Abstract

Regulation of the Minister of Education, Culture, Research, and Technology Number 30 of 2021 concerning the Prevention and Handling of Sexual Violence in Higher Education Environments raises pros and cons. The method used in this research is normative legal research. The forms of sexual violence that have become controversial in society are showing the genitals on purpose without the victim's consent; taking, recording, and/or distributing photos and/or audio and/or visual recordings of victims with sexual nuances without the victim's consent; upload a photo of the victim's body and/or personal information that is sexually nuanced without the victim's consent; disseminating information related to the victim's body and/or personal sexual nature without the victim's consent; touching, rubbing, touching, holding, hugging, kissing, and/or rubbing body parts on the victim's body without the victim's consent; and undressing the victim without the victim's consent. If there is an agreement or it is carried out on a consensual basis, then sexual acts within the university environment do not violate the Regulation of the Minister of Education, Culture, Research, and Technology Number 30 of 2021 concerning the Prevention and Handling of Sexual Violence in Higher Education. Prevention and handling of sexual violence in universities should be carried out with the principles of best interest for victims, justice and gender equality, equality of rights and accessibility for persons with disabilities, accountability, independence, prudence, consistency, and guarantee of non-repetition.Keywords: College, Sexual Violence, Regulation AbstrakPeraturan Menteri Pendidikan, Kebudayaan, Riset, dan Teknologi Nomor 30 Tahun 2021 tentang Pencegahan dan Penanganan Kekerasan Seksual di Lingkungan Perguruan Tinggi menimbulkan pro dan kontra. Metode yang digunakan dalam penelitian ini adalah penelitian hukum normatif. Bentuk-bentuk kekerasan seksual yang menjadi kontroversi di masyarakat yaitu memperlihatkan alat kelamin dengan sengaja tanpa persetujuan korban; mengambil, merekam, dan/atau mengedarkan foto dan/atau rekaman audio dan/atau visual korban yang bernuansa seksual tanpa persetujuan korban; mengunggah foto tubuh dan/atau informasi pribadi korban yang bernuansa seksual tanpa persetujuan korban; menyebarkan informasi terkait tubuh dan/atau pribadi korban yang bernuansa seksual tanpa persetujuan korban; menyentuh, mengusap, meraba, memegang, memeluk, mencium, dan/atau menggosokkan bagian tubuh pada tubuh korban tanpa persetujuan korban; serta membuka pakaian korban tanpa persetujuan korban. Apabila ada persetujuan atau dilakukan atas dasar suka sama suka, maka perbuatan seksual di lingkungan perguruan tinggi tidak melanggar Peraturan Menteri Pendidikan, Kebudayaan, Riset, dan Teknologi Nomor 30 Tahun 2021 tentang Pencegahan dan Penanganan Kekerasan Seksual di Lingkungan Perguruan Tinggi. Pencegahan dan penanganan kekerasan seksual di lingkungan perguruan tinggi seharusnya dilaksanakan dengan prinsip kepentingan terbaik bagi korban, keadilan dan kesetaraan gender, kesetaraan hak dan aksesibilitas bagi penyandang disabilitas, akuntabilitas, independen, kehati-hatian, konsisten, serta jaminan ketidakberulangan.Kata kunci: Perguruan Tinggi, Kekerasan Seksual, Peraturan

