Abstract

This study found the influence of Gross Domestic Product (GDP), the amount of profit sharing and the number of offices to the number of muḍārabah deposits of Islamic banks in Indonesia. The data used in this research is quarterly data from 2011-2015 period. The method of analysis used in this research is Data Panel Regression Analysis by using computer program Eviews version 9.0 and Microsoft Excel 2010. The results in this study indicate that partially Gross Domestic Product (GDP), the amount of profit sharing and the number of offices have a significant influence on the amount Muḍārabah deposits. This result is evidenced by a significant value of 0.0000 that is smaller than 0.05 and has a positive direction. So the greater of GDP, number of profit sharing and the number of offices, the greater number of muḍārabah deposits of Islamic banks in Indonesia.Penelitian ini menemukan adanya pengaruh Produk Domestik Bruto (PDB), jumlah bagi hasil dan jumlah kantor terhadap jumlah deposito muḍārabah bank syariah di Indonesia. Data yang digunakan dalam penelitian ini adalah data triwulan periode 2011-2015. Metode analisis yang digunakan dalam penelitian ini adalah Analisis Regresi Data Panel dengan menggunakan program komputer Eviews versi9.0 dan Microsoft Excel 2010. Hasil dalam penelitian ini menunjukkan bahwa secara parsial Produk Domestik Bruto (PDB), jumlah bagi hasil dan jumlah kantor memiliki pengaruh signifikan terhadap jumlah deposito muḍārabah. Hasil ini dibuktikan dengan nilai signifikan sebesar 0.0000 yaitu lebih kecil dari 0.05 dan memiliki arah positif. Sehingga semakin besar PDB, jumlah bagi hasil dan jumlah kantor, maka semakin besar pula jumlah deposito muḍārabah bank syariah di Indonesia.

Abstract

Perkembangan perbankan syariah dalam periode tahun 2007-2013 terus menunjukkan kinerja yang menakjubkan. Berbagai indikator keuangan seperti total nilai aset dan jumlah dana pihak ketiga yang berhasil dihimpun terus mengalami peningkatan. Begitu juga dengan tingkat kinerjanya yang digambarkan dari perolehan  laba yang  dibukukan oleh perbankan dan unit-unit pembiayaan syariah juga mengalami pertumbuhan yang positif. Menggeliatnya kegiatan perbankan syariah di Indonesia tidak terlepas dari meningkatnya tingkat kepercayaan masyarakat untuk mengakses jasa layanan perbankan syariah. Hal ini setidaknya juga dapat digambarkan dari keberadaan kantor perbankan syariah dan unit-unit pembiayaan syariah yang tersebar di hampir seluruh wilayah tanah air hingga ke pelosok. Dibandingkan dengan perbankan konvensional, praktek perbankan syariah memiliki perbedaan yang sangat mendasar yaitu tidak menempatkan uang sebagai komoditas perdagangan, penetapan suku bunga dalam transaksi perbankan sangat dilarang karena riba, tidak ada unsur time- value of money dan balas jasa atas penggunaan dana menerapkan prinsip bagi hasil. Untuk memberikan edukasi dan perlindungan kepada nasabah (masyarakat) perlu adanya analisa prinsip-prinsip kesyariahan pada praktek perbankan syariah.

Abstract

The concept of Time Value of Money in the LKS is not accepted because of riba, but in practically mainly on small investors to invest, will face a big problem if it rejects the principle of Time Value of Money, whenever any country will have inflation. will be injustice when Islamic banking do not give a rate of return to the investor. The research is a qualitative, primary data sources and data collection consisted of a document. The Brochure of Product Financing Transactions in LKS, b). Fatwa DSN-MUI 2000, c). CD-ROM File Maushuah al-Hadith al-Sharif al-Tisah 1997 Edition II, d). The Books related to the concept of Time Value of Money, e). SOP (Standard Operational Product) financing and acounting system. Secondary data consists of various books related to the concept of Time Value of Money both modern and classical fiqh books and  Research results related to this research problem. This research analyzes the discriftive approach, with results as follows: 1. Time Value of Money in the LKS is not acceptable, because the increase in the Time Value of Money earned should be of real business, not because of the debt contract / qardh 2. Time Value of Money by economic concepts Hadis Muhammad saw among other things contained in the contract of salam/ indent, BBA and disconto, araya and provision for debt payments 3. the occurrence of in-consistency between ideology Time Value of Money with praxis in LKS due in addition to not paying attention to the business logic of the Prophet, helplessness in operating system usage still based on the operating system Conventional Financial Institutions (LKK).

