Abstract

The long history of reforming Islamic Family Law in the Muslim world began in the 20th century when Turkey became the first Muslim country to pioneer this reform. These reforms greatly influenced the reform of Islamic family law in Egypt and provided a more forward-looking color compared to what was previously done, the impetus for reform and reform of Islamic law in Egypt came from within the Islamic tradition itself and from outside the Islamic tradition. In addition to reforming family law in general, Egypt has also reformed the concept of inheritance law regarding wajibat for orphan grandchildren, which actually does not discuss this matter in classical books. Egypt regulates the issue of compulsory wills in the Egyptian Law, namely Law no. 71 of 1946 concerning inheritance, Egypt introduced a new concept in terms of inheritance for orphaned grandchildren who are usually considered as dzawil arham who are prevented from obtaining inheritance, so they are now entitled to inheritance by using the mandatory will. The concept of wills, mandatory, for inheritance for orphaned grandchildren does not exist in classical jurisprudence, and it appears that Egypt is trying to reform the law by inventing new laws or rechtsvinding, in order to find a solution to the inheritance problems that occur in Egypt.

Abstract

This study aims to provide knowledge and understanding of the implementation of article 82 of Law no. 7 of 1989 JIS Law No. 3 of 2006 Law no. 50 of 2009 in divorce cases in Class I A Palu Religious Court, and how the efforts and solutions of Class I A Palu Religious Court in dealing with divorce. This research was designed using a type of field research, using a qualitative approach. After analyzing the research data, the final step of this research is checking the validity of the data with a view to proving that the research is truly valid. Results obtained from research in the Religious Courts concerning Implementation of article 82 of Law, no. 7 years. 1989 JIS Act. No. 3 years 2006 Law No. 50 years. 2009 concerning divorce cases is mandatory because it is a necessity to run it and has been implemented well as evidenced by existing data. The solution in dealing with divorce cases is to mediate and make trainings for judges to better understand the various cases in divorce.

Abstract

The implementation of adat in the Lauje community is aimed at upholding traditions that have been handed down as a symbol of honor and courtesy of the Lauje people in receiving guests. Then another goal in the implementation of this custom is to prevent the bride and groom's household from negative things that if this custom is not implemented. The purpose of this research is to describe and explain the implementation of the Mopopene’e custom system in the marriage of the Lauje tribe in the village of Lombok, Tinombo Subdistrict, Parigi Moutong Regency and how the objectives of Islamic law are towards the implementation of the Mopopene’e custom. This study uses qualitative methods and describes field research. In the technique of collecting data the author uses the method of observation and conduct interviews directly to the informant. The results of the study found that the implementation of the Mopopene'e custom which had been carried out by the Lauje people was a good tradition. As for the community's understanding of the adverse effects that will arise in the future if the custom is not implemented according to the author, it is only a myth that happens to happen and if it is not implemented it does not have any impact in the future because there is no power that exceeds the power of the creator, namely Allah swt.

Abstract

Based on the research background that has been mentioned, the remarriage agreement as a ritual of obtaining offspring in a review of Islamic law, a case study of a married couple in the village of Tinggede, Kec. Marawola Kab. Sigi, then obtained several objectives from this study, namely to explain and describe how the process of remarriage contracts for couples in the village of Tinggede Kec .arawola, Kab. Sigi as a ritual to obtain offspring and how Islamic law review of the remarriage agreement to the couple in the village of Tinggede Kec.Marawola, Kab. Sigi as a ritual to get offspring. This study uses a qualitative approach with more emphasis on the relevance of the findings that occur in the field, so that the data can be presented in actual terms, the data collection technique used is the field of data collection techniques (field research). The intended data collection technique is collecting a number of data directly. The results showed that the process of implementing a marriage contract that occurred in couples in the village of Tinggede was as follows: firstly there was an underlying reason and secondly halal and haram re-marriage contracts were seen in terms of or the intention behind the process of a remarriage contract. So that in the Islamic religion, the glasses of Islamic law see this as a prohibition because of the descendants in a family, purely the gift of Allah. Humans can only endeavor, looking for reasons that are permitted by the Shari'a to get them.

