resistance movement faced colonialism. In Indonesia, although Islam has become the "face" of the nation, its history has spawned several interpretations of thought which is viewed differently. This interpretation by itself has shown that the treasures of Islamic culture is not limited to understandings rigid theological and doctrinal alone. On the side of the paradox, Islam as a religion is a cultural force has caused the turmoil that is often unfairly accused. Adults have often campaigned that Islam as a religion of civilization has become a "threat" to the contemporary western world. As a cultural reality, Islam has always claimed to be a universal dimension and perform a variety of adaptations. In fact, in the development of its history, Islam often do contiguity are open to various local cultural areas targeted syiarnya. Islam also widened tolerant of local cultures. In a local view, we are certainly not too surprised, how Islam as a theology, for example, capable of combining with Javanese and Hindu syncretism understood that for centuries has been influenced each other. Islam as a culture has given a touch of "flexible and intimate" against the values of the local culture. By itself, this show Islam as a cultural reality has to ask himself. As far as can be mapped "cultural blindness" would occur in the region basically, that is the psychological dimensions-mental, so actuality cultured most Muslims are actually many detrimental to the development of Islamic culture. If Islam truly a religion that was revealed to the benefit of all the Worlds and its contents, it's time boundaries of formal-structural rigid avoided. Thus, it should be removed impression that when the advance of civilization and culture, it is precisely the religion (Islam) blocking it. Abstract

This study aims to find out the optimization of open green space as a public space in Taman Ayodia Kota Jakarta Selatan. In this context, researchers utilize the concept of optimization, open green space, and construction administration. By using qualitative methods, researchers are then free to the perception of informants consisting of Kepala Sudin Pertamanan dan Pemakaman Kota Jakarta Selatan as well as the visitors of Taman Ayodia. The results show that the function of open green space in the location of the research turned out to be not optimal because there are several factors that affected it, that the parks still needs additions and improvements, in addition to various less activity. So open green space becomes the container of the social interaction of citizens that can create creativity and motor activity of visitors, required periodic and ongoing socialization.Keywords: optimization of the function of the Green open space, and public spaces.

Abstract

This study discusses the dynamics of the interaction between state and society in the reconstruction of national identity on the community of Indonesia-Malaysia border in Sambas District, West Kalimantan, since Independence until the Reform Era. The research approach is qualitative with the ethnographic methods. The results of the study explained that the idea of nationalism and national identities are not fixed and final. In a dynamic, interpreted and constructed through negotiation, contestation, domination, and a compromise between the state and local communities, in a long period of time, and within the framework of political, economic, and socio-cultural.he rule and regulation and to conduct the law enforcement in accordance with law resemblance.

Abstract

Regionalism in international relations has been a contemporary phenomenon since the world entered its 20th century. In Southeast Asia, Indonesia as one member of ASEAN has managed consolidating  the country’s position in trade cooperation and competition. With  setting up its economic community of MEA in 2015, ASEAN has focused on trade sector cooperation. Given the strategic position of Indonesia where two third of ASEAN demands for goods and services are supplied by Indonesia, the setting up of ASEAN economic community (MEA) is crucial for individual members to compete and cooperate. How would Indonesia take this opportunity? The paper discusses the factors that need more attention in such areas as government regulation, technology, competitiveness, and innovation. While natural resources and Indonesia’s strategic position in terms of geography and trade route are there to exist, those factors will determine whether Indonesia will be the winner or the loser.  Keywords : regionalism, strategic factors, cooperation, competition, competitiveness.

Abstract

This research was purposed to develop model of impact caused by population, affluence, and technology, IPAT, to predict the effect of population total, Gross Domestic Producs (GDP) per Capita, and  forestry emplotee on forests and lands fire in Indonesia. This research was pointed out that additional of pupulation gives very siginificant effect, GDP Per Capita and forestry employee each gives significant effect to the total areas of forests and lands fire at nine provinces in Indonesia, namely North Sumatra, Riau, Jambi, South Sumatra, West Kalimantan, East Kalimantan, Central Kalimantan, South Kalimantan and Papua. This result was proven that IPAT model can be used to understand about anthropogenci factors contribute to the forests and lands fire in Indonesia.

