Abstract

Cases of domestic violence often occur in society and has become a very complex social problem. From year to year this case rapidly growing both quantitatively and qualitatively. Because of that,  Act No. 23 of 2004 comes to resolving  the cases of domestic violence , in addition to other laws related. Domestic violence includes any act that causes misery and suffering due mainly to women's physical, psychological, sexual or neglect of household. But according to Islamic law, wife beating because of nusyuz or children who were aged 10 years and still leave the obligatory prayers is not included in the category of domestic violence because this kind of action aimed educative. The domestic violence according to the school of Bio-sociological (school of Convergence) occurs due to internal factors (innate character, psychological) and external factors (environmental sociological) that encourage acts of violence. According to Islam, a violent action is mainly due to the weakness of the practice of religious values in family life, because in principle the humankinds were  born early  in a state of purity and after that their personality is determined by the mode of education and the dynamics of the environment surrounding them. To cope with domestic violence do efforts pre-emptive, preventive and repressive. The repressive effort was the last attempt to do after other efforts did not succeed. According to Islamic law when there has been a sign of disharmony (syiqaq) between the spouses, the settlement must be internally first by involving two mediators (hakamain) of each family of husband and wife. If this kind of settlement efforts are not successful then the solution that can be taken is talaq (divorce) to avoid more fatal  consequences. For the perpetrators of domestic violence Act No. 23 of 2004 provides a penalty of imprisonment or fines and additional penalty, while according to Islamic law, these violent acts, including category jarimah qisas-diyat or ta'zir depending on mode of action and the consequences thereof. Keywords: Violence, Domestic, Act No. 23 of 2004, Islamic Law.

Abstract

Masyarakat multikultural terpola oleh keragaman budaya termasuk keragaman agama. Di dalam perjalanannya, agama-agama yang muncul dalam masyarakat multikultural kemudian dipahami oleh umatnya. Di antara mereka, ada yang memahaminya secara rasional dan ada pula yang memahaminya secara irrasional atau mistis. Dampak heterogenitas agama ini bisa menmunculkan konflik di antara umat berbeda agama. Toleransi sangat dibutuhkan untuk menciptakan keseimbangan dan kohesi sosial dalam masyarakat multikutral

Abstract

Problems related to children resulting from adultery are still interesting to discuss, namely in terms of how the position of adultery children in the Compilation of Islamic Law in Article 43 paragraph (1) and Article 272 of the Criminal Code. This research is in the form of normative legal research, namely legal research conducted by researching library materials and using an approach. The type of research used is Libray Research. that the adulterous child in Compilation of Islamic Law or Civil Code both cannot be recognized by his genetic father, while in Compilation of Islamic Law he has more empathy so that the child has a kinship relationship with his mother and mother's family, while in the realm of the Civil Code an adulterous child will not have a juridical relationship with his parents , either to the father or to the mother. However, the child can only obtain rights from his mother and his mother's family. Whereas in the realm of the Criminal Code, adulterous children can only earn what they need according to the ability of their biological parents. But besides that, the adulteress child cannot ask and demand more for what he has given.

Abstract

Pemerintah dan/atau Pemerintah Daerah wajib memenuhi kebutuhan rumah bagi Masyarakat Berpenghasilan Rendah (MBR) dengan menyediakan tanah dan memberikan kemudahan dalam pembangunan dan perolehan rumah melalui program perencanaan pembangunan perumahan secara bertahap dan berkelanjutan.Tanggung jawab Pemerintah dan Pemerintah Daerah atas ketersediaan tanah untuk pembangunan perumahan dan kawasan permukiman diatur di di dalam pasal 105 dan pasal 106. Dalam hal ini Undang-undang Nomor 1 Tahun 2011 Tentang Perumahan dan Kawasan Permukiman disahkan untuk menggantikan peraturan sebelumnya yaitu Undang-undang Republik Indonesia Nomor 4 Tahun 1992 tentang Perumahan dan Permukiman yang sudah dianggap tidak sesuai dengan perkembangan saat ini.Namun dalam pelaksanaan Undang-undang Nomor 1 Tahun 2011 ini justru menimbulkan permasalahan baru. Permasalahannya adalah terkait pada Tanggung Jawab Pemerintah Daerah Dalam Penyediaan Tanah Bagi Pembangunan Perumahan Masyarakat Berpenghasilan Rendah (MBR) dan Masyarakat Berpenghasilan Rendah (MBR) dalam memperoleh perumahan.Tanggung jawab Pemerintah Daerah  dalam penyediaan tanah bagi pembangunan perumahan Masyarakat Berpenghasilan Rendah (MBR) berdasarkan Undang-undang Nomor 01 Tahun 2011 tentang Perumahan dan Kawasan Permukiman.  Kata Kunci: Tanggung Jawab, Pemerintah, Penyediaan Tanah, Perumahan dan Masyarakat Berpenghasilan Rendah (MBR).

Abstract

At present many transactions are done by the community one of them is ba'i al-muzāyadah. BPPKAD (Finance and Regional Asset Management Agency) Purworejo Regency Practice the ba'i al-muzāyadah in selling inventory items that are not usable in equipment because they are damaged or for development, namely The sales auction with a single-cover closed bidding method, in the sense of a letter of bidding (a bid size) along with all requirement files inserted in one closed envelope. Therefore, among the bidders can not know each other's offerings from other participants. This is different from the auction system in the Fiqh rulings (Islamic law) is an auction with a method of bidding in the middle of the crowd or public and the price quote is done repeatedly to find the auction winner. Departing from the background, researchers interested in discussing the problems of the BPPKAD auction operational system (the financial and Regional Asset Management Board) of Purworejo Regency using the perspective of Islamic law. With the aim that researchers can research more in whether the auction system used by BPPKAD Purworejo District is already in accordance with Islamic law. This type of research is a type of field study, the method of collecting data by interview. There are two data sources that are primary data sources and secondary data sources while the analysis uses a qualitative approach.

