Abstract

The writing of this scientific paper discusses the legal protection of TraditionalRetail Business Actors Against the Development of Modern Ritek in Padang City. Thebackground of this scientific work is the number of modern retail minimarkets as well asshopping centers that stand in line with the development of the city of Padang, withoutaccompanied by a clear regulation in accordance with what has been mandated by thelegislation in force. What causes traditional retailers to gain competition and theconversion of traditional retail customers to modern retailers. The aim of this scientificwork is to find out about the protection of legal protection for traditional retailers againstthe development of modern retail in the city of Padang. This scientific work usingdescriptive analysis methods that can be drawn conclusions are: Presidential RegulationNo. 112 of 2007 concerning the Arrangement and Guidance of Traditional Markets,Shopping Centers and Modern Shops and Regulation of the Minister of Trade No. 70 / MDAG / PER / 12/2013 concerning Structuring Guidelines Traditional Markets, ShoppingCenters and Modern Stores have provided legal protection to traditional retailers,mandating regional orders to refer to regional regulations on zoning in the establishmentof modern retail and traditional markets. But in fact the city government of Padang doesnot have regulations regarding the zoning.

Abstract

One of the objectives of the enactment of Law Number 23 Year 2004 on the Elimination ofDomestic Violence (PKDRT) is to maintain the integrity of harmonious and prosperoushouseholds. The police have the authority to enforce the law and ensure the security andorder of the people. The task can not be done only to rely on the legislation, therefore thepolice are given the authority to do the discretion of the police. In the writing of this thesisthe author discusses about the analysis of police discretion conducted by policeinvestigators in Polresta Padang in order to investigate the crime of violence in thehousehold . Related to this the type of research specification used is descriptive analytical.Based on the result of research that discretion act by the investigator in the settlement ofCriminal Act of Domestic Violence in Padang Polresta law area consist of: mediationeffort which initiated and done by Polri, termination of case and case waiver of case ofkekerasn in that household. There are two factors that can drive the discretion action are:internal factors and external factors. This internal factor is based on the legal basisapplicable to the exercise of discretionary authority by the police as well as the ordersfrom superiors to settle criminal cases which can be resolved through the ADR mechanismand for external factors namely the support of the community, and the goodwill of the thelitigant to solve his case in the best possible way. The obstacles faced in theimplementation of police discretion in the investigation of Domestic Violence Crime byPPA Unit Sat Reskrim Poresta Padang is the absence of a rule of law that specifically andfirmly regulate the police discretion itself applicable in the legal system in Indonesia atthis time, so that in the existing rules currently requires investigators to follow up onincoming cases. In other words investigators are required to process all incoming cases inaccordance with applicable legal procedures.

Abstract

Eksistensi Bidang Infrastruktur Pertanahan pada Kanwil BPN Sumbar dalam pelaksanaan kegiatan percepatan Pendaftaran Tanah Sistematis Lengkap (PTSL) adalah sebagai surveyor yang memonitoring, memberikan arahan dan pembinaan bagi Seksi Infrastruktur Pertanahan di Kantor Pertanahan. Pentingnya keberadaan surveyor untuk memonitoring, memberikan arahan dan pembinaan agar program PTSL dapat terlaksana dengan baik sesuai dengan target yang telah diberikan.Serta peningkatan kapasitas, kapabilitas dan profesionalitas Seksi Infrastruktur Pertanahan. Dalam pelaksanaan PTSL, Bidang Infrastruktur Pertanahan pada Kanwil BPN Sumbar berwenang untuk memonitoring, memberikan arahan dan pembinaan pada kegiatan perencanaan, penetapan lokasi, kepanitiaan, penyuluhan, pengumpulan data fisik, pengkartiran dan pemetaan, veritikasi hasil pekerjaan, pencetakan peta bidang tanah, revisi PBT, pencetakan surat ukur dan penyerahan output kegiatan. Kendala yang dihadapi oleh Bidang Infrastruktur pada Kanwil BPN Sumbar adalah kekurangan tenaga ukur, status tanah kaum, tradisi merantau, banyaknya tanah kaum yang tergadai serta beban biaya uang adat. Untuk mengatasi kendala tersebut Kanwil telah bekerjasama dengan BLK Padang, melakukan penugasan khusus petugas yuridis, dan melakukan FGD dengan Pemko Solok.

Abstract

PBB-P2 is a tax whose delegated authority is transferred to the Regency / City Government. Kerinci Regency Government began applying the Land and Rural Land and Urban Tax collection from January 1, 2014. This research was conducted to find out how the implementation of tax collection of earth and rural and urban buildings in Detailed District and to find out how its contribution to the original revenue area in Kerinci regency. This research uses primary data in the form of interview result as main data, and secondary data as supporter. Based on the result of this research, it is found that the taxation of earth and rural and urban building in Kerinci Regency has not run optimally, because the officer has not consistently run the regulation, so that its contribution to the local revenue is not optimal only about 1.23% in 2014 and 1.19 % By 2015.

Abstract

Basically, consumers need law care universally. The care to consumers materially and formally is very important, because the progress of science and technology become rule on productivity and efficiency of producing on goods and service produced in reaching the purposes of effort.The problem in this study are: First, how is the care of consumers to products of food by agents of small and middle effort (UMKM) who unlabelled food based on BPOM in Bukittinggi City? Second, how is the responsibility of UMKM who unlabelled food based on BPOM to consumers in Bukittinggi City?The specification of this research is descriptive analytic. The method uses in this research is the normative and juridical empiric method. The techniques of collecting data uses are field study by interviewing for the primary data and library study for the secondary data. Then, the data analyzed qualitatively in descriptive analysis form.From the research results obtained several conclusions: First, the care of consumers to products of food by agents of small and middle effort (UMKM) who unlabelled food based on BPOM in Bukittinggi City can be done with many instruments, such as civil law instruments, criminal law instruments and also administration instruments. Second, the responsibility of UMKM who unlabelled food based on BPOM to consumers in Bukittinggi City is ready to be given sanction on the contrary done. The contrary by the agents of effort on the determination of label can be given responsibly or sanction civilly, criminal sanction, and administration sanction. The sanction of civil and criminal sometimes ineffectively withoutadministration sanctions.

