Abstract

Tujuan memajukan kebudayaan adalah mewujudkan kesejahteraan lahir maupun batin bagi seluruh masyarakat secara adil dan merata. Sedangkan salah satu usaha dalam mencerminkan nilai-nilai luhur bangsa yang harus dilestarikan guna memperkukuh jati diri bangsa, mempertinggi harkat dan martabat, serta memp[erkuat ikatan persatuan dan kesatuan bagi terwujudnya cita-cita bangsa dimasa yang akan datang. Penelisan ini bertujuan untuk mengetahui dan memahami pentingnya dalam melindungi dan melestarikan Cagar Budaya sebagai warisan budaya yang memiliki sifat rapuh, unik, langka, terbatas dan tidak terbarui. Langka yang memotivasi penulis dalam mengkaji aturan-aturan tentang perlindungan hukum terhadap Cagar Budaya dan mengetahui dan menganalisis upaya Pemerintah Daerah dalam perlindungan dan pelestarian terhadap Cagar Budaya di Kabupaten Kepulauan Aru. Metode yang digunakan dalam penulisan ini adalah Yuridis Normatif, dilakukan dengan cara meneliti bahan hukum yang mempunyai relevansi dengan masalah yang akan diteliti. Jawaban yang diperoleh dari penulisan ini bahwa pemerintah atau isntansi terkait belum memberikan hasil yang harapkan dan tidak serius memperhatikan warisan Cagar Budaya. Hal ini disebabkan karena kurangnya perencanaan yang bersifat kesinambungan serta lemahnya koordinasi program antara sector-sektor dan instansi terkait yang bertanggung jawab untuk melindungi dan melestarikan warisan Cagar Budaya, di Kabupaten Kepulauan Aru khususnya di Kota Dobo, tidak mendapat perlindungan dan pelestarian secara baik dan hamper punah keberadaannya.

Abstract

Tujuan dari tulisan ini adalah mengkaji terkait dengan potensi sumber daya alam di Kota Ambon yang berkaitan dengan pembangunan pariwisata, wisata bahari di Kota Ambon dalam amanat UU tentang Kepariwisataan perlu ditetapkan Peraturan Daerah tentang Rencana Induk Pembangunan Kepariwisataan, Rencana Induk Pembangunan Kepariwisataan Daerah ini akan menjadi pedoman dalam pengelolahan wisata bahari di Kota Ambon. Penelitian yang dilakukan dalam penulisan ini adalah penelitian normatife dengan pendekatan peraturan perundang-undangan dan studi kepustakaan. Hasil dari penelitian ini diharapkan pemerintah Kota Ambon segera melakukan penetapan Perda tentang Rencana Induk Pembangunan Kepariwisataan Daerah.

Abstract

There are times when the bank blocks the customer's account so that the customer cannot access the money stored in the bank. This will certainly harm the customer because his money is unilaterally detained by the bank. This writing aims to discuss legal aspects and protection for customers against unilateral blocking by banks. The research method used in this research is normative juridical or what is known as legal research which is carried out by reviewing and analyzing the substance of legislation on the subject matter or legal issue in its consistency with existing legal principles. Blocking of customer accounts can be done based on the request of law enforcement if the funds are suspected to be the result of a crime. Blocking of a customer's account can also be done if the account holds assets belonging to customers who are declared bankrupt so that the curator has the authority to secure the assets. Customers who are harmed due to unilateral account blocking by the bank can take dispute resolution either outside the court or through the court.

Abstract

Land in Murai Lama Village which is the object of use rights is land located in Aru Tengah Benjina District, Aru Islands Regency with a land area of ​​about 26,4062 (twenty six thousand four hundred and six square meters). The land used by the people of Murai Lama Village has a usufructuary status granted by the Kaidel clan on August 13, 1946. This paper wants to examine and analyze how the arrangements for granting customary land rights are made and how legal protection is for owners of land that give rights to parties. other. The type of research used in this legal research is normative legal research. The approach used in a legal research is a law application approach and a conceptual approach. Sources of legal materials come from primary legal materials, secondary legal materials and tertiary legal materials. The results and discussion show that the arrangement for granting land rights has actually been regulated in the laws and regulations in Indonesia. Arrangements for granting rights to customary land of Koba Seltimur Village to Murai Lama Village with rights based on positive legal provisions in force in Indonesia. The positive legal provisions given to the party exercising the right refer to Article 43 of Law Number 5 of 1960 concerning Basic Agrarian Principles which states that land rights can only be transferred, if this is possible in the relevant agreement. Furthermore, regarding this provision, it is embodied in Article 53 paragraph (3) of Government Regulation Number 18 of 2021, Management Rights, Land Rights, Flat Units, and Land Registration which states that the occurrence of use rights is due to legal ownership. While the law of protection for the owner of the land that gives the right of use to the other party is a guarantee of the fulfillment of human rights so that the rights of every citizen are not violated by anyone. Legal protection for land owners who give rights to other parties is very urgent because it presents good land for the benefit of the people of Murai Lama Village so that the rights of indigenous peoples must be protected by the state and the community so as not to cause conflicts that can harm other parties.

