Abstract

A sale and purchase agreement of a defective land, whose settlementoutside the court may be settled in a familial manner by deliberating between theparties to the sale and purchase agreement outside this court. The parties mayrequest the assistance of village officials (Village Head or lurah), lawyers ornotaries. So the settlement of a sale and purchase agreement that contains defectsoutside the court can be done in a peaceful way, meaning that between the sellerand the buyer reconcile. Regarding the defect, if the defect there is an element oftrickery, then the party who cheated in this case the buyer is entitled to claimcompensation to the seller and the seller is obliged to provide compensation to thebuyer or the object of sale and purchase is returned to the seller and accompaniedby a change loss due to the ruse performed by the seller.

Abstract

Marriage is one of the important events in human life. Every person orpartner (male and female) if they have married then there is a bond of obligationand rights between them and children born from the marriage. Article 2 paragraph(1) of the marriage law that a marriage carried out according to each religion isthe main principle of a legal marriage. The formulation of the problem in this studyis a. What is the authority of the Desa Adat Institution in Bali in determining themarriage conditions before being registered. b. What are the Terms of MarriageAccording to Customary Law of Bali. that method. by using empirical legalresearch methods, namely legal research conducted because of the gap between theory and reality. In order for marriage to be considered legal as customary, itmust carry out Tri Upa Witness, namely Manusa Witness, Buta Witness, and Godof Witness. And administration must be recorded in the civil registry office.

Abstract

Every religion has provisions governing marriage, so everyone must obeyand be asked for their respective religions. Every Indonesian citizen who marries mustgo through their respective religious institutions. Because marriages based on birthbonds can be accepted as valid, it has been agreed to fulfill in Article 2 paragraph (1) ofLaw Number 1 of 1974, how legal marriages are conducted according to the law of eachreligion and its beliefs. Therefore, marriages must be carried out according to the law ofeach religion and belief, otherwise the marriage is not valid. While all religions inIndonesia do not allow marriages to be held if the two candidates are of differentreligions. For example, for Christians interfaith marriages are not legal, because theyare carried out according to the rules of the Christian religion not in accordance withthe conditions set out in the marriage. Every religion approved in Indonesia. Expellingeveryone to do a marriage different from religion is not in accordance with Indonesianreligious and national law.

Abstract

In the legal and governmental aspects, civil servant bureaucracy reform is a very strong issue to be realized. This is because the Indonesian government bureaucracy is suspected to have contributed greatly to the occurrence of these various crises. By using the method of normative legal research a research method that discusses tie the norm angle in legal material. Furthermore, some of the problems that will be studied are 1) about the neutrality of civil servants in the General Election and  2)   how to ensure the neutrality of civil servants themselves. By using a number of state legal theories, constitutional theories and legislative theories and theories of authority, and using the normative legal theory it will obtain discussion as follows:The bureaucracy built by the New Order government has fostered a bureaucratic culture that is thick with corruption, collusion and nepotism (KKN),Therefore bureaucratic reform is expected to be a corrective step towards the Government's political policy after the New Order.The conclusions obtained are: 1) the neutrality of civil servants in the reform of the bureaucracy, the Government has established new policies in coaching Civil Servants (PNS) as part of coaching 2) efforts to guarantee the neutrality of civil servants carried out with socialization and approach approach to the ceremony

Abstract

Bali as a place of tourism it has its own attraction than with the other touris, the appeal ofthe island of Bali which is in the field of tourism from the beauty of nature, the beauty of thebeaches, diverse arts and culture. One of the uniqueness that can attract tourists to come tothe island of bali is tourism in the field of terasering the ones in familiar wits this traditionalsubak. Along with the development of a more modern, irrigation system traditionally, hasbeen on leave by Sekaha tiller and switched to using the increasingly sophisticated. Subakbased on Tri Hita Karana in preserving and maintaining of tourism cultur in the era ofmodern in Gianyar. Discussion Tri Hita Karana with his village Pakraman is the last fortress to preserve the security and protecting the culture of bali, especially on iririgation systemsubak in Gianyar that has become a world heritage. The subak be done with theestablishment of a awig-awig the ban on the use of machines and chemicals in an irrigationsystem subak and awig-awig associated over the functions of agricultural land, so that theachievement of the subak based on Tri Hita Karana.