Abstract

Polygamy practice has already changed from the prophet era to the digital age. Polygamy, which was initially private, has now become public consumption. It has a sacred responsibility, but now is the lure of religious sharia, which is commercialized by certain elements. In this study, the author analyzes problems related to the mentoring polygamy campaign on social media in the discourse of gender thinking that is detrimental to women. In this study, the author uses a qualitative method with the type of literature review (library research). This approach uses various media, books, journals, articles and supporting references. The results of this study indicate that the narrative of the polygamy campaign that continues to exist until 2022 has resulted in the rise of Indonesian people to polygamy, which returns women to extreme patriarchal culture and gender-based violence. So the implicit meaning of one of the jargon on social media is "why does polygamy need permission from the wife? Is she a head of the service?" can be critically understood by the public. Polygamy is not to be abused, which oppresses women and distinguishes the class between humans and humans. However, this is an emergency solution in the realm of privacy that should not be disseminated to create family harmony, which honours women and works together in building a developed civilization.Keywords: Mentoring Polygamy; Social Media; Gender; Violence Against Women AbstrakPraktik poligami zaman Rasulullah mengalami perubahan hingga era digital ini. Poligami yang awalnya privat, kini menjadi konsumsi publik. Poligami yang memiliki tanggung jawab sakral namun sekarang menjadi iming-iming syariah agama yang dikomersialkan oleh oknum tertentu. Dalam kajian ini, penulis menganalisis permasalahan terkait kampanye poligami bermentoring di media sosial dalam wacana pemikiran gender yang merugikan perempuan. Dalam kajian ini, penulis menggunakan metode kualitatif dengan jenis kajian pustaka (library research). Pendekatan ini melalui berbagai media yaitu buku, jurnal, artikel dan referensi yang mendukung. Hasil penelitian ini menunjukkan bahwa kampanye poligami yang kian eksis hingga tahun 2022 ini mengakibatkan maraknya masyarakat Indonesia untuk berpoligami yang mengembalikan perempuan ke budaya patriarki ekstrem dan kekerasan berbasis gender. Sehingga makna implisit salah satu jargon di media social “untuk apa poligami, emang istri kepala dinas?” dapat dipahami secara kritis oleh masyarakat. Poligami sejatinya bukan untuk disalahgunakan yang faktanya menindas kaum hawa dan membedakan kelas antara manusia dengan manusia. Namun hal ini merupakan solusi darurat ranah privasi yang tidak untuk disebarluaskan agar tetap dapat menciptakan keharmonisan keluarga yang memuliakan perempuan dan bekerja sama dalam membangun peradaban negara yang berkemajuan.Kata kunci: Mentoring Poligami; Media Sosial; Gender; Kekerasan Perempuan

Abstract

Not all investment agreements are made before notary, so that agreement does not have strong enough evidence, so when one party commits default, the other party does not have sufficient evidence to prosecute the party committing the default before the law. The purpose of this study is to analyze the validity of investment agreements without a notary deed and the legal consequences of default in investment agreements without a notary deed. This research is normative legal research technique. This research used descriptive, interpretation, evaluation and argumentation technique to analyze legal material. Akad (contract) is a bond that occurs between two parties, one states ijab and the second states qabul, which then creates legal consequences, namely the emergence of rights and obligations between the two parties. This ijab and qabul show that both parties have voluntarily entered into an agreement that made must be in accordance with the Shari'a.The agreement made not before a notary is still valid, as long as it has fulfilled the legal requirements of the agreement stated in Article 1320 of the Civil Code and as long as no law that stipulates that the agreement to be made must be in writing. Legal consequences of the default, the debtor is required to pay compensation for the losses suffered by the creditor, if the engagement is reciprocal, the creditor can demand termination or cancellation of the engagement through the court, the engagement to provide something, the risk of switching to the debtor since the default, the debtor is required to fulfill the engagement if it can still be made or cancellation, accompanied by payment of compensation, and the debtor obliged to pay court fees if brought before a district court and debtor found guilty.

Abstract

Today people prefer to do online transactions on the marketplace. Online trading is the same as offline trading. But there is a different process between offline and online selling, and offline trading requires the seller and buyer to meet at the same time dan place, while the internet accesses online trading. Therefore, some consumers are disappointed when doing online transactions. For example, the goods or the orders are not sent by the seller. Moreover, for the highly nominal fraud of the consumer, that is why implementing Islamic businesses ethic is very important to practise at Tokopedia. The methodology used in this research is qualitative method data obtained by interview and observation. Investigation, observation and interviews show that implementing Islamic business ethics at Tokopedia is consistent with some of the ethical principles of Islamic business ethics. However, as a whole, it has not been in accordance with the ethical principles of the Islamic business, such as fraud, those who sell bad quality of goods or imitation products that we call KW goods. And still, others sell items that are cherished in Islam, such as alcohol, AIDS, and sex dolls.Keywords: implementation, Islam business ethics, online transaction AbstrakSaat ini, oranglebih cenderung  bertransaksi secara online . Transaksi online sama saja dengan transaksi offline. Hanya saja proses jual belinya berbeda dengan jal beli offline, jual beli offline penjual dan pembeli bertemu sedangkan jual belionline melalui melalui internet. Nyatanya beberapa konsumen kecewa dan dirugikan saat  bertransaksi secara online, misal barang yang di pesan tidak sesuai atau tidak dikirim oleh penjual, terlebih lagi bagi konsumen yang mengalami penipuan dengan nominal yang besar. Oleh karena itu sangat  penting untuk mempraktikan etika bisnis Islami saat bertransaksi di Tokopedia. Metodologi dalam skirpsi ini adalah metode kualitatif data diambil dari wawancara dan observasi.dari hasil penelitian, observasi dan wawancara menunjukkan, bahwa penerapan etika bisnis Islam di Tokopedia sesuai dengan beberapa prinsip etika Islam. Nmaun secara keseluruhan, penerapan etika bisnis Islam di Tokopedia belum sesuai spenuhnya. Sebab masih ada penjual yang melakukan penipuan, dan masih ada yang menjual produk berkualitas rendah dan produk yang diharamkan seperti produk tirun atau produk KW, minuman keras, alat bantu sex dan boneka sex.Kata kunci: Implementasi, Etika Bisnis Islam, Transaksi Jual Beli Online

