Abstract

Predatory pricing is one form of strategy undertaken by a business actor in selling a product at a price below the cost of production (average cost or marginal cost). Areeda and Turner say that is not a predatory pricing when the price is equal to or above the marginal cost of the production of a good. The main purpose of predatory pricing is to remove competitors from the market and prevent potential business actors from becoming competitors in the same market. As soon as it succeeds in getting the competitor out of the market and delaying the entry of new entrants, then he can raise the price again and maximize the profits that may be earned. To be able to perform such acts, then the business actor must have a large market share and the profits to be gained can cover the losses suffered during the predator. Keywords: Predatory pricing, Large market   Predatory pricing adalah salah satu bentuk strategi yang dilakukan oleh pelaku usaha dalam menjual produk dengan harga dibawah biaya produksi (average cost atau marginal cost).  bukan kegiatan predatory pricing apabila harga adalah sama atau diatas biaya marginal dari produksi suatu barang.  Adapun tujuan utama dari predatory pricing untuk menyingkirkan pelaku usaha pesaing dari pasar dan juga mencegah pelaku usaha yang berpotensi menjadi pesaing untuk masuk ke dalam pasar yang sama. Segera setelah berhasil membuat pelaku usaha pesaing keluar dari pasar dan menunda masuknya pelaku usaha pendatang baru, maka selanjutnya dia dapat menaikkan harga kembali dan memaksimalkan keuntungan yang mungkin didapatkan. Untuk dapat melakukan perbuatan tersebut, maka pelaku usaha tersebut haruslah mempunyai pangsa pasar yang besar dan keuntungan yang akan diperoleh dapat menutupi kerugian yang diderita selama masa predator. Abstract

Politics of crime prevention in general election law are interesting to be discuss because some prohibited acts already set out, for example, there are minimum specific criminal provisions and additional punishment for it perpetrators. Thus seemed to guarantee the implementation of a good election, yet in fact there are a variety of criminal acts which qualified as offense, criminal elections, etc. The offenses contained in the various election rules such as the Criminal Code, legislative elections laws and presidential election law are a criminal offense related to the general election. In other words, this criminal act also called as part of political criminal or political crimes. The legislative products which mentioned any punishments in the election laws means of political crime prevention offenses (criminal offense and elections). Abstract

For answer demand  the house as a place to stay that is growing but diminishing availability of land and limited then trigger the development of flats grew rapidly. Construction of flats not only can save the land use is increasingly crowded, but also one of the alternatives to the arrangement of land use land or often known as spatial planning. Spatial planning is a system consisting of three (3) phases, namely spatial planning, space utilization, and control the utilization of space. There are two (2) elements in the spatial arrangement of the structure and pattern of spaces. The structure of the room is the arrangement of settlements and the network of infrastructure and tools that support the social economy in society that its hierarchical structure. Then, the spatial pattern is the distribution of allotment of space in an area that includes the spatial allocation for protection functions and the allocation of space to function cultivation. Spatial planning shall be basically for the welfare and prosperity of the people. Abstract

Indonesia is a country that adopts welfarestate system where the state administration is aiming for the prosperous of society. The excistense of statehood based on Pancasila ideology and constituion of 1945 with desentralization principal government system. Desentralization system are system wich the authorize to manage and developed by the regional government/local government. That system excepting as otherwise stipulated in legislation. Distribution authority to region/local government is a manifestation of the spirit of the countrys development based on Region/Local Authonomy. Fulfillment of prosperous for society, central government of Negara Kesatuan Republik Indonesia forming an area exclusively dedicated to the development and investment strategies in increasing state revenues. In order to increase fulfillment the prosperous, needed an authority who focus on build and developed the special region to face the infrastructure developed in order to developed direct investment. This system made the Central Government intervened the Local/Region Government. The intervened reflected by Lawa Number 44 of 2007 juncto Governement Regulation Number 46 of 2007 about Free Trade and Free Port of Batam Island. The principal of implementing Free Trade Zone in Batam Island with special authority as executor contained inrelated with Desentralization principal. That system in accordance with Indonesian Constituion of 1945 specially in article 18B paragraph (1) wich specifies that the state respected with the special unit – a unit areas and special’s unit – a unit areas. That system are manifestation of Asymmetric Desentralization principal system. Pelaksanaan kehidupan bernegara berdasarkan Ideologi Pancasila dan Konstitusi Undang-Undang Dasar Tahun 1945 dengan sistem pemerintahan menganut prinsip desentralisasi yang memberikan kewenangan pengelolaan dan pembangunan kepada Pemerintah Kota/Kabupaten kecuali seperti yang telah diatur dalam ketentuan peraturan perudangan. Pemberian kewenangan bagi Pemerintah Daerah ini merupakan perwujudan dari semangat pembangunan negara berdasarkan Otonomi Daerah. Dalam pemenuhan kesejahteraan masyarakat tersebut, pemerintah Negara Kesaatuan Republik Indonesia membentuk suatu kawasan yang diperuntukkan khusus bagi pengembangan dan strategi investasi dalam peningkatan pendapatan negara. Guna peningkatan tersebut, dibutuhkan otoritas pembangunan yang berfokus dalam pengembangan suatu kawasan di wilayah daerah yang khusus untuk menghadapi pembangunan infrastruktur dalam rangka pengembangan investasi. Hal ini membuat Pemerintah Pusat kembali melakukan intervensi kepada daerah untuk turut hadir langsung dalam melakukan pembangunan. Penerpan wilayah investasi tersebut adalah melalui Undang Undang Nomor 44 Tahun 2007 juncto Peraturan Pemerintah Nomor 46 Tahun 2007 tentang Perdagangan Bebas dan Pelabuhan Bebas Pulau Batam. Prinsip tersebut masih sejalan dengan amanah konstitusi terkait dengan pelaksanaan pemerintah daerah khususnya Pasal 18B ayat (1) yang menentukan bahwa negara menghormati satuan – satauan daerah yang bersifat khusus dan satuan – satuan daerah yang bersifat istimewa. Abstract

