Abstract

The existence of marriage at a young age caused by the request of parents in the district of Muara Bangkahulu into a phenomenon that wanted to be examined by the author.  What is the underlying  cause of underage marriage due to parents’  requests in Muara Bangkahulu Subdistrict  and  how  Islamic law’s view of marriage at a young age caused by parental demand is a matter of concentration. This research is field research using descriptive analytic method. The results of this study indicate that the cause of marriage at a young age caused by the demand of parents in Muara Bangkahulu District is due to economic factors, socio-cultural and parents’ concerns about  the negative  impact  of globalization.  While the view of Islamic law against  marriage at a young age because the request of parents is to allow parents to ask their children  to marry even though still at a young age as long as there  is a clear reason and not harm the child.

Abstract

Abstrak: Kewajiban suami terhadap istri yang paling pokok setelah akad nikah adalah kewajiban pemberian nafkah baik secara lahir yakni pemenuhan kebutuhan rumah tangga dan batin yakni pemenuhan kebutuhan biologis. Dalam sebuah hadis ditunjukkan bahwa pemberian nafkah yang pantas adalah wajib bagi suami untuk istri atas kehalalan suami terhadap kemaluan istri. Di Desa Somagede ditemukan bahwa saat istri membantu suami mencari penghasilan untuk memenuhi kebutuhan keluarganya, ada sebagian suami yang tidak memberikan nafkah lagi pada istrinya dengan alasan bahwa istrinya telah bekerja sehingga menganggap bahwa nafkah telah gugur. Jenis penelitian ini adalah penelitian lapangan. Teknik pengumpulan data, yaitu dengan wawancara, observasi, dan dokumentasi. Subjek penelitian ini adalah pasangan suami istri yang bekerja di Desa Somagede Kabupaten Banyumas. Sedangkan objek penelitianya adalah praktik pelaksanaan pemberian nafkah dari suami kepada istri yang berpenghasilan di Desa Somagede Kabupaten Banyumas. Nafkah wajib hukumnya dipenuhi oleh suami berdasarkan nash-nash yang bersumber dari al Qur’an, hadis dan ijma.Nafkah adalah hak istri meskipun ia kaya dan suaminya miskin. Kewajiban memberi nafkah kepada istri tidak gugur, kecuali jika istri membangkang atau nusyuz. Tentang praktik pemberian nafkah dari suami pada istri yang berpenghasilan di Desa Somagede Kabupaten Banyumas berdasarkan hasil wawancara peneliti dengan responden, masing-masing keluarga mempunyai cara yang berbeda dalam mengaplikasikan kewajiban memberi nafkah pada istrinya. Sedangkan menurut sosiologi hukum Islam, suami tetap wajib memberikan nafkah pada istri yang berpenghasilan sendiri sesuai dengan kemampuannya tanpa menuntut nafkah melebihi batas kemampuan suaminya.Kata kunci: Nafkah, Berpenghasilan, Sosiologi Hukum Islam. Abstract: The most basic obligation of a husband to his wife after the marriage contract is the obligation to provide a living both physically, namely the fulfillment of household needs and spiritually, namely the fulfillment of biological needs. In a hadith it is shown that it is obligatory for a husband to provide a proper living for his wife for the husband's lawfulness of the wife's genitals. In Somagede Village, it was found that when the wife helps her husband earn an income to meet the needs of his family, there are some husbands who do not provide any more support for their wives on the grounds that their wives have worked so they think that their livelihoods have died. This type of research is field research. Data collection techniques, namely by interview, observation, and documentation. The subject of this research is a married couple who work in Somagede Village, Banyumas Regency. While the object of the research is the practice of providing a living from husband to wife who earns income in Somagede Village, Banyumas Regency. The husband's obligatory livelihood is fulfilled by the husband based on texts sourced from the Qur'an, hadith and ijma. Sustenance is the right of the wife even though she is rich and her husband is poor. The obligation to provide a living for the wife does not fall, unless the wife disobeys or nusyuz. Regarding the practice of giving a living from a husband to a wife who earns money in Somagede Village, Banyumas Regency, based on the results of interviews with respondents, each family has a different way of applying the obligation to provide for their wives. Meanwhile, according to the sociology of Islamic law, the husband is still obliged to provide a living for his wife who earns herself according to her ability without demanding a living beyond the limits of her husband's ability.Keywords: Live, Earn, Sociology of Islamic Law.

