Abstract

This paper aims to explore religious rationality among prostitutes. This study is a case study with a qualitative descriptive method at the Panti Sosial Karya Wanita Andam Dewi Solok. Data was collected using in-depth interview techniques. Using Max Weber's rationality theory as an analytical tool, this study found several important findings. First, the choice to enter the world of prostitution is a rational action taken by prostitutes. The act of prostitution that is carried out is an action that is goal-oriented (instrumentally rational). Actions of prostitution are rationally strived to gain utility, either to show "himself" as a woman or as a person who is responsible in his family. Second, for prostitutes, between prostitution and religion, both are profitable. Prostitution can empower families and improve the economic sector, while religion can reduce and eliminate the sin of prostitution. Religion is not only interpreted as a doctrine that only regulates ritual aspects such as prayer, fasting and all kinds of things, but more than that religion is interpreted as an antidote for any sexual act committed in prostitution.

Abstract

Nagari as a system of local wisdom that lives in the Minangkabau society has a long way in it relation to national law and international values, especially in the era of transnationalization of law. The regulations have been always led to a shifted the structure and function of the customary government structure in Minangkabau. This article is an evaluation of existing Nagari Government regulations in West Sumatra. The paradigm used is constructivist with a socio-legal approach. The result indicate that there is a shift in the order, structure, and function of cultural actors in society in the established local laws. The formation of local laws regarding Nagari as a response to the opportunities provided by the Village Law reaffirms the independence of the nagari through the existence of the Adat Salingka Nagari. The discussion to results leads to the use of the old legal assimilation in the legislation of Nagari Regulation has not succeeded to present a representative local law in protecting local wisdom in West Sumatra. So it is deemed necessary to minimize the state's domination of the people's needs in creating a balanced and comprehensive democracy.

Abstract

This study is aimed to describe the implementation of panca jiwa of Agro Nur El Falah Islamic boarding school Salatiga. The data is collected through observation, interview and document. This study shows the concept of the panca jiwa includes sincerity, self-awareness, simplicity, exemplary, compassion. Panca Jiwa has been rule of values in the daily activities of pesantren. However, the implementation of Panca Jiwa has not been maximized at the Pesantren Agro Nur El Falah Salatiga. Several factors inhibiting the implementation of the Five Souls include the lack of cooperation between teachers, the lack of activities that can make students become family to each other, damaged infrastructure and also their personalities at home. Therefore, teachers and senior students must set an example and be more diligent in directing, guiding, educating and supervising students to achieve the desired goals in accordance with the vision and mission of the pesantren.

Abstract

This study aim to explains prophetic ethics as an important issue in social life. For this reason, this study focuses on morality which is one of the main points of study in the book al-Adab an-Nabawy by Muhammad Abdul 'Aziz al-Khūly about prophetic ethics in social life. Through a literature study (Library Research) by exploring the meaning of hadith with techniques of classifying each hadith and focusing on hadith that examines prophetic ethics in the book of al-adab an-Nabawy, this study at least finds that prophetic ethics according to al-Khuly in social life includes good behavior, prohibition of prejudice, prohibition of spying, prohibition of envy, helping, controlling yourself from anger, making things easier and prohibiting making things difficult, prohibition of hurting neighbors and the obligation to respect guests, suggestions for greeting and not asking too many questions.

Abstract

This study aims to provide a new perspective in preventing stunting phenomena that occur in the community. This article is the result of a qualitative research conducted in Koto Tengah-Semurup, Kerinci Regency, Jambi Province. The data collection technique in this article uses in-depth interviews with a number of families whose children are stunted. The data in this article were analyzed using qualitative analysis starting from data reduction, data display to interpretation and drawing conclusions. The results of this study indicate that stunting is not only caused by the upbringing of a small family, but also the upbringing of an extended family, namely Ntino (grandmother). This parenting pattern arises because it is caused by the socio-cultural structure prevailing in society. With this socio-cultural structure, every child is raised with very traditional upbringing patterns, especially in diet. The conclusion of this article is that the occurrence of stunting is not only due to faulty parenting from the nuclear family, but also due to the social structure that gives birth to traditional parenting practices.

Abstract

This study explains how the state controls the Civil Servants (PNS). The research uses the Library Research method with the type of normative legal research through a statute approach. The method used is to analyze the laws and regulations and the Presidential Decree (PP). There are three forms of regulatory data analyzed, first, primary data consisting of the 1945 Constitution, Law No. 1 of 1974 concerning Marriage, Law No. 8 of 1974 concerning Basic Personnel, Law No. 5 of 2014 concerning ASN, Law No. 17 of 2014 concerning the MPR, DPR, DPD, DPRD PP No. 10 of 1983 in conjunction with PP No. 45 of 1990 concerning Marriage and Divorce Permits for Civil Servants. Second Secondary which consists of legal writings, expert opinion focused on family law. The second secondary data consists of legal writings, expert opinions focused on family law. Third, tertiary data, information obtained from primary and secondary legal materials; legal dictionaries, world encyclopedias, and also the Big Indonesian Dictionary in order to provide an understanding of the terms used by the law. The approach in this study uses the theory of the state, law and function in looking at the position of civil servants and the involvement of the state in regulating marriage for civil servants. The results of this study indicate that there are two forms of state interest in regulating the behavior of civil servants; 1) political loyalty, 2) sexuality restrictions on civil servants (PNS).