The most of the world’s trade is carried by sea.  There is always a risk that the object of the trade  may be delayed, damaged or lost in transit.Many events can occur during transit. For example, traders may be involved in an accident whereby the goods are destroyed or might be stolen.The result can be loss of profits.  Traders should therefore insure their goods against loss, damage or delay in transit to minimize the impact of such incidents on their business by being properly insured. One of mechanism by cover the risk of loss or damage the goods with marine insurance. This can cover the whole journey-over land as well as sea. Basically, marine insurance is third party vesselinsurance. This insurance covers liability for loss or damage to someone else’s property, arising from operation of the vessel. Third party vessel insurance, more commonly knowns as legal liability insurance (Protection and Indemnity insurance).There are many insurable interest can be covers by marine insurance, especially on legal liability insurance. The insurable interest in marine insurance like liability in respect of passanger, cargo liability, liability in respect of the crew members, ship collision, sea pollution risk, towage liabilities, liability for obstruction and wreck removal, and liability of damage to property port and navigation tools/telecommunications cruise. The problem in this research is the importance of legal liability insurance for the transfer of risk if loss or damage may be happen to the third party, arising from operation of the vessel.The second problem is about regulation on marine insurance in Indonesia.This research classified by normative legal research with descriptive type of explanatory and analytical approach to normative legal substance (approach of legal content analisys).The outcome of the research shows that the legal liability insurance has an important role for protecting the third parties for loss or damage, arising from operation of the vessel at sea. The second problem in this research is the regulation regarding marine insurance in Indonesia. Marine Insurance Regulation in Indonesia is Commercial Code since 1847 which is regulated colonial legacy from Deutch, had been outstanding for more than 150 years. While the development of todays insurance business has been growing very rapidly.It is necessary to create regulations governing marine insurance. Abstract

Indonesia is a maritime country with an area of ocean roughly two-thirds of the total area of the archipelago. Likewise, with the Riau Islands Province whose territory is surrounded by oceans. With the demographic conditions, the population in the Province of Riau Islands, especially Tanjungpinang, mostly working as a fisherman. To support the living standards of  fishermen are still far from prosperous, the necessary funding from various parties, especially banks that have the function of lending or financing based on Islamic principles. Expected by the function, the bank can provide the widest access for fishermen to the maritime economic development centered on the fishermen can be realized. This study classified normative legal research with descriptive type of explanatory and analytical approach to normative legal substance (approach of legal content analisys). Necessary data is secondary data consists of primary legal materials, secondary law and tertiary legal materials collected from the literature. The data is processed by editing, coding, and systematization of data, then analyzed using qualitative methods. Based on the results of research and discussion, that the regulation of banking activities in fund lending to the public regulated in Law No. 7 of 1992 on Banking as amended by Act No. 10 of 1998. Conventionally, banks can conduct business loans to community in the form of credit. Likewise, based on Sharia Principles, commercial  anks and rural banks can provide financing and fund placement based on Sharia Principles, in accordance with the provisions stipulated by Bank Indonesia. Fund Lending in the maritime sector, especially for fishermen implemented through credit programs Food Security and Energy and the People’s Business Credit which is the implementation of government programs through the bank’s status as a state-owned enterprise. In terms of the distribution of funding with Islamic principles, There are private banks in Tanjungpinang which has given the finance portfolio to some fishermen in Tanjungpinang. Abstract