Abstract

Village is as the lowest form of autonomous government, so that it can implement autonomyproperly, then the administration of its government must have the main factor that is said to beautonomous is the Human Resources factor as the executor, Financial factor, Supporting Infrastructureand Institutional Factors and Institution. Village Government whose existence is directly related to thecommunity and as the spearhead of development, the village government is increasingly required to beprepared both in terms of formulating village policies (in the form of village regulations), planningvillage development that is adapted to the situation conditions and in providing routine services to thecommunity. autonomous people must have the authority and ability to explore financial or revenuesources, manage and use their own finances, in other words there is independence or village autonomyin managing village budget and expenditure expenditure. which is the village's wealth, the compilationof the village's income and expenditure budget, the administration or administration of financial affairsand financial accountability. The problem in this research is whether the Village Law has givenautonomy to village finances, as well as the exercise of authority of the village government in realizingvillage autonomy. This research is a study using Normative Juridical research methods, using legalmaterials, namely the legislative approach and conceptual approach, is a normative analysis showingthat the authority of the village government is based on the principles and legal norms that apply, whilethe conceptual village financial management autonomy.

Abstract

The study on “Corporate Liability in Banking Criminal” aims to knowand give in-depth description concerning corporate liability of banking crime andlegal protection of banking criminal as a corporate. This study deals with normative law with analytical and conceptual approach,statute approach, and policy-oriented approach.The legal material in this study was obtained from primary and secondary source.The technique for collecting legal material is a combination of snowball andsystematic method while the study was analyzed by means of descriptiveevaluative, interpretative, comparative, and argumentative analysis.The findings show that there are no provisions of Banking Law that expressly statecorporation as legal subject. Although Article 46 Law No. 7, 1772 replaced by LawNo. 10, 1998 expilicitly states that a corporate as legal subject but there are noprovisions stating that a corporate can be made responsible criminally.Legal protection fror the victim in criminal law only gives abstract protection(indirect protection). Althogh in the legislation of criminal law as in the provisionof Article 14 c of the Criminal Code, Law No. 7, 1955 and also law No. 8, 1981contain provision of victim protection, but this provision is facultative in nature.While the legal protection of a victim in Law No. 8 is Hard to put into practice. Thelegal protection of a victim in the banking area as a corporate has a number ofabstacles. These obstacles indeed have some influence in upholding Law No. 7,1992 which has beeb changed into Law No. 10, 1998 about banking so that theimplications that emerges and legas protections of criminal victim in the bankingarea are still weak.

Abstract

Pembangunan dan pengembangan pasar desa merupakan aspek penting dalam meningkatkan pendapatan masyarakat dan pendapatan asli desa, pengembangan pasar desa melalui penggunaan dana desa untuk tahun 2020 menjadi sangat penting untuk di perhatikan oleh pemerintah desa yang ada di Kabupaten Bima, salah satunya pengembangan pasar Desa Kalampa Kecamatan Woha Kabupaten Bima. Penggunaan dana yang tepat sasaran seperti pengembangan pasar desa harus menjadi program prioritas bagi pemerintah desa, meski dalam Peraturan Menteri Desa, Pembangunan Daerah Tertinggal, dan Transmigrasi Nomor 11 Tahun 2019 tentang Prioritas Penggunaan Dana Desa tahun 2020, memberikan pilihan untuk menentukan pilihan program prioritas pada masing-masing desa. Hasil penelitian ini menunjukan bahwa Desa Kalampa Kecamatan Woha Kabupaten Bima, hanya mengalokasikan anggaran untuk pengembangan pasar desa pada aspek kebersihan, atau anggaran kebersihan, sehingga sampai penelitian ini dilakukan hanya sampai pada batasan perbaikan tempat dan kebersihan pasar desa, Desa Kalampa Kecamatan Woha Kabupaten Bima. Atas pengembangan pasar desa tersebut, maka ada banyak masyarakat desa yang bisa di perdayakan dan masyarakat desa juga bisa mengurangi kemiskinan melalui perputaran ekonomi pada pasar desa terus berjalan.

