Abstract

Notary status is regulated in Act Number 2 of 2014 relative to Amendments to Act Number 30 of 2004 (hereinafter referred to as UUJN). In carrying out its authority, the Notary is obliged to provide investment guarantees and is obliged to fulfill the rights and obligations of the parties in economic cooperation and other matters needed. This study uses a normative legal approach, which uses secondary data as primary data, consisting of primary, secondary and tertiary legal material. This study aims to analyze the authority and responsibility of a notary public in issuing fiduciary deeds to banks and their legal consequences if a fiduciary guarantee is made by the notary is not registered at the fiduciary registration office.   The results of the research and discussion resulted that a notary must be very careful in carrying out all his duties and authority over the rights and obligations of the parties and in the results of this study also showed that the role and responsibilities of the notary public in making a fiduciary deed at the bank financial institution because it was legal liability, namely the guarantee of legal certainty over a fiduciary deed made / registered. The legal consequence of PT Tjandra Artha Lestari if it is not registered is that the fidusian recipient will experience difficulties if the fiduciary provider defaults and the fidusian recipient does not have the right to overtake other creditors in terms of paying off debts.

Abstract

In Indonesia, frequently land disputes occurred between communities or the government with communities. Such as land disputes that arise between citizens of Kapuk Poglar RT 07 / RW 04 and Polda Metro Jaya. This research was combining using normative and empirical legal research methods. This research was conducted in  Kapuk Poglar RT 07 / RW 04. As for collecting and processing the data using qualitatively to understand the symptoms of the problem. This research aims to describe the relationship between this land disputes with citizens human rights and also the factors that cause land tenure disputes that occur in Kapuk Poglar RT 07 / RW 04 West Jakarta. The results of this research are known the factors that cause land tenure disputes that arise in Kapuk Poglar are overlapping, and there’s violence against human rights felt by Kapuk Poglar citizens in not obtaining the right to be free from fear and right to access water.

Abstract

Komunitas Ekonomi ASEAN (KEA) merupakan salah satu pilar dari dua pilar lainnya yang dihasilkan oleh KTT ASEAN pada Oktober 2003 di Bali. Pada KTT ASEAN ke-12 para pemimpin menguatkan komitmen untuk mempercepat pembentukan Komunitas ASEAN pada tahun 2015 agar sejalan dengan Visi ASEAN 2020 dan Bali Concord II,  dan sekaligus menandatangani Cebu Declaration on Acceleration of the Establishment of an ASEAN Community by 2015. Untuk mewujudkan pembentukan KEA perlu menyusun suatu cetak biru (blueprint) atau disebut Deklarasi Cetak Biru Komunitas Ekonomi ASEAN. Terdapat empat karakteristik dalam Blueprint, di mana karakteristik kedua dalam Cetak Biru KEA, yaitu menciptakan ASEAN sebagai kawasan yang berdaya saing tinggi di bidang ekonomi (Kawasan Ekonomi yang Kompetitif). Guna merealisasikan hal tersebut Cetak Biru menetapkan ketentuan tentang Kebijakan Persaingan Usaha yang pada tahun 2010 pedoman ini berhasil dirumuskan dan dinamakan Regional Guidelines on Competition Policy (Regional Guidelines). Dengan adanya Regional Guidelines ini maka Negara-negara anggota ASEAN harus menyesuaikan perundang-undangan persaingan nasionalnya. Dari tiga negara anggota ASEAN yang diteliti (Indonesia, Malaysia, dan Singapura) berdasarkan indikator dalam penyusunan undang-undang persaingan, untuk Indonesia masih ada enam indikator yang belum sesuai (harmonis), sedangkan untuk Malaysia dan Singapura masing-masing masih ada dua indikator yang belum sesuai(harmonis). Dalam penulisan ini digunakan metode hukum normatif dengan pendekatan yuridis normatif dengan jenis penelitian deskriptif analitis dan studi komparasi. Penelitian ini menggunakan sumber data dari literatur, artikel dan situs-situs internet.