Abstract

Prospects of radicalism movement in Indonesia. This writing uses literature research methods. The problem in this paper is how is the prospect of radical movement movement in Indonesia? The results of this writing found four interesting things. First, radicalism is not a product of religion, because all religions only teach goodness. The role of religion only invites or advocates good things and prevents things that are bad for society (in the context of Islam known a phrase in Arabic: Amar ma'ruf nahi munkar). Secondly, the main lighter of the radicalism movement is the destruction of the system, supported by the theory of system damage and the theory of structural violence. Third, the peaceful action of movements 411 and 212 denied the radicalism of religious products. Abstract

Taxation has been crucial in a country where government revenues from taxes are dominant. Business sectors often find tax policy discouraging. This paper looks into the impact of the government regulation to re-assess the asset of companies on taxes to be borne by the respective undertakings. the method is a case study experienced by PT Wiveris Herbatama located in Pakanbaru, Riau, Sumatera that undergo the implementation of the Decree of the Finance Ministry of the Republic of Indonesia, No. 191/PMK/010/2015.  The result of the study shows that the impact of the tax policy on the burden of taxes has existed. The taxes become higher. Therefore one recommendation of the study is that there is a need for provision of tax stimulus coming from the government in order to balance the interest of the government and that of business sectors.

Abstract

Unlike women emancipation in advanced nations in North America and Western Europe, the movement of Raden Ajeng Kartini’s movement in Indonesia has successfully enriched the tradisional culture with the Western spirit of modernity. The paper is an account of the novel Wajah Sebuah Vagina  (2004) by Naning Prawoto. The themes of the novel are ethics and gender equality. Using qualitative method along with the psychology of art-work, the study finds that fifty percents of 38 scenes deal with ethics and another fifty percents with gender. Secondly the study finds that the novel has successfully portrait typical women with ambition and forgetting social norms and values of the society that lead her to her failure; the implied message is the need to adopt modernism and at the same retain the “modernity” within her own culture.Keywords : Ethics,  gender equality, modernism, novel

Abstract

This study was conducted to analyze the Influence of Quality of Human Resources, Work Culture and Organizational Climate toward Legislative Council Secretariat Performance, Bogor Regency. Reference theory study variables using the theory of Human Resources of Sedarmayanti (2014: 13), the theory of Work Culture of Paramita (in Umam, 2012: 15), the theory of Organizational Climate of Denison (in Wirawan, 2008: 124), and the theoretical performance of Moeheriono (2010: 63). This study uses a quantitative explanatory. The study population numbered 133 consists of a Chairman and members of DPRD Bogor and Bogor Regency DPRD Secretariat staff, with Slovin (5%) in the can 100 samples and each respondent get as many questions as 46 statements using a Likert scale. Based on the results showed a positive and significant influences of the Quality of Human Resources toward the Performance Legislative Council Secretariat Performance, Bogor Regency. The amount of influence Quality of Human Resources toward the Performance Legislative Council Secretariat Performance to 60.4%. There is a positive and significant Influence of Work Culture toward Legislative Council Secretariat Performance, Bogor Regency. The amount of Influence of Work Culture toward Legislative Council Secretariat Performance amounted to 61.2%. There is a positive and significant Influence of Organizational Climate toward Legislative Council Secretariat Performance, Bogor Regency . The amount of Influence of Organizational Climate toward Legislative Council Secretariat Performance to 63%. There is a positive and significant Influence of Quality of Human Resources, Work Culture and Organizational Climate together toward Legislative Council Secretariat Performance, Bogor Regency. The amount of Quality of Human Resources, Work Culture and Organizational Climate together toward Legislative Council Secretariat Performance together amounted to 73.3%.