Abstract

Pendidikan tidak bisa dipisahkan dari al-Qur'an. Ia menjadi sumber (mashadir), dan inspirasi bagi tumbuh berkembangnya pendidikan. Ini dibaca cermat oleh seorang tokoh pendidikan Bondowoso, KH. Imam Barmawi. Ia menemukan konsep ideal dan mempraktikkannya di Madrasah Aliyah Negeri Bondowoso. Konsepnya adalah menjadikan pendidikan menjadi satu tarikan nafas dengan al-Qur'an.Kata Kunci: al-Qur'an, Pendidikan, KH. Imam Barmawi, MAN Bondowoso.

Abstract

Mengingat kedudukan dan perannya yang sangat besar bagi kehidupan masyarakat, agama merupakan isu yang sangat sensitif bagi sebagian besar masyarakat. Pun demikian, dengan persoalan kepercayaan yang dianut oleh sebagian kalangan masyarakat Indonesia. Tidak dicantumkannya kepercayaan yang mereka yakini berimbas pada banyak aspek kehidupan mereka, sehingga menuntut penganut kepercayaan untuk memasukkan salah satu agama yang resmi diakui oleh bangsa indonesia dalam kependudukan (KTP) mereka. Hal ini pada puncaknya menimbulkan perlakuan yang diskriminatif, ketidakadilan bahkan kesewenang-wenangan dari pemangku kekuasaan terhadap penganut kepercayaan. Pada tahap selanjutnya, perlawanan terhadap kesewenang-wenangan tersebut muncul dari masyarakat dengan menguji kebijakan yang bertentangan dengan nilai-nilai keadilan masyarakat di Mahkamah Konstitusi (MK), karena MK satu-satunya lembaga yudikatif yang memiliki kewenangan menguji konsistensi undang-undang (UU) terhadap undang-undang dasar (UUD) 1945.Kata Kunci: Agama, Kepercayaan, dan Mahkamah Konstitusi

Abstract

'Iddah is a waiting period that must be lived by a woman due to the termination of the marital relationship, either due to divorce or death, in order to restore mental or physical condition after being left by her husband. The implementation of 'iddah in the jahiliyyah period is considered no longer appropriate to be applied today because, at that time, a wife whose husband died would be placed in a hut (a small, fragile, and old house), given the ugliest clothes, not allowed to wear clothes. Perfume, so that the smell is very unpleasant, then brought himar animals, goats, or birds and then occupied with him. The majority of women today have a myriad of activities outside the home as career women, which sometimes makes some of them the backbone of the family, whether they are with their husbands or not. Some scholars' to leave the house, if it is in an emergency, the state of emergency is understood differently by ulama' Usul al-fiqh. Such as, al-Shatibi understands the meaning of emergency with an essential need to be maintained. a woman whose husband dies, then she has to provide for her family, then she is allowed to leave the house because she is in an emergency

Abstract

Almost every day, issues and news about corruption become part of several headlines in newspapers, or become a theme raised in television media in this country. This fact indicates that, today Indonesia is still unable to escape from a culture of corruption that is getting stronger and running systemically. Although it is not proclaimed as an Islamic state, Indonesia is listed as a country with a Muslim majority. Even so, the quantity of diversity is not directly proportional to the moral quality and practice of religion which explicitly states, both in the Koran and al-Sunnah, that it prohibits actions that harm others, let alone the State. Because Indonesia is dominated by a Muslim majority, whether it is recognized or not, the perpetrators of corruption in this country are mostly Muslims. This article will discuss the discourse on the eradication of corruption as stipulated in Law Number 20 of 2001 and in Islamic law. By using literature research methods and descriptive analysis of the sources of positive law and Islamic law, this article produces several findings, namely; 1) efforts to eradicate corruption as regulated in Law Number 20 of 2001 are carried out with physical punishments such as fines and a maximum sentence of life which does not provide a deterrent effect to the perpetrators; 2) Islam emphasizes that the eradication of corruption is carried out by means of theological-morality, namely awareness of corruptors and the provision of moral sanctions, such as being displayed to the public so as to provide an educational effect for others. From these findings, this article agrees with Mahfud MD's idea that punishment for corruptors should be carried out in the aspects of physical and moral punishment.

Abstract

The problem in this research is whether the difference between cash and non-cash payment of GrabBike wages accompanied by additional costs unilaterally by the GrabBike driver is in accordance with Islamic law. Data analysis using descriptive qualitative analysis method. The results of this study are that according to Islamic law there is a difference between cash and non-cash payment of GrabBike service wages because in accordance with ijarah dzimmah, namely rental benefits for buying and selling services, Grab and Ovo have the right to provide promo rates or discounts as a form. Prizes and the giving of legal prizes are permitted by the syara 'because in this case the passenger and driver are not disadvantaged but instead benefited, but in connection with the additional wages that the GrabBike driver unilaterally demands for various reasons, Grab does not justify Islamic law is not in accordance with the pillars of the ijarah contract because one party feels forced.
