Jurnal Khuluqiyya diterbitkan oleh Sekolah Tinggi Agama Islam Al-Hikmah 2 sebagai media untuk menyalurkan pemahaman tentang hukum dan studi Islam berupa hasil penelitian lapangan atau laboratorium maupun studi pustaka. Khuluqiyya secara etimologi berarti hukum-hukum yang berkenaan dengan akhlak. Petunjuk untuk mengembangkan potensi kebaikan yang ada dalam diri manusia agar menjadi makhluk terhormat yang sesungguhnya (mulia). Redaksi menerima naskah yang belum pernah diterbitkan dalam media lain dari dosen, peneliti, mahasiswa maupun praktisi dengan ketentuan penulisan, Naskah yang masuk akan dievaluasi dan disunting untuk keseragaman format, istilah dan tata cara lainnya. Khuluqiyya: Journal of Islamic Law emphasizes the study of Islamic family law and Islamic law in Islamic countries in general and specifically by emphasizing the theory of Islamic family law and Islamic law and its practice in the Islamic world that developed in attendance through publications of articles. Scope This journal specializes in studying the theory and practice of Islamic family law and Islamic law in Islamic countries, Islamic studies, Islamic socio-political, Islamic philosophy, Islamic perspectives which are intended to reveal original research and current issues. Abstract

Tujuan dari pembahasan artikel ilmiah ini adalah untuk mengetahui maksud dari Hukum Islam dan keadilan serta relasi antara keduanya, untuk mengetahui urgensi dari keadilan terhadap perkara poligami dan juga untuk mengetahui keadilan sebagai suatu keniscayaan formulasi Hukum Islam. Hukum Islam terdiri dari  syari’at dan fiqh. Syari’at terdiri dari wahyu Allah dan Sunnah Nabi Muhammad dan fiqh adalah pemahaman juga hasil pemahaman tentang syari’at. Adapun keadilan merupakan berasal dari kata ‘adl yaitu adil, sehingga keadilan adalah melakukan suatu perbuatan yang adil. Antara hukum Islam dan keadilan memiliki kaitan atau hubungan, bahwa keadilan merupakan tujuan akhir dari hukum Islam. Tidak dinamakan hukum jika tidak terdapat keadilan dan tidak akan ada keadilan jika tidak ada hukum yang memformulasikannya. Antara keadilan dengan Penyamarataan itu berbeda. Yang dimaksud dengan adil itu bukanlah harus sama rata dan sama rasa. Antara keadilan dan kebijakan, bahwa kebijakan harus tetap mengeksiskan keadilan. Dan kekebalan hukum terjadi jika ada keadilan didalamnya. Keadilan dalam perkara poligami dijadikan sebagai suatu keniscayaan formulasi hukum islam, bahwa dalam perumusan hukum Islam, terdapat yang namanya keadilan. Karena keadilan selalu dijadikan sebuah nilai ideal dalam pembuatan maupun pelaksanaan hukum Islam. Keadilan begitu penting dalam pelaksanaan poligami, hal ini karena keadilan merupakan syarat dalam melaksanakannya sebagaimana firman Allah dalam surah an-Nisa ayat 3 (tiga). Jenis penelitian yang digunakan dalam pengumpulan data-data maupun bahan-bahan penelitian ini adalah studi kepustakaan atau library research

Abstract

This article discusses the importance of observing regulations to prevent marriage at a young age based on the philosophy of Islamic rules (Maqasid asy-Syari'ah). the author put the view that the above regulation is something that must be done. This shows that the application of child marriage to citizens is still relatively high. Mother and child deaths, low human resources, domestic violence & child abuse, and poverty are the effects that occur if child marriages are allowed to continue. Regulations for preventing child marriage are in line with maqasid asy-shari'ah, namely hifz an-nasl (protection of the soul-concern for the family), hifz an-nafs/hifz al-'ird (protection of the soul/honor/maintenance of human dignity), hifz al-'aql (multiplying mindsets & scientific research, prioritizing travel to seek knowledge, avoiding efforts to undermine brain performance), & hifz al-mal (protection of property, increasing the economy).

