Abstract

Kajian ini melihat tentang konsep pemilihan Presiden dan wakil Presiden. Studi dilakukan dengan melihat perbandingan pendapat sampai pada model pemilihan Presiden di Indonesia. Kalau ditelisik lebih jauh bahwa memang tidak ada dalil qat’i tentang tata cara memilih Presiden dan Wakil Presiden dalam Islam. Kalau pun ada pada masa klasik Islam, teknis memilih presiden dalam Islam yang pernah ada dengan cara dipilih oleh Ahlu hilli dan Wal’ Aqdi, dan cara langsung dipilih oleh penguasa sebelumnya atau mewariskan kepada orang sesudanya. Adanya perbedaan ulama kontemporer dan klasik adalah masalah ijtihadi tergantung pada landasan tiorinya mereka berbeda. Bahkan Undang- Undang no 23 tahun 2003 tentang memilih Presiden secara Langsung Mubah atau boleh selama jujur, adil, umum, bebas dan rahasia. Peningkatan kualitas pemilih dari segi pendidikan dan keagamaan serta ilmu pengetahuan yang lainnya harus ditingkatkan agar terpilih Presiden dan Wakil presiden yang berkualitas.

Abstract

One of the most actual issues nowadays is about the maintenance and protection of human rights moreover in a developing county, even in a poor country. The maintenance towards human rights is a kind of every human’s responsibility, it is not only a duty for the government but also it is a part of the duty for all societies. For this case, giving a judicial help for the victims of the human rights abuses by some lawyers is a kind of an implementation from the functions and purposes of judicial helps. Without the roles of giving the judicial helps for the victims of the human rights abuses, then it may cause an injustice for the protection of human rights moreover in Indonesia. As we know if our country Indonesia actually has a good system of the regulation about human rights, thus we only need to have any efforts as the implementation.

Abstract

Determination start of ramadan, shawwal and early 10 Zulhijjah State, Saudi Fasting in Ramadan and perform worship to the Holy Land of Mecca Hajji are pillars of Islam, to determine when the fall month of Ramadan and 10 Zulhijjah in Indonesia to implement fasting and praying ‘Id. This has been a study in this paper. Fasting Ramadan is based on paragraph 183 the second letter. O ye who believe, fasting obligatory upon you, as prescribed for those before you, that ye pious. And implement Eid al­Adha prayers in Indonesia. To set the start of Ramadan, Shawwal and early 10 Zulhijjah in Indonesia Government in this regard the Ministry of Religious Affairs has been trying to establish at trial Isbatnya, but the Islamic organizations also set according to the will of each, finally khilafiyah always occurs in the initial set and 10 Zulhijjah end of Ramadan. The author believes after reviewing terms of the verses of the Quran, the hadith of the Prophet, and Siwak MUI Fatwa Fiqh that the determination of the government (Kemenag) must be obedient in legal certainty because Islam Indonesia and Indonesia is a unitary state, as also, the Egyptian, Arabia and other countries that set.

Abstract

Other than having the religious dimension hablum minallah, zakat also reflects social dimension hablum minannas. These two dimensions will be realized only if the implementation is in line with Islamic law which is based on the Qur’an and the sunnah of the prophet. The most dominant receiver of zakat knows as mustahik zakat is the needy and the poor. The distribution of the zakat can be carried out by national committee of zakat formed by the government based on the constitution and can also be carried out directly by the one who intended to pay zakat known as muzakki to the needy and the poor known as mustahik. Lately, the distribution of zakat has caused some humanity problems; it even has become the most addressed social issues among the muslim community since there is an indication that the applications violate islamic laws. Therefore, this book tries to address the problematic issues in the distribution of zakat in order to prevent the distribution problem so that zakat can be regarded as a social religious activity which can also be highly valued by Allah.

Abstract

This article discusses public finance, one of studies in Islamic economics, in history perspective from prior of Prophetic to Khalifaurasyidin. That time is supposed as operated Islamic State (Daulah Islamiyyah) efectively . From history noticed that zakat, ghanimah, fai, jizyah, kharaj, ‘ushur, dharimah and waqf as wel as shadakah are nation of Islamic income. Before distributing to ummat, all of them organized by baitul maal. Nation of Islamic expenditures are spending to develop public facilities or to reduce proverty, war, education, propagantion (dakwah) and development of religion in society. Conclution of this discusses that the characteristic of nation of Islamic expenditure is not only to reach society peaceful on material aspect but also to develop society based on spritual.

