Abstract

This paper aims to find out how the principles of participation in the election of regional heads in Indonesia. The conventional method is an approach that uses a conceptual approach that can be used to analyze synthetic. The results of the study indicate that the basic principles for conducting the election of regional heads must be conducted at the time of openness as a basic principle of community participation. It must also be based on the Principle of Legal Certainty, the orderly principle of the state organizer, the public interest principle. principle of transparency, proportionality principle, principle of professionalism, principles of accountability, principles of efficiency and principle of effectiveness. Keywords: Community Participation, Election of Head of Region, Pricimples of Openness.

Abstract

Pekerja/buruh outsourcing mulai dikenal di indonesia sejak berlakunya UU Nomor 13 tahun 2003 tentang ketenagakerjaan, Undang-Undang Nomor 13 Tahun 2003 tentang Ketenagakerjaan tidak menyebutkan secara tegas mengenai istilah dari outsourcing, namun dalam Pasal 64 secara tidak langsung disinggung mengenai outsourcing yaitu “Perusahaan dapat menyerahkan sebagian pelaksanaan pekerjaan kepada perusahaan lainnya melalui perjanjian pemborongan pekerjaan atau penyediaan jasa pekerja/ buruh yang dibuat secara tertulis”.kehadiran perjanjian kerja melalui outsourcing menimbulkan prokontra dikalangan para pelaku proses produksi barang dan jasa. Dikalangan pekerja modal perjanjian tersebut dipandang sangat melemahkan posisi mereka, sedangkan disisi lain pengusaha merasa diuntungkan dengan hadirnya sistem tersebut. Dari kacamata pemerintah sistem outsourcing ada dalam UU yang bari adalah dalam rangka merespon tuntutan kalangan investor khususnya asing.Kata kuci : Perlindungan Hukum , Pekerja , Outsourcing

Abstract

The purpose of this study is to know that the Certain Working Agreement on Oral Time is not allowed in the legislation, the Supreme Court judges consideration in deciding the case Number 501 K / Pdt.Sus-PHI / 2016 and the conformity of the decision with the law applicable in Indonesia. This study uses normative juridical method, which is analytical descriptive, with data collection method in the form of library study and supported by interview with judges. The results of the research show that First, the judge's decision is unfair to both parties litigation because the defendant is not punished to pay the wage of suspension (wage process) with emphasis on the consideration of unwritten PKWT so that by law become PKWTT. Second The process wage demands which are not accepted by the judge are contrary to the laws and regulations on employment and on the settlement of industrial relations disputes because the law requires that workers and employers continue to perform their obligations until the establishment of an Industrial Dispute Settlement Institution, including the obligation of employers to pay the wage of a suspension (wages process). So the Supreme Court Decision Number 501 K / Pdt.Sus-PHI / 2016 is less in accordance with the prevailing laws and regulations in Indonesia. Keywords: Oral Employment Agreement, Termination Dispute, Employment

Abstract

Penelitian ini bertujuan untuk mengetahui peran ombudsman sebagai badan pengawasa penyelenggaraan pelayanan publik di Indonesia. Penelitian merupakan penelitian hukum normatif yang dianalisis menggunakan analisis kualitatif. Hasil penelitian menunjukan bahwa Ombudsman sebagai badan pengawas penyelenggara pelayanan publik dalam pelaksanaan perannya untuk mendukung good governance, menjalankan tugasnya dengan cara menerima Laporan/pengaduan setiap Warga Negara Indonesia atau penduduk terhadap dugaan maladministrasi yang dilakukan oleh penyelenggara negara. Berdasarkan hasil pemeriksaan substantif maka Ombudsman dapat melakukan klarifikasi tertulis, investigasi lapangan maupun pemanggilan. Hasil pemeriksaan Ombudsman dapat berupa: a. menolak laporan, atau b. menerima laporan dan memberikan rekomendasi. Selain itu Ombudsman dapat melakukan mediasi/konsiliasi untuk memperoleh kesepakatan di antara para pihak, dan juga melakukan ajudikasi khusus yang berkaitan dengan penyelesaian ganti rugi apabila tidak dapat diselesaikan melalui mediasi dan konsiliasi. Dalam melakukan pengawasan pelayanan publik, selain menerima Laporan dari masyarakat, Ombudsman juga dapat melakukan atas inisiatif sendiri melalui systemic review yang hasilnya dapat berupa rekomendasi/saran. Untuk memastikan ditaatinya upaya penyelesaian Ombudsman oleh Terlapor atau Atasan Terlapor, maka Ombudsman melakukan monitoring langsung maupun melalui media/publikasi serta menyampaikan laporan berkala dan tahunan kepada Presiden Reublik Indonesia dan Dewan Perwakilan Rakyat.Kata Kunci: Ombudsman, Pengawasan, Pelayanan Publik

