Abstract

Negara sebagai wadah dari suatu masyarakat memiliki dasar, keyakinan, cita-cita ataupun tujuan untuk mendirikan sebuah Negara yang maju dan terpandang. Tujuan Negara merupakan kepentingan utama dari tatanan suatu Negara. Pengakuan ternyata membuka lebar peluang bagi negara-negara tertentu untuk melakukan intervensi terselubung terhadap negara atau pemerintah baru.   Dalam kasus seperti ini praktek pengakuan seperti yang dilakukan oleh Amerikia Serikat membuktikan bahwa pengakuan itu diberikan bukan berdasarkan pertimbangan kelayakan secara hukum, melainkan berdasarkan kepentingan politik, diantaranya pemberian pengakuan Amerika Serikat terhadap Panama yang memisahkan diri dari Mexico dan penangguhan pemberian pengakuan terhadap rejim Oregon di Mexico yang sesungguhnya telah memenuhi syarat untuk diakui dapat dinilai sebagai campur tangan atas urusan negara lain. Bahwa ada beberapa rumusan masalah yang ingin diketahui dan dicapai dalam penelitian ini diantaranya, Bagaimanakah Pengaturan Hukum Internasional kontemporer dalam kasus pengakuan Amerika Serikat pada Daratan Tinggi Golan? Dan Bagaimanakah pandangan masyarakat Internasional tentang pengakuan yang dilakukan oleh Amerika Serikat.  The state as a vessel for a society has the basis, belief, aspiration or goal of establishing a developed and respected country. State objectives are the main interests of the order of a State. The recognition actually opens opportunities for certain countries to carry out covert intervention against the new state or government. In cases like this, the practice of recognition as practiced by the United States proves that recognition is given not based on legal considerations, but based on political interests, including the recognition of the United States against Panama, which separated itself from Mexico and the suspension of recognition of the Oregon regime in Mexico. which actually has met the requirements for recognition can be considered as interference in the affairs of other countries. Whereas there are several problem formulations that want to be known and achieved in this research, including, what is the contemporary International Law Arrangement in the case of the recognition of the United States on the Golan Heights? And how is the view of the international community about the recognition carried out by the United States.

Abstract

Kekerasan di dalam rumah tangga adalah suatu hal yang sering terjadi di dalam kehidupan setiap manusia. Terdapat beberapa bentuk dalam kekerasan yaitu baik di bidang soial, politk dan ekonomi, pendidikan dan korbannya adalah perempuan serta anak-anak di dalam keluarga. Di dalam Undang-Undang Pasal 44 Nomor 23 Tahun 2002 menyatakan pemerintah harus bisa memenuhi fasilitas serta menyelenggarakan usaha kesehatan yang baik untuk semua anak dan masyarakat. Agar semua warga dan anak-anak mendapatkan hak kesehatan yang optimal dan baik dari sebelum mereka lahir. Pada Undang-Undang diatas juga menjelaskan tentang perlindungan terhadap anak untuk bisa menentukan sanksi pidana yang berupa denda dengan sejumlah uang ataupun dipenjara. Semua dilakukan untuk kepentingan anak, karena anak merupakan generasi penerus bangsa untuk bisa hidup, berkembang, bersosialisai serta berpartisipasi untuk semua orang dan bangsa kita agar menjadi bangsa yang berkembang dan maju. Violence has become a phenomenon in the lives of Indonesian people. Domestic violence is something that often happens in every human life. There are several forms of violence, namely in the social, political and economic fields, education and the victims are women and children in the family. In Law Article 44 Number 23 of 2002 states that the government must be able to fulfill facilities as well as conduct health businesses that are good for all children and the community. So that all citizens and children get the right to optimal health and good before they are born. The Act above also explains the protection of children in order to determine criminal sanctions in the form of fines with a sum of money or imprisonment. All is done for the benefit of children, because children are the next generation of the nation to be able to live, develop, socialize and participate for all people and our nation to become a developing and developed nation.

Abstract

Salafism-Wahhabism is intolerance in the problem of khilāfīyah. In ideological issues they are completely intolerant, and in some cases of of worship are tolerant.  This research supports some of the statements from the work of Natana J. Delong-Bas through his book titled “Wahhabi Islam: From Revival and Reform to Global Jihad” (2004), Abdullahi Ahmed an-Naʻim in “Islam and Secular State: Negotiating the Future of Sharia” (2008), and Mazen Hashem through his writings titled “Contemporary Islamic Activism: The Shades of Praxis”, Sociology of Religion (2006). These scholars generally stated that Wahhabism was a radical Madhhab or doctrine or movement because it always persuades the followers to maintain the ‘pure teachings of Islam’, which believed by the proponents applicable to all Muslims. In addition, the Wahhabis have a view of puritanical Islam, which is to be intolerant in a variety of differences, so as to impose uniformity of religious understanding in Indonesia. Therefore, there is no one among them who said that the Salafi Wahabi is a moderate school of though.

