STAATSRECHT: Indonesian Constitutional Law Journal (ISSN: 2549-0915) is a national journal published by Center for the Study of Constitution and National Legislation (POSKO-LEGNAS) UIN Jakarta, INDONESIA. The focus is to provide readers with a better understanding of Constitutional Law and present developments through the publication of articles, research reports, and book reviews. STAATSRECH specializes in Constitutional Law and is intended to communicate original researches and current issues on the subject. This journal warmly welcomes contributions from scholars of related disciplines. It aims primarily to facilitate scholarly and professional discussions over current developments on legal issues in Indonesia as well as to publish innovative legal researches concerning Indonesian laws and legal system. Published exclusively in English, the Review seeks to expand the boundaries of Indonesian legal discourses to access English-speaking contributors and readers all over the world. The Review, hence, welcomes contributions from international legal scholars and professionals as well as from representatives of courts, executive authorities, and agencies of development cooperation. The Review basically contains any topics concerning constitutional law. Novelty and recency of issues, however, is a priority in publishing. The range of contents covered by the Review spans from established legal scholarships and fields of law such as privacy laws and public laws which include constitutional to various approaches to legal studies such as comparative law, law and economics, sociology of law and legal anthropology, and many others. Specialized legal studies concerning various aspects of life such as commercial and business laws, technology law, natural resources law and the like are also welcomed. Abstract

AbstractViolence against women is an act that is contrary to human rights. That is why the act of violence against women is one of the acts that violates human rights, so we need a national legal instrument regarding the elimination of violence against women in Indonesia. The purpose of this research is to find out what are the factors of women becoming victims of domestic violence, and to find out legal protection efforts for women victims of domestic violence. The analysis used in this research is descriptive which uses qualitative research types with the aim of revealing facts, circumstances, phenomena and circumstances when researching. The results of this study indicate factors that cause women to become victims of domestic violence, such as individual factors, partner factors, socio-cultural factors, and economic factors, and efforts to protect the law of women victims of domestic violence are regulated in the Criminal Code, Law Number 23 of 2004 concerning Elimination of Domestic Violence. Forms of legal protection directly through institutions such as Integrated Service Centers and Legal Aid Institutions.Keywords: Violence, Household, Legal Protection

Abstract

AbstractThe performance of village office staffs that still has many weakness related to the recruitment which was based on the family relation and not based on professionalism and also there were many public service that did not run well and smoothly. Islam rules this life based on Al-Qur’an and Hadith and it has good management in regulating the government by prioritizing the education of aqidah Islamiyah as the base of organizing the country and nurturing the noble attitude and behavior. The researcher was interested and encouraged to study and investigate the discipline of village office staffs especially at Gantar Village The aims of this research are to find out how is the discipline of village officestaffs in running their daily duties and how is the discipline implementation of village office staffs according to The Law Number 6 in 2014. This research employed analytical descriptive research by describing the discipline practice applied by the village chief of Gantar as the person in charge of the village government. The results of this research, it is found out that the work discipline expected by the government through The Law Number 6 in 2014 for each staff of village office at Gantar Village is less maximal. This was proven by the village office staff who did not obey the work hours either when it supposed to be started or when it supposed to go home, even the performance is still very poor. The control of the village chief as the executif officer at the village is not maximal yet. There are still some village office staffs that are not active for three months but still free of any reprimand letter, sanction until firing based on the suggestion from BPD (The Board of Village Representative) and The Law Number 6 in 2014. This condition is complained by most of the villagers because they need good public service. Keywords: Discipline, Village office Staffs, Islamic Law, The Law Number 6 in 2014AbstrakKinerja Aparatur ditingkat desa masih banyak terdapat kekurangan terkait dengan rekrutment yang didasari dengan orang-orang dekat bukan karena profesionalitas, dan masih banyaknya pelayanan publik yang seharusnya dilayani oleh aparatur desa belum berjalan dengan lancar. Islam mengatur tata kehidupan dengan landasan al-Quran dan Hadist, Islam mempunyai manjemen yang baik dalam mengatur pemerintahan dengan mengedepankan pendidikan aqidah Islamiyah sebagai dasar bernegara, pembinaan ahlaq dan penjelasan secara teratur. Penulis tertarik dan terdorong untuk mengkaji dan meneliti tentang Implementasi  Disiplin Aparatur Desa, khususnya yang berada di Desa Gantar, bagaimana disiplin aparatur desa dalam mejalankan tugas setiap harinya. Bagaimana  implementasi disiplin aparatur desa menurut UU No.6 Tahun 2014.  Penelitian ini mengunakan metode deskriptif analitik dengan cara menggambarkan praktek disiplin yang diterapkan oleh kepala Desa Gantar selaku penanggungjawab Pemerinatahan desa. Hasil penelitian ini diketahui bahwa disiplin kerja yang telah dicanangkan oleh pemerintah melalui UU No. 6 Tahun 2014 bagi setiap aparatur desa gantar kurang maksimal hasilnya. Hal ini terbukti masih adanya Aparat Desa yang tidak mengindahkan jam kerja baik sewaktu mulai kerja maupun jam pulang, bahkan kinerjanya masih tumpang tindih.  Kontrol kepala desa sebagai Pejabat eksekutif di desa belum maksimal. Masih terdapat beberapa aparat desa yang tidak aktif selama 3 bulan tapi belum mendapatkan surat teguran, sanksi hingga pemecatan sesuai dengan saran dari BPD (Badan Pengawas Desa) dan UU No.6 Tahun 2014. Kondisi ini dikeluhkan oleh sebagian warga yang perlu pelayanan publik.Kata kunci: Disiplin, Aparatur desa, Hukum Islam, UU No. 6 Tahun 2014

