Abstract

The concept of democracy in a state is explicit as a human right and the constitution House of Representatives members is not a representative of a political party. Supposedly if a member of the House of Representatives is to be dismissed, it must be through the constitutional sovereignty of the people. The Interim Replacement rights of political parties to their members are the rights that can be taken by members of the Parliament to not voice the total votes of the people and there is no freedom of Parliament members to carry out the people's mandate. Based on this, a question can be formulated regarding the legitimacy House of Representatives members in Interim Replacement by Political Party Bearers and the legal remedies House of Representatives members in Interim Replacement by Political Party Bearers. The type of research used is normative legal research and there use a statue approach and analytical concept approach. Legitimacy House of Representatives members in Interim Replacement does not get recognition, guarantees, protection and legal certainty, as well as fair treatment in carrying out their constitutional duties and in fact Interim Replacement right to allow private law (privaatrechtelijk) must override public law. The legal remedies House of Representatives members in Interim Replacement by political party bearers in the form of filing objections to the resolution of internal political party disputes to the Political Party Court, but the regulation contains contradictions, stated that the decision of the Political Party Court is final and binding internally but still opens the possibility of legal efforts to the District Court and Court Great.

Abstract

The existence of dimly lit cafes is quite easy to find in Bali, even its existence in remote villages. A lot of commotion and crime that occurred in that place. In this research, we will discuss criminal acts that occur in dimly lit cafes and dim café control policies. The dimly-lit café is the place where criminal acts, namely the circulation of alcohol and prostitution activities. This activity is against the rule of law, and disturbs order in society, therefore its existence must be addressed. Tackling dimly lit cafes can be carried out with a penal policy and non-penal policy, namely by criminal law enforcement, licensing, community participation and a value approach.

Abstract

The existence of the Law on violence in the household indeed seems to give new hope to the resolution of some women's issues. Besides because this law contains various rules governing the prevention, protection and restoration of victims of domestic violence, it also regulates specifically the violence that occurs in households, such as physical, psychological, economic and sexual violence with elements of criminal acts especially different with criminal acts of persecution like those in the Criminal Code. In addition, this law also regulates the obligations of law enforcement officers, health workers, social workers, escort volunteers or spiritual guides to protect victims of violence so that they are more sensitive and responsive to the interests of creating integrity and harmony as expected. The problem is that if we look closely, we will find a variety of legal loopholes which, instead of allowing this law to provide solutions to community problems, may actually create new problems, even legitimize moral deviations in society. . This is related to the weakness of the underlying thinking paradigm / perspective along with assumptions and definitions used in developing legal material. Just as the article on the prohibition of sexuality violence regulated in this Law has multiple interpretations, so that when compared to Islamic law there are several contradictions in the article, so that a solution is needed.

Abstract

Sebagai mahluk sosial manusia pasti melakukan hubungan dengan manusia lain. Hubungan tersebut dapat berupa hubungan yang bersifat bisnis, sosial, tetapi sering dibarengi dengan perkawinan. Masalah perkawinan sudah diatur dalam Undang Undang Nomor 1 Tahun 1974 tentang Perkawinan. Secara umum Perkawinan merupakan ikatan lahir batin antara seorang laki laki dengan perempuan sebagai suami istri untuk membentuk rumah tangga berdasarkan Ketuhanan Yang Maha Esa.Jadi Perkawinan dilangsungkan antara seorang istri dengan seorang pria. Dalam kenyataan di masyarakat ada perkawinan yang dilangsungkan dengan simbul, dimana karena sesuatu hal seorang perempuan dikawinkan dengan memakai simbul yang berupa sebilah kris, yang disebut dengan perkawinan dengan kris. Perkawinan dengan simbul kris dari perspektif hukum adat dianggap sah karena merupakan tradisi yang diterima dari zaman kerajaan pada masa lalu.Perkawinan dengan simbul keris terjadi apabila pihak calon suami tidak hadir dan sudah tidak ada (meninggal) pada saat upacara perkawinan itu dilangsungkan, tetapi perkawinan tetap dilangsungkan di rumah suami dengan memakai simbul keris. Jadi perkawinan dilangsungkan hanya dihadiri oleh pihak istri, sehingga akan sangat berdampak pada psikologis isteri tersebut. Disisi lain Undang Undang Perkawinan yang berlaku di Indonesia menyatakan bahwa perkawinan dianggap ada apabila calon suami istri ada pada saat perkawinan dilangsungkan. dan tidak mengenal adanya perkawinan dengan simbul simbul, dan apabila dikaitkan dengan perkawinan dengan simbul keris akan menimbulkan permasalahan terhadap keabsahan dari perkawinan tersebut.