Abstract

The development of a hajj fund that is so great has the potential to be used in supporting the implementation of a better quality Hajj through effective, efficient, transparent, accountable, and in accordance with the provisions of legislation. The strategy that has been taken by the Ministry of Religion to optimize the management of the Hajj fund so that its benefits can be used to improve the quality of Hajj implementation is by developing these funds through investment. But in fact, the dynamics that occur are in the BPIH deposit. When the funds are managed which constitute funds deposited by prospective pilgrims to the government (Ministry of Religion or BPKH) to finance the implementation of their pilgrimage, problems arise regarding the appropriate contract formulation to be used, whether wakalah contract, mudlarabah (profit sharing), or altogether no longer need a contract, because the government acts as a statutory power for prospective pilgrims, as consideration of the decision of the Constitutional Court (MK).

Abstract

Dinamika penafsiran al-Qur’an dan beragam upaya untuk memahami maksud tersirat dibalik ayat-ayatnya hingga hari ini masih tetap menarik perhatian dan minat para cendikiawan muslim maupun non muslim. Satu hal yang menjadi salah satu faktor mengapa al-Qur’an tetap menjadi the most wanted hingga saat ini mungkin saja adalah posisi al-Qur’an sebagai sumber primer ajaran Islam dengan kajian yang cukup holistik. Segala masalah yang dihadapi muslim dapat dikembalikan dan dicari solusinya dalam al-Qur’an. Pesatnya upaya penafsiran al-Qur’an pada dinamikanya diimbangi oleh berkembangnya ilmu bantu penafsiran yang juga menunjukkan pertumbuhan yang cukup menjanjikan. Hal ini menjadi logis dan rasional sebab untuk memiliki pemahaman yang komprehensif, seorang mufassir haruslah menguasai beberapa ilmu bantu seperti ilmu bahasa, balaghah, qawaid, fiqih, ushul fiqih dll.

Abstract

Decision about first day of qamariyah months, especially in regard to worship (Ramadan, Shawwal, Zulhijjah) is determined by the appearance of the new moon. When the sun sets and the moon is above the horizon, which is an indication that the new moon has been there. But in reality, Ulama differ in determining whether the initial first day of qomariah months shall be based rukyat (observe of moon appearance) or can be based hisab (calculation). This is not apart from understanding dalil (reason based on Prophet exemplary).

Abstract

Mu’amalah objects in Islamic terminology is very broad, so Koran and sunnah explain more on muamalah issues in global and universal language that demand active interpretation of Moslem. This fact is actually an indication that Islam provides an opportunity for people to do their own innovation and new creations to do mu’amalah activity in accordance with the importance of their needs as long as the form of muamalah are not againts the basic foundations of Islamic teachings. One of the many practices of mu’amalah done by today’s modern society is what is known as an employment system or employment contract, or in terms of the classical fiqh it is called al­Ijarah. For the clearer goal of this discussion it is necessary to determine the thinking framework about the concept of Ijarah and its foundation used. Study on this article found that Islam sets regulation on the employment relationships traffic arrangements for the employment relationship in mutual way: what becomes the right for one side and vice versa. This reciprocal relationship is manifested in the form of employment agreement. The aspects that must exist in the employment agreement or contract between the employee and employer are working conditions, working hours, and wages determination. While employee’ rights are the right to receive decent wage, the right to get the job according to ability, the right for health services, and the right for legal protection.