Abstract

The age of adulthood for marriage has always been a polemic both in terms of cultural factors and even the rules that govern it, the age of adulthood for marriage has long been regulated both in the Compilation of Islamic Law and Law No. 1 of 1974, over time the rules regarding the age limit for marriage have always been in the spotlight of academics so that Seeing these conditions, in 2019 Jokowi Dodo passed the Marriage Law, namely Law number 16 of 2019, seeing this condition it is known that the KHI is a reference for the Religious Court Judge but the KHI does not follow any changes to the Law which is the reference for the Religious Courts , so that with this background the author is interested in writing about the existence of a compilation of Islamic law in Indonesia after the enactment of Law No. 16 of 2019 concerning marriage using a normative juridical research methodology and a statutory approach. Abstract

Indonesia is a constitutional state, where all forms of irregularities have been regulated in order to achieve harmony in human life. In the national legal system there are three elements that play a role, namely customary law, Islamic law and western law. However, are the perspectives of each legal category aligned? This article discusses the perspective of Islamic law and national law in the settlement of adultery crimes using qualitative research methods and approaches to literature studies and interviews. The results of the study show that there are differences regarding the terms and sanctions for adulterers. In Article 284 of the Criminal Code, the perpetrators of adultery who are bound by legal marriage ties only carry a maximum penalty of nine months in prison. Meanwhile, from the perspective of Islamic law, any intercourse between a woman and a man without a valid marriage bond is said to be adultery with two categories of punishments given, namely muhsan adultery where the adulteress is married, the punishment is stoning or stoned to death and adultery ghairu muhsan where the adulteress is never been married, the penalty is binding (100 lashes) and if still alive, then must be exiled to a secluded blood for one year.

Abstract

There are source texts of Islamic law that allow and prohibit the beating of a husband against his wife. Thus it can be said that there is a contradiction in the argument for beating a husband against his wife. Meanwhile, there are different methods in resolving conflicts between arguments used by Ḥanāfiyah and Syafi'iyah scholars. This paper attempts to answer the views of Ḥanāfiyah and Syāfi'iyah regarding the law of beating a husband against his wife and how the methods of resolving conflicting arguments for beating a husband against his wife according to Ḥanāfiyah and Syāfi'iyah. This type of research is library research. The results of the study show that the Ḥanāfiyah and Syafi'iyah scholars both agreed to allow husbands to beat their wives who were nusyuz, it's just that there are some Syāfi'iyah who punish khilāf al-aulā. In resolving conflicting arguments, the majority of Ḥanāfiyah scholars use the nasakh method because the chronology of the text can be known clearly. While the majority of Syafi'iyah scholars use the al-jam'u wa al-taufiq method. According to Syafi'iyah practicing both propositions is better than completely ignoring one of them.

Abstract

The family planning program established by the Indonesian Family Planning Association (PKBI) since 1957 with its services, namely managing or managing pregnancies, treating infertility, and offering marriage counseling for married couples. In its development in the New Order Era, the family planning program was used as a solution to population problems in Indonesia. This family planning aims to regulate childbirth, regulate distance, the ideal age of childbirth, and regulate pregnancy through programs, protection and assistance in accordance with reproductive rights. Islam does not contain rules about family planning but in Islam it is known to exist azl. Here it is important to see how Islam views family planning law. During the Covid-19 pandemic, the government imposed new habits to prevent the transmission of Covid-19. One of them is the family planning program, where mothers give birth during Covid-19 have a higher risk of contracting it. Pregnant women have weaker immunity than non-pregnant women. Here it is important to see how Islam views family planning law during the Covid-19 pandemic. This research is a library research with a normative approach. With primary sources Presidential Decree Number 32 of 1969 concerning the Implementation of the Family Planning Program. The result of this study is a family planning program that aims to create a peaceful, prosperous family, not contrary to Islamic law. Where to protect the health of mothers and children and raise children who are morally straight, smart, and healthy, family planning programs are a solution. Moreover, the recommendation of the family planning program during the Covid-19 pandemic, where to protect the health of mothers and children, the family planning program is the right solution during the Covid-19 pandemic. But family planning is prohibited from using it if it has a terrible social impact and is done with bad intentions