Abstract

Qualitative issue discussed in this study is: "how is consistency ijarah fee in product  financing arrangement Hajj bailout at Syariah Bank in relation to the provision of normative ijarah fee in the DSN-MUI Fatwa No. 29 Th. 2002 and what main factor hindered the implementation of the fatwa. Data about the Arrangement of the Hajj bailout financing obtained from three Islamic banks Semarang branch through two methods of documentation and interviews. Study on substance DSN 29 of 2002, actually offering two models in the arrangement  of the Hajj bailout funding: through qardh or through ijarah contract. There is no indication that the Fatwa  requires the merger two  agreement contract. Ijarah contract made by the BPS and its customers over the filing and registration services to SISKOHAT to get a seat portion of Hajj is ijarah practices that do not conform to the requirements of the contract of ijarah. Because of the service and the work performed by the bank is already a BPS duties. Ijarah fee levied by Bank Muamalat Indoneisa (BMI) in the financing pattern Bailout Hajj, though not violate the provisions of the  DSN fatwa, but does not meet the requirements of ijarah contract as provided in Islamic law (fiqh). The Ijarah fee levied by Bank Syariah Mandiri (BSM) and BNI Shariah, not in accordance with the fatwa DSN, as calculated by the nominal amount of the bailout and the the contract period. Misconceptions in understanding the content of this fatwa is caused due to lack of a comprehensive understanding of the elements contained in the fatwa.

Abstract

The development of Islamic banking is relatively significant modifications to the current demands of product variants resulted in raising funds and financing at Islamic banking. The concept of ijārah and ijārah muntahiyah bi al-tamlīk (IMBT) both are one example of financial products and services in Islamic banking. By the mindless, this paper aims to describe the concept of ijārah and IMBT on Islamic banking and explained at the level of practice and compliance with the law analyze normative (al-Qur’an, Hadith, and the MUI Fatwa/DSN) and positive law (the Compilation of Sharia Economic Law which issued by the Supreme Court). This research uses a field of research that is descriptive analytical study then combined with the library to produce a comprehensive description of the ijārah and IMBT. Data analysis techniques starting from the identification of problems, data collection, solve problems which eventually led to the solution in the form of a conclusion. From the findings it can be concluded that the implementation of ijārah and IMBT as financing products at Bank BRI Syariah Cabang Yogyakarta is done by the bank to buy what is desired by the customer (such as home and vehicle), then rent it to their bank, at the end of the contract/agreement the bank gives them the option, to have the leased goods bought by way of BRI Sharia (IMBT), or by handing it back to BRI sharia (ijārah). In practice, the operational foundation based on the Sharia Board of the National Fatwa No. 09/DSNMUI/IV2003 the Compilation Economics and Shariah Law Chapter XI of ijārah and IMBT.

Abstract

Baitul Maal Wat Tamwil (BMT) has been growing rapidly in Indonesia from year to year. However, its development has still not been followed by the legal rules. Some of them follow the legal system of Cooperatives, that are Act No. 25 of 1992 and Decree of the Minister of Cooperatives and SMEs, No. 91 /KEP/M.KUKM/IX/2004 about the Implementation Guidelines for Cooperative Operations of Islamic Financial Services (KJKS). However, after Act No. 1 of 2013 about Micro-finance Institutions had been issued, the legal institutional status of BMT and its supervision has become a problem for the existence of BMT. Therefore, this study met the issues of how the legal status and supervision of BMT before and after the issued Act No. 1 of 2013 about micro-finance institutions. This study was an empirical law rechtdogmatik against Act No. 1 of 2013 about Micro-finance Institutions. It used primary legal materials, namely the Micro-finance Institutions Act; the result of interviews; and documentation that were analyzed qualitatively. The result analysis showed that before the Law of Microfinance Institutions was issued, there were 3 groups of BMT, namely: BMT with the Cooperative legal entity and being supervised by the State Ministry of Cooperatives and SMEs; BMT that were formed under the foundations legal entity; and BMT that were formed under Non Governmental Organisation. However, after Act No. 1 of 2013 had been issued, Microfinance Institutions should only have legal status, either as a cooperative or an incorporated company (PT). In addition, the supervision should be conducted by the Financial Services Authority of Indonesia (OJK) coordinated with both the Ministry of Cooperatives and SMEs, and the Ministry of Home Affairs. Nevertheless, the competence of supervision has still not been clearly regulated in the Microfinance Institutions Act, because the new law might effectively run two years after being enacted while the implemention is also still not regulated yet. Thus, it should be recommended to make clear implementation rules in the legal status of Microfinance Institutions, especially for those not have legal entities as well as those should transform. Similarly, in terms of supervision, there should be a clear competence of supervision performed by the FSA and the two mentioned Ministry above. So, there might not be either overlapping or loose supervision.

