Abstract

Married is the sunnah of the prophet, although the law of marriage alone for Muslims is determined by its purpose, marriage can be obligatory, sunnah, mubah, even haram is basically adjusted by human intention to get married. The complexity of human life raises several problems in marriage. Among them is the debate about polygamy that has happened so far, which has seized the attention of Muslims, because polygamy is associated with Islamic culture even the sunnah of the prophet. Historically the practice of polygamy has existed since pre-Islamic times. Many figures gave views on polygamy from various aspects related to women.

Abstract

The principle of monogamy adhered to by Law Number 1 of 1974 concerning marriage, so efforts to tighten polygamy, namely if desired by the person concerned, because the Law and Religion of the person concerned allows it and has fulfilled several specified conditions. As in article 4 of Law No.1 of 1974 concerning marriage, it states that, among other things, a husband will have more than one wife, so he is obliged to submit an application to the court in the area where he lives, the court which is meant to only give permission to a husband who will have more wife. from a. This article will mainly focus on the views of the Provisions for the Application of Article 4 of the 1974 Law on Marriage in the Granting of Polygamy Permits at the Ciamis Religious Court and to find out the judges' considerations in granting polygamy permits at the Ciamis Religious Court. The methodology of this study is in the form of a qualitative study. The application of this method includes the stages of data collection through observation, interviews, documentation, data analysis and research reports. This study also uses an anthropological approach. This research is a foundation for understanding human behavior according to cultural backgrounds and beliefs humanely. Based on a description of the results of the research and discussion relating to the considerations of the Judge of the Ciamis Religious Court in granting permission for polygamy, the following can be concluded: 1). Application of article 4 of Law Number 1974 case number: 3496 / Pdt.g / 2017 / PA. Ciamis is correct and correct because of the reasons put forward in the case the wife cannot bear offspring. 2). Judges' considerations in the decision number: 3496 / Pdt.g / 2017 / PA. Ciamis has granted permission for polygamy for alternative reasons, namely article 4 paragraph 2 letter c of Law Number 1 of 1974 and the cumulative reasons for article 5 of Law Number 1 of 1974 have been fulfilled.

Abstract

This research was motivated by the implementation of the correction of the direction of the mosque's Qibla by the Regional Hisab Rukyat Agency of Banjar City to determine whether the Qibla direction of the mosque in Purwaharja District, Banjar City and to follow up on the fatwa decision of the Indonesian Ulema Council number 05 of 2010 regarding the Qibla direction. The Banjar City Regional Hisab Rukyat Agency corrected the Qibla direction of the mosque in Purwaharja District, Banjar City. The purpose of this study was to determine the implementation of the correction of the mosque's Qibla direction and the responses and legal basis of the DKM leaders in Purwaharja District to the results of the correction of the mosque's Qibla direction. From the results of the research and discussion of this thesis, it can be concluded that the City of Banjar, including Purwaharja District, is located at 07° 23' South Latitude and 108° 32' East Longitude, so the angle of the Qibla direction is 25° 4' from the West point to the North or 64 ° 56' from the point North to the West. After re-measurement/correction of the mosque's Qibla direction by the Banjar City Regional Hisab Rukyat Agency, it turned out that of the ten mosques in Purwaharja District the Qibla direction was not right, although there were two mosques whose Qibla direction was approaching 25° from the West point to the North. . But the heads of DKM in Purwaharja District gave a good response, meaning that they agreed to the implementation of the correction of the direction of the mosque's Qibla by the Hisab Rukyat Board of Banjar City and they followed up the results of the correction by rearranging the rows/rows in the implementation of prayer services.

Abstract

One of the pillars of Islam related to the matter of treasure is zakat. Zakat is divided into two, namely zakat mal and zakat fitrah. In the zakat mâl, humans menzakati treasure or opinion such as gold, silver, animals, plants and commercial goods with clear conditions (Muslims, freedom, property is perfect, nishab and haul). While zakat fitrah different from zakat mâl, because the dizakati are human (self or soul) not a wealth or income. In the matter of zakat fitrah, the scholars are different pendapa about the obligation of zakat for the fetus that is still in the womb. Jumhur ulama argue that does not obligate zakat fitrah for the fetus that is still in the womb. While the fuqaha Dzahiri argues that zakat fitrah is obligatory for the fetus who is still in the womb when it has been perfect one hundred and twenty days in the mother's belly before the dawn on the night of Eid al-Fitr.

Abstract

In line with the socio-religious dynamics in society, various problems surrounding fiqh have also developed, most of which have not been absorbed in the legal thinking of the scholars. Concerning issues commonly referred to as masa’il fiqhiyyah al-hadithah, scholars have institutional mechanisms to solve these problems. Nahdlatul Ulama, the most prominent Islamic religious organization in the country, is also concerned with masa’il fiqhiyyah al-hadithah through the Bahtsul Masa’il (BM-NU) mechanism. However, the BM-NU legal istinbath framework is unique, because it is different from the legal istinbath framework that previous scholars had—such as the legal istinbath framework used by Abu Hanifah and Muhammad Ibn Idris al-Syafi’i, also different from the legal istinbath framework with mass organizations. Other Indonesian Islam—such as the legal istinbath framework of the Persis Hisbah Council and the legal istinbath framework of Majlis Tarjih and the Development of Muhammadiyah Islamic Thought. The uniqueness is mainly because the legal istinbath framework adopted by BM-NU tends to present themselves as muttabi’ ulama and does not present themselves as mujtahid clerics as is generally understood by fuqahâ.