Abstract

Tujuan dari penulisan mengetahui, mendeskdripsi, menganalisis dan memberikan pengetahuan kepada masyarakat tentang hikmah yang terkandung atas wabah penyakit virus corona dalam kehidupan manusia sehari-hari. Adapun hikmah atau pelajaran yang dapat diambil atas wabah virus corona diantaranya, manusia dianjurkan untuk makan dan minum yang halal, baik, sehat dan bergizi;, manusia harus memperoleh dan mengolah makanan dan minuman sesuai dengan ketentuan syariah, misalnya tidak memakan makanan yang tidak dimasak secara sempurna, tidak memakan makanan yang bisa mengundang penyakit misalnya makan tikus, ular, kelelawar dan hewan lainnya;, manusia harus menjaga kebersihan, baik kebersihan lahir dan kebersihan bathin misalnya menjaga kebersihan diri, pakaian, lingkungan dan menerapkan pola hidup sehat. Manusia bisa mengendalikan emosi dan amarahnya dalam menghadapi berbagai masalah misalnya jangan mudah panik, jangan mudah terprovokasi dengan kabar atau berita yang tidak bertanggungjawab. Manusia harus banyak melakukan aktivitas positif dan menjauhi aktivitas negatif. Aktivitas positif misalnya berolahraga secara teratur, beribadah, berbuat kebaikan (sedekah, infak atau sumbangan) kepada yang membutuhkan dan aktivitas positif lainnya, sedangkan Aktivitas negatif misalnya minuman keras, perjudian, perzinaan dan aktivitas negatif lainnya. Mempertebal keimanan kita dan menyakinkan bahwa Allah SWT Maha Kuasa atas segalanya;, melaksanakan anjuran, himbauan dan perintah pemimpin (ulil amri) selama perintahnya dalam melakukan hal kebaikan;, yakin bahwa musibah atau wabah penyakit yang melanda manusia saat ini merupakan peringatan dari Allah SWT agar kita senantiasa berada dijalan-Nya;, berikhtiar, berdoa dan tawakal kepada-Nya; Dan Manusia harus yakin bahwa wabah atau musibah yang sedang melanda umat manusia saat ini akan segera berakhir dengan izin-Nya.

Abstract

Humans need to carry out marriage in order to legalize the relationship between the prospective husband or wife. Given the importance of marriage to human life, it is appropriate for marriage rules to be regulated in such a way that it can minimize the occurrence of problems in the field of marriage. One important thing to realize orderly in the field of marriage is the existence of legal certainty in the field of marriage, especially on marriage dispensation in prospective husband / future wife whose age has not been eligible by law. The law governing marriage is Law no. 1 of 1974 and the Compilation  of Islamic Law. One of the issues  discussed in the Act and KHI is the minimum age limit for marriage. Therefore it must be prevented the existence of underage marriage. The type of research used is qualitative research, which produces descriptive data in the form of words or oral from people and observed behavior. Based on the formulation of problems and research objectives, the approach method used is the sociological juridical approach. Means that this study could include research on legal principles, legal systematics, legal synchronization, legal history, and  comparative law.  While  the  sociological means this research consists  of research on legal identification (not  written)  and  research on the  effectiveness of the  law. Research location in Religious Court of Bengkulu  City. The data  used  in this study consist  of primary data  and secondary data.  Data obtained from both the literature  and the interview  will be analyzed  by using qualitative  analysis method, a research procedure that produces analytical  descriptive data.  In this analysis,  the authors conclude that the determination of the dispensation has been juridically appropriate. While the sociological reasons proposed by the applicant is not in an ideal position. This lack of ideals is due to the fact that the applicant does  not have a plan to mature marriage, the status  of the applicant who is still a student, and has not / does not have a job or income to support  the family.

