Abstract

This article aims to provide legal education to the public about the resolution of common property disputes from the perspective of the Compilation of Islamic Law (KHI). More specifically, the author reviewed casuistically the rulings produced by the Kediri City Religious Court regarding the resolution of marital property disputes. This article was compiled using qualitative methods with this type of case study. Data is collected through interviews, observations, and documentation. Next, the data were analyzed with Miles-Huberman’s interactive model. This article concludes that the ruling of the Kediri City Religious Court is quite flexible and contextual. This is reflected in several cases, where on one occasion, the Kediri City Religious Court had given a ruling on the settlement of property disputes together regarding article 97 of the KHI while considering article 89 paragraph 1 of Law No. 7 the Year 1989 on Religious Justice. Then on another occasion, the Kediri City Religious Court has also ruled out article 97 of KHI as a consideration in the ruling regarding the settlement of marital property disputes because it is considered unfair based on the facts before the trial. That is, judges have the authority to position the principle of justice and contextual expediency as key in the resolution of common property disputes, which have far exceeded the normative side or formal legal aspects of the law.

Abstract

This study wanted to analyze Sufistic education by the Shadziliyah order under the wrath of KH. Jamaluddin Ahmad Tambak Beras Jombang in the process of forming a moderate-humanistic attitude of pilgrims. The research method used is field studies with a qualitative approach. Extracting data through interviews and observations of non-participants. The results of the study showed that the concept of Syadziliyah order teachings has been able to lead pilgrims to have moderate, wise, and balanced paradigms. Thus, they focus not only on the power of spirituality but also on social aspects, morality, and humanism. Thus, the teaching model applied by the Shadziliyah order is based on the moderation and integration of science between ukhrawi and dunyawi principles as a foundation of behavior in society. In the process of forming social, moral, and spiritual behavior of the pilgrims of the Shadziliyah order, affirming not to be inclusive, individualist, and extreme in wading into the Sufistic world. Moderate attitude is more emphasized in this order, then plus the role of murysid teachers as educators who are not limited as spiritual guides, as well as moral and social educators of their congregations. It is also strengthened by amaliah practiced by the pilgrims consistently who can cleanse their inner aspects so that it has an impact on their behavior, attitude, and actions.

Abstract

This study aims to analyze the differences in students’ critical thinking skills improvement between students that joined the Blended Learning model based on the Kutub al-Tis’ah and students who get the ordinary learning model. This study uses a quasi-experimental method with purposive sampling. The research samples were two classes from the Architecture Study Program of the State Islamic University of Sunan Ampel Surabaya in 2020/2021. Experiment class was a class with Blended Learning model based on the Kutub al-Tis’ah whether the conventional class was control class. The Blended model is effective if the post-test score of the Experiment class is better than the Control class. The results of the study showed that the average post-test value for the Experiment class was 90,32 with a variance of 6,799 and the Conventional class had an average value of 65,81 with a variance of 5,872. The hypothesis test of the similarity of the two post-test data averages was carried out through a normality test whose calculation results using Kolmogorov-Smirnov and Spiro-Wilk showed the post-test values for both the Experimental class and Control class were normally distributed with Sig 0,200 > =0,05. While the homogeneity test of the calculation results using the Levene test showed that the post-test value of both the Experiment class and the Control class was homogeneous with Sig 0,206 > = 0,05. While the statistical test calculation results obtained a value of Sig 0.00 < = 0.05, which means rejecting H0. The average post-test value for the Experiment class is greater than the average post-test value for the Control class that means the blended learning model based on the Kutub al-Tis’ah application is effective for improving students’ critical thinking for Hadith Studies courses.