Abstract

Bidan adalah wanita yang telah berhasil menempuh sekolah bidan yang sudah terdaftar sesuai ketentuan perundang-undangan. Profesionalitas bidan memiliki tiga kerja utama, yaitu melayani kesembuhan wanita hamil, melayani kesehatan anak, dan melayani kesehatan reproduksi wanita dan KB. Tetapi didalam praktik dijumpai sejumlah yang melakukan kegiatan diluar diluar ketiga fungsi utamanya yang mengandung zat antioksidan, utamanya berupa vitamin C dosis tinggi (1000 s/d 4000mg) yang dicampur dengan glutation (600mg). Banyak juga yang menambahkan plasenta, baik yang berasal dari manusia maupun hewan, yang halal (sapi) atau haram (babi). Campuran zat tersebut disuntikan ke pembuluh darah yang ada di , otot tangan atau lengan.Bahkan ada pula yang  disuntikan melalui wajah pasien. Praktik penyimpangan ini, jelas tidak dibenarkan karena tidak sesuai dengan fungsi utama bidan. Namun dalam kenyataan sehari-hari praktik illegal ini terus berlangsung. Penulis tertarik untuk mengkaji masalah ini dari sisi sosiologis, apakah dengan berpedoman pada pertanyaan: apakah mendorong praktek ini dilakukan oleh seorang bidan, dan tidak menghukum apakah terjadi praktek inilah kami.

Abstract

In certain circumstances, the minister of land and the head of the land office can register the scavenging of land rights in a parcel of land, which in this case the act was not done by the Land Deed Making Officer or PPAT. It is inversely proportional to the provisions contained in Article 37 paragraph (1) Government Regulation or PP No. 24 of 1997 concerning Land Registration which stipulates that the transfer of title to a parcel of land can only be done if it can be proven by a deed made by the authorized PPAT according to the provisions of the prevailing laws and regulations. The problem that will be discussed in this research is how the legal implications of the policy of the head of the land office in land registration? This study uses a normative legal method, with the approach to the legislation and other literature.   Based on the results of research that the policy of registering the transfer of ownership of a parcel of land carried out by the head of the land office is contrary to the provisions contained in Article 37 PP No. 24 of 1997 concerning Land Registration, so the transfer of rights to a parcel of land carried out is not legal according to law. The implication applies as long as the head of the land office explicitly registers the ownership rights to a parcel of land in an urban area, so it can be ascertained not to be categorised as a remote area as intended under Article 37 PP No. 24 of 1997. Thus, the content needs to be changed in Article 37 PP No. 24 of 1997, concerning regulation in certain circumstances. It would be better if the situation in question is specified in the torso so as not to cause multi-interpretation which can be a gap of abuse of authority so that it has the potential to harm the community.

Abstract

Eksistensi CCTV pada pembuktian perkara tindak pidana umum adalah dapat menjadi alat bukti yang sah apabila dilakukan dalam rangka penegakan hukum atas permintaan kepolisian, kejaksaan, dan/atau institusi penegak hukum lainnya yang diitetapkan berdasarkan undang-undang. CCTV dijadikan alat bukti dalam Hukum Pidana Indonesia merupakan suatu kebijakan kriminal dengan menggunakan sarana penal dan non penal. Dalam Hukum Pidana Indonesia, penggunaan CCTV sebagai alat bukti termasuk dalam kebijakan dengan Sarana Non Penal yang merupakan suatu cara yang digunakan oleh aparat penegak hukum dalam mengatasi belum adanya pengaturan dalam KUHAP. Abstract

The clash between Balinuraga Village and Agom Village was caused by sexual harassment where there was a slander to the Balinese by the Lampung people. The issues raised are the factors that cause social conflict, efforts to handle and inhibiting factors from the Police, Local Government and Community Leaders / Customary Leaders / Religious Leaders in handling post-conflict conflicts in Lampung as an effort to provide legality. legal certainty and protection for the wider community, especially people in South Lampung. This study aims to determine the causes of conflict, post-conflict handling of social conflict in South Lampung society and inhibition of post-conflict handling in social conflict in South Lampung society. This type of research is analytical descriptive research using the approach of normative legal problems (library research). This study uses secondary data in the form of secondary legal materials, the books of legal experts. The results show that there are reasons that can cause social conflict in South Lampung, such as lack of work; Unresolved conflict; Social inequality factor; Lack of communication that causes confusion in the certainty of a news; There are those who want a split between the two villages. Post-conflict handling is carried out by the Regional Government, Lampung Regional Police and Community Leaders / Customary Leaders / Religious Leaders together through reconciliation, rehabilitation and reconstruction efforts, then counseling and spreading the need for people who are aware of the law and harmony society, to create a community that is orderly, and peaceful.   The conclusion of this study is that the Police, Local Government assisted by the community (religious leaders, traditional leaders and community leaders) must make a planned, integrated, sustainable and measurable post-conflict recovery effort through reconciliation, rehabilitation and reconstruction efforts. Law Number 7 of 2012 concerning Management of Social Conflicts also regulates the role of the community, and funds the handling of conflicts, so that the community is aware of the law and harmony in society, orderly, and peaceful.

