Jurnal Masyarakat dan Budaya (JMB) or Journal of Society and Culture is a peer-reviewed journal that aims to be an authoritative academic source on the study of society and culture. We publish original research papers, review articles, case studies, and book reviews focusing on Indonesian society, cultural phenomena, and other related topics. A manuscript describing society and culture outside Indonesia is expected to be analyzed comparatively with the issues and context in Indonesia. All papers will be reviewed rigorously at least by two referees. JMB is published three times a year, in April, August , and December.

Abstract

Ethnicity is a very important issue for the pluralistic Indonesian society, but before ethnic violences exploded in various places of Indonesia, not many social scientists were interested in studying the topic, and their understanding of ethnicity was mostly limited to the classic meaning of “an ethnic group’s identity” introduced by Fredrik Barth in 1969. This classic meaning has obviously failed to help us understand the dynamics of ethnic violences that occurred in Indonesia during the 7-8 years after the 1996 Sanggauledo conflict because it implied “old histories, local rivalries, and deep hatred” that could be traced back to the beginning of tribalism, but had no real connection to contemporary occurrences such as how ethnicity (of the Acehnese and the Papuan) was mobilized as ‘identity politics’ at the level of nation-state which led to state’s violences against those (ethnic) groups. Therefore, I think it is quite critical to discuss the new definition of ethnicity as ‘a new cultural dimension of difference’ and/or ‘the question of culturalism’, as well as its significance within the present socio-political context of Indonesia. For instance, is the (re)construction of ethnicity by the Acehnese, the Papuan, the Dayak, the Riau-Malay, and others in mobilizing ethnic solidarity really ‘the (re)making of ethno(local)-nationalism’ as some people have suggested? Abstract

Abstract The implementation of the communities’ rights, including the right of the natural resources has not been consistent with the principles of the constitution, although the existences of entities of the adat law societies (Kesatuan Masyarakat Hukum Adat, or KMHA) have already recognised and guaranteed by the Constitution and have also been mentioned in various Laws regarding the natural resources. For that reason, the Constitutional Court through its decisions, which determines the legal policy of Constitutional Court exists to balance the power between the excecutives and the judicials. There are already various papers about the entities of the adat law societies, but none of it elaborate on how the Laws protects the rights of KMHA and the role of Constitutional Court in protecting its existences from the legal politics. Laws and regulations related to the rights of KMHA regarding the natural resources and Constitutional Courts decisions related to KMHA and the natural resources were used in this paper as research objects. In addition, a number of bibliography and primary law resources were also employed as the source of study. This research unveiled that since the issue of the Constitutional Court Decision No.35/PUU-X/2012, there have been numerous technical rules regulating the existence of KMHA explicitly. In the meantime, the Constitutional Court through its decisions, based on the philosophical, juridical and sociological considerations, have already produced landmark decisions regarding the important limitations to define KMHA. This was one of the main role of Constitutional Court to uphold the principles of Constitution. Abstrak Sejatinya pelaksanaan hak-hak KMHA, khususnya hak-hak di bidang Sumber Daya Alam (SDA) belum sejalan dengan amanat konstitusi, walaupun keberadaan Kesatuan Masyarakat Hukum Adat (KMHA) telah ditegaskan dalam konstitusi dan diturunkan melalui peraturan perundang-undangan terkait Sumber Daya Alam (SDA). Untuk itulah Mahkamah Konstitusi melalui putusan-putusannya yang melahirkan Politik Hukum Mahkamah Konstitusi hadir untuk menyeimbangkan kekuasaan antara eksekutif dan yudikatif. Penulisan tentang Masyarakat Hukum Adat sudah banyak, namun belum ada yang lebih spesifik menulis tentang bagaimana Peraturan perundang-undangan mengatur hak-hak Kesatuan Masyarakat Hukum Adat (KMHA) dan bagaimana kontribusi Mahkamah Konstitusi dalam melindungi eksistensi KMHA dari aspek politik hukum. Peraturan Perundang-undangan yang terkait dengan hak-hak KMHA di bidang Sumber Daya Alam dan Putusan-Putusan Mahkamah Konstitusi yang terkait dengan KMHA dan Sumber Daya Alam khususnya digunakan sebagai objek penelitian serta meneliti bahan-bahan pustaka dalam menganalisis dan mengkaji bahan hukum. Dalam penelitian ini ditemukan bahwa sejak adanya Putusan MK No.35/PUU-X/2012, banyak muncul peraturan-peraturan teknis yang mengatur lebih tegas tentang keberadaan KMHA. Sementara itu, Politik Hukum Mahkamah Konstitusi melalui putusan-putusannya yang berlandaskan filosofis, yuridis dan sosiologis melahirkan landmark decision mengenai batasan penting untuk mendefinisikan KMHA. Hal ini merupakan salah satu peran Mahkamah dalam menjalankan amanat konstitusi.