Abstrak : Rumusan penelitian ini adalah Bagaimana pertimbangan hukum atas terbitnya Surat Keputusan Bersama Menteri dalam memutuskan membubarkan Organisasi Masyarakat Front Pembela Islam. Bagaimana Pandangan Hukum Administrasi atas Pembubaran Organisasi Masyarakat Front Pembela Islam. Bagaimana Tinjauan Hak Asasi Manusia atas Pembubaran Organisasi Masyarakat Front Pembela Islam. Jenis penelitian ini adalah Yuridis Normatif dan Kepustakaan (library research) Hasil penelitian Pertimbangan atas terbitnya surat keputusan bersama menteri yang mencakup instansi kementerian dan lembaga penegak hukum kepolisian dan kejaksaan memuat tiga aspek yaitu aspek filosofis, sosiologis dan yuridis, Hukum Administrasi menilai pembubaran front pembela islam melalui Surat keputusan bersama menteri menyatakan tidak terdaftar sebagai organisasi masyarakat yang secara de jure dianggap bubar tersebut sudah sesuai dengan prosedur dan mekanisme yang ada dengan hanya tidak diperpanjang status badan hukumnya yang secara de jure otomatis tidak diakui lagi legalitasnya sebagai badan hokum Pandangan Hak asasi manusia atas pembubaran front pembela islam (FPI) berdasarkan Surat Keputusan Bersama Menteri tersebut bahwa terhadap Hak berserikat, berkumpul, dan mengemukakan pendapat tidak boleh di larang karena menyangkut hak dasar warga Negara dalam Negara demokrasi namun disisi lain hak – hak tersebut harus dibatasi oleh hukum dan undang – undang   Atau melalui putusan pengadilan yang berkekuatan hukum tetap.Kata kunci: Yuridis, Pembubaran Front Pembela Islam. Abstract : The formulation of this research is how the legal considerations for the issuance of a Joint Ministerial Decree in deciding to dissolve the Islamic Defenders Front Community Organization. What is Administrative Law's View on the Dissolution of the Islamic Defenders Front Community Organization. How is the Human Rights Review on the Dissolution of the Islamic Defenders Front Community Organization. This type of research is normative juridical and library research. The results of the study. Consideration of the issuance of a joint ministerial decree covering the ministry and law enforcement agencies of the police and the prosecutor's office contains three aspects, namely philosophical, sociological and juridical aspects, Administrative Law assesses the dissolution of the Islamic defense front through a joint ministerial decree stating that it is not registered as a community organization which is de jure considered disbanded, it is in accordance with existing procedures and mechanisms with only the status of a legal entity not being extended which de jure automatically no longer recognizes its legality as a legal entity. the dissolution of the Islamic Defenders Front (FPI) based on the Joint Ministerial Decree that the rights of association, assembly, and expression of opinion should not be prohibited because it involves the basic rights of citizens in a democratic country, but on the other hand the rights This must be limited by laws and regulations or through court decisions that have permanent legal force.Keywords: Juridical, Dissolution of the Islamic Defenders Front

