Abstract

New problems that have arisen in this disruption era have inevitably influenced the law of family relations together with its dynamism which developed revolutionary. Moreover, they have demanded speedy and permanent solutions with a strong Sharia bases. As a product of Islamic law that is responsive and flexible, fatwa has a strategic role in renewal and sustainability of Islamic family law for every challenge in different era as well as being a dynamist in the pluralism of Indonesian Islamic family law implementations. The study of recognition of fatwa from authoritative circles is important to be considered since there has been the outbreak and shifting on Muslim communities’ interest on application-based fatwa products from non-authoritative circles.

Abstract

Hukum waris Islam, terkhusus ahli waris pengganti dalam perundang-undangan (Kompilasi Hukum Islam) di Indonesia merupakan hal unik. Berdasarkan analisis yuridis, ditemukan eksistensi ahli waris pengganti merupakan pertemuan ekletisisme hukum Islam dan local wisdom. Maka dalam menyelesaikan persoalan ahli waris bisa memakai KHI, local wisdom, putusan hakim (jurisprudensi).

Abstract

The renewal of Islamic family law continues to develop over time. So there are many solutions offered by scholars, especially in Indonesia in solving family law. In the field of Islamic inheritance law, there are several reforms, one of which is the wasiat wajibah. Wasiat wajibah is a solution given by scholars to the heirs who are suspended by the Shariah 'to receive a portion of the assets from the heirs that are entitled. Two kinds of heirs who are given the right to receive a share even if it is blocked by the shariah '. First, heirs to non-Muslims, secondly, children out of wedlock and, third, adopted children. They are entitled to inheritance through wasiat wajibah. However, the portion must not be more than 1/3. This is the discussion in this paper

Abstract

The development of Islamic law in Indonesia cannot be separated from the political configuration that occurred in the Transition Era, the Old Order, the New Order and the Reformation Era. Every political era certainly provides value and color to the product of Islamic legal legislation produced. Legislation on Islamic law is always carried out gradually considering the development of the Indonesian political system also continues to develop. Since Law No. 1 of 1974 concerning Marriage to Law No. 16 of 2019 concerning Amendments to Law Number 1 of 1974 concerning Marriage, efforts to reform Islamic law nationally are a necessary thing to do in line with social change and the legal values in the middle of Indonesian society. Eclectically, the characteristics of adaptive and dynamic Islamic law have great potential in the development of national law amid the pluralism of the Indonesian legal system, both in substance and in the essence of law. Keywords: Development, Islamic law, political, legislation Abstrak Perkembangan hukum Islam di Indonesia tidak dapat dipisahkan dari konfigurasi politik yang terjadi di Era Transisi, Orde Lama, Orde Baru, dan Era Reformasi. Setiap era politik tentunya memberikan nilai dan warna pada produk legislasi hukum Islam yang dihasilkan. Legislasi tentang hukum Islam selalu dilakukan secara bertahap mengingat perkembangan sistem politik Indonesia juga terus berkembang. Sejak Undang-Undang Nomor 1 Tahun 1974 tentang Perkawinan hingga Undang-Undang Nomor 16 Tahun 2019 tentang Perubahan atas Undang-Undang Nomor 1 Tahun 1974 tentang Perkawinan, upaya untuk mereformasi hukum Islam secara nasional adalah hal yang perlu dilakukan sejalan dengan perubahan sosial dan nilai-nilai hukum di tengah masyarakat Indonesia. Secara eklektik, karakteristik hukum Islam yang adaptif dan dinamis memiliki peluang dan potensi besar dalam pengembangan hukum nasional di tengah pluralisme sistem hukum Indonesia, baik secara substansi maupun dalam esensi hukum. Abstract

The culture of the Marind tribe of Papua has been preserved for a long time to be preserved until today. like the traditional culture of Marind in the tradition of marriage and wedding parties. The Marind people believe in Islam as their religion. so there is an acculturation process in displaying the practice of the tradition. For this reason, this study will examine the tradition of marriage and walīmat al-‘urs, the Muslim community of the Marind Tribe of Papua in a review of cultural acculturation. Qualitative research is used during the research process. In-depth observations and interviews were applied during data collection. This research shows that the Muslim community of the Marind Tribe of Papua in its implementation still uses the traditions of the past because they respect the customs and minority Islam in the family, practice mixed traditions between the two cultures, and eliminate traditions. While the process of cultural acculturation experienced by the people of the Marind tribe of Papua to the tradition of marriage and marriage parties. So that emerged a new tradition of the Marind Muslim community. This research also results that the Muslim community of Marind tribe upholds the customs that prioritize the appreciation and practice with the content of customary values, but on the other hand also fulfills all matters relating to sharia in Islamic culture. The occurrence of cultural contact meetings between Marind and religious customs, according to this study does not indicate a process of rejection.