Abstract

This research belongs to the normative law research. The research has two problem formulations to find out whether the sub-district head is categorized as abusing authority if he does not supervise the work performance of the village government. And to find out the legal consequences if the sub-district head does not supervise the work performance of the Koijbi village government. This research is a normative juridical research, this research examines legal materials related to the problem, namely the applicable legal norms. The Work Performance of the Koijabi Village Head who discusses matters regulated in Article 25 of Law NO 23 of 2014 concerning Regional Government. Furthermore, Government Regulation of the Republic of Indonesia Number 17 of 2018 concerning Districts in article 1. The duties of the Village Head are regulated in Law Number 6 of 2016 concerning Villages articles 26 and 27 and Article 28.

Abstract

The purpose of this paper is to examine the arrangement of traditional villages in Indonesia, which in its development nomenclature must be used in accordance with the Minister of Home Affairs Regulation No. 1 of 2017 concerning Village Arrangement is to use the nomenclature of changing the status of the village to become a traditional village. the basis for consideration is that the status of the community called customary community units still has the status of a village. The research method used in this research is a normative research method with an approach to legislation and literature study, theory and legal principles.

Abstract

Penelitian ini bertujuan yang Pertama Mengkaji dan menganalisis indikator masyarakat hukum adat di Indonesia berdasarkan ketentuan Pasal 18B ayat (2) UUD 1945; Kedua, Mengkaji dan menganalisis pengaturan hak-hak dan wewenang masyarakat hukum adat dalam pengelolaan sumber daya alam pada petuanan laut; Jenis penelitian yang digunakan dalam penelitian ini yaitu Penelitian ini akan menggunakan tipe penelitian hukum normatif yaitu suatu proses untuk menemukan aturan hukum, prinsip-prinsip hukum, maupun doktrin-doktrin hukum guna menjawab isu hukum yang dihadapi serta suatu penelitian yang terutama mengkaji ketentuan-ketentuan hukum positif maupun asas-asas hukum. Hasil penelitian menunjukkan Bahwa Pengaturan eksistensi masyarakat hukum adat sebagaimana diatur dalam Pasal 18B ayat (2) UUD 1945 merupakan pengakuan bersyarat yang dilakukan oleh negara. Syarat eksistensial ini tidak perlu dicantumkan dalam Pasal 18B ayat (2) UUD 1945, oleh karena politik hukum pembentukan pasal ini sebagai upaya reformasi terhadap Undang-Undang Nomor 5 Tahun 1979. Pada hakikatnya pengaturan dalam Undang-Undang Nomor 5 Tahun 1979 tersebut bertentangan dengan Pasal 18 UUD 1945 (sebelum amandemen), karena tidak mengakui adanya hak-hak masyarakat hukum adat. Pengaturan hak dan wewenang masyarakat hukum adat dalam berbagai undang-undang tidak mengakomodir adanya hak dan wewenang masyarakat hukum adat dalam pengelolaan sumber daya alam pada wilayah pesisir (petuanan laut). Masyarakat hukum adat yang memiliki hak bawaan tentunya akan dirugikan dari pengaturan tersebut. Padahal, hak dan wewenang masyarakat hukum adat merupakan hak bawaan yang diakui dalam UUD 1945, karena itu masyarakat hukum adat tetap memiliki hak dan wewenang dalam pengelolaan sumber daya alam pada wilayah petuanan laut. Masyarakat Di Kepulauan Kei (Tanimbar Kei) secara nyata telah mengatur dalam Peraturan Adat terkait penyelenggaraan kegiatan di wilayah petuanan pesisir dan laut, menunjukan bahwa masyarakat di Kepaualauan Kei (Tanim,bar Kei) masih eksis dalam pengelolaan wilayah petuanan pesisir dan laut.

Abstract

Law of the Republic of Indonesia number 19 of 2019 concerning the second amendment to law number 30 of 2002 concerning the Corruption Eradication Commission was formed with the aim of increasing the efficiency and effectiveness of efforts to eradicate corruption. In carrying out its duties, the Corruption Eradication Commission was given the authority to conduct investigations, investigations, and prosecutions (indictments) of corruption crimes involving law enforcement officers, state administrators, and other people related to corruption crimes committed by law enforcement officers or state administrators.

Abstract

This study aims 1) to find out how effective the formation of regional regulations for Batang Hari Regency is based on the Regulation of the Minister of Home Affairs Number 80 of 2015 concerning the Establishment of Regional Legal Products. 2) To find out the inhibiting factors in the formation of regional regulations in Batang Hari Regency. The type of research is empirical juridical. The procedure for sampling is done by purposive sampling. Then the analysis of the data obtained, namely primary data and secondary data collected is drawn into a conclusion inductive method, namely from general data formulated in the form of questions. The results show that the formation of regional regulations in Batang Hari Regency is based on the Minister of Home Affairs Regulation Number 80 of 2015 concerning the Establishment of Regional Legal Products, the proposed Ranperda can be submitted by the regional government or DPRD. With the existence of local governments, it is expected to be effective in the practice of making local regulations by adjusting the interests of the community. The formation of regional regulations is required to prioritize the interests of the community, so it is hoped that there will be maximum cooperation between agencies related to the regional government so as to produce a regional regulation that has aspects of justice and legal certainty for the people of Batang Hari Regency.
