Abstract

The Civil Servant Management aims to produce professional civil servants who have a basic value, professional ethics, politic intervention free, corruption, collusion, and nepotism free. It covers preparation and determination of needs, procurement, rank and position, career development and pattern, promotion, mutation, performance assessment, payroll and benefits, appreciation, discipline, dismissal, pension guarantee and plan, and protection process. All of the above processes become the main task of employment analyst functional officer (Analis Kepegawaian) based on applicable laws and regulations. But in feet those processes have been done also by administration officer and high-rank officer, so it makes an authority duplication. As the result, there was validation authority duplication between employee analyst with administration officer and high-rank officer the civil servant management process, so this result makes a conclusion that validation authority of civil servant management processbecome an authority for employee analyst because it has a strong legal basis based on applicable laws and regulations. While the regulation authority between employee analyst with administration officer and high-rank officer should be restored and regulated by ethic code and professional ethic of each position.

Abstract

Kedudukan PTS dan PTN yang tidak apple to apple sifatnya menghadapi banyak tantangan dalam pengelolaan perguruan tinggi sejak diberlakukannya sistem akreditasi sebagai ukuran kelayakan sebuah universitas menyeleggarakan pendidikan tinggi. Ukuran atau standar dimaksud berlaku sama untuk PTS dan PTN, sehingga PTS menghadapi hampir semua masalah dalam pemenuhan standar dimaksud. Di sisi lain, karena keterbatasan daya tamping PTN, keberadaan PTS sangat diperlukan untuk memperluas kesempatan mendapatkan pendidikan bagi seluruh warga. Oleh karena itu, penting untuk mengidentifikasi kesiapan PTS dalam memenuhi standar tersebut tanpa mengurangi fungsinya sebagai penyedia sistem pendidikan tinggi bagi masyarakat. Menggunakan kriteria pengukuran yang ditetapkan dalam sistem akreditasi oleh BAN-PT, dan dengan mengambil sampel di wilayah Jakarta Timur, maka dari 5 aspek yang diidentifikasi: (1) pembiayaan, (2) sumber daya manusia, (3) fasilitas, (4) SPP, dan (5) mahasiswa, maka diperoleh skor antara 2,42 sampai dengan 2,5; hal ini berarti bahwa kinerja PTS dalam memenuhi standar pengelolaan perguruan tinggi sesuai dengan peraturan perundang-undangan adalah cukup atau C. Untuk itu, diperlukan kebijakan yang bersifat responsif terhadap situasi di lapangan dengan membentuk cluster atau klasifikasi perguruan tinggi, sehingga penilaian dan pembinaan pun bisa lebih terarah. Pendekatan laisezz faire dalam dunia bisnis dengan membiarkan PTS bersaing secara bebas di pasar sehingga siapa yang tidak bisa bertahan akan dimerger, bukanlah pendekatan dalam sistem pendidikan yang berkewajiban memastikan education for all.

Abstract

The commitment, step, and efforts to realize the vision of Indonesia as ademocratic constitutional state law based on Pancasila and the 1945 Constitutionis a necessity and the duty of every constitutional state officials as well as citizensand even the whole nation, regardless of political and social strata bears. In theperspective of philosophical, sociological, and juridical, can be formulated in adynamic perception that in a democratic constitutional state, a profile of thecountry remains the ideal state at once realistic that can be manifested. In thecontext of Indonesia, for example, a living reality, Indonesia as a unitary staterepublic Indonesia is a country of law (the rule of law) must always be built andlived in a discursive procedure. For the law to be created and applied in a manneryng properly, fairly and impartially, that's the ideal law namely that the law is builton and the value of ethics and high morality of a nation. Abstract