Abstract

New norms and social institutions have emerged in connection with the Covid-19 pandemic and in many ways have replaced the previously considered good order. The foreign phrase which is currently a term has been agreed upon by all parties as an invitation and a word of hope - new normal. Through literature study, this article reviews the fact that there have been institutional changes in various aspects of life because of the pandemic faced by the community for more than a year. By conducting a study of the results of research and internal monitoring of the Covid-19 Task Force and supported by secondary data, this article discusses three levels of social interaction structure that are interconnected and influence each other. At first the pandemic brought shocks that caused negative effects on almost all aspects of life, but in the course of time the difficult conditions gave various optimism to rearrange existing institutions to be more relevant to the contemporary context full of change. Doubts, incoherence, and weak aspects of government institutions are the cause of the continued spread of the pandemic. The legitimacy of the policy is the key to stopping the pandemic as well as institutional restructuring.

Abstract

Industrialization makes people pragmatic and individualistic. The impact can be seen from the estrangement of family relations. Family ties are getting looser because each person is required to have certain duties and professions to fulfill their needs. Social transformation and deregulation make it increasingly difficult to create social intimacy. The purpose of this is to analyze the inequality of the domestic role of the household in litigation, which is more common than talak divorce, as well as social changes in family relations. The method used in this research is qualitative with descriptive approach. The research data was obtained from the results of interviews with the administrators of the Religious Courts and the people of the City/Regency in the Padang Religious High Court Region related to divorce. Other data search techniques are also carried out by means of documentation and observation to the research location. The main objective of this study is to answer one question; How is the transformation from shifting roles between husband and wife to household harmony. That the effect of social transformation on divorce is 1. increasing divorce due to nusyuz: the wife's disobedience to her husband or the wife's lack of rights and obligations. The independence of women is the main factor. 2. Increasing divorce due to shiqaq: husband and wife fighting and arguing with each other. Disharmony is the most common reason put forward by the plaintiffs. The factors that cause divorce is a form of social deviation. This study agrees with the opinion of Emile Durkheim who said that independence in life and economic level as well as the need for social deregulation in the form of deviation.

Abstract

This study raises the theme of Uang panggilan in the Gadih Angik Community Tradition. Call money is a form of tradition in the form of giving a kind of money to the host who is holding a baralek event. This tradition is carried out on the principle of mutual cooperation and mutual help, so of course if someone is invited and has paid the summons, then with a sincere heart, the person who was given the call money must also give when the person who gave earlier held a baralek event. So based on this, the question arises, how is the tradition of calling money in the baralek event in the tradition of the Gadih Angik community, starting from the formation factor, the implementation process and what are the implications of this tradition for the surrounding community. With a qualitative descriptive approach, this study will describe some of the data obtained from the field, both observational interviews and documentation as data collection methods. In addition, this research also uses a mix method, in the sense of a combination of social science research and Islamic law approach research, then also analyzed with 'urf and maqasyid shari'ah and with social exchange theory. From the factors that occur, the implementation process to the implications for society, it can be concluded that the law for the implementation of this tradition of calling money is permissible at the level of hajjiyah.

Abstract

In electoral politics, the relationship between bureaucrats and politicians is increasingly obvious because the interests between the two meets at one point, namely power. As a result, ASN, which should be neutral in elections and elections, is drawn into the vortex of political currents, especially in the implementation of the Pilkada which is in direct contact with the interests of the bureaucrats and ASN. This phenomenon occurs in almost all of Indonesia during the Pilkada, especially since the candidate who is advancing is the incumbent candidate. This practice also occurred in the 2020 West Sumatra gubernatorial election. Bureaucrats became one of the supporters and loyalists (brokers) of the candidates who came forward. One of the pairs of candidates who have a lot of contact with these bureaucrats is the pair Mahyeldi-Audy. One of them is the appointment of three Padang City Government officials to become officials in the West Sumatra Provincial Government, although they have gone through the screening process, there are still allegations of remuneration for the contributions of the three bureaucrats in winning Mahyeldi-Audy. To analyze the problems above, the method used is a qualitative approach and the type of research used is a literature review. In this study, it is explained that in the process of selecting the governor, bureaucrats and PKS collaborate in collecting votes according to their respective duties. This collaboration was one of the decisive factors for Mahyeldi and PKS's victory in the West Sumatra gubernatorial election. the practice of political brokers and pig-barrel politics explains the relationship between bureaucrats and politicians. Bureaucrats who have a strong social network engine are able to get votes in their respective environments, especially those senior bureaucrats are community leaders who have supporters. Coupled with pragmatic politics that prioritizes money politics in elections, making these bureaucrats and politicians a force in the winning process.
