Abstract

Mengkaji pemikiran seorang tokoh cendekiawan Muslim adalah suatu upaya mulia agar kita sebagai penulis dan pembaca dapat mengetahui dan memahami hakekat dari pemikiran tokoh dimaksud. Sehubungan dengan hal tersebut, penulis dalam kesempatan ini ingin melakukan kajian singkat Pemikiran Ibnu Rusyd tentang Filsafat dan Agama dengan harapan akan mengantar kita sebagai pembaca mengerti dan memahami apa sesungguhnya yang menjadi pemikiran seorang cendekiawan Muslim seperti Ibnu Rusyd. Tulisan ini juga dimaksudkan untuk memenuhi tugas yang diberikan oleh Dr. A. Ilyas Ismail, MA sebagai Pengampu Mata Kuliah Filsafat Ilmu dalam kapasitas Penulis sebagai Mahasiswa pada Program Studi S3 (Doktor) Ilmu Hukum. Filsafat sebagaimana yang penulis fahami adalah suatu pemikiran yang mengarahkan seseorang untuk cinta kebijaksanaan sesuai pengertian secara etimologi dari kata “filsafat”, yang dalam bahasa Yunani disebut philoshopia (philos : cinta dan sophos : bijaksana)” (Sukarno Aburaera dkk, 2013 : 25). Dari pengertian ini kita diberikan pemahaman bahwa filsafat adalah upaya seseorang dalam melakukan perenungan untuk memperoleh pengetahuan yang luas sehingga yang bersangkutan dapat menjadi manusia bijaksana dan hasil pemikirannya bermanfaat bagi dirinya dan orang lain secara terpadu. Hal ini sesuai dengan Sabda Rasulullaah Sallallaahu ‘Alayihi wa Sallam bahwa “sebaik-baik manusia adalah yang bermanfaat bagi manusia laiinya”.

Abstract

Intellectual property rights are related to human creativity which is the result of the work of creativity, human sense and intention. In Intellectual Property Rights that are protected is the right of the owner of Intellectual Property Rights, not the final product produced by the owner of Intellectual Property Rights. In the global economic order, Intellectual Property Rights are seen as a trade problem that includes interactions of three main aspects, namely intellectual property, commercialization and legal protection. This means that Intellectual Property Rights become important when there are intellectual works that will be commercialized so that the owners of intellectual works need formal legal protection to protect their interests in obtaining benefits from the commercialization of their intellectual work. This study explains the role of how the decision of the Patent Appeal Commission on patent applications, especially on patent applications number W00200903691 submitted by Repros Therapeutics Inc. through Intellectual Property Consultants in Indonesia who represent it (in this case AMR Partnership) with the title of the invention "Antiprogestin Dosage Regimen" and how to analyze the decision.

Abstract

Eradication of Criminal Acts Trafficking in persons is a problem that does not only occur in Indonesia but has also become an international problem, and involving many people is therefore an organized crime. Crime of Trafficking in Persons has been regulated in legislation including Law No. 39 of 1999 concerning Human Rights, LAW OF THE REPUBLIC OF INDONESIA NUMBER 7 OF 1984 CONCERNING CERTIFICATION OF CONVENTIONS ON ELIMINATION OF ALL DISCIRIMINATION FOR WOMEN. LAW OF THE REPUBLIC OF INDONESIA NUMBER 23 OF 2002 CONCERNING CHILDREN'S PROTECTION, WHICH IS CHANGED BY LAW OF THE REPUBLIC OF INDONESIA NUMBER 35 OF 2014, Criminal Code (KUHP), and Law No. 21 of 2007 concerning Eradication of Crime in Trafficking in Persons. Even though it has been regulated following the sanctions, the criminal act of trafficking still continues to this day, this is inseparable from various factors including the occurrence not only in urban areas but also in looking for victims from rural areas, generally underage children and women, factors poverty, education factors, family factors, and others.

