Abstract

Analisis Perubahan Bentuk Badan Hukum Perusahaan Daerah Bank Perkreditan Rakyat (PD BPR) Kota Makassar Menjadi Perusahan Perseroan Terbatas. Penelitian ini bertujuan untuk menemukan dan menjelaskan proses dan akibat hukum perubahab bentuk badan hukum Perusahaan Daerah Bank Perkreditan Rakyat (PD BPR) Kota Makassar menjadi Perusahaan Perseroan Terbatas. Penelitian ini merupakan penelitian normatif-empiris. Hasil penelitian ini menunjukkan bahwa perubahan Perusahaan Daerah Bank Perkreditan Rakyat menjadi Perseroan Terbatas Bank Perkreditan Rakyat Kota Makassar dilakukan dengan tahap persiapan dimana dalam tahapan ini melalukan revaluasi aset dan audit serta pembuatan anggaran dasar. Hal-hal yang harus diketahui Pemerintah Kota selaku Pengelola Badan Usaha Milik Daerah terkait perubahan bentuk badan hukum. Penyusunan rancangan perubahan bentuk badan hukum Bank Perkreditan Rakyat. Mengajukan permohonan persetujuan perubahan bentuk badan hukum kepada Otoritas Jasa Keuangan. Dikeluarkannya Peraturan Daerah Kota Makassar Nomor 7 Tahun 2016 tentang Perubahan Bentuk Badan Hukum Perusahaan Daerah Bank Perkreditan Rakyat Kota Makassar menjadi Perusahaan Perseroan Bank Perkreditan Rakyat Kota Makassar. Setelah berlakunya Peraturan Daerah tersebut, pelaksanaan perubahan bentuk badan hukum tersebut dilakukan sesuai dengan mekanisme pendirian Perseroan Terbatas sebagaimana tercantum dalam ketentuan Undang-Undang Nomor 40 Tahun 2007 tentang Perseroan Terbatas yang mana pendirinya dilakukan oleh Walikota. Adapun akibat hukum perubahan bentuk badan usaha Bank Perkreditan Rakyat adalah berubahnya struktur organisasi, manajemen dan penyebutan nama. Kata Kunci : Badan Hukum, Perusahaan Daerah, Bank Perkreditan Rakyat, Perseroan Terbatas.

Abstract

Sexual exploitation of children is a crime that makes children not only as sex objects as well as commercial objects. This terminology comes from an international criminal law instrument, Commercial Sexual Exploitation of Children (CSEC). In the national context, this terminology has not been mentioned in national criminal law, even academic studies on this issue have not been widely practiced. In addition, the crime of child sexual exploitation has not been regulated in a special article. The terminology found is only about child sexual violence, whose meaning is different from child sexual exploitation. Indonesia has ratified the Optional Protocol on Sale of Children, Child Prostitution and Child Pornography (OPSC), it is important to harmonize national laws related to the crime of child sexual exploitation. This research is normative law research, with approach of legislation. This study found that post-ratification of OPSC through Law no. 10 Year 2012, no steps have been taken to harmonize national criminal law related to child sexual exploitation as required in OPSC, so that measures to improve national law and measures to tackle this criminal problem have not been followed in accordance with the standard desired by OPSC. Therefore, it is recommended that the government immediately take steps to transform the current national law of child protection by incorporating aspects of child sexual exploitation as set forth in the OPSC into the R-Criminal Code and in the revision of the Child Protection Act.

Abstract

The implementation of the act of number 25 years 2009 about the public services in an effort to create the principle of good governance ( good governance ) in the province of Riau and Jakarta west important because of anything services for the community of course there has been a the command of implementation , procedures and authority so that the recipient the service will be satisfied for what he received . The implementation of law number 25 years 2009 concerning public services in west sumatra still has not been effective, because of year to year still happens reporting by the community for government agencies, soe, who do not give public services such as delays , abuse, received in exchange for money and services and goods. Constraints that have been faced in the delivery of public among other: the low the quality of public services , public service system not clearly regulated , overlapping authority , the low external supervision from the community , the ineffectiveness of the decentralised system .The efforts being done to deal with the obstacles is besides built supervision external by the community through active provided a report on the ombudsman representatives to Riau and Jakarta , so internal control each agencies needs to be improved the system , if a long considered be unable to improve the quality of public services . The concept of public services ideal is well applied by ombudsman when is supervision public service done with activities investigation initiative , supervision public services , systemic investigation , and the compliance.

