Abstract

Criminality is one of the most andocentric acts (centered on men) based on public view. This perspective binds women to appropriate behaviors for women that are the atributes and behaviors that keep them from violating laws and crimes. Qualitative phenomenology was used in this research where the data taken from interview and observation which involved 5 women prisoners. Hence, when a woman is involved in a crime she will be considered very bad and labeled in ways that are negative and stereotypical. In the analysis of feminist criminology theories criticize that men are actually commit more crimes than women. Unfortunately, the women fall in a crime are caused by various factors. One among factor is the unfair treatment on women. Even in criminal acts women often get layered violence. They are not only judged as perpetrators but also become the victims. The punishment they received were not only in prison but also entail them after leaving the prison. The rejection and negative responses are also delivered from the environment reinforce the negative stigma about themselves. Stigma as criminals, unbelievers, and labeling as prisoners make it is difficult for them to adapt, find work, and become antisocial. The stigma develops along with the process of understanding (interpretation), the definition of criminals, and the differentiation of treatment that society gives to them (discrimination). The negative self-acceptance and self-acceptance became one of the triggers that pushed former female prisoners to repeat their criminal acts (recidivists).

Abstract

In Minangkabau community, ulayat land known as heritage is a land dominated by ninik mamak and ownership by women, actually  ulayat always dominated by ninik mamak. This study aims to describe the challenge  in the women's struggle against ulayat land by men in the Gunung Sarik Distrik, Padang. The qualitatif methode was done by using in-depth interview and focus group discussion with informant taken by purposive sampling. Women who are members of Gunung Sarik Saiyo Cooperative meet the obstacles in the struggle that is the first, the social system that is not supported. Second, get challenges from other people in community. Thirdly, the streotype of society is not good for women who often do activities outside the home in Gunung Sarik Village.

Adat Minangkabau has the values of equality and gender justice. Men and women based on the status and function are given rights, obligations and responsibilities in proportion. Fairness and equality of cover sako and pusako heritage, as well as participation in decision making. Women as Bundo Kanduang has domestik and public roles. Abstract

Benchmarks for ideality for the body that prioritize aspects of physical appearance as well as social demands of the Sasak people who determine women should be able to nyesek or make sesek cloth as a source of value and meaning to the body. This article aims to examine the centrality of the body to explain how the discourse of nyesek is used as a benchmark of female maturity and as a standardization of the ideal wife in the Sasak tribe. This research tries to identify various traditional discourses in the Sasak tribe and study how these discourses function to discipline women. This study also tries to see the views of Sasak women, both the older generation and the younger generation, about the concept of nyesek. This research applies a qualitative descriptive approach. Data obtained through interviews with Sasak women in the range (18-80s). Since most sesek weavers are elderly who can only use the Sasak language, interpreting it into Indonesian requires an interview with a young Sasak tribe. This research seeks to show that the ability of nyesek to be learned by Sasak women not only serves to preserve tradition, but also to encourage women to have an economic role in the family. That is because most of the respondents interviewed were farmers' wives, nyesek was considered as an additional family income, even though its contribution was still small. This research is important because there are still many Sasak women who are not aware of the existence of body control through the discourse contained in the nyesek tradition.

The article describes the forms of labels provided by the public in the city of Padang as part of Minangkabau culture, particularly aimed at women who pass social deviation in behavior related to the community. Abstract

Religion, in the past time, was flourished by servitude system. Therefore, there are more words in religious literature related to slavery issues. The words also implicitly indicated the superiority of man position to women in some degrees. In Jahiliyah time, there were customs and bad habits that related to woman. Woman felt more inferior to men in the freedom of status context. Accordingly, Al-Qur’an presented to escalate the social status of women and against the negative tradition and customs that had been prevalent. This article tries to analyze hadits perspective on regarding woman in public space.

Abstract

There are not a few Muslims who make the story of Adam and Eve as an argument to consider women as a source of triggering sin.This study aims to find out the Qur'anic view of the story of the expulsion of Adam and Eve from heaven, expressing the comprehensive view of the Qur'an about the chronology of the exorcism of Adam and Eve and outlining the causes of the expulsion of Adam and Eve from Heaven. This study uses thematic method with Q.S.  An-Nisa  (4): 1 and al-A'raf (7): 22 as  sources of data. Linguistic analysis was used to analyze the data. The results of the study showed that the emergence of this assumption is motivated by several reasons. Among the reasons is the history of Israiliyyat made by the classical interpreters as the primary source in interpreting the verses about Adam and Eve, which began at the end of the first century of Hhijriyah. The Israiliyyat narrations which speak of the story of Adam and Eve in general provide information which tends to make Eve a degrading party as well as a source of sin. This understanding ultimately affects the lowering of women's position over men in real life. In fact, if we examine directly the linguistic structure of the text of the verses in the Qur'an and read it holistically, and linked with the maqashid of equality of human creation, we will find that the Qur'an always makes Eve in an equal position with Adam.

Abstract

This article would like to elucidate the history and the difference betwen the movement  of feminism in west and Islam and the status of woman in Islam. According to western perspective feminism is a history of struggles for women’s rights and freedoms  and emphasizes that religion is one of the chief enemies of its progress. Unfortunately, many of the goals of western feminism are not necessarily relevant across cultural boundaries. On other hand, Islam gives a special rights, freedoms and place to women. Abstract

This paper describes some efforts to build gender equality in Islamic law against domestic violence. Family is the smallest institution in society as a mirror of a nation. Nevertheless, family problems continue to occur, including domestic violence. Domestic violence is a classic problem in a family resulting in caring for family functions to realize harmonious family. Based on the data collected, the number of women victims of domestic violence is still high, due to gender relations with patriarchal culture.  This situation is legitimized by the sacred text which is still considered gender bias, such as in Islamic family law. Therefore, Islamic family law reform is obviously needed by discussing the concept of sakīnah (harmonious) family with gender equality through formal legal approach, legal culture, uṣūl fiqh (philosophy of Islamic law), and al-maqāṣid al- syarī'ah (the purposes of Islamic Law) and universal Islamic values as raḥmah li al-‘ālamīn (blessing for the universe) to establish harmonious family.

Abstract

Women are the subject of endless, it is often said that Islam is very discriminatory against women but even if it compared with other religions, both divine religions such as Jewish and Christian; categorized as a religion or religions like Hindu religion Ardhi, will be found that real respect for women it is the religion of Islam. Similarly, if the comparison is made with the religion of nations before the coming of Islam it will be obvious that the symbolic gesture of respect for women, It is also recognized by people outside of Islam.