Abstract

This study  aims to determine the legal considerations in rejecting the application of marriage  dispensation in the Manna  Religion Court and  to find out the determination of the Manna  Religion Court Number  0024  / Pdt.P  / 2018  / PA.Mna in accordance with the  elements  of legal justice, legal certainty  and  legal benefits.  Based  on the  results of the  research, it is known that the legal consideration of the refusal of marriage  dispensation applications because the Petitioners  in the trial only submitted 1 (one)  witness so that the applicants  could not prove  the argument of their petition  and  in court found  a fact that the children of the applicant  had been  married  before the application for marriage  dispensation was tried . The cause  of rejec- tion of marital dispensation of minors due to actions that are contrary  to Article 7 of Act Number  1 of 1974.  Determination of the Manna  Religion Court  Number  0024  / Pdt.P  / 2018  / PA.Mna is in accordance with the elements  of justice, certainty  and legal benefit because in the Determination of the application for marriage  dispensation is guided  by Law Number  1 of 1974. The results of this study, are expected to be a deterrent effect for the community and the Office of Religious Affairs, so as not to violate Law Number  1 Year 1974  by marrying minors without the Religion Court dispensation. The rejection of the granting of marriage  dispensation in substantial  justice will be difficult to be felt by the applicants, but in order to enforce procedural justice, the stipulation  of marital dispensation creates order in recording  marriage

Abstract

Abstrak :Penelitian ini membahas dua kajian pokok perkara yaitu: 1) Bagaimana Kedudukan Perkara Nomor 1098/Pdt.G/2021/PA.Bn dalam Undang-Undang Nomor 50 Tahun 2009? 2) Bagaimana kedudukan Perkara 1098/Pdt.G/2021/PA.Bn dalam tinjauan Nebis In Idem? 3) Bagaimana Perkara Nomor 1098/Pdt.G/2021/PA.Bn dalam Perspektif Hukum Islam?. Tiga permasalahan ini dibahas dengan menggunakan jenis penelitian hukum normatif dengan studi kepustakaan. Adapun pendekatan yang digunakan dalam penelitian ini adalah pendekatan kasus, pendekatan perundang-undangan, dan pendekatan analitis. Hasil dari penelitian ini ialah 1) Kedudukan putusan perkara Nomor 1098/Pdt.G/2021/PA.Bn dalam perspektif Undang-undang Nomor 50 Tahun 2009 tentang Peradilan Agama, secara tekstual memang bertentangan dengan Pasal 70 ayat (6) Undang-undang Nomor 50 Tahun 2009 tentang Peradilan Agama. 2) Putusan perkara cerai talak Nomor 1098/Pdt.G/2021/PA.Bn ini jika ditinjau dari asas ne bis in idem, telah memenuhi syarat berlakunya asas ne bis in idem dalam perkara ini. 3) Putusan Perkara Nomor 1098/Pdt.G/2021/PA.Bn Perspektif Hukum Islam, kedudukan putusan perkara Nomor 1098/Pdt.G/2021/PA.Bn yang telah ditetapkan oleh Hakim Pengadilan Agama Bengkulu Kelas 1 A telah sesuai dengan hukum Islam, karena dalam pertimbangan hukum putusan itu, hakim menghindari kemudharatan yang lebih parah jika pernikahan itu dilanjutkan, maka hakim mencari kemaslahatan dan mengedepankan keadilan dengan tetap menerima perkara tersebut dengan mengenyampingkan peraturan perundang-undangan semata-mata demi keadilan, kepastian dan kemanfaatan para pihak.Kata Kunci : Putusan Hakim, Cerai Talak, Asas Nebis In Idem, UU Nomor 50 Tahun 2009 dan Hukum Islam Abstract: This study discusses two main studies of the case, namely: 1) What is the Status of Case Number 1098/Pdt.G/2021/PA.Bn in Law Number 50 of 2009? 2) What is the position of Case 1098/Pdt.G/2021/PA.Bn in the Nebis In Idem review? 3) What about Case Number 1098/Pdt.G/2021/PA.Bn in the Perspective of Islamic Law?. These three issues are discussed using a normative legal research type with a literature study. The approaches used in this research are case approach, statutory approach, and analytical approach. The results of this study are 1) The position of the decision of the case Number 1098/Pdt.G/2021/PA.Bn in the perspective of Law Number 50 of 2009 concerning Religious Courts, is textually contrary to Article 70 paragraph (6) of Law Number 50 of 2009 concerning Religious Courts. 2) The decision on the talak divorce case Number 1098/Pdt.G/2021/PA.Bn, when viewed from the ne bis in idem principle, has fulfilled the requirements for the application of the ne bis in idem principle in this case. 3) Decision on Case Number 1098/Pdt.G/2021/PA.Bn Islamic Law Perspective, the position of the decision on case Number 1098/Pdt.G/2021/PA.Bn which has been determined by the Bengkulu Religious Court Judge Class 1 A is in accordance with the law Islam, because in the legal considerations of the decision, the judge avoids more severe harm if the marriage is continued, then the judge seeks benefit and prioritizes justice by continuing to accept the case by setting aside statutory regulations solely for the sake of justice, certainty and benefit of the parties.Keywords: Judge's Decision, Divorce Divorce, Nebis In Idem Principle, Law Number 50 Year 2009, and Islamic Law.