Abstract

The education system is part of the aspired life order, which in essence cannot be separated from the connection with the teachings of Islam itself. The new Islamic education system is considered Islamic, only if it is in harmony with the concepts of the Qur’an and hadith which are the basis and purpose of Muslim life. The presence of individuals who have moral integrity is the basis for the construction of a civilized society. Moral integrity arises if individuals can make decisions through the process of correct rational consideration, and wisely implement them, following the context of a particular space and time. Moral integrity includes the ability of individuals to make practical policies that are meaningful to their own lives and others. The difference is human nature. Appreciating differences is a fundamental attitude that must be cultivated in individuals. Especially in the life of nation and state in the Unitary Republic of Indonesia, respect for differences must be cultivated in each individual, because our country stands. After all, the founders of this nation respect difference, and in that difference, they want to unite strength and energy in building the nation. Appreciating differences or tolerance is part of the character of the Indonesian people, who love the sovereignty, unity, and unity of the Republic of Indonesia.

Abstract

The lack of creativity of parents and educational institutions in exploring children’s talents can have an impact on the reduced innovation of student talent development. On a broader scale, innovation of underdeveloped student talent can result in limited contributions to important work that can hinder the progress of various fields in the future. This research uses a qualitative descriptive method, with the method of extracting observation data, interviews, and documentation. While data analysis uses Miles and Hubberman’s theory, namely, data reduction, data display, and conclusion drawing. The results showed that the teacher’s strategy in detecting students’ talents was carried out through four stages. First, internal exploration of students by giving freedom to choose the talents to be developed. Second, treatment of talent tests. Third, confirmation with parents. And Fourth, final determination of talents. Talent development strategy is carried out through two channels. First, internal madrasah coaching pathway. And second, external coaching through course institutions and training in Madrasah Ibtidaiyah environment. To ensure the continuous growth of student talent, Madrasah conducts cooperation with parents, course institutions, and training with a mutually agreed memorandum of understanding (MoU). This form of cooperation is a new talent development management strategy that can provide progressive results for the development of student talent.

Abstract

This study will examine solutions to strengthen moderate religious literacy among millennials after the outbreak of Covid-19 in the era of disruption with the following research focus: Improving skills to strengthen the religious literacy of urban millennials after the outbreak of Covid-19; Explaining the contribution of these skills in improving religious moderation for urban millennials after the outbreak of Covid-19. This study uses a phenomenological qualitative approach. Data was collected using the method of participant observation and independent interview, so that this research is done in-depth, intensively, and in detail on the phenomenon that occurs. Data was analyzed by reducing, displaying, inference, and verification of data. To test the validity of the data, credibility, transferability, dependability, and confirmability are carried out. This study reveal that to strengthen millennial religious literacy means equipping students with the knowledge and skills to understand and discuss religions and issues around them confidently, accurately, critically through reflection, inquiry, empathy, analysis and evaluation skills, reasoning, synthesis, and communication. That way students will understand that a friendly, peaceful, friendly, tolerant, flexible, and inclusive face is the face of Islam in the framework of moderation. Contributions of religious literacy strategies in improving religious moderation, namely as follows: First, form mental adjustment and critical in understanding various religious content; Second, being able to identify differences in beliefs, and practice the teachings of Islam in the community; Third, have a preventive spirit from hate speech wrapped in religious content.

Abstract

This research describes human existence in various scientific studies; psychological, physiological, spiritualist (interdisciplinary) which has an integral value to the human role in Islamic education. This research is library research, using the Koran and hadith as primary sources to explore the strong relationship between humans as nature and Islamic education. The significance of this research lies in an interdisciplinary study in revealing human nature, both in terms of psychology and sociology in the context of Islamic education. The research method used is descriptive qualitative with a library model. To deepen the study, the approach used is hermeneutics. The findings of this study are first, from psychological analysis, humans are objects as well as subjects in education, so the formulation, objectives, materials, methods, curriculum, and evaluation of education must be based on an understanding of humans within the framework of essence and existence which cannot be separated from its substance. Second, physiologically, humans are chosen beings, semi-celestial and semi-earthly creatures in which the recognition of a supernatural (God) is embedded, beings who have freedom, have a sense of responsibility towards themselves and nature. Third, spiritually, humans besides having a material physical dimension also have a spiritual dimension. In addition to being created from the essence of soil, humans were also created from the breath of God's spirit, to carry out dual duties as servants (abd), as well as God's ambassadors on earth (khalifa fil ardh).

