Abstract

The Amendment of the 1945 Constitution of the Republic of Indonesia has made the sovereignty still retained by the people, no more represented and fully held by the People’s Consultative Assembly like when the constitutional system of Indonesia was still embracing supremacy of parliament. In the constitutional perspective, the standing and relation between the state and people is becoming more obvious. Hence, in the case that constitutional  dispute happened, there should have been an adjudication forum for solving the  dispute.  Therefore,  Contitutional  Court  Of  the  Republic  of  Indonesia  is established and designed constitutionally to solve  the  constitutional  dispute through The  Amendment of  the  1945  Constitution of  the  Republic of Indonesia. Settlement of constitutional dispute through the review of constitutionality of norms in the regulation of outsourcing contract in The Labour Law at Contitutional Court of the Republic of Indonesia, with specific issue “the Contract of Employment for a specified time” that is regulated in Article 65 paragraph (7) and Article 66 paragraph (2) b of Labour Law is  declaredconditionally  unconstitutional.

Abstract

The Constitutional Court has created a legal breakthrough in handling the local head election dispute, in order to uphold the democracy and break     away from habitual practice of systematic, structured, and massive (STM) violations. The Court does not simply calculate the results of vote count but also have to seek the justice and prosecute results counting rate that were disputed. As the juridical normative research, the research uses a statutory, case, historical approach and  the  sociology  of  law.  The  research  shows that throughout 2008-2011 Court has granted the dispute for as many as thirty-two cases. Of that amount  of  cases,  those  with  the  STM  violations are as many as 21 (twenty one) cases. Whereas the nature of TSM were   divided into two kinds namely cumulative and alternative which both may cancel local head election results. There are three types of local head election violations, first, violation  in  the  process  that  does  not  affect  the  results of the election. Second, the breach in the process that affect the election  results, thirdly, violation of the terms of conditions to be a candidate which  are principal in nature and can be measured. The systematic, structured and massive violation of the local head general election is violations committed by the structural apparatus, both government officials and election organizers, collectively; not an individual action, well-planned (by design) and the impact of such offencesis extensive rather than sporadic.

Abstract

Constitutional Court is an  state  institution  given  with  the  authority,  by  the constitution, to review act toward constitution, UUD 1945, in the first    and final level of which the decision has binding power. The existence of ratification act becomes a problem to the constitutional enforcement system  in Indonesia. Goverment’s binding to the international conventions/agreements are given on the grounds of ratification by The House of Representatives and the President in the form of act. This is because Indonesia recognizes intenational laws after the adoption of the international coventions/agreements. This “special adoption” regarding international coventions/agreements are formed by national law with the same level as the act. Because of taking the form of an act, it is then becomes a problem whether this ratification act can be categorized in the hierarchy of laws based on Law No. 12 Year 2011 and thus can be judicially reviewed by the Constitutional Court.

Abstract

Constitutional right is basic right for all Indonesian people, not least for indigenous people which still uphold the values of their customary law. Customary law is often  different  from  the  positive  law  in  Indonesia,  but it’s not a reason to deny the customary law on  indigenous  people  in  a region. One of the Indigenous people is in Yahukimo where the community uses their customary law in various patterns of life. Therefore, even in the election they use their own customary law and are not  guided  by  the  Election Law. Noken is the way they cast a vote. Constitutionality of Noken is accepted as a cultural value by the Constitutional Court.

Abstract

The existence of Constitutional Court after the amendment the 1945 Constitution of Republic Indonesia (1999-2002) brought a fundamental change in the constitutional review of norms. Constitutional review mechanism not just a “review” but the court is also required to search the essence of constitutional review itself and its relation to the constitutional rights. Therefore, the ultra petita decisions issued  by  the  Court should not  be  viewed  as  absurd  but as  a  way  to  uphold justice.

Abstract

Article 33 of the 1945 Constitution serves as the basis for Indonesian  Economy. It contains the principle of togetherness and brotherhood. Therefore, in the development of Indonesian Economic Law, Article 33 of the 1945 Constitution is imperative in nature that it is asserted in the laws and regulations concerning the economy, “...it is the prosperity of the society that should be prioritized...not the welfare of individuals”.

Abstract

Through the decision No. 117/PUU-VII/2009, Constitutional Court applies Rawls conception of justice that emphasizes the equality of all people with equality  of opportunity by applying fair or equal opportunity principle. Institutional design between the DPR and DPD viewed by Constitutional Court as an inequiality condition, so that to reach a value of justice, equal opportunity principle should take precedence and priority. Stregthening DPD is necessary to uphold the checks and balances mechanisms in Indonesia.

Abstract

Not  all  juridical  products  are  along    with  the  society’s  aspiration.  There     are some of the juridical products assessed as against the democracy  enforcement by  the  society.  The  verdict  number  15/PUU-IX/2011  given  by  the Constitutional Court is a kind of correction to the performance of the  lawmakers (UU) if the law they produce are considered contra-democracy. Besides,  the  verdict  of  the  Constitutional  Court  to  some  of  the  articles  in  the  Law  No.  2  Year  2011  actually  might  be  read  as  a  warning  from    the Constitutional Court to the lawmakers, especially those regulating  the  problem of  political  parties  so  that  their  performance  could  be  maximized  and  transparent,  and  consider  egalitarianism  in  the  future.
