Abstract

Ibnu Rusyd is a popular philosopher and very expert in Islamic law study. In his Islamic book under the title of Bidayah al­Mujtahid he wrote the arguments of some scholars, and then he analyzes the arguments critically and argues the reason of different arguments appearance. Start from this point, he begins to express his arguments related with the problem discussed. This article will explain about his arguments related the state of guardian in a marriage.

Abstract

There are two major streams in Islam which up to now have a very significant influence in the Islamic community, namely the Shiite sect and the Ahlus Sunnah wa al-Jama'ah sect. Apart from differences in theological discourse, the differences between these two sects also touch the jurisdictions (fiqh). The most obvious differences in fiqh products, for example, appear in the permissibility of marriage if married (contract marriage). Some non-fundamental differences occur in other discourses, such as in prayer, azan, etc. This article intends to discuss legal theory that animates legal products in the Ja'fari school. The presence of Imam Ja'far in his capacity as a respected founder of the Ja'fari school, both Sunni and Shiite, will be discussed specifically in this paper. In addition, this article also discusses a number of fiqh Ja'fari products which may be fundamentally different from the Sunni fiqh products, including about khumus and mut'ah. The legal sources used in the Ja'fari school are not much different from the legal sources used in Sunni schools, which revolve around the Qur'an, Sunnah, Ijma', and Intellect. Although there is an understanding of the different definitions of the sources of the law, this does not indicate that Syi'ah and Sunni have different principles in determining the law.

Abstract

Secara filosofis, pemikiran hukum Islam yang pernah dan sedang berkembang saat ini menampakkan kecenderungan pola pemikiran yang kedua. Diantara beberapa tokoh pemikir hukum Islam penganut teori adabtabilitas antara lain Hasby Ash-Shiddieqiey, Munawir Sadzali, Sahal Mahfudz, Ali Yafi, Masdar F Mas’udi, Al Ghozali, Asy-Syathibi dan Najmuddin ath-Thufi. Dalam catatan sejarah, eksistensi maslahah sebagai pendekatan atau metode istinbath hukum telah membentuk polarisasi tersendiri, yang secara simplistik mengarah pada histories hirarki perumusan konsep yang khas dan berbeda, terkait peran akal di dalamnya. Corak maslahah Najmuddin ath-Thufi berbeda dengan al-Ghazali dan Asy-Syatibi. Perbedaan corak maslahah para pemikir hukum Islam sangat dipengaruhi oleh kapasitas rasional, kondisi sosio-kultural, dimensi ruang dan waktu yang melingkupinya. Tulisan ini memfokuskan pembahasan kepada tiga pemikiran tentang mashlahah oleh al-Thufi, al-Syathibiy, dan al-Gazaliy dengan metode desktiptif analitis menggunakan pendekatan studi komparatif.

Abstract

A fatwa is often influenced by social and political conditions that occur when the fatwa was born. It is possible also occurred in 1954 when Lajnah Bahtsul Masail Nahdhatul Ulama (NU-LBM) decided that the President of the Republic of Indonesia, Ir. Sukarno was waliyul amri dharury bisy syaukah. Although LBMNU fatwa based on fiqh, especially the fiqh Syafi’iyah. Someone says that the fatwa is influenced by maintaining position in Departemen Agama Religion Department) as managing board. Regardless that opinion, actually, NU maintains his power on Departemen Agama until 1971. This paper will simply want to research this fatwa and connecting it with the social realities when the fatwa is issued.