Abstract

Waqf, like zakat, infaq, and alms, emphasizes collective tasks and responsibilities and promotes social security from economic progress. The productive waqf paradigm uses waqf assets and production management to create a group of entrepreneurs. UU no. 41 of 2004 encourages renewing and expanding waqf items' administration to maximize Indonesia's waqf potential. Yogyakarta's Jogokariyan Mosque's productive waqf administration affects Kampung Jogokariyan's social and economic life. Field researchers interviewed the caretakers of the Jogokariyan Mosque, Jln Jogokaryan No. 36, Mantrijeron District, Yogyakarta City, Special Region of Yogyakarta. Sharia-compliant banks like Bank Mandiri Syariah manage fruitful waqf. Ummah (public) renewal is also practiced. Mosque management learning with a modern social media-based recruitment strategy that reflects the professional nazhir waqf. This is because the mosque manager publishes financial and aspirational reports and consults with the mosque administration and Jogokariyan Yogakarta village community. UU 41 of 2004 governs waqf at the Jogokariyan Mosque.

Abstract

The Islamic community wants to properly manage waqf because of its many benefits. Waqf assets are managed, maintained, used, and distributed by an institution that regulates waqf. Empirical normative qualitative descriptive research is used. This study found that the Panji Nusantara Foundation implements cash waqf transparently, uses the tabarru' contract, conducts transactions directly and indirectly, and always thanks donors who deposit a minimum of IDR 1,000,000. The Panji Nusantara Foundation builds orphanages, tahfidz residences, and livestock companies to employ cash waqf assets. Law No. 41 of 2004, Government Regulation No. 42 of 2006, Compilation of Islamic Law Book III on Waqf Law, BWI, and MUI Fatwa state that waqf assets benefit the public. Thus, the Panji Nusantara Foundation uses cash waqf assets in conformity with Islamic law and waqf regulations.Keywords: Utilization; cash waqf; Positive Law; Islamic law AbstrakUmat Islam ingin mengelola wakaf dengan baik karena memiliki banyak manfaat. Harta wakaf dikelola, dipelihara, digunakan dan didistribusikan oleh lembaga yang mengawasi wakaf. Penelitian deskriptif kualitatif normatif empiris digunakan. Kajian menemukan bahwa Yayasan Panji Nusantara menerapkan wakaf tunai secara transparan, menggunakan akad tabarru', melakukan transaksi baik secara langsung maupun tidak langsung, dan selalu berterima kasih kepada donatur yang telah menyetor minimal Rp 1.000.000. Yayasan Panji Nusantara mendirikan panti asuhan, rumah tahfidz dan perusahaan peternakan untuk memanfaatkan aset wakaf tunai. UU No 41 Tahun 2004, PP No 42 Tahun 2006, UU Wakaf, BWI dan Buku III Kompendium Hukum Islam Fatwa MUI semuanya menyatakan bahwa harta benda wakaf bermanfaat bagi masyarakat. Oleh karena itu, Yayasan Panji Nusantara menggunakan harta benda wakaf tunai yang sesuai dengan syariat Islam dan peraturan wakaf.Kata Kunci: Pemanfaatan; Wakaf tunai; Hukum Positif; Hukum Islam

Abstract

Wakil Menteri setelah berakhir masa jabatannya diatur dalam pasal 8 Perpres No 60 Tahun 2012, tidak mendapatkan uang pesangon. Dalam perjalanannya mengalami perubahan melalui Perpres No 77 Tahun 2021 yang mengatur pemberian pesangon kepada Wakil Menteri setelah berakhir masa jabatannya. Nominal pesangon yang didapat sesuai Perpres adalah Rp 580 juta. Perpres ini lahir dilatar belakangi adanya persamaan hak antara Menteri dan Wakil Menteri. Namun yang menjadi persoalan adalah waktu dikeluarkannya Perpres. Dimana negara dan masyarakat tengah mengalami penurunan pendapatan akibat adanya pandemi Covid 19. Penelitian ini menggunakan metode studi pustaka yang bersifat deskriptif dengan menggunakan pendekatan yuridis normatif. Hasil penelitian menyatakan bahwa pemberian pesangon untuk para Wakil Menteri di masa pandemi ini tidak memiliki urgensi. Hal ini disebabkan kurang sejalan dengan nilai-nilai yang terkandung dalam Dasar Negara. Menurut Fiqh Siyasah dikaitkan dengan konsep darurat ketatanegaraan Islam, terbitnya Peraturan Presiden No 77 Tahun 2021 tidak sesuai dengan maqasid syariah memelihara agama, akal, harta, jiwa, dan keturunan/kehormatan. Abstract