Abstract

Penelitian ini bertujuan untuk mengetahui perbedaan dalam prosedur penyelesaian kasus perceraian di Pengadilan Agama Arga Makmur dan melalui pengadilan wilayah di Distrik Mukomuko, dan untuk mengetahui penerapan kepastian hukum dan efektivitas dalam persidangan Pengadilan Agama Arga Makmur di Mukomuko Distrik dalam pandangan hukum positif dan hukum Islam. Jenis penelitian ini adalah penelitian lapangan dengan pendekatan yuridis normatif. Teknik pengumpulan data adalah wawancara dan dokumentasi. Sedangkan teknik analisis data yang digunakan adalah kerangka berpikir induktif, yaitu cara berpikir dengan menarik kesimpulan dari data tertentu. Hasil dari penelitian ini adalah: 1) Perbedaan dalam prosedur penyelesaian kasus perceraian di Pengadilan Agama Arga Makmur dan melalui pengadilan bergerak di Distrik Mukomuko, yaitu dalam prosedur untuk mengimplementasikan pengadilan sirkuit penyelesaian kasus yang didengar di balai desa di bidang pemohon, sementara dalam hal biaya dan waktu persidangan tidak menemukan perbedaan dan penyelesaian kasus perceraian melalui persidangan secara umum di kantor pengadilan; 2) Penerapan kepastian hukum dan keefektifan sidang keliling Pengadilan Agama Arga Makmur di Kabupaten Mukomuko dalam pandangan hukum positif dan hukum Islam adalah efektivitas penyelesaian kasus perceraian melalui sistem pengadilan keliling oleh Arga Makmur Pengadilan Agama dalam upayanya membantu orang miskin agar menjadi efektif hanya dalam hal waktu perjalanan dan biaya transportasi saja, untuk prosedur pelaksanaan dan lainnya tetap sama, tidak ada perbedaan yang ditemukan seperti penyelesaian kasus perceraian melalui persidangan pada umumnya di kantor pengadilan. Relevansi sistem kebijakan untuk menyelesaikan kasus perceraian di Indonesia adalah bahwa pengadilan wilayah dalam konteks kasus perceraian tidak tepat, karena pada dasarnya perceraian dilarang. Dan jika prosedur perceraian difasilitasi, lebih banyak orang di Indonesia akan bercerai.