Abstract

Instruments such as working, living cost, waqf, kaffarat, and others that protect societal economy could be included as social security in Islamic view. Yet, zakat is the main instrument and has most significant role in giving Islamic social security for human besides conventional social security. Furthermore, zakat might be the main instrument in national social security if it manged well due to its superiority than conventional social security instruments. Semua instrumen yang memberikan perlindungan terhadap ekonomi masyarakat, dapat dikatakan sebagai instrumen jaminan sosial dalam Islam, seperti bekerja, nafkah, wakaf, kaffarat, dan lain-lain. Namun dari berbagai instrumen tersebut zakat menjadi instrumen yang paling utama dan memainkan peranan yang paling signifikan memberikan jaminan sosial atas masyarakat muslim yang bergerak seiring sejalan dengan instrumen jaminan sosial moderen lainnya. Bahkan zakat bisa menjadi instrumen utama dalam sistem jaminan sosial negara dengan pertimbangan bahwa dari berbagai sudut insitusi zakat mempunyai persamaan bahkan kelebihan dibanding instrumen jaminan sosial konvensional.

Abstract

The purity of limbs from any dirtiness is one of requirement which must be fulfilled before shalat. That is why many Ulama were explaining this case deeply. In this paper, the study of it was the character of the water which was pure and purified that can be used for wudhu, and which was not. In Bukittinggi, most of management mosques provide small basin with full water in front of wudhu room. It was aimed to facilitate people cleaning their feet before come into mosque. Yet, some of the basins have provided with no flowing water and less than two qullah (jars). Moreover, some of mosques only have one basin in one way (in and out of wudhu room). Basically, every feet of Muslim that get into the basin will do not affect anything to the pool. However, the problem was generated by the purity of the feet that some of them may unclean and take the water into effect. That is to say that providing the basin in front of wudhu room is obnoxious (makrûh) based on precaution (ihtyâth) principle. Kata Kunci: Washing feet basin, wudhu’, dirtiness, two qullah. Abstrak Kesucian anggota tubuh dari najis merupakan salah satu syarat untuk sahnya ibadah shalat yang dilakukan oleh seorang muslim. Oleh karena itu berbagai aturan dalam membersihkan diri sebelum shalat dibahas secara mendalam oleh ulama fiqh. Salah satu pembahasan yang terkait dengan hal itu adalah persoalan air yang boleh dipakai untuk berwudhuk, yang intinya merupakan air suci dan dapat mensucikan. Untuk menjaga kesucian jamaah yang akan memasuki masjid, maka sebagian pengurus masjid membuat bak kecil untuk mencuci kaki sebelum masuk dan keluar dari tempat berwudhuk. Namun pada sebagian masjid, air yang terdapat pada bak tersebut tergenang, tidak mengalir, dan kurang dua qullah. Di samping itu hanya tersedia satu buah bak, tempat masuk berwudhuk dan sekaligus tempat keluar dan selanjutnya masuk ke dalam masjid. Pada dasarnya kaki seorang muslim yang menginjak air yang tergenang tidak akan membuat air itu bernajis, tetapi mengingat beragamnya kondisi kaki yang masuk dimungkinkan ada najis yang tertinggal di air genangan itu. Oleh karena itu berdasarkan prinsip ihtiyath, membuat bak seperti itu hukumnya makruh.

Abstract

The enactment of Small claims court mechanism that marked with the enactment of PERMA Number. 2 Year 2015 concerning Procedure for Simple Quarrel Settlement is a new breakthrough in the civil justice system in Indonesia. This breakthrough was reached by the Supreme Court in order to reduce the queues for settling of civil Quarrel in court that the value is under $ 200 million. Implementation of Quarrel resolution by Small claim court mechanisms is done by a single judge assisted by a Registrar and can be completed within 25 working days and the decision is final and binding so that it is unable filed an appeal or judicial review to the Supreme Court, the decision of which can be directly execute in accordance with the civil judicial mechanisms in general. Small claims court jurisdiction which is set in PERMA No. 2 2015 is the General Courts, considering the Religious Courts are also authorized to settle a civil case with the Shari'ah economic and legal mechanisms of the same event with the civil court of the General Courts, the judicial application of the Small claims court mechanism in Religion Court is also possible and prospective,so that regulatory support as well as PERMA No. 2 of 2015 applied to the Religious Courts is required, especially in the process of sharia economic quarrel resolution.