Abstract

This study aims by using qualitative methods with data collection techniques, namely interviews, observation, verification in order to obtain data that is truly valid and can be accounted for. The results of this study indicate that the marriage in the adat of the Tajio Tribe in Siney Village, Tinombo Selatan District, Parigi Moutong Regency is to open the tajalang to open the road, that is, the man will tell his desire to propose to the woman but with satire words, then Nalolo Tevulang Nombosi is looking for a day or It is a good month to meet the family of the woman who wants to be married to, the next stage is to open the first tejarita, namely the man comes to the woman's house to discuss further the matchmaking plan and the last marriage process is tevea nelili, which is sprinkling yellow rice on the man's family This is a sign that the woman's family has officially accepted the proposal of the male party and the view of Islamic law on the marriage of the Tajio Tribe in Siney Village, Tinombo Selatan District, Parigi Moutong Regency is not against Islamic Law and even in accordance with Islamic Law because of the marriage in The traditions of the Tajio Tribe in Siney Village, South Tinombo District, Parigi Moutong Regency contain elements of faith, elements of worship and contain elements of akhlakul karimah.

Abstract

The application of family law in Muslim-majority countries, especially the Middle East and its surroundings, has different practices, we do not find uniformity in family law practices in these countries. This is influenced by differences in government systems, cultures, situations and conditions of society of each country. Egypt is one of the predominantly Muslim countries which has established Islam as the state religion. Therefore, the principles of Islamic law are the main source of law in the making and formulation of laws, including family law. The practice of Islamic law in Egypt does not fully apply only to areas of family law in a limited scope including the distribution of inheritance and marriage. However, the application of family law in Egypt continues to undergo reforms and reforms. Family law reform took place in Egypt in 1920. This was marked by the promulgation of Law no. 25/1920 regarding family law and care (Law of Maintenance and Personal Status / Qanun al-Ahwal al-Syakhsiyyah wa al-Siyanah). Family law reform in the 1970s was marked by the issuance of laws regarding the authority to the judiciary to force parties (husbands) to pay maintenance fees to wives, widows, children, or parents in 1976. the current era of family law in Egypt continues to experience development. Abstrak Penerapan hukum keluarga di negara-negara yang berpenduduk mayoritas Muslim khususnya kawasan Timur Tengah dan sekitarnya memiliki praktik yang berbeda-beda, kita tidak menemukan keseragaman praktik hukum keluarga di negara-negara tersebut. Hal ini dipengaruhi oleh perbedaan sistem pemerintahan, kultur, situasi dan kondisi masyarakat setiap negara. Mesir merupakan salah satu negara yang berpenduduk mayoritas Muslim yang menetapkan Islam sebagai agama negara. Karena itu, prinsip-prinsip hukum Islam menjadi sumber hukum utama dalam pembuatan dan perumusan undang-undang termasuk hukum keluarga. Praktik hukum Islam di Mesir tidak berlaku secara utuh hanya bidang-bidang hukum keluarga dalam ruang lingkup yang terbatas meliputi pembagian warisan dan perkawinan. Namun, penerapan hukum keluarga di Mesir terus mengalami reformasi dan pembaruan. Pembaruan hukum keluarga terjadi di Mesir pada tahun 1920. Ini ditandai dengan diundangkannya UU No. 25/1920 mengenai hukum keluarga dan penjagaan (Law of Maintenance and Personal Status/Qanun al-Ahwal al-Syakhsiyyah wa al-Siyanah). Reformasi hukum keluarga pada tahun 1970an ditandai dengan dikeluarkannya aturan undang-undang mengenai kewenangan kepada lembaga peradilan memaksa pihak-pihak (suami) untuk membayar uang pemeliharaan kepada isteri-isteri, janda-janda, anak-anak, ataupun orang tua pada tahun 1976. Hingga era sekarang hukum keluarga di Mesir terus mengalami perkembangan.