Abstract

This article aims to reveal the planning, implementation, constraints, and solutions of Merdeka Belajar policy in East Java. This article was written based on field research using a qualitative case study approach. Data were collected through interviews, observation, and documentation. Furthermore, the data were analyzed using the Miles-Huberman version of the interactive qualitative data analysis technique. This article concludes that the planning for the implementation of Merdeka Belajar policy in East Java is carried out through two activities. The first activity was the socialization of the four pillars of Merdeka Belajar from the Indonesian Ministry of Education and Culture. The second activity is to prepare infrastructure such as Dapodik and e-learning systems to support the implementation of the Merdeka Belajar policy. Then, Merdeka Belajar in East Java was implemented through three concrete steps. The first is to carry out the instructions of the Ministry of Education and Culture as optimally as possible under the capabilities of each institution. The second is to join the Motivating School program. The third is optimizing the implementation of student-centered online learning. The implementation of Merdeka Belajar in East Java encountered two main obstacles. The first is the uneven understanding and readiness of teachers in applying the concept of Merdeka Belajar. The second is the delay in the implementation of online learning due to the varied economic backgrounds of the parents of students and the uneven readiness of institutions in conducting online learning. Two solutions are carried out to overcome the obstacles faced in the implementation of Merdeka Belajar in East Java. The first is to strengthen teachers' understanding of the concept and implementation of Merdeka Belajar through outreach activities and workshops. The second is conducting limited face-to-face learning while working on the implementation of blended learning.

Abstract

Knowledge is one of the important assets owned by universities. The core business of higher education is the development of knowledge, so of course, knowledge assets are very important to be developed by universities. Knowledge occupies an important position because it can stimulate innovations in the activities of the Tridharma of Higher Education. Knowledge management needs to be done so that the knowledge possessed by each individual in the organization can be managed properly. This study examines the implementation of knowledge management in the field of learning at IAIN Kediri, then conducts an epistemological analysis. The approach used is a qualitative approach. This research was conducted at the State Islamic Institute (IAIN) Kediri, Indonesia. The sources of data for this research are leaders, both at the rectorate, faculty, and unit levels, and lecturers. The data collection method is the method of documentation, questionnaires, and in-depth interviews and observations. The results of this study indicate that the management of learning at IAIN Kediri has applied the principles of knowledge management. The institution has made efforts to realize knowledge creation and knowledge sharing among lecturers in improving learning performance. Both of these things continue to be pursued although there are still some obstacles. However, there are still several obstacles and challenges that must be resolved in developing a culture of knowledge creation and knowledge sharing, developing facilities and human resources in the IT sector for the field of learning, and improving the online learning document storage system.

Abstract

This research aims to analyze the views, attitudes and approaches of PAI teachers in teaching the materials of fiqh which are puris in madrasa. The research was carried out qualitatively based on phenomenological research design. Researchers withdrew the data by conducting in-depth interviews with Fiqh teachers at Madrasah Aliyah. Furthermore, researchers also utilized documentation of textbooks used by teachers. They also distribute questionnaires via google form. Consequently, it concluded that, Fiqh teachers generally in Mojokerto have moderate religious views and attitudes. There were three types of approaches used by teachers in teaching the materials of puritan fiqh. First, the contextual approach which was assumed to be able to form a moderate character and tends to be liberal for students. Second, the textual approach, the implications of it can lead students to have fundamentalist perspective. Third, the integration of textual and contextual can influence students' perspectives to be moderate based on wasathiyah principles. By having moderate views and attitudes and supported by the integration of contextual and textual approach, it can form a moderate perspective of students. Then, this research rejected the anxiety that Islamic Religious Education can create puritanical Islamic teaching. It also rejected the claim that the radicalization process was carried out through madrasa.
