Abstract

Abu Hanifah (80H-150H) is one of the figures who made valuable contributions to the development of Islamic law. His legal thought more advanced aspects of rationality that is affected by geographic and demographic environment of Iraq. Many progressive thinking and different from other scholars, both on methodological aspects and results of ijtihad.Al-Fiqh al-Akbar (big fiqh) is the only monograph work of Imam Abu Hanifah who was instrumental in developing the school of fiqh he built. Therefore, reviewing Abu Hanifah's fiqh paradigm cannot be separated from the discourse contained in it. Unlike fiqh works in general which contain comprehensive legal dictums, al-fiqh al-Akbar actually elaborates a lot on the science of monotheism. For Abu Hanifah, the idea of ​​kalam is very important to embody the principles of faith contained in the Qur'an. While the law is nothing but the relation of the science of kalam which is directly in touch with the deeds of the mukallaf. Human actions are judged to have kasbi nature so that they have room to adjust to the Qur'an and Hadith. It is this perspective of the Qur'an and the deeds of the mukallaf that later colors every phrase in the work of al-Fiqh al-Akbar. This study discusses the book of Fiqh al-Akbar by Imam Abu Hanifah using the library research method, in analyzing the data this method uses a descriptive analysis model. As a source of information, namely; scientific books, research reports, scientific articles and journals. From the results of this study, it can be explained that the work of Imam Abu Hanifah has made a major contribution to Islamic scholarship today with the existence of al-Fiqh al-Akbar which reviews the science of kalam.

Abstract

The discussion of jihad is a very extrem theme. Wise people must be careful discuss it. The word jihad if expressed by someone in a speech can be dangerous because with that word can be people’s blood who should be respected, instead it flows. Some teachers of salaf islamic boarding school in Tegal Regency always be careful in discuss the concept of jihad. Their strategy is create a curriculum that is not to detailed. They not necessarily give a discussion of jihad to their students. The power of intellectual, spiritual and student mentality get the teacher’s attention in giving a discussion of jihad to theirs student. The intellectual power, spirituality and mentality of the santri are the concern of the teacher in giving discussion of jihad to his students. This research aims to deeply analyze the pattern of teaching carried out by salaf islamic boarding school teachers in Tegal Regency on the meaning of jihad. This type of research is field research and using a qualitative approach. The sources of this research is Nurul Huda Al-Mu’awanah Islamic Boarding School Danawarih Balapulang Tegal Regency. Methode of data collection is documentation, observation and interviews. The analysis used is descriptive field analysis. The result of this reserach is discussion of the meaning of jihad has new discourse that implemented throught the curriculum of salaf islamic boarding schools ini Tegal Regency, that is in the form of intellectual and spiritual cultivation as study, full respect for pancasila, red and white flag and traditional customs as well as doing self defense training, karate and pagar nusa.

Abstract

This research descreption are based on the rampant the phenomena of the use of gadgets in their business over the daily activity by all groups within the community without looking at the age limits of and the sexes, in practice these marketing almost all users of gadgets a small number of participants oblivious of dangers of the total value of negative a result of the use gadgets that is exaggerated. This research descreption how efforts to optimize the role of gadgets in daily life especially for education that was held in SMP Islam Pecangaan Jepara. This study attempts to get understanding whole about optimizing this role of the gadgets as a medium learning on the subjects of Tahfidz, empirical were based on the data to be implemented in the field show that 80 percent other students SMP Islam Pecangaan Jepara is using gadgets, methods used in the study analysis by approach deskreptif analytic outlined based on the findings in the field. From the results of research deskrepsi it can be concluded that the optimization of the role gadgets, as the media on the subjects Tahfidz striking result. it is an will have very significant in supporting the success of learning.

Abstract

It is difficult to find a study of ethical philosophy issues in the history of Islamic civilization. The reason is because it was not written separately by Muslim thinkers. It is discussed in tandem with or mixed with other reviews, such as mixed with reviews of metaphysics, psychology, and so on. This paper attempts to reconstruct the philosophy of ethics in Suhrawardi al-Maqtul's thought through the metaphysical theory that he offers. This is qualitative research that is categorized in the type of library research. The field of research is Suhrawardi's work in the form of text, therefore the method used is hermeneutics. More precisely, the hermeneutics used are the hermeneutics of intentionalism and the hermeneutics of Paul Ricoeur. This research shows that Suhrawardi has provided a well-established ontological view for developing ethical concepts. Suhrawardi symbolically identifies good with light (al-nūr) and bad with darkness (ẓulm). Become a perfect human being when the soul is able to let go of the elements of darkness and merge with the light of goodness. The ethical concept offered by Suhrawardi tends to be mystical-rationalist like his big ideas that accommodate Sufism that is harmonized with philosophy.

Abstract

IMBT is a form of multi-contract product. At the beginning of the contract agreement used by both parties is an ijarah agreement so that there is a transfer of the right to use the benefits from the lessor (Mu'jir/muajir) to the lessee (Musta'jir) accompanied by the transfer of property rights from mu'jir to muajir on the basis of promise. The ijrah contract with ownership at the end is a contract that has been recognized by the Indonesian Ulema Council through the DSN. In Islamic banking, the application of ijarah and IMBT products, the bank works as an investor/provider of funds and promises. This paper aims to find out how IMBT is in Islamic Banking. This study uses a type of library research (library research). Data collection techniques were carried out by means of documentation studies and triangulation. The data analysis technique was carried out by content analysis using a qualitative study with a conceptual realm. The results of the study show that if there is a dispute between the parties, the settlement guideline is an "Unnamed" agreement whose form and submission is based on the agreement of the parties based on article 1338 (1) of the Civil Code; All agreements legally made apply as law to those made.