Abstract

This study aims to determine the protection of child labor in Indonesia, especially the rules that protect child labor both in industrial areas and on entertainment such as artist child and the like. The research method used is legal research with statutory approach approach (analytical approach) which is analyzed with qualitative analysis. The results of the study show that child labor has gained enough protection from Indonesian legislation. Such protection is both at the level of the country's basic laws (contitutions) and the Law, as well as on derivative regulations issued by the central government, ministers, and local governments. Keywords: Labor Law, Child Labor, Child Protection

Abstract

Sengketa pajak dapat terjadi antara wajib pajak atau penanggung pajak dengan pemerintah (fiscus) , karena perbedaan pendapat tentang besarnya pajak yang terutang. Berdasarkan ketentuan hukum pajak yang berlaku, wajib pajak diberikan upaya-upaya hukum dalam sengketa pajak, yaitu keberatan, banding, gugatan dan Peninjauan Kembali. Seiring dengan adanya perubahan ketentuan tentang kedudukan Pengadilan Pajak sebagai Pengadilan Khusus di lingkungan Pengadilan Tata Usaha Negara, seharusnya terdapat perubahan terhadap prosedur penyelesaian sengketa pajak termasuk upaya-upaya hukumnya . Namun sampai saat ini masih belum terdapat perubahan, karena belum ada tindak lanjut dari pemerintah setelah adanya perubahan kedudukan Pengadilan Pajak. Prakteknya, penyelesaian sengketa pajak masih didasarkan pada ketentuan UU Nomor 14 tahun 2002 tentang pengadilan Pajak.Kata Kunci : Upaya Hukum, Pajak, Sengketa Pajak, Pengadilan Pajak

Abstract

This study aims to determine the existence of public service agencies as public service providers in Indonesia. The research method used is legal research with statutory approach approach (analytical approach) which is analyzed with qualitative analysis. The results of the research show that the Public Service Agency (BLU) as the public service provider plays an important role in providing services to the public in the form of the provision of goods and / or services. Legally BLU is not a legal entity, but BLU operates as a working unit of state ministries / agencies / local governments for the purpose of providing public services whose management is based on the authority delegated by the respective parent agency. Abstract