Abstract

Running married life, of course between husband and wife have rights and obligations of each that must be fulfilled. The duty of the husband is to give dowries and livelihood to the wife. while the obligation of the wife who is the husband's right is a wife must obey and obey the husband. In addition, the wife is also required to meet all the needs of the husband, both spiritual and spiritual needs. However, among the community there are many problems of role as if exchanged, the wife who feeds the husband with the reasons husband is no longer able to work due to illness, also because the husband is reluctant to work. Reality is much happening among the people of Sindangjaya Village. This attracted the attention of researchers to find out more, how the opinion of the village cleric Sindangjaya towards providing a loving wife to her husband.

Abstract

Perbedaan utama antara perbankan Syari’ah dan perbankan konvensional adalah bahwa yang pertama mematuhi prinsip-prinsip hukum Islam (Syari'ah). Namun, beberapa produk perbankan Syari’ah dikritik karena tidak memenuhi persyaratan syariah karena produk-produk konvensional ini sangat mirip. Artikel ini membahas bagaimana kontrak Islam tradisional digunakan untuk menstrukturkan moda pembiayaan Islam selama masa kontemporer. Untuk memahami pilihan mode pembiayaan yang digunakan oleh bank-bank Islam, proses pengembangan produk diperiksa dan serta dikaji peran badan-badan syariah di lembaga-lembaga ini (departemen syari'ah dan dewan pengawas Syari'ah). Kajian ini menemukan bahwa pilihan moda pembiayaan yang digunakan oleh lembaga keuangan Islam bergantung pada faktor eksternal dan internal. Dalam beberapa kasus bank Islam memilih mode pembiayaan kontroversial karena ini adalah satu-satunya yang layak di bawah rezim hukum dan peraturan yang ada.

Abstract

This study aims to determine the legal provisions of interfaith marriage, both according to Law Number 1 of 1974 concerning Marriage and according to the Islamic Law Compilation. The study used a content analysis method by comparing the legal provisions of interfaith marriage according to the two legal sources. The results showed that interfaith marriage according to Law Number 1 of 1974 concerning Marriage was actually prohibited, in accordance with Article 2 paragraph (1) and Article 8 letter (f) of Law No.1 of 1974. Interfaith marriage is also prohibited according to the Legal Compilation Islam according to articles 40 to 44 and article 61 that marriage is prohibited

Abstract

In living a married life, there are always problems that arise and can trigger the desire and courage of a husband to choose to leave a wife and child or what is called household abandonment. This article mainly focuses on the views of the Ulama of Ciherang Village, Banjarsari District, Ciamis Regency, about the Psychological Impacts of neglecting their wives by their husbands. This study uses a qualitative method. The application of this method includes the stages of data collection through observation, interviews, documentation, data analysis and research reports. This study also uses an anthropological approach. This research is the basis for understanding human behavior according to cultural backgrounds and beliefs humanely. The Ulama of Ciherang Village is of the view that it is a legal sin for a husband who abandons his wife without giving any news even though a husband loves the birth support, because basically it is not only the physical income that must be fulfilled but also the internal income. The inner life does not have to be intimate, but also gives advice, comforting the wife is also part of the inner support. If indeed the wife sincerely accepts it then there is no problem, otherwise the husband will sin. The psychological impact of the wife arising from her husband's abandonment in Ciherang Village, Banjarsari District is as follows: (a). The wife feels a deep hurt, resentment and hatred as a result of being neglected by her husband for more than 2 years. (b). The habit of crying because the incident seemed unexpected. In other words, she still did not believe her husband left her without giving news. And this has an effect on reduced appetite. (c). The wife feels hopeless in living with her child because she is depressed by circumstances. (d). Feeling embarrassed when leaving the house because it is the topic of the neighbors' conversation. (e). The wife more often tells about her family problems to other people, be it neighbors or relatives, this is only to vent her feelings of annoyance to her husband.

Abstract

Usaha pembaruan hukum Islam dengan pendekatan terpadu merupakan ikhtiar intelektual yang cukup ideal. Sifat sui-generis metode penemuan hukum Islam tampaknya merupakan trade mark, yang mungkin memang harus demikian, nampaknya tidak mungkin diubah. Namun demikian, hal ini perlu diimbangi dengan apresiasi proporsional terhadap realitas sosial yang harus dapat dibawa dan masuk dalam analisis penyimpulan hukumnya. Dengan membawa realitas empirik masuk ke dalam analisis penemuan hukum, akan sedikit ada jaminan hukum Islam di Indonesia dapat tampil lebih kreatif dan hidup di tengah-tengah proses regulasi sosial modern.