Abstract

Information systems of political parties (Sipol) as a set of information systems and technologies used to support the work of Political Parties and Election Organizers in registering, administrative research and factual verification of the fulfillment of the requirements of political parties to participate in the elections. But in its application, Sipol actually becomes an obstacle for certain parties to become election participants. In this research, the method used is normative juridical. The result of his research is Sipol is not as the main element in determining the political party to be the eligible participant, especially in the political party which becomes the participant of the election in the previous election. However, Sipol is only a supporter of work for KPU and political parties in completing the registration of political parties as eligible participants.

Abstract

Doktrin Lex Sportiva dirumuskan sebagai ajaran mengenai hukum yang khusus mengatur tentang olahraga yang dibentuk oleh institusi komunitas olahraga itu sendiri dan berlaku serta ditegakkan oleh lembaga olahraga itu sendiri tanpa intervensi dari hukum positif suatu negara dan tanpa intervensi dari hukum internasional. Lex sportiva ini tegas-tegas menolak digunakannya hukum nasional suatu negara, baik dalam penyelenggaraan, pengawasan, pengendalian, maupun penyelesaian sengketa olahraga cabang olahraga. Selain itu cabang-cabang olahraga juga menolak campur tangan atau intervensi pemerintah atau negara dalam kekisruhan yang terjadi dalam organisasi cabang olaharaga. Bahkan federasi internasional cabang olahraga ini tidak segan-segan menjatuhkan sanksi kepada federasi nasional cabang olahraga dari suatu negara peserta yang pemerintah atau negaranya melakukan campur tangan atau intervensi terhadap penyelenggaraan cabang olahraga ini. Dalam konteks Indonesia, kehadiran peraturan perundang-undangan keolahragaan seringkali dimaknai oleh federasi internasional cabang olahraga dan atau penganut lex sportiva di Indonesia sebagai bentuk campur tangan atau intervensi negara terhadap penyelenggaraan sepakbola yang menjadi kewenangannya, sehingga harus ditolak. Mereka berpandangan bahwa Hukum Olahraga Nasional Indonesia yang dimanifestasikan dalam Undang-Undang Sistem Keolahragaan Nasional (UU SKN) dan 3 (tiga) Peraturan Pemerintah, hanya boleh mengatur hal-hal yang berkaitan dengan olahraga dari sisi public interest-nya saja. Itupun dengan catatan bahwa norma-norma hukum dari peraturan perundang-undangan yang dibuat oleh Pemerintah Indonesia tersebut tidak mengintervensi terhadap Lex Sportiva. Jika UU SKN dan peraturan perundang-undangan lainnya mengatur terlalu jauh dan masuk ke ranah lex sportiva, maka dapat dipastikan olahraga di Indonesia tidak diakui sebagai bagian dari olahraga internasional. Disini dapat dikatakan telah terjadi benturan antara sistem hukum keolahragaan nasional sebagai salah satu alat pengembangan kedaulatan negara yang menganut paham positifisme dengan lex sportiva sebagai alat pengembangan kesejahteraan masyarakat yang menganut paham utilitiarisme.

Abstract

According to Article 22 Paragraph (1) of the 1945 Constitution stated that 'inHappenings crunch that forced the President has the right set of governmentregulations in lieu of law'. Therefore the president has the constitutional rights inaccordance with the legislation in force in the issuing of Government Regulation inLieu of Law (Perppu) Number 1 Year 2013 regarding the Second Amendment toLaw Number 24 Year 2003 regarding the Constitutional Court, however, in issueda decree quo should qualify crunch forcing matters, and at least a race on expertopinion that has been formulated as a picture crunch forcing matters, namely: thestate never considered previously and demanded an immediate action withoutwaiting for the consent of the advance; there is an urgent need for action orreasonable necessity; limited time available (limited time) or there is a timecrunch; no other alternative is available or based on logical reasoning (beyondreasonable doubt) Another alternative is not expected to be able to cope with thesituation, so that the regulation has the determination is the only way to remedy thesituation; can not be replaced by other measures; The measure is temporary; andwhen action is taken, the parliament can not be real and earnest. So if it ismaterially the president can not be issued a decree quo, because it is not in mattersof urgency into force as the force crunch criteria. Formulation matters of urgencywas an act of force to avoid the arbitrariness of the authorities and as aconsequence as a legal state.