The purpose of this study was to determine the process of resolving disputes through arbitration institutions for business actors. Dispute resolution through arbitration institutions is in great demand by business people, because dispute resolution through arbitration institutions has advantages over formal court institutions. The advantages of arbitration institutions include fast and simple processes, low costs, confidentiality of disputes is maintained, decisions are embracing and beneficial to the parties (win-win solution), as well as maintaining the business relationship of the parties, so that they are made choices by business actors.Keywords: Dispute Settlement, Arbitration Institution. Abstrak.Tujuan penelitian ini adalah untuk mengetahui proses penyelesaian sengketa melalui lembaga arbitrase bagi pelaku usaha.   Penyelesaian sengketa melalui lembaga arbitrase banyak diminati oleh para pelaku bisnis, sebab penyelesaian sengketa melalui lembaga arbitrase memiliki kelebihan dibanding lembaga pengadilan yang bersifat formal. Kelebihan lembaga arbitrase diantaranya yaitu proses cepat dan sederhana, biaya murah, kerahasiaan sengketa terjaga, putusan bersifat merangkul dan menguntungkan para pihak (win-win solution), serta menjaga hubungan usaha para pihak, sehingga dijadikan pilihan oleh pelaku usaha.Kata Kunci : Penyelesaian Sengketa, Lembaga Arbitrase

Abstract

In Indonesia, the last five years is very rapid development of technology until it penetrated into the field of transportation called online transportation. The existence of online transportation is hypothesized by most people as a positive part of the evolution of Industry 4.0 in the field of transportation in Indonesia. Not a few people also look negatively at this online transportation, because the existence of online transportation is considered to displace the existence of conventional transportation and the impact of income from conventional transportation is decreasing. The need for legal protection against online transportation businesses and conventional transportation must be provided by the government. This research is a normative research that examines regulations related to transportation and legal protection of online transportation businesses. Then there needs to be a role from the government to provide a legal umbrella on this online transportation.Keywords: Legal Protection; Revolution; Industry 4.0.  Abstrak.Di Indonesia, lima tahun terakhir ini sangat pesat perkembangan teknologi sampai sampai merambah ke bidang transportasi yang dinamakan transportasi online. Keberadaan transportasi online dihipotesiskan oleh sebagian besar masyarakat sebagai hal yang positif dari revolusi Industri 4.0 dalam bidang transportasi di Indonesia. Tidak sedikit masyarakat juga memandang negatif transportasi online ini, karena keberadaan transportasi online ini dianggap menggusur keberadaan transportasi konvensional dan berdampak penghasilan dari transportasi konvensional ini semakin menurun. Perlu adanya perlindungan hukum terhadap pelaku usaha transportasi online maupun transportasi konvensional harus diberikan oleh pemerintah. Penelitian ini merupakan penelitian normatif yang mengkaji peraturan terkait transportasi dan perlindungan hukum terhadap pelaku usaha transportasi online. Abstract:A nation-state that adheres to democracy is considered the best choice among the many options available, including countries with a majority Muslim population such as the Middle East. Muslim countries that used to be under the auspices of a system called the khilafah are now dividing themselves into small nations in the spirit of nationalism. Therefore, democracy is an option in the state system. The approach method used is a normative juridical approach. The type of this research is library research. In this case the researcher is dealing with texts or data that are directly usable and can be found in the library. The results of this research are in reading the present reality in the double movement asbabun nuzul macro is that the social context at the time this verse was revealed was where the people needed a sense of security and peace after the migration from Mecca to Medina. Therefore, the initial interpretation of the Prophet Muhammad about power at that time was to make a joint consensus contained in the Medina Charter, and this became the first constitution in the history of Islamic civilization as the basis for living in society, nation and state. Modern reality is essentially the same, in that the basic human need to feel safe and secure in an area of authority must continue to be fulfilled. At the same time, the shape and nature that are currently changing are not a fundamental issue because the moral ideals in the nation-state and democratic system are still dialoguing with Islamic values itself. Keywords: nation-state, democracy, double movement