Abstract

This study aims to determine the implementation of nanau labe marriage in the marriage of the Kaili tribe in Baluse village and the underlying factors as well as to know the legal aspects of this type of marriage. This study uses a mix method of empirical juridical and normative juridical research. In this study, the authors took field data through interviews with the subjects studied regarding the problems contained in the research. Data collection in the field in this study is a characteristic of empirical legal research. In this study the authors also explore legal materials related to marriage for comparison. The use of legal materials in legal research is a characteristic of normative juridical research. Based on the results of the research conducted, the authors conclude that: first, the implementation of the nanau labe marriage in Baluse village is not only carried out for pregnant women and men who are willing to marry them, but also between the pregnant woman and the man who impregnates her. In the implementation of the nanau labe marriage, there has been a shift in customary law regarding the sanctions that apply to the perpetrators of the nanau labe marriage where the sanctions are no longer valid because they consider economic and humanitarian aspects. There are also factors that affect nanau labe marriages, namely promiscuity resulting in pregnancy, irresponsible men impregnating women, inappropriate family communication, selfish attitudes of parents and ensuring the status of the child being born. Second, nanau labe may be carried out if it is based on the opinion of the Hanafi School about the permissibility of marrying pregnant women due to adultery and marrying pregnant women not the result of adultery but must pay attention to the provisions that limit it. The nanau labe marriage does not guarantee legal certainty in the marital relationship, so there is no basis for both parties to the marriage to make demands relating to rights after divorce. Furthermore, the nanau labe marriage does not guarantee legal certainty regarding the status and rights of the child born. Abstrak Penelitian ini bertujuan untuk mengetahui pelaksanaan nikah nanau labe pada perkawinan suku Kaili di desa Baluase dan faktor-faktor yang mendasarinya sekaligus mengetahui aspek hokum dari jenis perkawinan tersebut. Penelitian ini menggunakan mix method dari jenis penelitian yuridis empiris dan yuridis normative. Pada penelitian ini penulis mengambil data lapangan melalui wawancara kepada subjek yang diteliti terkait permasalahan yang terdapat dalam penelitian. Pengambilan data pada lapangan pada penelitian ini merupakan ciri dari penelitian hokum empiris. Dalam penelitian ini penulis juga menelusuri bahan-bahan hokum yang berkaitan dengan perkawinan untuk dilakukan perbandingan. Penggunaan bahan-bahan hokum dalam penelitian hukum merupakan ciri dari penelitian yuridis normatif. berdasarkan hasil penelitian yang dilakukan, penulis menyimpulkan bahwa: pertama, pelaksanaan nikah nanau labe di desa Baluase tidak hanya dilakukan kepada perempuan hamil dan laki-laki yang bersedia untuk menikahinya, tetapi juga dilakukan anatara wanita yang hamil tersebut dengan laki-laki yang menghamilinya. Dalam pelaksanaan nikah nanau labe telah terjadi pergeseran hokum adat mengenai sanksi yang berlakukan pada pelaku nikah nanau labe dimana sanksi tersebut sudah tidak berlaku karena mempertimbangkan aspek ekonomi dan kemanusiaan. Ada pun faktor yang mempengaruhi nikah nanau labe yaitu pergaulan bebas sehingga mengakibatkan kehamilan, laki-laki yang menghimili perempuan tidak bertanggung jawab, komunikasi keluarga yang tidak tepat, sikap egois orang tua dan memastikan status anak yang lahir. Kedua, nanau labe boleh dilakukan apabila didasarkan pada pendapat Mazhab Hanafi tentang kebolehan menikahi perempuan hamil akibat perzinahan dan menikahi perempuan hamil bukan hasil zina tetapi harus memperhatikan ketentuan-ketentuan yang membatasinya. Nikah nanau labe tidak memberikan jaminan kepastian hokum dalam hubungan perkawinan, sehingga tidak ada dasar bagi kedua belah pihak yang melakukan perkawinan untuk melakukan tuntutan yang berkaitan dengan hak-hak setelah perceraian. selanjutnya nikah nanau labe tidak memberikan jaminan kepastian hokum terhadap status dan hak-hak anak yang dilahirkan.

Abstract

The study, entitled "Reasons for Early Marriage Dispensation (Case Study in the Palu Religious Court class IA") aims to provide an overview and explanation of the submission of an early marriage dispensation request at the 1.A Palu Religious Court and the consideration of judges in giving or rejecting requests for dispensation early marriage at the Klas 1 Palu Religious Court. This research was designed using descriptive research type, using a qualitative approach in data collection techniques. The results of the study, pointed out that the reason for the request for marriage dispensation in the Palu Religious Court was due to the fear of slander, pregnancy outside marriage, economic aspects, social aspects, and moral aspects. As for the judges' consideration in providing the determination of marriage dispensations at the hearing, the Panel of Judges used "kaida namely al-mashlahah al-mursalah". because the provisions on age restrictions and marriage dispensation are not explained in detail in the Koran, but the benefits are in line with the shariah action 'which wants to bring benefit to humans (the two brides and their families). Abstrak Penelitian yang berjudul “Alasan Dispensasi Nikah Usia Dini (Studi Kasus di Pengadilan Agama Palu klas IA” ini bertujuan untuk memberikan gambaran dan penjelasan terhadap pengajuan permohonan dispensasi nikah usia dini di Pengadilan Agama Klas 1.A Palu dan pertimbangan hakim dalam memberi atau menolak permohonan dispensasi nikah usia dini di Pengadilan Agama Klas 1 Palu. Penelitian ini di desain dengan menggunakan jenis penelitian deskriptif, dengan menggunakan pendekatan kualitatif dalam teknik pengumpulan data. Hasil penelitian, menujukan bahwa alasan permohonan dispensasi nikah di Pengadilan Agama Palu dikarenakan khawatir timbulnya fitnah, hamil diluar nikah, aspek ekonomi, aspek sosial, dan aspek moral. Sedang mengenai pertimbangan hakim dalam memberikan penetapan dispensasi nikah di persidangan, Majelis Hakim menggunakan”kaida yaitu al-mashlahah al-mursalah”. karena ketentuan pembatasan umur dan dispensasi nikah tidak dijelaskan secara rinci di dalam al-Quran, tetapi kandungan maslahatnya sejalan dengan tindakan syara’ yang ingin mewujudkan kemaslahatan bagi manusia (kedua calon mempelai beserta keluarga).