Abstract

Pedoman beracara seperti KHAES menjadi sangat urgent terutama bagi para hakim di pengadilan agama. Idealnya, memang ketika hukum materil yang berlaku (KHES) sudah bersumber dari hukum islam. Maka pedoman beracaranya pun semestinya juga ikut menyesuaikan (KHAES). Jika tidak, Fanani menilai, akan ada sejumlah hal yang tidak terjawab oleh hukum acara perdata konvensional ketika sumber hukum materil yang ada sudah mengacu kepada aspek hukum Islam. Hukum materiil dan formiil seharusnya satu nafas satu tarikan dengan mengaju pada maqashid al-syari’ah maka perlu ada hukum acara khusus ekonomi syariah (KHAES) yang selaras dengan semangat, tujuan, dan asas yang menjadi dasar hukum ekonomi syariah. Penyelesaian sengketa ekonomi atau bisnis syariah yang sudah berjalan saat ini masih merujuk pada ketentuan hukum acara perdata yang biasa dilaksanakan di lingkungan peradilan negeri.

Abstract

This study examines the governance of villages in Manggarai Regency, NTT Province. The performance of village governance is measured by the principles of good governance; transparency, accountability, responsiveness, rule of law, and participatory. The research method uses qualitative research methods with an empirical approach. Data obtained by literature studies and interviews. The study population consisted of villages in Manggarai Regency as many as 145 villages spread across 11 sub-districts (except Langke Rembong District). The results showed that village governance was classified as positive. Village officials and villagers organize village governance according to aspects of transparency, accountability, law enforcement, responsiveness and participation. However, village governance tends to be administrative.

Abstract

Abstrak. Perluasan Wewenang Mahkamah Konstitusi dalam Memutus Sengketa Kewenangan Antar Lembaga Negara Hingga Lembaga Pemerintah Tingkat Pusat dan Daerah. Pembentukan Mahkamah Konstitusi dapat dipahami dari dua sisi, yaitu dari sisi politik dan dari sisi hukum. Dari sisi politik ketatanegaraan, keberadaan Mahkamah Konstitusi diperlukan guna mengimbangi kekuasaan pembentukan undang-undang yang dimiliki Dewan Perwakilan Rakyat dan Presiden. Hal itu diperlukan agar undang-undang tidak hanya menjadi legitimasi bagi tirani mayoritas wakil rakyat di Dewan Perwakilan Rakyat dan Presiden yang dipilih langsung oleh rakyat. Mengenai lembaga negara yang yang bersengketa dan penyelesaiannya pada mahakamah konstitusi adalah lembaga yang di atur dan kewenangannya diberikan oleh Undang-Undang Dasar 1945, adapun lembaga lembaga tersebut yaitu MPR, Presiden, Dewan Pertimbangan Presiden, Kementrian Negara, Pemerintah Daerah, (Pasal 18 ayat 2), DPRD Prov, DPRD Kab/Kota, DPR, DPD, KPU, BPK, MA, KY, TNI, POLRI. dari tujuh belas lembaga Negara, namun yang dapat menjadi pihak dalam Mahkamah Konstitusi hanya lima belas karena Mahkamah Agung dan Mahkamah Konstitusi yang merupakan pengecualian yang disebutkan diatas. Abstract