Abstract

As shown from the gap between actual situation of gender inequity and the implementation of gender policy, it can be seen that the representation of gender policy is low. Gender mainstreaming is a knowledge as well as a strategy to build gender equality. The sensitivity of gender issue has been acknowledged by international community commitment through several international meetings, that this issue must be integrated into national policy. Although Indonesia has ratified The Convention on the Elimination of All Forms of Discrimination against Women (CEDAW) into the UU No. 7 year 1984, the Gender Mainstreaming policy has only implemented in 2000 with the Inpres No 9. The gap between Human Development Index and Gender Development Index, despite the increase of both indexes, also shows that the problem of marginalization of women is still exist in Indonesia. The data from the indexes also show that Indonesia is unable to fulfill the MDG’s goal in preventing the number of death of mother in delivering baby. As strategy, the Gender Mainstreaming shows challenges from individual as well as bureaucracy, not to mention problem in ideas, interest and institution that tend to exclude gender as priority. The exsternal challenges are capitalism through media that sometimes have differentinterest. As strategy gender mainstreaming needs media to disseminate gender problem and gender knowledge. Abstract

Ethnic cohesion in the Indonesian context is still problematic. Religions, political, and legal approuches could be utilised to achieve that cohesion. However, democratic and just society could only be achieved if there is political will to establish egalitarian society through applying equality before law among all ethnic groups.

Abstract

This article discusses the results of research in Sumenep, East Java Province. The purpose of the research is to understand the community perceptions on natural conditions and symptons related to climate change; to understand the impact of the climate change to the coastal environmental and livelihood activities; and to identify how the adaptations made strategy developed on the economic activity. The study was using a qualitative approach. Collecting data was carried out through in-depth interviews with the help of an interview guide. Purposive selection of informants and snowball step is then performed. The results showed that climate change and its impacts have been felt by the people in the District of Bluto, even though they do not understand that the time shift transition seasons, the rainy season to the dry season is the symptoms of climate change. The impacts felt by people such as reduced income to meet their economic needs, adding to the reduction in yield from the sea as a fisherman, was also unable to obtain additional land, because they can not grow tobacco. An adaption strategy undertaken by fishermen is to do seaweed farming and the farmers to grow herbal chilly. Keywords: climate change, impact, strategy of adaptation, fisherman

Abstract

This article is a part and highlights of findings of research conducted in North Probur village, North-West Alor district of Alor region in 2017. It is written here to describe and proof that social harmony and unity in a traditional society is natural and running well without any disturbance even though their identity by languages and ethnics is quite different. From this study the fruitful lesson how unity develops social harmony in community life could be promoted and implemented both in local and national levels. In term of sociological perspective in which this study is addressed, this qualitative study found tradition and tolerance in religiosity or being religious as two prominent pillars the unity leading to social harmony within North Probur community possible. It means that the continuation of tradition in people’s daily life activities and the fact that religions that are divided into two mainstreams, Islam and Christianity, are embeded in their life and of course become indicators of their identity. In connection with sociological perspective, traditional culture as cultural capital in one hand and religions as social capital in the other hand are considered from their practices, ritual and institutional aspects in which social structure and social function of their formal and informal leaders are also quite important. All primary data related to research objective was information collected through field observation and in-depth interview with some relevant informants of those institutional officials, teachers and religiuos, cultural and youth leaders.

Abstract

Demographically, Indonesia is the fourth largest country in the world, yet international migration is a meager issues and only recently becoming a hot policy debates on the problem of migrant workers protection. The huge demand for domestic workers since the mid 1980s from the Gulf countries, Malaysia, Singapore and Hong Kong, continue unabated, increasingly creates tensions between the state and the civil societies, as many migrant workers exposed to exploitation and human right abuses. The center of the tension lays on the wide discrepancy between the policy to bolster the overseas labor and the failure of the state in providing a proper regulation in which protection for migrant workers is secured. To understand the current problems of overseas labor policy in Indonesia is necessary to trace the relationship between migration and the state and the history of state policy on migration. Assessing the role of stakeholders in this migration industry is important in able to understand the apparently lack of grasp and continuously reactionary and ad hock nature of the policy and related regulations.