Abstract

Perjanjian Kredit dengan menggunakan model standar baku/perjanjian baku merupakan model perjanjian yang digunakan di dunia perbankan. Dengan meningkatnya kegiatan berbagai bidang mensyaratkan adanya pelayanan cepat dan tepat tanpa mengabaikan kepatutan dan keadilan semua pihak yang akan terikat pada perjanjian itu. Salah satu cara untuk memberikan pelayanan yang cepat dengan cara mempersiapkan terlebih dahulu blanko perjanjian yang akan digunakan untuk kegiatan transaksional. Perjanjian kredit dengan perjanjian baku di dunia perbankan merupakan cara mencapai tujuan ekonomi yang efisien, praktis, dan cepat. Tetapi bagi konsumen, hal tersebut merupakan pilihan yang tidak menguntungkan, karena konsumen hanya dihadapkan pada pilihan menerima atau menolak perjanjian tersebut. Berdasarkan ketentuan tersebut, muncullah fenomena adanya ketidakseimbangan dalam kontrak/perjanjian. Dengan dibentuk nya Badan Otoritas Jasa Keuangan (OJK) sebagai lembaga pemeriksa dan pengawasan terhadap Perbankan, dan dikeluarkannya POJK No 1/POJK.07/2013 tentang perlindungan konsumen di sektor jasa keuangan diharapkan dapat mengurangi pelanggaran terhadap perlindungan konsumen di sektor jasa keuangan. Permasalahan dan tujuan dari penelitian ini antara lain untuk mengetahui penerapan asas keseimbangan dalam perjanjian kredit perbankan berdasarkan ketentuan peraturan perundang-undangan yang berlaku dan pasca dikeluarkanya POJK No 1/POJK.07/2013 dan bagaimana akibat hukum terhadap perjanjian kredit yang tidak menerapkan asas keseimbangan. Metode penilitian yang digunakan dalam tesis ini yaitu tipe penilitian yuridis empiris. Sumber bahan hukum yang digunakan adalah sumber bahan hukum premier, sekunder, dan tersier. Berdasarkan hasil penelitian, penulis menemukan bahwa, pertama, bahwa tidak ada perubahan pada perjanjian kredit pada Bank Nagari dan Bank BNI cabang dobi padang pasca dikeluarkanya POJK, karena masih ditemukan klausula-klausula yang bertentangan dengan peraturan per Undang-Undangan yang berlaku dan tidak terpenuhinya asas keseimbangan pada perjanjian kredit tersebut. Kedua, akibat hukum terhadap perjanjian kredit yang tidak memenuhi asas keseimbangan akan mendapatkan sanksi sebagaimana yang tercantum dalam pasal 53 POJK No 1 tahun 2013. Namun sampai sejauh ini apabila ditemukan pelanggaran, pihak OJK hanya memberikan sanksi berupa teguran. Kata Kunci : Perjanjian Kredit, Asas Keseimbangan, Otoritas Jasa Keuangan

Abstract

Penelitian ini bertujuan Untuk mengetahui peran Kantor Badan Pertanahan Nasional dalam menyelesaian Sengketa Pertanahan melalui Mediasi sesuai dengan Peraturan Menteri Agraria dan Tata Ruang/Kepala Badan Pertanahan Nasional nomor 11 tahun 2016 tentang Penyelesaian Kasus Pertanahan. Penelitian ini merupakan penelitian normatif empiris, yaitu suatu penelitian disamping melihat aspek hukum positif juga melihat pada penerapannya atau praktek di lapangan. Teknik analisis data yang digunakan adalah deskriptif kualitatif, yaitu setelah data terkumpul kemudian dituangkan dalam bentuk uraian logis dan sistematis, selanjutnya dianalisis untuk memperoleh kejelasan penyelesaian masalah, kemudian ditarik kesimpulan secara deduktif, yaitu dari hal yang bersifat umum menuju hal yang bersifat khusus. Hasil dari penelitian ini menunjukkan bahwa Sebagai mediator, Kantor Pertanahan Kota Makassar mempunyai peran membantu para pihak dalam memahami pandangan masing-masing dan membantu mencari hal-hal yang dianggap penting bagi mereka. Mediasi di lingkungan instansi pertanahan dalam hal ini Kantor Pertanahan Kota Makassar sebenarnya juga secara tidak di sadari telah di jalankan olah aparat pelaksana secara sporadis dengan mengandalkan kreatifitas dan seni di dalam gaya kepemimpinan masing-masing pejabat, tetapi baru pada saat sekarang ini upaya mediasi telah memiliki payung hukumnya di lengkapi pedoman serta petunjuk teknis yang memadai sehingga tidak ada keraguan lagi bagi aparat pelaksana untuk menjalankannya. Kata Kunci: Kantor Pertanahan, Mediasi, Penyelesaian Sengketa.

Abstract

The definition of person and non-person always change through legal history. Long time ago, law did not recognize the personality of slaves. Recently, it accepted non-human legal subject as legitimate person before the law. This article examines sufficient conditions for being person in the eye of law according to its particular purposes, and then, analyses the meaning of legal person in criminal law. In order to do that, scientific methodology that is adopted in this research is doctrinal legal research combined with philosophical approach. Some theories regarding person and legal person were analysed, and then the concept of person was associated with the accepted definition of legal person that is adopted in the latest Indonesian drafted criminal code. From the study that has been done, can be construed that person in criminal law concerned with norm adressat of the rule, as the author of the acts or omissions, and not merely the holder of rights. It has to be someone or something with the ability to think rationally and the ability to be responsible for the choices he/she made. Drafted penal code embraces human and corporation as its norm adressat. Corporation defined with broad meaning of collectives. Consequently, it will include not only entities with legal personality, but also associations without legal personality. Furthermore, it may also hold all kind of collective namely states, states bodies, political parties, state’s corporation, be criminally liable.