Abstrak Pemerintah berperan melakukan pemanfaatan dan penggunaan tenaga kerja asing untuk pengembangan tenaga kerja lokal dengan mekanisme transfer knowledge dan transfer technology. Selain pemerintah juga menjadikan tenaga kerja asing sebagai salah satu subjek PNBP (Penerimaan Negara Bukan Pajak) untuk pemasukan kas negara. Dengan melihat besarnya potensi tenaga kerja asing di Indonesia, maka pemerintah mengakomodir dengan menghadirkan undang-undang Nomor 13 Tahun 2003 tentang Ketenagakerjaan, Peraturan Presiden Nomor 20 Tahun 2018 tentang Penggunaan Tenaga Kerja Asing, Peraturan menteri ketenagakerjaan Nomor 10 Tahun 2018 tentang Tenaga Kerja Asing, dan Keputusan Menteri Nomor 40 Tahun 2012 tentang Jabatan-Jabatan Tertentu yang Tidak Boleh Diduduki Tenaga Kerja Asing. Penelitian ini menggunakan jenis penelitian yuridis normatif dan perpustakaan dengan melakukan penilaian terhadap undang-undang dan peraturan, buku, jurnal, dan sumber-sumber dari internet terkait. Hasil penelitian menunjukkan bahwa terdapat problematika dalam pengadaan tenaga kerja asing seperti tidak sesuainya jabatan yang dibatasi oleh peraturan perundang-undangan, masa kerja yang melebihi batas kontrak, dan kurang jelasnya penyusunan hingga pengesahan RPTKA, sehingga mengakibatkan diskriminasi terhadap tenaga kerja lokal. Maka berdasarkan penelitian ini dapat disimpulkan bahwa dengan tidak adanya lembaga pengawasan tenaga kerja asing yang jelas, maka akan berimplikasi pada terderogasinya hak-hak warga lokal dalam memperoleh pekerjaan sesuai maklumat UUD NRI 1945.Kata kunci: Bela Negara, Pengawasan Tenaga Kerja Asing, Kontrak Sosial