Abstract

Adam Smith as the founder of modern economics laid the basic foundation for economic development through the capitalist system in which capital factor used as a measuring tool for economic success. One opinion of Adam Smith "the theory of invivisble hand" in economic activity every individual has the full authority of his property and free use of economic resources in ways that he likes, disregarding the interests of the general public. This shows that capitalism has the right to have a peribadi an unlimited of the means of production, which is the driving force personal profit. Islam is essentially bringing the teachings to human life that comes the Koran and Hadith. Economic activity in the view of Islam is the guidance of life, in addition it is also a suggestion that has a dimension of worship. Wealth (material wealth) is trustworthy, thus the mandate that God bestowed it must be used together, not to suck other people or enslave other people. Islam allows every person to own property in person, but as it also enjoins on his property was to be used collectively (together), alms or spend a portion of such property in Allah. Economic activity in the view of Islam is not only material but more than that - "material plus" -. Islam has always stressed that every person living in a lawful manner. Islam also does not prohibit untukmelakukan economic activity, but Islam provides guidance and guidance in the form of Islamic values.

Abstract

The objective of this research is to analyze the comparison of sharia and nonsharia stock performance. The sample is a company listed on the Indonesia Stock Exchange, listing from 2013-2017. The sample consists of nonsharia stock (LQ45) and sharia stock (Jakarta Islamic Index). Sampling method used purposive sampling technique. Data analysis technique used Risk-Adjusted Return Measurement and analyzed by using paired sample T-Test. Based on analysis and discussion, there is no significant differences between portfolio performance of LQ45 and JII, either using Sharpe, Treynor, and Jensen alpha Index. Based on annual data, the performance of JII’s portfolio is better than LQ45 when macroeconomic is depression, while LQ45 portfolio performance is better when macroeconomic is booming. Thus, JII portfolios are more effective used when the economy is depressed, while LQ45 is more effective when the economy is booming.

Abstract

Fiscal policy is not synonymous with Islam taxation / tribute that made the king / emperor , nor synonymous with modern fiscal policy born of the failure of the free market mechanism. Referring to public finance policy at the beginning of the Islamic era, Islamic fiscal policy is a practical representation of the mission of the Islamic economic system oriented religiosity , justice and wealth distribution.Not only deal with the fiscal revenue and expenditure of state revenue but also about the mission of fair distribution of wealth . Jizya, kharaj and ghanimah is a fiscal instrument in accordance with the circumstances at that time for the mission fair distribution of wealth . Based on the concept of fiscal Islam , then the application of fiscal policy now must somehow form could lead to a fair distribution of wealth towards a comprehensive community welfare ( falah ), not just the budget deficit

Abstract

Tulisan ini meneliti pengaruh antara Return on Assets (ROA) sebagai proksi dari profitabilitas dan kapitalisasi pasar terhadap Tobins Q sebagai proksi dari nilai emiten. Tujuan penelitian adalah untuk menemukan bukti empiris tentang pengaruh profitabilitas  dan kapitalisasi pasar terhadap nilai emiten. Sampel dalam penelitian ini adalah emiten Jakarta Islamic Index (JII)  yang terdaftar dalam  Indonesia Stock Exchange (IDX)  dalam  rentang tahun 2012-2014. Sampel penelitian adalah sebanyak 21 perusahaan dengan 63 kali pengamatan. Analisis data menggunakan analisis regresi linear berganda.  Hasil penelitian dengan analisis regresi linear berganda menunjukkan bahwa profitabilitas berpengaruh signifikan terhadap nilai emiten. Hal ini ditunjukkan dengan taraf signifikansi dari hasil uji statistik t sebesar 0,000 (<0,05). Sedangkan kapitalisasi pasar tidak berpengaruh secara signifikan terhadap nilai emiten yang ditunjukkan dengan taraf signifikansi sebesar 0,195 (>0,05). Namun secara simultan profitabilitas dan kapitalisasi pasar berpengaruh signifikan terhadap nilai emiten. Hal ini diketahui dari hasil uji statistik F, taraf signifikansinya sebesar 0,000 (<0,05). Nilai Koefisien Determinasi sebesar 0,653  menunjukkan bahwa model regresinya sudah baik karena kemampuan variabel bebas dalam menjelaskan variabel terikat  sebesar 65,3%.  Sisanya sebesar 34,7% dijelaskan oleh variabel di luar penelitian.