Abstract

As a state of law, Indonesia highly upholds the legal values existing in societies. By highly upholding the legal values indicates that Indonesian is a nation who abides the law. One of the laws that must be abided by people is criminal law sourced from the Criminal Code or as familiarly known as KUHP. As a positive law Criminal Code (KUHP) is prevailing all over the territorial of Republic of Indonesia and shall be a guide for the entire legal apparatus to impose sanction for violation and crimes. Unfortunately, the Criminal Code which is currently used by the law enforcers as a guide and reference to punish the guilty persons is no longer appropriate with the cultural value of our nation. Actually Criminal Code as the colonial law product is not relevant any longer with the condition of the era and ideology of Indonesian. It is impossible that Indonesia that have been feeling independence for decades but still use the law product of the nation who had occupied it. Consequently, it is urgent that the Indonesian criminal law renewal must be carried out and cannot be negotiable.

Abstract

Observing a lot of land conflicts in Indonesia which is constantly increasing, and followed by the rapidly growing populations that caused the demand for land will also increase automatically. While the number of the available land is limited (not increasing). This condition will surely causes problems on controlling and ownership of the land. This research aims to identify the factors which causes conflict (dispute) of land, by doing inventory to the lands which is owned by the community (whether it is registered or not registered). From this temporary research result, it is known that, the implementation of the land registration in Deli Serdang district (the research location) has not happened as expected. It can be seen from the number of land which has not been registered, this condition will certainly trigger conflicts or disputes in society, both ownership boundary disputes, control of illegal land (arable land), inheritance disputes, etc. Certificate ownership mostly only exist in urban area. The lack of interest by the community to join the land registration is due to various of reasons, which is: 1) the community do not recognized the purpose of land registration, 2) the cost is expensive, 3) the management is convoluted, 4) the community feels that it is not a necessary to do it, 5) arable land. In this research, the role of National Land Agency (NLA) as the organizer of land registration has not been surely prominent, it is visible that the NLA office is more passive, which is only waiting for the arrival of the owner land to register their lands, NLA should be more involved in land registration and followed by socialization, counseling for the community. As well for the land disputes which is in the region of the Land Office until this moment is currently unfinished and still having a lot of problems, in order to achieve the above purpose, Deli Serdang Land Office has taken steps by empowering all the existing abilities, it has been a huge duty for Land Office, by remembering there will be more and more usage and utilization in the future, while the available land is limited, and hoping that the community will be motivated to registered their lands for achieving the legal certainty.

Abstract

This study aims to determine the implementation of Presidential Regulation No. 44 of 2016 for retailers in Indonesia as well as to know the application of foreign investment in the retail sector in Makassar. This research is an empirical normative research based on library research with regard to the prevailing laws and regulations, legal literature such as books, journals, articles on the internet as well as other legal materials and field studies. The results of this study indicate that given the opportunity for foreign investors to own a maximum of 67% shares, it is considered a policy that causes no restrictions on ownership in the retail industry, so that the attitude of openness is expected to encourage the growth of modern retail expansively. Given the rapidly growing growth of the retail industry, one of the alternative solutions to zoning problems for large-scale modern retailers is required to be in a mall or shopping mall but so far this location permits are not observed by a number of modern retailers Keywords: Foreign Investment, Retail, Modern Retail, Traditional Retail

Abstract

Pasca ditetapkannya UU No. 12 Tahun 2011, Peraturan Nagari tidak lagi diakui dalam hierarki peraturan perundang-undangan di Indonesia. Padahal jika merujuk pada Pasal 18 B ayat (2) UUD NRI 1945 pemerintah wajib mengakui keberadaan masyarakat hukum adat berikut hak tradisionalnya. Dalam konteks otonomi daerah, jika dikaitkan dengan Pasal 18 ayat (6) UUD NRI 1945 bentuk pengakuan pemerintah kepada desa sebagai bagian dari pemerintahan daerah idealnya berupa hak untuk mengatur dan mengurus sendiri urusan rumah tangganya. Sebagai lex specialis, Pasal 26 ayat (2) huruf d UU No. 6 Tahun 2014 tentang Desa juga menegaskan hak nagari untuk membentuk peraturan otonominya. Sebagai solusi, sebenarnya Pasal 8 ayat (1) UU No. 12 Tahun 2011 sebenarnya mengakui keberadaan peraturan nagari yang dibentuk atas kewenangan yang bersumber dari perundang-undangan. Dalam implementasinya, pembentukan peraturan nagari terutama yang berkenaan dengan hak asal-usul/ulayat di Sumatera Barat mengalami kendala ytang signifikan. Meski MK melalui putusan PUU No.35/2012 menetapkan kewenangan itu ada di tangan nagari, dalam pelaksanaannya kewenangan dimaksud dibatasi secara bersyarat oleh pemerintah.
