Abstract

Today the progress of science and technology requires a person can master the information and knowledge. Thus required an ability to obtain, select and process information. These abilities require critical thinking, systematic, logical and creative. Therefore we need an education program to develop the ability to think critically, systematic, logical and creative. Abstract

Today, the anxiety of the authorities in the name of religion is an issue of interest to the talk. This is due to increasingly widespread and growing ideology of fundamentalism in the Islamic world. As an academic who is very familiar with Islamic law, Abou al-Fadl admitted that Islamic law is the heart and core of the Islamic religion. However Abou al-Fadl just do not believe that the intellectual treasures were able to survive the onslaught of the trauma of colonialism and modernity. Even thought, the remnants of the treasures of classical Islamic law is on the brink of extinction. Rests on the idea, he wanted to ‘revive’ the tradition of classical Islamic law is quite dynamic, and has a base that is tolerant and pluralistic epistemology. If Mohammed Arkoun claims, that in Islamic thought, there is still something ‘thoughtless’, then, Abou el-Fadl want re-formulation of the treasures of Islamic thought, namely ‘something that has been forgotten’.

Abstract

Based on constitution number 20 year 2003 about National Education System and Permendikmas number 39 year 2008 about coaching students, chapter one, clause one, paragraph (a), which reads develop potential students in an optimal and integrated matching with the talent, enthusiasm, and creativity. Paragraph (c) reads actualize the potential of students in achieving seeded according to their talents and interests. Based on this, the school needs to establish a special container to improve the talent, potential and creativity of students so as to support school improvement.

Abstract

Arabic capability is an ability which should be mastered by students who follow learning Arabic. Because in learning Arabic, there are four skills that must be mastered by students, among others listening skills, speaking skills, reading skills and writing skills. This four skills is a series of language skills are inseparable from one with another. Of the four skills are an indicator of the success of learning Arabic must not be separated from the appropriate learning methods. Because with the right approach four mahârah above can be mastered by students. From this statement, the author conducted research in Islamic boarding school Al-Munawaroh Ngemplak Ngudirejo Diwek Jombang with a focus on Implementation and factor. With descriptive qualitative method is concluded; this Islamic boarding school is successfully practiced in Arabic as the language of daily communication, one of the many Islamic boarding school in Jombang to realize learning Arabic completely through the communicative approach, these are points that must be considered for can be used as a model by institutions other in enhancing learning potential, especially in learning Arabic.

Abstract

In reading a hadith, it is not enough just to a dictionary and a book of hadith as a reference. This is because the hadith collected in many books of hadith. So as a takhrîj al-h?adîth emerged as a method to track the tradition to the original source. Application of the method takhrîj al-h?adîth has two major variants; conventional (sanad and matn) and modern (computer) . Two variants will certainly have advantages and disadvantages of each.

Abstract

A Judge is a key element in the trial. In fact he was identical to the court itself. Similarly, the decision of the court identified with the judge's decision. Therefore, law enforcement and justice lies in the ability of judges in formulating decisions that reflect fairness. With regard to the duties and functions of the judge, in this case the trial judge Religion in Indonesia, which is one element of the law enforcement component directly involved with the legal process will be faced with a dilemma problem. On the one hand, the religious court judge must hold to Irish law. While on the other hand, the religious court judges must take into account the level of public awareness of the legal instruments. In addition, for the assurance of the process of law enforcement, religious court judges are also faced with a problem that dilemma. Abstract

Learning mechanism based on character building is structured in inter-effecting three phases of learning; planning, engagement and evaluation. Lesson plan based on character development comprised of various aspects related with the educational system elected by particular school or madrasah. Therefore, Lesson plan based on character building is employed in all school subjects. There is an interconnection among the school subjects in passing down the values that brings of character education perpetually. It shall not be halted by employment at specific classes. As necessary, school or madrasah may develop the values of character building as pasrt of formal curriculum

Abstract

Not been much found a study evaluating the comparative-integrative among one religion to another religion related regulation of marriage are sourced directly from the scriptures respective religion, in particular Islam and Christianity. This is to give a balanced understanding and response to gender issues, social inequality relation of husband and wife is exhaled by Western scholars-Christians who are quite a lot of cornering the teachings of Islam. Starting from this idea authors conducted research using descriptive-analytic method to then compare giving rise similarities and differences to material for further research. The study concluded that marriage in Islam can be said to have a double dimension; vertical and horizontal dimensions, whereas the more dominant Christian vertical dimension though there is also a horizontal dimension, as well as striking differences more visible on the issue of legal origin of marriage, polygamy, the permanence of marriage and the problem of intermarriage

Abstract

Islamic Nusantara is not new religion, not just the new thought. Islamic Nusantara is the approach resourches of transcendent scientific which have religion character and then mergered by humanism sciences resourches which have humanism character. Islamic nusantara culture hoped became scientific resouches and culture inheritance which resourched form local wisdom Indonesian people that mixed between transcendent approach and local wisdom aprroach . Islamic Nusantara not just born from tradition, that the tradition became new power which rested on the power of society and constructed by sciences and knowledge and became morality power as the first bollard. Abstract

Different from most scholars of Ushul Fiqh, al-T?ûfî tend to put theory mas?lah?ah independence of human reason. For al-T?ûfî vision of a more objective reason in positioning the criteria mas?lah?ah compared to antagonist nas?s? with one another. Therefore, the validity of argument mas?lah?ah should be determinant above the arguments of others, not to mention al-nas?s? al-shar’î though. Pattern of this determination, in analytical with an approach normative-juridical and nature descriptive content analysis. That pattern, departing from the view that to discover the existence of mas?lah?ah not have to wait information and support nas?s?. The mind can independently determine the matters contained therein mas?lah?ah and things are mafsadah. However, in its application, mas?lah?ah must be observed whether related to religious and muqaddarât or related to mu’âmalât and ‘âdat. If related to religious and muqaddarât it must have the support of legality nas?s? and ijmâ’. Unlike the case with regard to issue mu’âmalât and ‘âdat, then mas?lah?ah be the most powerful and independent argument, did not need a legality nas?s? and ijmâ’. In fact, even if turns out mas?lah?ah contrary to nas?s? and ijmâ’, mas?lah?ah must keep favored either with takhs?îs? (specialization) and bayân (explanation) against nas?s? and ijmâ’.