Abstract

The purpose of this paper is to know concept of engagement in Islam and Christianity, then find the similarities by using literature study, because the materials and data in its preparation use holy book, books, and related literacy, then the data used in this paper is a qualitative and the method used is descriptive. Begins with the understanding of the engagement of the two religions, the author concludes a similarity that can be drawn, namely the engagement is an attempt by the two brides the choose, know, and understand each other before stepping up the dream of marriage. Of the objectives also include the definition of engagement which is choosing, knowing and understanding each other to carry out and make heart choices to create a harmonious family. Regarding the cancellation of the engagement there are similarities in which there is room to be canceled with various established reasons

Abstract

The Supreme Court Circular No. 1 of 2017 aims to provide legal protection for women's rights after divorce. But in its implementation women's rights are neglected. Wives are often in an attenuated position. The problem in this paper is between the expectations and challenges of the execution of the living in the pronunciation of the divorce pledge no. 121/Pdt.G/2018/PA TALU which is not carried out by the husband. The research method uses a gender analysis approach. Data is collected based on observations, interviews and documents. The findings in this study are three conditions in which all three cannot provide justice to women's rights. First; the husband does not execute the judge's decision on the obligation of living set by the judge of the Talu Religious Court, the pledge of divorce cannot be carried out, the marriage remains valid but the husband and wife are not home anymore and the wife never again earns a living. Second; If the sincere wife does not get her rights after the divorce, then the judge can witness the divorce pledge of the husband finally occurs divorce. Third; when the research was done the husband had done siri marriage. Women become psychologically and materially victimized in the absence of efforts to seek justice (dead ends). The best solution is to expect the husband's awareness of his responsibility to provide a living which is his obligation, will be accounted for before Allah SWT. In certain circumstances divorce is the best solution so that both regardless of the burden of birth and mental suffering, do not cause greater mafsadah. SEMA's goal of protecting the rights of wives is not in fact also achieved.

Abstract

Marriage creates a balance of one's life biologically, psychologically and socially. Biologically, sexual needs are met. Psychologically, mental maturity and emotional stability, determine the diversity of married life. Marriages that are too young will result in a rise in divorce cases due to a lack of awareness to be responsible in married life. Sociologically, marriage makes a man and a woman legally considered legal. A lasting marriage is characterized by the husband and wife's readiness to assume responsibilities. According to the Marriage Law No. 16 of 2019 paragraph (7) states that marriage is performed if the male party has reached the age of 19 years and the woman is 19 years old provided that there must be permission from the parents. However, if there is something that deviates from the Law for example because of the free association of a pregnant woman outside of marriage and the woman has not reached the age of 19 years and the man has not reached the age of 19 years then Law No. 16 of 2019 can still provide the possibility of the age limit that has been set by the dispensation of marriage to the Court or other officials appointed by both parents of the women and the male side , this is based on article 7 paragraph 1 of the Marriage Law No. 16 of 2019.

Abstract

Penelitian ini bertujuan untuk menganalisis perbedaan kedudukan hukum dan klasifikasi dari anak luar kawin menurut hukum Islam dan hukum positif di Indonesia. Kehadiran anak dalam sebuah keluarga merupakan anugrah dari Allah Ta’ala yang harus dijaga. Akan tetapi, tidak sedikit dari masalah yang terjadi terkait keabsahan perkawinan yang berakibat hukum pada status hukum anak yang dihasilkan. Dari 2 sudut pandang hukum yang berbeda, yaitu hukum Islam dan hukum positif di Indonesia terkait anak luar kawin, dan siapa saja yang termasuk anak luar kawin dan apa akibat hukumnya. Penelitian ini menggunakan metode penelitian yuridis normatif dengan menggunakan sumber hukum primer berupa UU No.1 Tahun 1974, KUHPDT, Yurisprudensi, Al-Qur’an dan Al-Hadis, sumber hukum sekunder seperti jurnal, buku, tesis, disertasi yang berkaitan, dikumpulkan dengan metode studi pustaka dan dianalisis melalui deskrisi analisis. Hasil penelitian ini menunjukan bahwa terjadi perbedaan klasifikasi anak luar kawin menurut hukum positif dan hukum Islam, karena berbeda cara pandang khususnya terkait anak yang dihasilkan dari perkawinan sirri yang menurut hukum positif dalam ketegori anak luar kawin, sebagai akibat dari perkawinan yang tidak sah di mata hukum negara.

Abstract

Provisions of the wajibah testament to adopted child contained in the Compilation of Islamic Law Article 209 verse 1 and 2 constitute a renewal of Islamic inheritance law in Indonesia, but many legal experts doubt the validity of this provision and assume it does not have a clear legal basic in the form of naṣ (maṣadir al- ahkām), the method of istinbath (qaidah al-ahkām) and the purpose or legal implications (maqaṣid al-ahkam). This study aims to verify the validity of the wajibah testament to adopted child with the siyāsah al-shar'iyyah approach. The results of the study showed that the wajibah testament to the adopted child are legal rules that run based on government policy to resolve the issue of inheritance between heirs or persons who have a close relationship with the heir but is prevented from inheriting. The government is making the wajibah testament for adopted child in KHI as a solution to resolve this problem.