Abstract

The development of the Trans Sumatera toll road for the Bakauheni-Terbanggi Besar Section II package currently causes uncertainty in the calculation of compensation for residual lands, so that there is a change in the function of the land from the remaining land affected by the development. The remaining land referred to in this study is the rest of the land that has been compensated by agencies that need land, in this case the Ministry of Public Works and Public Housing but still leaves problems that have not been resolved. The problem in this study relates to the basis and process of settlement of compensation for the residual land that has lost its social function and economic value in the construction of the JTTS Bakauheni-Terbanggi Besar Section, efforts that must be undertaken by the community for the remaining land that loses social function and economic value in the JTTS development Large Bakauheni-Terbanggi Section. This research is a normative and empirical juridical research. This research was conducted in Serdang Village, tanjung Bintang District, South Lampung Regency. Aiming. This study uses a normative legal problem approach (library research). The results of this study indicate that the remaining land can be classified based on its designation, namely, agriculture / plantation, settlement and place of business which are categorized into 2 (two) based on the type of loss experienced by the rightful parties namely: economic losses and social losses. Where economic losses can be requested for compensation in the form of money while social losses can be given access roads to the remaining land so that the residual land that loses its social function will live and the economic value of the residual land will not decrease so that it will not suffer economic losses.

Abstract

The control of land by the state is stated in Article 33 paragraph (3) of the 1945 Constitution of the Republic of Indonesia (UUD 1945). Based on this article, it means that the State has authority over land tenure, this encourages the writing of a journal on the application of social functions and the determination of compensation that occurs in the land sector. This research was conducted because the authors see that there are still many disputes related to the implementation of the social function itself and the application of the determination of compensation as stipulated in the provisions relating to this matter it is caused because the application in real life has not been running optimally. This study aims to find out how the government’s authority should be for land tenure and its relation to social functions and the determination of compensation. The location used as a case study is located in Batu Jaya Village, Tangerang City. Data collection is done by interviewing several related parties and also conducting a literature study by finding sources related to government authority over land tenure, the concept of social functions, and the determination of compensation. The results of this study indicate that the government has the power to grant land rights and revoke land rights in the public interest.

Abstract

Sebagaimana diketahui, tindakan perawat asisten operator bedah dilakukan sesuai dengan perintah dokter bedah, maka secara hukum tanggung jawabnya ada pada pemberi perintah. Selanjutnya, jika terjadi penyimpangan dari perintah maka sepenuhnya menjadi tanggung jawab perawat asisten operator bedah. Namun demikian, jika didapati terjadi kelalaian yang dilakukan oleh perawat maka apakah dokter turut bertanggung jawab atau rumah sakit tempat ia bekerja. Permasalahan dalam penelitian ini adalah bagaimana bentuk kewenangan dan bentuk tanggung gugat operator bedah, dan akibat hukum bila terjadi sengketa medis terhadap perawat asisten operator bedah dalam menjalankan profesinya di kamar operasi? Metode yang digunakan dalam penelitian ini adalah metode penelitian yuridis empiris dengan data primer hasil wawancara dan data sekunder dari buku serta literature. Hasil penelitian menunjukkan bahwa bentuk kewenangan tenaga perawat asisten operator bedah dalam menjalankan profesinya di kamar operasi adalah melaksanakan tugas mandiri keperawatan, dan pelaksanaan tugas pelimpahan wewenang. Bentuk tanggung gugat perawat asisten operator bedah dalam menjalankan profesinya di kamar operasi rumah sakit merupakan tanggung jawab dokter. Akibat hukum bila terjadi sengketa medis terhadap perawat asisten operator bedah dalam menjalankan profesinya di kamar operasi dibebankan kepada rumah sakit atas segala terjadi atas kemudaratan akibat kelalaian yang diperbuat oleh dokter maupun perawat, sepanjang kelalaian tersebut tidak adanya faktor kesengajaan oleh tenaga kesehatan dan kejadian kesalahan tersebut dilakukan di rumah sakit bersangkutan. Kata Kunci: Tanggung Gugat, Perawat Asisten Operator, Kamar Operasi