Abstract

AbstractGaps between regions and underdevelopment of an area are still issues that must be addressed. Thus, the objectives of social welfare and fulfillment of the constitutional rights of Indonesian citizens can be realized. Because, realizing social welfare is one of the goals of the State of the Republic of Indonesia which is stated in the opening of the 1945 Constitution of the Republic of Indonesia.Indonesia is still experiencing social inequality, as evidenced by the fact that there are still a number of regions in the Unitary State of the Republic of Indonesia that are left behind, outermost, and frontier which are considered to have lower development and welfare indexes than other regions in general. To overcome this problem, the Government in the National Medium Term Development Plan (RPJMN) for the 2015-2019 period prioritizes acceleration of infrastructure development in order to realize equitable national social welfare and development.In its implementation, this plan does look very effective because of real results. However, if seen further, it turns out that it is still far from effective, because it is sad in various regions to be the government's top priority such as in Eastern Indonesia (KTI). Therefore, the accelerated development policy must pay more attention to the economic aspects of society, human resources, facilities and infrastructure, regional financial capacity, accessibility and regional characteristics in order to run effectively.Keywords: Acceleration of Infrastructure Development, Constitutional Rights, Social Welfare Abstrak Kesenjangan antar wilayah dan ketertinggalan suatu daerah masih menjadi isu yang harus diatasi. Sehingga tujuan kesejahteraan sosial dan pemenuhan hak konstitusional warga negara Indonesia dapat terwujud. Karena, mewujudkan kesejahteraan sosial merupakan salah satu tujuan Negarta Republik Indonesia yang tercantum dalam pembukaan Undang-Undang Dasar Negara Republik Indonesia Tahun 1945. Indonesia masih mengalami kesenjangan sosial, terbukti dengan masih terdapat beberapa wilayah di Negara Kesatuan Republik Indonesia yang tergolong sebagai daerah tertinggal, terluar, dan terdepan yang dianggap mempunyai indeks pembangunan dan kesejahteraan lebih rendah dibandingkan dengan daerah lain pada umumnya. Untuk mengatasi permasalahan tersebut, Pemerintah pada Rencana Pembangunan Jangka Menengah Nasional (RPJMN) Periode 2015-2019 memprioritaskan akselerasi pembangunan infrastruktur dalam rangka mewujudkan kesejahteraan sosial dan pembangunan nasional yang merata. Dalam pelaksanaannya, rencana ini memang terlihat sangat efektif karena hasil yang real. Namun, jika dilihat lebih jauh ternyata masih jauh dari kata efektif, karena mirisnya di berbagai wilayah yang menjadi prioritas utama pemerintah seperti di Kawasan Timur Indonesia (KTI). Oleh karena itu, maka kebijakan akselerasi pembangunan harus lebih memperhatikan aspek-aspek perekonomian masyarakat, sumber daya manusia, sarana dan prasarana, kemampuan keuangan daerah, aksesbilitas dan karakteristik daerah agar dapat berjalan secara efektif.Kata kunci : Akselerasi Pembangunan Infrastruktur, Hak Konstitusional, Kesejahteraan Sosial

Abstract

Implementation of the state in practice, sometimes experiencing abnormalities (emergency). The legal system, which is generally used, is often unable to accommodate the interests of the state or society, so a separate arrangement is needed to move the functions of the state to run effectively. This paper discusses the constitutional emergency law in Indonesia according to statutory regulations and state of emergency constitutional principles fiqhiyah perspective. This research uses a qualitative method with a conceptual approach. The data in this study came from the 1945 Constitution of the Republic of Indonesia, Perppu No. 23 of 1959 and Law No. 24 of 2007 and the Fiqhiyah Rule. The results of the study stated that the policy in the state administration of Islam must be eliminated emergency conditions, both those that come from the internal state and external. The state of state emergency in Indonesia is regulated in such a way as to protect all its citizens in order to realize the ideals of the proclamation.

Abstrak. Persetujuan Dewan Perwakilan Rakyat Dalam Pengangkatan Kepala Kepolisian Republik Indonesia Perspektif Undang-Undang Nomor 2 Tahun 2002  Tentang kepolisian. Fenomena yang terjadi di masyarakat yaitu dewan perwakilan rakyat ikut serta dalam menentukan Kepala Kepolisian Republik Indonesia bersama presiden padahal sistem pemerintahan kita menganut sistem presidensil kewenangan pengangkatan Kepala Kepolisian Republik Indonesia harusnya utuh berada ditangan presiden karena presiden memiliki hak prerogratif dalam pengangkatan Kepala Kepolisian Republik Indonesia. Peran Dewan Perwakilan Rakyat dalam hal pengangkatan Kepala Kepolisian Republik Indonesia yakni, pergeseran kekuasaan presiden sebagai kepala Negara dan kepala pemerintahan dalam sistem presidensil, Presiden bukanlah pemegang otoritas tunggal dalam memilih Kepala Kepolisian Republik Indonesia, dan. Abstract

Abstract:The Constitutional Court in its position as guardian of the constitution has the authority to examine laws against the Constitution. The position of the Constitutional Court is only limited to negative legislature. However, in its implementation many Constitutional Court decisions sometimes make positive legislature decisions. This has become a debate among observers of state administration law. This research method uses a normative juridical legal research approach, while the type of research used is descriptive qualitative analytical, and data collection techniques are library research. From this research it is known that the constitutional court has raised new norms in judicial review.Keywords: New Norms, Laws, Constitutional Court