Abstract

Based on humanitarian considerations and human rights enforcement, the Indonesian government through the Ministry of Law and Human Rights of the Republic of Indonesia has issued a policy to protect children in prisons during the Covid-19 pandemic. This policy is not far from the pros and cons of various circles. On the one hand, the policy is welcomed to reduce the spread of Covid-19, on the other hand, the policy is considered to disturb public security. Therefore, the policies of the Ministry of Law and Human Rights, especially those related to child protection during the Covid-19 pandemic, are important to be further reviewed in this article. This research is normative legal research / doctrinal research. The approach used in this research is the statutory approach (statute approach), analytical approach (analytical approach), conceptual approach (conceptual approach), and the case approach (case approach). The increasingly massive spread of Covid-19 poses its challenges in protecting children as a vulnerable group. Responding to this condition, the central government issued several policies to protect children during a pandemic. These policies include Regulation of the Minister of Law and Human Rights of the Republic of Indonesia Number 10 of 2020 concerning Terms of Providing Assimilation and Integration Rights for Prisoners and Children in the Context of Preventing and Combating the Spread of Covid-19, as well as Decree of the Ministry of Law and Human Rights Number M.HH-19. .PK / 01.04.04 concerning the Release and Release of Prisoners and Children through Assimilation and Integration in the Context of Preventing and Combating the Spread of Covid-19. Abstract

The existence of a law that regulates polygamy permits is intended to establish public order, provide legal protection and guarantees for the rights and obligations of regulatory relations. In addition, to protect the rights of everyone. So, the formal conditions of polygamy will care to achieve the goal of judicial marriage. Therefore, the permission of polygamy philosophically makes the goal of marriage to be achieved and educates the public to be aware of the regulations.

Abstract

Alat bukti surat berupa fotokopi dan bukan dalam bentuk aslinya tidak memiliki kekuatan pembuktian yang sah menurut hukum apabila tidak dilengkapi dengan legalisasinya atau otentifikasinya. Pada dasarnya alat bukti surat berupa fotokopi dapat terdiri dari alat bukti surat yang telah dilegalisir oleh pihak yang berwenang yang menyatakan sudah sesuai dengan aslinya dan alat bukti surat yang tidak dalam bentuk aslinya (resmi). Penggunaan alat bukti fotokopi surat yang tidak dalam bentuk aslinya (resmi) atau tidak dilegalisir oleh pihak yang berwenang mengeluarkan surat tersebut tidak memiliki nilai dan kekuatan pembuktian. Pada perkara pidana, bukti surat adalah konsep materiilnya. Mencari bukti materiil kemudian untuk mewujudkan kebenaran materiil, ini di dalam konsep pidana. Namun di dalam perdata adalah formil. Kendala dalam penyidikan tindak pidana korupsi dengan menggunakan alat bukti surat berbentuk fotocopy oleh penyidik pada Kejaksaan Negeri Payakumbuh adalah kesulitan untuk menemukan bukti surat yang asli karena telah dimusnahkan oleh tersangka. Tersangka buron/masuk daftar pencarian orang (DPO). Hal ini menjadi kendala dikarenakan penyidik juga memerlukan keterangan dari tersangka. Hambatan secara non teknis antara lain dokumen yang dicari hilang. Sebelum tersangka diperiksa atau digeledah, biasa tersangka akan menghilangkan dokumen-dokumen yang sudah lama. Sehingga biasanya dokumen ini tidak bisa di ungkap lagi.

Abstract

Pertimbangan Penyidik Pada Satreskrim Polres Kerinci Dalam Penerapan Unsur Tindak Pidana Persetubuhan Terhadap Anak Yang Disiarkan Melalui Media Sosial adalah dengan hanya menerapkan unsur yang terdapat pada Pasal 76D jo Pasal 81 Ayat (1) Undang-undang RI No 35 tahun 2014, tentang perubahan atas Undang-Undang RI Nomor 23 Tahun 2002 Tentang Perlindungan Anak dan tidak mempertimbangkan perbuatan terdakwa merekam dan menyebar luaskan perbuatan persetubuhan tersebut dalam media sosial. Hal ini dilakukan dengan pertimbangan tingginya biaya pembuktian dan juga pertimbangan usia tersangka yang masih muda sehingga diharapkan dapat memperbaiki prilakunya. Kendala Yang Ditemui Penyidik Pada Satreskrim Polres Kerinci Dalam Penerapan Unsur Tindak Pidana Persetubuhan Terhadap Anak Yang Disiarkan Melalui Media sosial adalah hambatan yang menyangkut segi sumber daya manusia dari penyidik. Penyidik yang kurang memahami materi undang undang perlindungan anak yang telah diperbaharui yaitu Undang undang nomor 35 tahun 2014 tentang perubahan atas undang undang nomor 23 tahun 2002 tentang perlindungan anak juga dalam hal menerapkan undang undang informasi transaksi elektronik karena perbuatan tersebut direkam yang kemudian disebar luaskan. Namun dalam penyidikan ini penyidik sama sekali tidak menerapkan unsur unsur yang terdapat dalam perundang undangan ITE tersebut. Penyidik beralasan karena adanya kesulitan dalam hal pengumpulan bukti dan pengujian kebenaran alat bukti.