Abstract

Dalam bidang hukum pidana, media massa adalah pendukung dari kebijakan hukum pidana, yaitu memberikan peran pencegahan kejahatan. Pencegahan melalui media massa sangat disarankan karena kebijakan hukum pidana tidak selamanya dapat digunakan sebagai sarana utama menekan kejahatan. Meski demikian, peran tersebut harus disertai dengan pengamalan nilai-nilai Pancasila dalam kesadaran diri masing-masing manusia Indonesia. Penelitian ini dilakukan secara normatif yakni penelitian yang mendasarkan pada kajian norma yang ada pada sistem hukum. Hukum ditelaah asas-asasnya, dijabarkan dari undang-undang, peraturan yang terkait media massa. Norma-norma terkait media massa disandingkan dengan asas-asas serta doktrin mengenai kontrol sosial oleh media massa untuk dianalisis berdasarkan penanaman nilai-nilai Pancasila pada kehidupan masyarakat Indonesia. Hasil penelitian menunjukkan bahwa pengamalan nilai-nilai Pancasila dalam peran media massa memberitakan informasi belum terlaksana. Masih banyak terdapat berita yang tidak teruji kebenarannya yang dapat merusak tatanan sosial. Media massa hanya memuat berita sebagai pemuas informasi saja tanpa menanamkan pembentukan pribadi sosial yang berjiwa Pancasila.The mass media is an essential support for the criminal policy, namely providing the role of crime prevention. Whilst penal policy is still available as solution, prevention through mass media is highly recommended because penal policies should not employed as the only way of suppressing crime. Nevertheless, the mass media must  carries the values of Pancasila as the fundamental way of life of each Indonesian citizen. This is a legal normative research which studies norms in the legal system. The law is examined by its principles, analysed thoroughly particulary any regulations regarding mass media. Norms that correspond to mass media are juxtaposed with the principles and doctrines related to social control of the mass media to be analysed based on the inculcation of Pancasila values in the lives of Indonesian citizen. The results showed that the practice of Pancasila values in the role of the mass media had not been implemented. There are still many untrustworthy news that detrimental to social order. The mass media only contains news as a satisfactory to the society without instilling the importance of Pancasila values.

Abstract

Pancasila as a legal ideal (rechtsidee) in its implementation is still not running as it should. One of the problems is influenced by the quality of legislators who are members of political parties. The poor quality of human resources produced by the party in turn also has an impact on the formation of laws that do not reflect the ideals of law. The problem discussed in this paper is about shifting the role of political parties in realizing legal products based on Pancasila. The research method used in this paper is the normative legal research method, legislation and conceptual approach, based on the position of the Pancasila as a legal ideal, and the role of political parties in the Pancasila Law State. The findings obtained are that political parties have a very strategic role in translating the aspirations of the people, besides that political parties also have a role in realizing legal products based on Pancasila. But so far, this role has experienced a shift caused by the crisis of political party ideology, weak membership system and regeneration of political parties, poor political education, minimal party funding resources, and the massive corruption of legislation.Pancasila sebagai cita hokum (rechtsidee) dalam pelaksanaannya masih belum berjalan sebagaimana mestinya. Permsalahan tersebut salah satunya dipengaruhi oleh kualitas pembentuk undang-undang yang merupakan anggota dari partai politik. Buruknya kualitas sumber daya manusia yang dihasilkan oleh partai pada gilirannya juga berdampak pada pembentukan undang-undang yang tidak mencerminkan cita hokum. Permasalahan yang dibahas dalam tulisan ini ialah mengenai pergeseran peran partai politik dalam mewujudkan produk hukum yang berdasarkan Pancasila. Metode penelitian yang dipergunakan dalam tulisan ini adalah metode penelitian hukum normatif, serta pendekatan perundang-undangan dan pendekatan konseptual, dengan mendasarkan pada kedudukan Pancasila sebagai cita hukum, serta peran partai politik dalam Negara Hukum Pancasila.  Temuan yang didapat yaitu partai politik mempunyai peran yang sangat strategis dalam menerjemahkan aspirasi masyarakat, selain itu Partai politik juga mempunyai peran untuk mewujudkan produk hukum yang berdasarkan Pancasila. Namun sejauh ini, peran tersebut mengalami pergeseran disebabkan oleh krisis ideologi partai politik, lemahnya sistem keanggotaan dan kaderisasi partai politik, buruknya pendidikan politik, sumber pendanaa partai yang minim, dan massifnya korupsi legislasi.