Abstract

Purpose the research is With the research title The Implementation of Disk Murattal Learning Media in Improving Learning Understanding of Al Quran Hadith in Class VII MTs Students. Private TarbiyahWaladiyahPulauBanyak. The problems found in the research location were: 1). The learning and teaching process in madrassas, teachers in the field of study of Al-qur'an hadith have not involved students directly with the digital Al-qur'an application from the subject matter of the Al-qur'an hadith study area taught so that students have not been trained in solving various field problems study of Al-qur'an hadith. 2). The unavailability of media that supports learning and teaching activities of Al-quran Hadith in madrasas. The focus of this research is that the researcher focuses on the application of Disk Murattal Media and the efforts made by the teacher in the Al-quran Hadith study field to improve students' reasoning abilities. 1). The influence of digital Al-quran-based Disk Murattal Media on students' reasoning abilities in the concept of understanding and memorizing Al-quran verses by students of the TarbiyahWaladiyah Island Many Private Tsanawiyah Madrasah is significant, namely the application of the model helps students to better understand the subject matter. 2). Improved reasoning skills of students on indicators of creative thinking, flexible thinking, original thinking, and detailed thinking after the application of Disk Murattal Media to students of TarbiyahWaladiyah Island Banyak Madrasah Tsanawiyah. 3). Abstract

Having a passion for learning is an important role in education, apart from being an encouragement for students to achieve optimal understanding, learning motivation also plays a role as a determinant of learning outcomes and student achievement. Therefore, a measuring tool is needed in the form of a learning motivation questionnaire, this will be done in testing the validity and reliability of the Al-Quran Hadith subjects. This study aims to describe the methods and steps of testing the validity of the questionnaire instrument, the reliability correlation test coefficient and the reliability test. The method used is a qualitative approach, by collecting data, calculating and analyzing data. The results of this study (1) find out how to measure reliability with internal consistency, the split half method, using the moment product formula Spearman Brown (2) find the level of validity of the questionnaire instrument which is declared good, namely 0.682, showing the coefficient of reliability correlation exceeds the product moment value of 0.725 and the reliability test was stated to be reliable with a high level of 0.841 (3) that the evaluation instrument, scoring administration instrument and answers from students were factors that influenced validity.

Abstract

Talking about human beings means talking about the complexities within the human being. Alexis Carrel says that man is a mysterious creature because the degree of human separation from him is inversely proportional to his close attention to the world outside him. This opinion shows how difficult it is to understand human beings thoroughly. So that every time one finishes understanding from one aspect of human beings, then there is also another aspect. This article presents a discussion about human nature according to the text of the Quran, the dimension of Islamic personality. Gandhi states that Westerners have succeeded in achieving outstanding achievements for others (non-Western), but he thinks Western humans are incapable of reflecting on themselves, and this is enough to reveal the glaring failures of modern Western civilization.

Abstract

The presence of Islam which is proven to be able to acculturate with customs and culture in Indonesia has brought a shift in people's behavior. Changes in people's behavior are not instantaneous, but shift along with the rhythm of the movement of civilization progress. The same applies to inheritance issues in Indonesia. Although the majority of Muslims have followed religious guidance in its implementation, the reality on the ground is that community groups still use customary rules. As done by the indigenous people of Lampung Pepadun in the South Menggala Village, Menggala District, Tulang Bawang Regency, they still maintain the distribution of inheritance with the Patrilineal system or what the community calls the single heir system, namely the male mayorat. This research is a field research with a case study approach. Data analysis was carried out by means of data reduction, data presentation, conclusion drawing and verification. The purpose of this study is to find out the Patrilineal system carried out by the indigenous people of Lampung Pepadun in the review of Maqâshid Al-Syarî'ah and al-'Urf. The results showed that the inheritance distribution system which was carried out based on the customs of the Lampung Pepadun community by applying the Patrilineal inheritance system, contained the al-'Urf aspect. From the perspective of Maqâshid Al-Syarî'ah, the value of benefit in implementing an inheritance distribution system based on the customs of the Lampung Pepadun community in South Menggala Village, Menggala District, Tulang Bawang Regency is not fully in accordance with Maqâshid Al-Syarî'ah, which is only able to maintain religion and maintain property. Meanwhile, for the rest, namely maintaining the soul, maintaining the mind and maintaining offspring for girls or boys other than the sole heir, it still depends on the awareness of the sole heir regarding his responsibilities as a substitute for parents.

Abstract

Applications for marriage dispensation at the Batang Religious Court (PA) are increasing, especially after the revision of the Marriage Law (Law Number 16 of 2019) which limits the minimum age for marriage to 19 years. The trial of marriage dispensation cases also changed with the existence of PERMA Number 05 of 2019 concerning Guidelines for Submitting Applications for Marriage Dispensations with a single judge. The aims of this research are examine the implementation of the marriage dispensation examination with single judge and it’s benefits in PA Batang. This research is a legal research with an empirical juridical approach, primary data in the form of information from the chairman and judges in PA Batang, data collection using semi-structured interviews, observations of marriage dispensations in PA Batang, and documentation of marriage dispensation decisions. This study resulted (1) the examination of the marriage dispensation case by single judge at PA Batang was in accordance with PERMA Number 05 of 2019, but did not involve TKSK as a child assistance institution because the community has difficulty in presenting TKSK and the still unfamiliar with the procedures for examining marriage dispensations. Alternatively, PA Batang brings village officials to testify in the case, (2) The benefits of examining a marriage dispensation case by a single judge in Batang PA are, the trial process can be completed quickly, the granting of a marriage dispensation permit can prevent violations of applicable norms, and as an effort to realize the benefit of maintaining religion, soul, mind, lineage or descendants.