Act No. 4 Year 1996 On Amenability Rights, did not recognize the selling power of attorney known is the agreement between the creditor and the debtor to sell the object of a security interest is under the hand as efforts to resolve the bad credit borrowers, the agreement between the creditor and the debtor agreed after the occurrence of bad loans by the debtor. Use of the selling power of attorney by the creditor for the sale of objects Amenability Right are not in accordance with the provisions of Act No. 4 Year 1996 On Amenability Rights, the lender and the buyer objects encumbrance not get legal protection, the purchase agreement does not meet the requirements of the agreement validity requirements as stipulated in Article 1320 of the Civil Code. Abstract

The change of system in this Republic is not necessarily followed by cultural change (behavioral culture) of society and apparatus. The conception of the state of welfare state law can not be felt maximally by the society, given the amount of state money lost due to acts of corruption committed by a handful of people. Law enforcement efforts against corruption must go hand in hand with efforts to change the behavior patterns of people who are happy to commit acts of corruption. The research problem is how to build a political system that is not vulnerable to corruption (Perspective of Cultural Change (Culture) Versus System Change (Structural)). The research methodology used is normative legal research (Doctrinal Reseach). The conclusions obtained include: apart from strengthening the system in the form of institutional strengthening and legislation, strengthening the efforts of preventing corruption through the improvement of anti-corruption community behavior must go hand in hand. Efforts to eradicate corruption from the aspect of behavior change is not an easy thing, but it takes a long time since the changed is the behavior of the society that has been entrenched. The approach to behavioral change in society of corruption perceptions should be changed by building a new perception that corruption is an act that can be very harmful to the state and society. Keywords: Corruption, System, Culture   Perubahan sistem di Republik ini tidak serta merta diikuti dengan perubahan kultural (budaya perilaku) masyarakat dan aparat. Konsepsi negara hukum welfare state belum dapat dirasakan secara maksimal oleh masyarakat, mengingat banyaknya uang negara yang hilang akibat tindakan korupsi yang dilakukan oleh segelintir orang. Upaya penegakkan hukum terhadap tindak pidana korupsi harus berjalan beriringan dengan upaya merubah pola perilaku masyarakat yang senang dalam melakukan tindakan korupsi. Permasalahan penelitian adalah bagaimana Membangun Sistem Politik yang Tidak Rentan Korupsi (Perspektif Perubahan Budaya  (Kultural) Versus Perubahan Sistem (Struktural)). Metodologi penelitian yang digunakan adalah penelitian hukum normatif (Doctrinal Reseach). Kesimpulan yang diperoleh antara lain; selain dari penguatan sistem berupa penguatan kelembagaan dan peraturan perundang-undangan, penguatan terhadap upaya pencegahan korupsi melalui pembenahan perilaku masyarakat yang anti korupsi harus berjalan beriringan. Upaya memberantas korupsi dari aspek perubahan perilaku masyarakat bukanlah suatu hal yang mudah, akan tetapi membutuhkan waktu yang lama mengingat yang dirubah adalah perilaku masyarakat yang sudah membudaya. Pendekatan perubahan perilaku masyarakat akan persepsi korupsi semestinya dirubah dengan membangun persepsi baru bahwa korupsi adalah perbuatan yang sangat dapat merugikan negara dan masyarakat. Abstract

Banking activities conducted based on the Principle of Fiduciary between the bank and its customers. Society will entrust his money to the bank if the bank can provide a guarantee that all the information about the customer can be kept confidential by the bank. To maintain customer confidence in the bank in carrying out business activities must also apply the principle of confidentiality. The principle applied by the bank secrecy is a form of commitment and bank protection in keeping customers personal data. However, what happens today is that many people who complain of financial institutions that offer their products through long-distance phone lines (telemarketing). This is a big question that customers experiencing financial services product offerings through the phone line. Customers generally concluded unilaterally that the banks where they deposit funds, have provided their personal data to other parties (financial institutions). This is of course contrary to the principles of fiduciary and confidentiality that must be firmly held by the bank as a financial institution that is dependent on the source of funds from the public (depositors). Protection of confidentiality of customers personal data, in addition to the duty of the bank, also the responsibility of policy makers in the banking business. Birth of Law Number 21 Year 2011 concerning the Financial Services Authority, authorizes the protection of the confidentiality of customers personal data, which had previously been the Bank Indonesias duty, then switching function to the Financial Services Authority. Financial Services Authority as an agency that has the task of regulating and supervising the financial services institution, is able to provide legal protection for the consumer in this case bank customers, so as to foster consumer confidence in the financial institution.  Keywords: Financial Services Authority, Confidentiality Principles/Bank Secrecy Principle, Customer Personal Data