Abstract

With the number of suspects receiving less humane treatment from investigators atthe investigation level, the application of the provisions of article 56 paragraph (1)of the Criminal Procedure Code, especially at the Police level as Investigator,there are still many who have not been able to realize it. Whereas the applicationof Article 56 Paragraph (1) of the Criminal Procedure Code regarding the rightsof suspects to obtain legal aid at the trial level has been partially implemented,especially in the District Courts located in major cities, although there are stillsome courts that have not implemented the provisions Article 56 paragraph (1) forthe defendant who can not afford it. Whereas the implementation of the legalassistance process for suspects/accusers as mandated in article 56 (1) of theCriminal Procedure Code is not always smooth as expected by all parties, with theargument that there is no legal counsel to be appointed in the jurisdiction, thedeliberate misconception that the appointment of a legal counselor necessarilyrequires a special budget, and in such an institution is not budgeted, it is clearly aconstraint factor in enforcing the concept of article 56 (1) of the CriminalProcedure Code. Seeing several laws and regulations governing the concept oflegal assistance to the suspect, that all existing laws are currently meeting theexpected criteria, as mandated in article 56 paragraph (1) of the CriminalProcedure Code, but still exist some implementing regulations as a complementthat have not been made.

Abstract

Syarikat Islam in the Integrity of the World Education and Entrepreneurship (economicempowerment of the ummah) For Self-Reliance The Ummah is an inseparable part sincethe beginning of Syarikat Islam up to the present. Although the world of education andentrepreneurship (the economic empowerment of the ummah) has long been part of theSyarikat Islam struggle, it is related to the Education Institution based on existing data,Muhammadiyah and Nahdatul Ulama (NU), much more developed than educationalinstitutions in Syarikat Islam. There are some output figures generated from education inthe broad sense of Syarikat Islam which acts as a religious figure, nation and state,including Tayeb Muhammad Gobel, Rachmat Gobel and Sandiaga Salahuddin Uno, so asto realize entrepreneurship for the independence of people in Indonesia.

Abstract

The condition is often preached in various mass media law violations committed bypolice officers, such as the number of cases of drug abuse by members of thepolice, the police officers involved in criminal, arbitrary police officers, and manyother cases that describe the lack of discipline police officers, make its ownconcern for the people involved in the implementation of the main tasks of thepolice are to maintain security and public order, orderly and law enforcement, theimplementation of protection, guardianship, and service to society, and terbinanyapeace of the community by upholding human rights. The purpose of this study wasto determine how the Legal Efforts Against Members of the Police Crime ThroughConducting Enforcement Police Code of Ethics, and other objective is to knowabout the mechanism of the implementation of legal sanctions Code of Conduct forpolice officers who commit crimes and offenses - violations of law in the effort tostrengthen the image of the Police. This research is descriptive and includes viewsof the purpose of empirical legal research. What research was conducted at theNational Police Agency. The type of data used include primary data and secondarydata. Abstract

That the zakat of the profession is compulsory, equal to zakah and other incomesuch as agriculture, livestock and trade. The limit of nisab assets obtained from theprofession business can be equated nisabnya with zakat crops that is 5 wasaq(about 750 kg of rice), with a zakat obligation of 5% or 10%, and paid whengaining the rewards or wages of the profession. For professions that are notclassified as "a collar white", whose income is not so great, as doctors in hospitals,teachers or lecturers who only receive a fixed salary from the government agencywhere it works, likened nisabnya with gold and silver nisab , which is 93.6 grams,with a zakat obligation of 2.5 percent, issued every one year, and after expenditureof basic needs.