Abstract

The practice of polygamy which is carried out by some Tunisian society generally torments the wife. This is the basis for the prohibition of polygamy in Tunisia. The purpose of this research is to find out about the prohibition of polygamy in Tunisia which is contained in the Tunisian Family Law. This study uses literature research that focuses on the object of study on existing books and literature. While the method used in this research is descriptive-analysis method, which provides an overview and analyzes the Tunisian family law regarding the prohibition of polygamy. The results of this study indicate that the Tunisian State in implementing the law on the prohibition of polygamy cannot be separated from social politics. The factor is the number of husbands who torment their wives and children. This is one of the reasons that makes the law on the prohibition of polygamy come into effect. Because of the injustice committed by husbands to their wives. But in reality the regulations on the prohibition of polygamy are still not running optimally. This is because there is no common will between the government and the people. Abstrak Praktek poligami yang dilakukan oleh sebagian masyarakat Tunisia pada umumnya menyengsarakan pihak isteri. Inilah yang menjadi dasar pelarangan Poligami di Tunisia. Tujuan penelitian ini adalah mencari tau terhadap pelarangan poligami di Negara Tunisia yang termuat dalam Hukum Keluarga Tunisia. Penelitian ini menggunakan penelitian kepustakaan yang memfokuskan pada objek kajian pada buku-buku dan literature yang ada. Sedangkan metode yang digunakan dalam penelitian ini adalah metode deskriptif-analisis, yaitu memberikan gambaran dan menganalisis Hukum Keluarga Tunisia terkait tentang pelarangan poligami. Hasil dari penelitian ini menunjukkan bahwa Negara Tunisia dalam penerapan undang-undang tentang larangan poligami tidak lepas dari social politik. Faktornya ialah dengan banyaknya para suami yang menyengsarakan pihak isteri dan anak. Inilah salah satu penyebab yang menjadikan berlakunya perundang-undangan tentang larangan poligami. Karena ketidakadilan yang dilakukan suami terhadap para isterinya. Tetapi pada kenyataannya peraturan larangan poligami tersebut berjalan masih belum maksimal. Ini disebabkan karena tidak adanya kesamaan kehendak antara pemerintah dan masyarakat.

Abstract

This research examines the application of customary law as a solution to conflicts between villages in Dolo District, Sigi Regency. This research focuses on solving problems about how to apply customary law as a solution to conflicts between villages in Dolo District. This research method uses a qualitative approach, data collection techniques through observation, interviews or interviews and documentation, data analysis techniques used are data reduction, data presentation, data verification. Then check the validity of the data. What is found in this research is that the solution to prevent conflict in society must involve the roles of all elements, not only the Dolo District government, but the community itself, especially the facilitators, because the progress of an area cannot be separated from the participation of the youth in the area itself. Apart from that, there are obstacles to implementing customary law as a solution to conflicts between villages and what methods or approaches are used in implementing customary law. Abstrak Penelitian ini mengkaji tentang penerapan hukum adat sebagai solusi konflik antar kampung di Kecamatan Dolo, Kabupaten Sigi. Penelitian ini memfokuskan untuk menyelesaikan permasalahan tentang bagaimana penerapan hukum adat sebagai solusi konflik antar kampung di Kecamatan Dolo. Metode penelitian ini menggunakan pendekatan kualitatif, teknik pengumpulan data melalui observasi, interview atau wawancara dan dokumentasi, teknis analisis data yang digunakan adalah reduksi data, penyajian data, verifikasi data.kemudian melakukan pengecekan keabsahan data. Adapun yang ditemukan dalam penelitian ini adalah solusi untuk mencegah terjadinya konflik di masyarakat harus dilibatkan peran dari semua elemen, bukan hanya pemerintah Kecamatan Dolo, tetepi masyarakat sendiri, khususnya pemudah, karenan kemajuan suatu daerah tidak lepas peran serta dari pemuda yang ada diderah itu sendiri. Selain itu, kendala-kendala penerapan hukum adat sebagai solusi konflik antar kampung.serta metode atau pendekatan apa yang digunakan dalam menerapkan hukum adat.