Abstract

The ASEAN Community consists of 3 (three) pillars, namely the ASEAN Security Community (ASC), the ASEAN Economic Community (AEC) and the ASEAN SocioCultural Community (ASCC) that are mutually binding and strengthen to achieve common goals in order to ensure sustainable peace, stability and prosperity that is divided in the Southeast Asia region. These three pillars supporting the ASEAN Community are a new paradigm that will drive ASEAN cooperation towards a community and a new, more binding identity. ASC must be a mechanism to solve problems internally which has the potential to disrupt the stability and security of the region through peaceful means. Including sensitive issues that have the potential to cause problems without having to abandon the principle of not interfering in the affairs of other countries.

Abstract

Banks in providing credit, require the role of Notary/PPAT in the process of binding credit agreements and credit guarantees. Because of the increasing number of Notary/PPAT in some area, this cause more difficult for a Notary/PPAT to get clients. To overcome this, some Notaries/PPAT’s want to get many clients by collaborating with the banks, which is stated in a partnership agreement. When a Notary/PPAT becomes a partner of the bank, they will obtain job and client from the bank and binding themselves to the bank. The problems in this study are How is the existence of a partnership agreement between the Notary/PPAT with the bank reviewed from UUJN, Notary Code of Ethics and PPAT Regulation. This study used a normative legal research, with a Statute Approach and the Analytical Concept Approach. The legal materials are primary, secondary and tertiary legal materials.The conclusions in this stydy that the partnership between Notary/PPAT and the bank violates the provisions of article 16 paragraph 1 letter of the Law of The Notary and violates code of Ethics Notary and code of Ethics PPAT, as well as the partnership agreement between Notary/PPAT with the bank raises a contractual relationship between the Notary/PPAT and his client so that the Notary/PPAT can no longer carry out his position independently.

Abstract

The era of regional autonomy provides an opportunity for each regional government to regulate its own households except for matters that are the authority of the central government. The form of regulation carried out by the regional government is by issuing legislation in the form of regional regulations. The regional regulations created should be able to accommodate the needs and interests of the community, so that the goal of regional autonomy, namely the welfare of the people in the region, can be realized. The research method is normative legal research. Legal materials in the form of primary, secondary and tertiary legal materials. Qualitative legal materials collected will be sorted, analyzed and then presented in a descriptive form in the form of a research report as referred to in this study. The results of this study indicate that through participatory methods, the substance of the regulations in regional regulations can accommodate the interests, needs and values of the community. The next implication is the high obedience of community law to regional regulations and the attainment of the nature of the existence of law that is creating order and happiness in society.

Abstract

Memorandum of understanding agreed and signed by the Indonesian Notary Association with the Indonesian National Police Number: 06 / MOU / PPINI / VIII / 2018 Number: B / 46 / VIII / 2018 concerning guidance and law enforcement in an effort to increase professionalism. Agreements made using memorandum of understanding in a legal review have binding or not binding power. Based on the memorandum of understanding agreement that guidance can be carried out by the Indonesian National Police, Regulation the notary position that the Notary Honorary Council has such authority. Based on the above problem, the formulation of the problem used is how to bind the memorandum of understanding signed by the Indonesian National Police with the Indonesian Notary Association and What is the scope of the discussion in the memorandum of understanding signed by the Indonesian National Police with the Indonesian Notary Association. that based on the discussion of the problem, the conclusion is that the strength of the memorandum of understanding by the parties can be binding if in accordance with the legal conditions of the agreement and the parties carry out the agreement. The scope of the memorandum of understanding is in terms of information exchange, coaching, law enforcement and improving the quality of human resources. The intended coaching is to carry out an understanding of notary science.

Abstract

The Attorney General's Office of the Republic of Indonesia as one of the law enforcers who has main duties and functions in law enforcement, one of which is related to eradicating corruption. Seeing the importance of the position of the prosecutor in the special law enforcement in eradicating corruption, it is important to conduct a study of the Politics of Law to eradicate corruption in the prosecutor's office, especially during the administration of President Joko Widodo. The conclusions of this paper are the first Political Law to eradicate corruption in the era of President Jokowi's administration has similarities with previous era governments, including the issuance of regulations on eradication and prevention of corruption, the formation of adhoc teams, and several regulations in the Jokowi era that curb corruption eradication. Secondly, the Republic of Indonesia's Attorney General's Office as a government agency indirectly in making its legal policies requires policies taken by the government. The prosecutors' policies in eradicating corruption are in line with the government's intentions, namely the formation of the TP4 Team, and the emphasis on handling cases that are of legal equality which make the basis for consideration on the principle of benefit and the principle of proportionality to support the government's development and smooth running program.

Abstract

Postponement of Debt Payment Obligations(PKPU) is regulated in Law No. 37 of 2004 concerning Bankruptcy and Postponement of Debt Payment Obligations. PKPU is an inseparable matter in the bankruptcy process. PKPU can also be understood as a certain period of time given to debtors and creditors determined by a commercial court decision to make a joint agreement related to the payment or settlement of debt problems between the parties, both all or part of the debt also the possibility of debt restructuring. The methodology in this paper uses library research with a statute approach. PKPU is requested if the debtor is unable or estimates that he will not be able to continue paying his debts which have fallen due in reaction to the request for bankruptcy filed by his creditors.