Abstract

This research  raises the issue of punishment imposed by the judges on Curup  District Court  Number  7 / Pid.Sus. Anak / 2016  / PN.Crp  to the child as the perpetrator of rape  accompanied by the murder  of the child victim. The purpose of this research  is to know the punishment and  basic consideration of judges panel  then  reviewed  from positive law and  Islamic law. This research  uses normative juridical legal method, with approach of Act, case approach and  conceptual approach. The method of collecting legal material  used  is literature  study  and  documentary study  then  analyzed  by normative descriptive. From the results of research  shows that the implementation of criminal punishment for perpetrators of rape coupled  murder  of children  in terms of positive law can be implemented by the panel  of judges by applying  Article 81 paragraph (1) of Law RI.35 Year 2014  About Amendment to Law no. 23 of 2002  in conjunction with Article 76D of RI Law. 35 of 2014  on Amend- ment to Law No. RI. Article 55 Paragraph (1) and (2) of the Indonesian Criminal Code  and Article 80 Paragraph (3) of RI Law No. 23 Year 2002  on Child Protection jo Article 55 Paragraph (1) of the Criminal Code  jo Article 65 Paragraph (1) and  (2)35 Year 2014  About Amendment to Law no. Law No. 23 Year 2002  on the Protection of Children  in conjunction with Article65 Paragraph (1) and  (2) of the Criminal Code  are cumulative. Whereas  in Islamic law the perpetrator may be subjected to a more  severe  crime (murder)  which is the murder  in which the perpetrator is assumed to have  committed  intentional  murder with the punishment of the principal in the form of diat and  kafarat, the substitution  of ta’zir and  the additional punishment of the inheritance and  will. Abstract

Abstrak: Perwalian merupakan kewenangan yang diberikan kepada seorang subjek hukum melalui putusan Pengadilan untuk mewakili seorang anak yang belum dewasa dalam melakukan perbuatan hukum. Pada dasarnya hanya akan ditetapkan seorang wali bagi anak dalam perwalian. Pasal 8 PP Nomor 29 Tahun 2019 tentang Syarat dan Tata Cara Penunjukan Wali mengatur bahwa penunjukan wali dilakukan berdasarkan permohonan atau wasiat orang tua. Pada tahun 2021 terdapat 6.363 perkara permohonan perwalian yang diputus di Pengadilan Agama yang mana hal tersebut meningkat dari tahun-tahun sebelumnya. Tujuan dari penelitian ini yaitu untuk mengkaji dan menganalisis mengenai perlindungan hukum bagi seorang anak dalam perwalian yang diajukan oleh kedua belah pihak keluarga. Metode penelitian yang digunakan dalam penelitian ini yaitu metode yuridis normatif dengan memperoleh data dari studi kepustakaan dan studi lapangan. Hasil penelitian ini dapat disimpulkan bahwa perlindungan hukum bagi seorang anak yang berada dibawah perwalian adalah sama dengan perlindungan hukum bagi seorang anak yang berada dibawah kekuasaan orang tua karena seorang wali merupakan peran pengganti orang tua dimana perlindungan hukum tersebut dapat dilakukan dengan memenuhi hak-hak anak yang telah diatur dalam peraturan perundang-undangan dan adanya Balai Harta Peninggalan sebagai wali pengawas juga menjadi salah satu upaya perlindungan terhadap harta kekayaan anak yang berada dibawah perwalian.Kata Kunci: Anak, Perlindungan Hukum, Perwalian. Abstract: Guardianship is an authority given to a legal subject through a court decision to represent a child who is not yet an adult in carrying out legal actions. Basically only a guardian will be appointed for the child in the guardianship. Article 8 of PP Number 29 of 2019 concerning Terms and Procedures for Appointment of Guardians stipulates that the appointment of guardians is carried out based on the request or will of the parents. In 2021 there were 6,363 cases of guardianship applications that were decided in the Religious Courts, an increase from previous years. The purpose of this study is to examine and analyze the legal protection for a child in guardianship proposed by both parties of the family. The research method used in this research is the normative juridical method by obtaining data from literature studies and field studies. The results of this study can be concluded that legal protection for a child who is under guardianship is the same as legal protection for a child who is under parental control because a guardian is a substitute role for parents where legal protection can be carried out by fulfilling the rights of children who has been regulated in laws and regulations and the existence of Balai Harta Peninggalan as supervisory guardian is also one of the efforts to protect the assets of children who are under guardianship.Keywords: Chlidren, Legal Protection, Guardianship.