AbstractThe aim of regional autonomy and decentralization of the authority of the regency and city governments is to shorten the bureaucracy and optimize public services. In reality the products of regional regulations overlap their competencies, contradict the substance and material content with other regional regulations that are parallel, as well as the existing regulations above, which have implications for the emergence of the complexity of licensing bureaucracy, and uncertainty of society and business in carrying out activities business and investment activities, interests of capital owners, and business / trade, regional and national competitiveness. This study highlights the problems related to the relationship between the central and regional governments as determinants of regulations that are codified for investment, product characteristics of regency / city government regulations that are conducive to investment competitiveness in the region, and the competence of district / city governments in setting conducive regulations for investment using an empirical approach. The conclusion of the results of this study is that the synergy between the central and regional governments is needed in designing conducive regulations to encourage the business and investment climate in the region, namely the product of regional regulations that do not conflict with the higher applicable regulations, efficient in tariff setting taxes, regional levies, and do not result in a high cost economy, do not result in double taxation with central taxes or with other regional taxes / levies, are not discriminatory, guarantee legal certainty and are equal in the eyes of the law, there is standard certainty services related to licensing); and regulations that are environmentally friendly, namely local regulations that support the management of natural resources well so that natural resources can be utilized optimally and sustainably. Recommendations in this study are: Central and regional governments must synergize and harmonize regulatory products at the central and municipal district levels, the regency and city governments must take the initiative to revise regulations on taxes and levies whose substance and material content are contrary to the regulations above, district governments and the city in formulating and determining the direction of reform policy and the implementation of governance in the regions must be oriented and refer to hierarchical relations between the central government and regional governments to support national development.Keywords: District /City Government, Regulation, Investment Abstrak Tujuan otonomi daerah dan desentralisasi kewenangan pada pemerintah kabupaten dan kota diantaranya adalah memperpendek birokrasi dan mengoptimalkan pelayanan publik. Pada kenyataannya produk peraturan daerah yang tumpang tindih kompetensinya, bertentangan substansi dan materi muatannya dengan peraturan-peraturan daerah lainnya yang sejajar, maupun dengan peraturan-peraturan yang ada diatasnya, yang berimplikasi pada munculnya kerumitan birokrasi perijinan, dan ketidakpastian masyarakat dan dunia usaha dalam melakukan kegiatan usaha serta aktivitas investasi, minat pemilik modal, dan daya saing usaha/ perdagangan, perekomian daerah maupun nasional. Penelitian ini menyoroti permasalahan-permasalahan terkait dengan relasi antara pemerintah pusat dan daerah sebagai faktor penentu regulasi yang kodusif bagi investasi, karakteristik produk regulasi pemerintah kabupaten/kota yang kondusif bagi daya saing investasi di daerah, dan kompetensi pemerintah kabupaten/kota dalam menetapkan regulasi yang kondusif bagi investasi dengan  menggunakan pendekatan empiris. Kesimpulan dari hasil penelitian ini adalah  sinergi antara pemerintah pusat dan daerah diperlukan dalam merancang regulasi yang kondusif untuk mendorong iklim usaha dan investasi di daerah, yaitu diperlukan produk peraturan daerah yang sifatnya tidak bertentangan dengan peraturan-peraturan yang lebih tinggi yang berlaku, efisien dalam penetapan tarif pajak, retribusi daerah, dan tidak mengakibatkan ekonomi biaya tinggi, tidak mengakibatkan pungutan berganda (double taxation) dengan pajak-pajak Pusat  atau dengan pajak/retribusi daerah lainnya, tidak diskriminatif, menjamin kepastian hukum dan kedudukan yang sama di mata hukum, adanya kepastian standar pelayanan yang berkaitan dengan perizinan); dan perda yang ramah terhadap lingkungan, yaitu perda yang mendukung pengelelolaan sumber daya alam dengan baik agar sumber daya alam dapat dimanfaatkan secara optimal dan berkelanjutan.  Rekomendasi pada penelitian ini yaitu: Pemerintah pusat dan daerah harus bersinergi dan mensikoronkan produk regulasi di tingkat pusat dan daerah kabupaten kota, pemerintah daerah kabupaten dan kota harus berinisiatif merevisi regulasi pajak dan retribusi yang substansi dan materi muatannya bertentangan dengan peraturan yang ada diatasnya, pemerintah kabupaten dan kota dalam merumuskan dan menetapkan arah kebijakan reformasi dan penyelenggaraan pemerintahan di daerah harus berorientasi dan  mengacu pada hubungan hierarkhi antara pemerintah pusat dan pemerintah daerah untuk mendukung pembangunan nasional. Kata Kunci: Pemerintah Kabupaten/Kota, Regulasi, Investasi

