Abstract

Adjustment of statutory regulations in the field of tourism business law in Indonesia is one of the consequences of the WTO agreement, thus the GATS-WTO agreement does not only concern Law Number 10 of 2009 concerning Tourism, but also all other related regulations. with tourism, such as labor regulations, Intellectual Property regulated in TRIP's, investment regulations (TRIM's), etc. These regulations will be affected by the provisions of the GATS-WTO, which must immediately be adjusted and harmonized with the GATS agreement commitment that has been agreed by Indonesia. It is by putting the principles of liberalization that it can have an impact on tourism arrangements in Indonesia which are not liberal but adhere to the principles of the Pancasila democracy state. The impact of the WTO on Indonesia's tourism business law arrangements related to TRIMS and GATS is the creation of tourism regulations that can protect local communities and cultures, limiting the liberalization of foreign investors from modern countries. The tourism arrangement must be in accordance with the nature of the purpose of its existence, namely to: increase economic growth; improve people's welfare; eradicating poverty; overcoming unemployment; preserving nature, environment and resources; promote culture; lifting the image of the nation; cultivate a love of the country; strengthen national identity and unity; and strengthen friendship between nations.

Abstract

Development in the tourism sector requires enormous funds, sourced from government, private, public and foreign investors funds. Indonesia as a developing country often experiences funding difficulties in the implementation of development due to limited funding sources. The government needs to formulate policies in the form of legislation as well as reform of the bureaucracy so that it is able to provide optimal public services and attract foreign investment in order to accelerate the implementation of development in the context of realizing national goals, namely the welfare of the community. In general, the regulations regarding investment including foreign investment have been regulated in Law Number 25 of 2007 concerning investment, Presidential Regulation Number 27 of 2009 concerning One Stop Integrated Services and Regulation of the Head of the Investment Coordinating Board Number 14 of 2015 concerning Procedures and Principles. Investment and Law Number 23 of 2014 concerning Regional Government. Tourism development in Bali is very fast with the construction of various types of tourism facilities, and in the future, to avoid burnout, it is necessary to develop alternative tourism such as Tourism Village. The stipulation of the Bali Provincial Regulation Number 4 of 2019 concerning Traditional Villages confirms that Traditional Villages can manage tourism villages. The involvement of foreign investment in developing tourism based on traditional villages is very possible, so the Regional Government needs to work together with Regency / City Governments and Traditional Villages based on their position and authority can stipulate regulations to ensure legal certainty for investors and the public by continuing to be based on the principles of good governance.

Abstract

The development of tourism on the island of Bali which is the largest foreign exchange contributor for Indonesia has not been able to provide significant economic benefits for the Balinese people. This can be seen from the increasing number of poor people in Bali covering urban and rural areas from 2012 to 2020, before the tourism sector experienced a significant decline due to the CORONA Virus pandemic. Based on these conditions, it is necessary to develop tourism which prioritizes improving the economy of the local Balinese community by involving local communities directly in tourism development. One of them is by developing traditional markets as a tourist attraction. The reason is because traditional markets are places for buying and selling transactions from all levels of society in Bali. In addition, the development of traditional markets into tourist attractions is expected to be able to compete with the increasing number of modern markets in Bali. The research location chosen is Kumbasari Market which is located in the city of Denpasar. Kumbasari is one of the biggest traditional markets in Bali and currently in the process of renovation. Before the pandemic Covid-19 spread in Bali, Kumbasari was open for 24 hours and became a place to earn a living for hundreds of people of Bali. This development strategy using SWOT analysis (Strengths, Weaknesses, Opportunities, Threats). Internal and external factors before renovation analyzed to find various conditions whether it be shortcomings / weaknesses, threats, opportunities and strengths. This can be considered in efforts to improve the quality of the market, so it could be a place worth a visit for both local and foreign tourist so as to provide the maximum benefit for the economic improvement of the people of Bali.