Abstract

Lembaga Pemasyarakatan merupakan tempat untuk melaksanakan pembinaan bagi para narapidana dan anak didik pemasyarakatan. Serta untuk mengetahui fungsi lembaga pemasyarakatan dalam melaksanakan pembinaan terhadap warga binaan pemasyarakatan (WBP) di Lembaga Pemasyarakatan Perempuan Kelas IIA Denpasar sesuai dengan Undang-Undang Nomor 12 Tahun 1995 Pasal (7) ayat (1) yaitu pembinaan dan pembimbingan warga binaan pemasyarakatan diselenggarakan oleh menteri dan dilaksanakan oleh petugas lapas. Dalam melaksanakan fungsi pembinaan terhadap warga binaan pemasyarakatan di Lembaga Pemasyarakatan Perempuan Kelas IIA Denpasar tentu memiliki kendala yang dihadapi oleh lembaga pemasyarakatan dan petugas pemasyarakatan itu sendiri. Upaya untuk melaksanakan fungsi pembinaan terhadap warga binaan pemasyarakatan di Lembaga Pemasyarakatan Perempuan Kelas IIA Denpasar.Penelitian ini merupakan penelitian deskriptif dengan pendekatan kualitatif. Subjek penelitian ini adalah petugas pemasyarakatan. Objek penelitian ini adalah proses pembinaan yang dilakukan di Lembaga Pemasyarakatan Perempuan Kelas IIA Denpasas. Pengumpulan data dilakukan dengan metode observasi, wawancara, dan dokumentasi. Peneliti merupakan instrumen utama dalam melakukan penelitian yang dibantu oleh pedoman observasi, pedoman wawancara dan pedoman dokumentasi. Teknik yang digunakan dalam analisis data adalah display data, reduksi, dan penarikan kesimpulan. Hasil penelitian menunjukkan bahwa proses lembaga pemasyarakatan dalam pembinaan narapidana di Lembaga Pemasyarakatan Perempuan Kelas IIA Denpasar berjalan dengan efektif sesuai dengan tujuan pemasyarakatan, faktor pendukung dalam pembinaan ini adalah keinginan warga binaan untuk menjadi lebih baik dari sebelumnya dan faktor penghambat dalam pembinaan adalah saran prasana kegiatan, keadaan di dalam lapas yang over kapasitas, jumlah petugas yang masih kurang, upaya yang dilakukan dalam memaksimalkan pembinaan warga binaan pemasyarakatan di Lembaga Pemasyarakatan Perempuan Kelas IIA Denpasar berkerjasama dengan pihak lain untuk membantu fungsi pembinaan di dalam lapas berjalan dengan baik.Setelah dilakukan pembahasan dan penganalisaan, maka dapat disimpulkan bahwa Lembaga Pemasyarakatan Perempuan Kelas IIA Denpasar, sesuai dengan sistem Pemasyarakatan berdasarkan Undang-Undang Nomor 12 Tahun 1995 tentang Pemasyarakatan dan Peraturan Pemerintah Nomor 31 Tahun 1999 tentang Pembinaan dan Pembimbingan Warga Binaan Pemasyarakatan yang sudah berupaya membuat kerjasama seperti moU dengan pihak-pihak terkait sebagai contoh dengan pihak BLK IP Provinsi Bali dalam bidang menjahit, merajut kecantikan food processing, Pemerintah Daerah Kota Denpasar dalam bidang keagamaan, POLRI dalam bidang keamanan, IKIP PGRI Bali dalam pembinaan seni, budaya dan pendidikan.Yayasan Mercusuar dalam pembinaan bidang pelayanan ibu hamil dan bayi. BRI dalam pelayanan perbankan (e-money/ BRIZZI).