Acceleration of the development of Sharia business will be more easily done throughSharia Banks. With the separation of Sharia Business Unit into Sharia Banks it willhopefully be easier to compete, more agile and flexible in making business decisions inthe future. Improve the quality of trust and image as Sharia Bank; by separating theexpected bank that is formed will have a high reputation and a deep understanding ofsharia products and services. Increase productivity and efficiency, Separation is donealso expected to encourage the passage of market best practice and good corporategovernance (GCG) in business management of Sharia Banks. Easier In Improving thecapital structure, by doing the separation, Sharia Banks can conduct effective strategiccooperation with third parties, including related to the capital increase if needed in orderto anticipate future business opportunities. Providing benefits to shareholders, Theresults of the separation of UUS into Sharia Banks is believed to have a positive impacton shareholder value as well as in the form of dividends to bank shareholders whoperform the separation. Support the growth rate of Islamic banking, Sharia Bank Plan inaccordance with the business plan has been prepared, the separation of bank assetgrowth is expected to rise and contribute significantly to the growth of Islamic bankingindustry. Improve financial performance as reflected in the Consolidated FinancialStatements.

Abstract

that true religious and social solidarity is a supporting factor in the handling ofrefugees in Indonesia. The groups are voicing solidarity keumatan Islam as thecornerstone of refugee protection in Indonesia, either by the strengthening of thecivil society as well as with the approach of religious behavior such as infaq,zakat, sadaqah, sacrificial, and pegumpulannya used to fund the protection andhandling of refugees in Indonesia, even some group voiced that the oppressedMuslim Rohingya refugees to be recognized as part of the citizens of Indonesia,this is all a form of commodification of religion in handling the issue of refugees inIndonesia. Although there are no clear synchronization between communitysolidarity with national interests, even precisely tend paradox, but unconsciouslycommoditization of religion in handling the issue of refugees is preciselystrengthen the role of the international regime to intervene against the nationalinterests of the handling of refugees in Indonesia.

Abstract

Implementation or enforcement of Law No. 23 of 2011 provides authority to BadanAmil Zakat Nasional (Baznas) and Baznas Provincial / Municipal and ZakatManagement Unit (UPZ) as an institution that has the right to manage zakat ortreasury. BAZNAS role with regard to the implementation or enforcement of LawNo. 23 of 2011, carried out with the collection, distribution, utilization andreporting charity. Abstract

Legal Aspects of Social Security Agency (BPJS) in the field of employment in theperspective of national social security system in order to improve the welfare of thecommunity is very clear, it is seen from the implementation of the Law on National SocialSecurity System (Social Security Act) and the Law on Social Security Agency (BPJS) bothby governments and society in general. The government of which has made theimplementation provisions of the Act mentioned above, also have to continuously executeall commands such legislation. From the second application of the law is seen thatparticipants in the National Social Security System Social Security Agency conducted everyyear has increased. Thus it can be said that the Government succeeded in organizingnational social security system in the public welfare.

Abstract

The interaction of politics and law in the process of establishing regionalregulation (Perda) taxes and levies as the implementation of Law No. 28 Year2009 on Local Taxes and and Levies (process each influences the other, and eachrequest and giving and mutual intervention between parties which has legislativepowers in the process of forming Regulation) occur in every stage of the formationprocess of the law. Abstract

Abstract

Dalam perkembangannya jaminan pinjaman polis bukan lagi berfungsi sebagai sarana pemasaran polis saja, akan tetapi sudah merupakan sumber investasi bagi perusahaan asuransi dengan menerapkan bunga yang cukup tinggi yang didapatkan dari setiap kredit dengan jaminan pinjaman polis tersebut. Bersamaan dengan berkembangnya kredit dengan jaminan pinjaman polis pada setiap perusahaan asuransi, maka bersamaan itu pula pelaksanaanya haruslah dilakukan dengan regulasi yang jelas serta memerlukan penanganan yang baik dan serius bagi setiap perusahaan asuransi, hingga hasilnya dapatlah dirasakan saling menguntungkan bagi kedua belah pihak, baik itu pemberi jaminan pinjaman polis/nasabah asuransi maupun pemegang jaminan pinjaman polis/ perusahaan asuransi, dengan tetap berpegang kepada keadilan, kepastian hokum dan kebahagiaan.