Abstract

The law of Inheritance in Islamic law as one part of the law of family (al-ahwalus al-Syahsiyah) is very important in order in execution studied Division of property inheritance does not occur the error and can be implemented with seadil-fair, because by studying the Islamic inheritance laws then for Muslims, will be able to fulfil the rights relating to inheritance after it was abandoned by the muwarris (the heiress) and delivered to the beneficiary who is entitled to receive it. Thus one can avoid Sin i.e. it takes a property which is not right, because it is not ditunaikannya the Islamic law regarding inheritance. The Division of the estate in islam has been so clearly set up in al Qur'an, in surat an-Nisa. God with all his grace, has given guidelines in directing humans in terms of Division of property inheritance. Division of property is aimed at in order to be among the people who left no quarrels in doling out the estate. The estate be shared if indeed people who died leaving the property useful for others. Rules regarding marriage and Mewaris arranged in a book of civil law Act ("KUHPerdata"), applies to the Eastern Chinese Foreign WNI, who are not Muslim. In article KUHPerdata 852 stated among other things that: the beneficiary is a child or all of their descendants, let me be born from other marriage though, mewaris from both parents, grandparent or all their blood family next in a straight line upwards with no difference between men or women and there is no difference between the birth of the first. They head for the sake of mewaris head if they died with the associated families in degrees is considered and each have the right because it yourself; They mewaris a stake for the sake of the stake, if they all or just some of them act as a replacement. In the case concerning the inheritance of a husband or wife who died first, the wife or husband who lives longest equated with a legitimate child of the deceased. Based on the foregoing means children descendants entitled to mewaris from parents or grandparents and the family of blood with the same part number. So did his wife, have the right and the magnitudes of the heritage as well as legitimate children. Hukum Kewarisan menurut hukum Islam sebagai salah satu bagian dari hukum kekeluargaan (al-ahwalus al-Syahsiyah) sangat penting dipelajari agar supaya dalam pelaksanaan pembagian harta warisan tidak terjadi kesalahan dan dapat dilaksanakan dengan seadil-adilnya, sebab dengan mempelajari hukum kewarisan Islam maka bagi ummat Islam, akan dapat menunaikan hak-hak yang berkenaan dengan harta warisan setelah ditinggalkan oleh muwarris (pewaris) dan disampaikan kepada ahli waris yang berhak untuk menerimanya. Dengan demikian seseorang dapat terhindar dari dosa yakni tidak memakan harta orang yang bukan haknya, karena tidak ditunaikannya hukum Islam mengenai kewarisan. Pembagian harta waris dalam islam telah begitu jelas diatur dalam al qur an, yaitu pada surat an-Nisa. Allah dengan segala rahmat-Nya, telah memberikan pedoman dalam mengarahkan manusia dalam hal pembagian harta warisan. Pembagian harta ini pun bertujuan agar di antara manusia yang ditinggalkan tidak terjadi perselisihan dalam membagikan harta waris. Harta waris dibagikan jika memang orang yang meninggal meninggalkan harta yang berguna bagi orang lain. Aturan mengenai Perkawinan dan Mewaris yang diatur dalam Kitab Undang-undang Hukum Perdata (“KUHPerdata”), berlaku untuk golongan WNI Timur Asing Tionghoa, yang bukan beragama Islam. Dalam Pasal 852 KUHPerdata dinyatakan antara lain bahwa : Ahli waris adalah anak-anak atau sekalian keturunan mereka, biar dilahirkan dari lain-lain perkawinan sekalipun, mewaris dari kedua orang tua, kakek nenek atau semua keluarga sedarah mereka selanjutnya dalam garis lurus keatas dengan tiada perbedaan antara laki atau perempuan dan tiada perbedaan antara kelahiran lebih dahulu. Mereka mewaris kepala demi kepala jika dengan si meninggal mereka bertalian keluarga dalam derajat kesatu dan masing-masing mempunyai hak karena diri sendiri; mereka mewaris pancang demi pancang, jika sekalian mereka atau sekedar sebagian mereka bertindak sebagai pengganti. Dalam halnya mengenai warisan seorang suami atau istri yang meninggal terlebih dahulu, si istri atau suami yang hidup terlama dipersamakan dengan seorang anak yang sah dari yang meninggal. Berdasarkan ketentuan di atas berarti anak-anak keturunan berhak mewaris dari orang tua atau kakek-nenek dan keluarga sedarah dengan jumlah bagian yang sama. Begitu pula istri, memiliki hak dan besaran warisan seperti halnya anak sah.