Abstract

The diversity of conceptions of the rule of law raises whether or not they contain the same idea? This juridical-normative research finds that the diversity of conceptions of the rule of law is strongly influenced by the historical and conceptual specificities of the underlying national traditions. The idea of the rule of law has marked the entire historical span of an idea (historical span of a notion) that cannot be separated from the national culture in which the idea is located and is actually used. The concept of the rule of law boils down to protecting the rights and freedoms of individuals (dignity of man) and restricting the state to respect individual rights without discrimination. Thus there must be a division of power and an independent judiciary to supervise and guarantee adherence to the law.Keragaman konsepsi negara hukum menimbulkan pertanyaan apakah mengandung gagasan yang sama ataukah tidak? Penelitian yuridis-normatif ini menemukan fakta bahwa keragaman konsepsi negara hukum disebabkan oleh sangat dipengaruhi oleh kekhususan historis dan koseptual dari tradisi nasional yang mendasarinya. Gagasan negara hukum telah menandai keseluruhan rentang sejarah sebuah gagasan (historical span of a notion) yang tidak dapat dipisahkan dari budaya nasional (national culture) dimana gagasan tersebut berada dan benar-benar dipergunakan (actually used). Konsepsi negara hukum sebenarnya bermuara pada perlindungan hak dan kebebasan individu (dignity of man) dan pembatasan negara untuk menghormati hak-hak individu tanpa diskriminasi. Dengan demikian harus ada pembagian kekuasaan dan Lembaga peradilan yang independent untuk mengawasi dan jaminan ditaatinya hokum.

Abstract

This research entitled "Implementation of Auction Through Internet Against State Property Assets at the State Assets and Auction Service Office (KPKNL) Serang Based on the Principle of Legal Certainty. The background of this writing is that the implementation of an auction through the internet specifically regulated in PMK Number 90 / PMK.06 / 2016 concerning Guidelines for Implementing Auctions with Written Offers without Attendance of Bidders Through the Internet, has not fully accommodated internet auction transactions especially for auction of Property Country. The purpose of this paper is to find out and analyze the principle of legal certainty and the form of legal protection for auction buyers in the implementation of an auction through the internet on assets of State Property in the Serang KPKNL. This research is normative legal research, so the approach used is the approach to legislation. Data obtained from literature is accompanied by field studies, namely interviews, and analyzed qualitatively descriptive. The results of this study indicate that the implementation of the auction through the internet still does not meet the principle of legal certainty, because the legal certainty of the implementation of the auction through the internet is only found in auction procedures while the certainty of the truth of the auction object is not fully regulated in the regulation. Legal protection for auction buyers in the implementation of an auction through the internet on BMN assets at Serang KPKNL has not been fully provided, there are still rights from several auction buyers that are not fully fulfilled, namely receiving all auctioned goods / object purchased in accordance with the existing auction announcement.Penelitian ini berjudul “Pelaksanaan Lelang Melalui Internet Terhadap Aset Barang Milik Negara pada Kantor Pelayanan Kekayaan Negara dan Lelang (KPKNL) Serang Berdasarkan Asas Kepastian Hukum. Latar belakang penulisan ini adalah pelaksanaan lelang melalui internet yang diatur secara khusus dalam PMK Nomor 90/PMK.06/2016 tentang Pedoman Pelaksanaan Lelang dengan Penawaran Secara Tertulis Tanpa Kehadiran Peserta Lelang Melalui Internet, belum sepenuhnya mengakomodir transaksi lelang melalui internet khususnya untuk lelang Barang Milik Negara. Tujuan dari penulisan ini adalah untuk mengetahui dan menganalisis asas kepastian hukum dan bentuk perlindungan hukum bagi pembeli lelang dalam pelaksanaan lelang melalui internet terhadap aset Barang Milik Negara pada KPKNL Serang. Penelitian ini adalah penelitian hukum normatif, maka pendekatan yang digunakan adalah pendekatan peraturan perundang-undangan. Data yang diperoleh dari studi pustaka disertai dengan studi lapangan yaitu wawancara, dan dianalisis secara kualitatif deskriptif. Hasil penelitian ini menunjukan bahwa pelaksanaan lelang melalui internet masih belum memenuhi asas kepastian hukum, karena kepastian hukum pelaksanaan lelang melalui internet hanya terdapat dalam prosedur lelang sedangkan adanya kepastian kebenaran objek lelang belum sepenuhnya diatur dalam peraturan tersebut. Perlindungan hukum bagi pembeli lelang dalam pelaksanaan lelang melalui internet terhadap aset BMN pada KPKNL Serang belum sepenuhnya diberikan, masih terdapat hak dari beberapa pembeli lelang yang tidak seluruhnya terpenuhi, yaitu menerima seluruh barang/objek lelang yang dibelinya sesuai dengan pengumuman lelang yang ada.

Abstract

Development that carried out every day requires policies to limit and regulate these activities. Development that still relies on natural resources is still abundant in Indonesia. Continuous development will have a positive impact, but it cannot be denied if the development also has a negative impact. One of them is the declining capacity of the environment. If this happens continuously it can have an impact on the survival of all living things, not only humans. Therefore, a policy that regulates permits related to the development is needed. Indonesia has a legal basis relating to environmental destruction instruments that regulate about the types of environmental-related permits such as Environmental Impact Analysis. If there are legal rules, the rules are also important. Implementation of Environmental Permits that will have an impact on maintaining the carrying capacity of the environment.