Abstract

AbstractThis study aims to determine the review of tax dispute resolution through objection agencies. The method used in this study is normative legal research. The results of the study point out that First, the position of the tax objection institution, including one form of administrative effort, is recognized as being in the positive law of Indonesia, specifically to resolve an administrative dispute. Second, the position of the objection institution, on the one hand, is intended to accelerate the settlement of tax disputes, but on the other hand, has a weakness related to the objectivity of the decision considering the breaker is one of the parties that issued the decision. The suggestion of this research is that if the objection institution is seen as very important in its existence, especially in an effort to accelerate the settlement of tax disputes, the institution must be truly able to demonstrate its existence as an institution capable of providing objective dispute resolution. Breakers must uphold moral integrity so that they can produce fair decisions.Keywords: Tax Disputes, Objection Institutions, Legal SettlementAbstrakPenelitian ini bertujuan untuk mengetahui tinjauan terhadap penyelesaian sengketa pajak  melalui  lembaga keberatan. Metode yang digunakan dalam penelitian ini adalah penelitian hukum normatif. Hasil penelitian menujukan bahwa Pertama, Kedudukan lembaga keberatan pajak termasuk salah satu bentuk upaya administrasi  diakui keberadaannya dalam hukum positif  Indonesia khususnya untuk menyelesaikan suatu sengketa administrasi. Kedua, Kedudukan lembaga keberatan disatu sisi dimaksudkan untuk mempercepat penyelesaian sengketa pajak, tetapi disisi lain mempunyai kelemahan terkait keobyektifan putusan mengingat pemutus adalah salah satu pihak yang mengeluarkan putusan. Saran dari penelitian ini adalah apabila lembaga keberatan dipandang sangat penting keberadaannya khususnya dalam upaya mempercepat penyelesaian sengketa pajak maka lembaga tersebut harus betul-betul mampu menunjukkan eksistensinya sebagai lembaga yang mampu memberi penyelesaian sengketa yang obyektif. Pemutus harus menjunjung tinggi integritas moral sehingga mampu menghasilkan keputusan yang adil.Kata Kunci: Sengketa Pajak, Lembaga Keberatan, Penyelesaian Hukum

Abstract

Abstract This paper aims to describe the existence of the decisions of the industrial relations court, especially related to the execution of the decisions of the industrial relations court. This article only elaborates on the empirical issues that have become the problem in carrying out the execution of the decisions of the industrial relations court. The interim findings show that efforts must be made to provide space for the execution of the industrial relations court. So far, the execution of barren industrial relations court decisions has not been implemented. One reason is the lack of regulation on the procedure for the execution of industrial relations court decisions in Law No. 2 of 2004 concerning the Settlement of Industrial Relations Disputes. The solution is left to the execution procedure at Herzien Inlandsch Reglement (HIR) and Rechtsreglement voor de Buitengewesten (Rbg). Keywords: Decision Execution, Industrial Relations Court, Indonesian Civil Procedure  Abstrak Tulisan ini bertujuan untuk menguraikan keberadaan putusan pengadilan hubungan industrial, khusunya terkait dengan eksekusi putusan pengadilan hubungan industrial. Tulisan ini hanya menguraikan sekilan permasalahan empiris yang menjadi kendalam dalam melaksanakan eksekusi putusan pengadilan hubungan industrial. Hasil temuan sementara menunjukan bahwa harus ada upaya untuk memberikan ruang bagi pelaksanaan eksekusi pengadilan hubungan industrial. Selama ini eksekusi putusan  pengadilan hubungan industrial mandul, tidak dapat dilaksanakan. Salah satu penyebabnya adalah tidak adanya pengaturan tata cara eksekusi putusan pengadilan hubungan industrial dalam Undang Undang Nomor 2 tahun 2004 tentang Penyelesaian Perselisihan Hubungan Industrial. Penyelesaiannya diserahkan kepada tatacara eksekusi pada Herzien Inlandsch Reglement (HIR) dan Rechtsreglement voor de Buitengewesten (Rbg). Kata Kunci: Eksekusi Putusan, Pengadilan Hubungan Industrial, RUU Hukum Acara Perdata
