Abstract

Continental shelf is a relatively new concept in international law of the sea. Full authority and exclusive rights over natural resources located in the continental shelf region and its ownership is on the coastal state, where the meaning of this natural wealth is a source of minerals and other lifeless on the seabed and subsoil. Through the establishment of the United Nations Convention on the Law of the Sea 1982, as well as enactment of the provisions of the New Law of the Sea, Indonesia is an archipelagic state which is seen as a unified whole between the islands and waters. We realized the sea was rich in minerals mining goods that is priceless natural resources, which is expected to be able to fulfill the needs of the world if mineral resources on land are not sufficient or run out completely. In Indonesia, mostly consisting of ocean territory, surely have the very wide continental shelf, where there is a variety of natural resources, especially oil and gas resources. Hence it needs regulation for the natural resources utilization in the region.Keywords :  Continental Shelf, Natural Resources, Seabed and Subsoil.

Abstract

Product of local government is needed to regulate various aspects in a area, especially in regulating the distribution of alcohol. While, Cilegon a pluralistic society because it is a gateway island of Java-sumatera, so it takes the right product from the target governmentThe results showed that the city government is committed to eradicate Cilegon liquor circulation by issuing a Regional Regulation No. 5 of 2001 on Decency Abuse, Alcohol, Gambling, Drug Abuse, Psychotropic and other Addictive Substances. That rule is a reference in the discipline and control of liquor producers and consumers. Obstacles encountered in circulation curb liquor constrained in financing and the availability of human resources, especially law enforcement officers. Abstract

AbstractThe act of someone who gives something to someone else, of course it is allowed, however when the gift is an expectation to be able to influence the decisions or policies of the officials who were given a gift, then giving it not only a sign of greeting or thank you, but as a attempt to obtain the advantages of an officer or examiner that will affect the integrity, independence and objectivity, such actions included in the definition gratification. Corruption can’t be separated from what is called a gratification. One form of gratification that is still under discussion and debate among the public and the legal profession is Gratification of sexual services, which are made by women as objects and items that can be bought and sold. Women who used to lobby or as a gift to state officials who want to cooperate with corruption bribe giver. Although not stipulated in the legislation specifically, gratification of sexual services have negative effects for the implementation of the State government, and should be anticipated more seriously in order to achieve a clean governmentKeyword : Judicial review, gratification, sex service. AbstrakPerbuatan seseorang yang memberikan sesuatu kepada orang lain tentu saja hal tersebut diperbolehkan. Namun ketika pemberian tersebut merupakan suatu harapan untuk dapat mempengaruhi keputusan atau kebijakan dari pejabat yang diberi hadiah, maka pemberian itu tidak hanya sekedar ucapan selamat atau tanda terima kasih, akan tetapi sebagai suatu upaya untuk memperoleh keuntungan dari pejabat atau pemeriksa yang akan mempengaruhi integritas, independensi serta objektivitasnya, perbuatan tersebut termasuk dalam pengertian gratifikasi. Korupsi tidak dapat dipisahkan dari apa yang disebut gratifikasi. Salah satu bentuk gratifikasi yang masih dalam pembahasan dan perdebatan di kalangan masyarakat dan profesi hukum adalah gratifikasi layanan seksual, yang dibuat oleh wanita sebagai obyek dan item yang dapat dibeli dan dijual. Perempuan yang digunakan untuk melobi atau sebagai hadiah kepada pejabat negara yang ingin bekerja sama dengan pemberi suap korupsi. Meskipun belum diatur dalam peraturan perundang-undangan secara khusus, gratikasi pelayanan seksual memberikan efek negatif bagi penyelenggaraan pemerintahan negara, dan perlu diantisipasi lebih serius demi tercapainya pemerintahan yang bersih.Kata kunci : Tinjauan yuridis, gratifikasi, pelayanan seks

Abstract

Indonesian Criminal Justice System consists of the police, public prosecutor and the courts. The role of the police investigators is certainly vital as the frontline in building public confidence in the rule of law in Indonesia. The role of the investigator is very big in the realization of justice in society. The era of globalization which demands a pattern of life that is fast-paced, instant, measurable, and transparent requires investigators to follow the times by optimizing the use of technology. The aim is to give effect to the rule of law in Indonesia that provides fairness, expediency and certainty. However that must be considered is the priority values of Pancasila in the process of inquiry and investigation. The values of supreme divinity, God (religious), humanity, unity, democracy and justice are values that establish a balance (harmony) in enforcing the law. Law and its implementation so that the product meets the demands for social justice. Abstract

Tulisan ini membahas tentang asas-asas hukum yang harus diimplementasikan dalam pembentukan peraturan perundang-undangan, dan implementasi asas-asas hukum dalam pembentukan peraturan perundang-undangan yang partisipatif dan berkeadilan. Dengan metode pendekatan yuridis normatif dapat disimpulkan bahwa pembentuk peraturan perundang-undangan seringkali mengabaikan asas-asas hukum, karena asas hanya merupakan sebuah ide yang abstrak dan bersifat umum dan tidak memuat tentang sanksi. Implementasi asas-asas pembentukan peraturan perundang-undangan dan asas-asas materi muatan peraturan perundang-undangan belum optimal, sehingga masih sering terjadi sebuah peraturan perundang-undangan ketika diimplementasikan mendapatkan penolakan atau resistensi dari masyarakat.

Abstract

Imperialisme di era globalisasi adalah meningkatnya marginalisasi / hilangnya identitas sebuah bangsa termasuk bangsa Indonesia, dan digantikan oleh ideologi liberalisme. penyebab hukum dan sistem hukum kami terasa kering dari nilai-nilai kemanusiaan dan keadilan sosial.Perasaan keadilan tidak dapat dihapus dari akar di mana hukum lahir, keadilan tidak dapat dipisahkan dari nilai-nilai/hukum agama dan hukum adat yang hidup dalam masyarakat, dan merupakan hal yang wajar bahkan sebuah "semangat zaman" terutama bagi bangsa Indonesia untuk mengakomodasi nilai-nilai itu ke dalam hukum nasional yang di cita-citakan.Kata Kunci : Liberalisme, Sekularisme, Keadilan, Pancasila.

Abstract

The emergence of idea toward the candidates of president and vice president independently is influenced by the people distrust tendency due to the role and functioning of political parties at this time.The national leadership quality has not been measured because of many leaders tends to pragmatic and ambiguous, this is because; lack of leaders resource quality who has specific character at the branches of country power in all stratification, as well as the rising phenomenon of leader who is oriented only to maintain power. Therefore, it seems reasonable if people expect the president and vice president candidates independently appropriate to the people in the upcoming election. The efforts were made in order to be approved of presidential and vice presidential independently in the upcoming elections by recovering enactment UU No. 42 Year 2008 about the President and Vice-President Election toward UUD 1945. Additionally alternatives can be pursued in adopting an independent candidate by constitutional convention. Abstract

Abstract            The Government of the Republic of Indonesia in its efforts to improve the performance of a notary in Indonesia, reflected by the enactment of Law Notary No. 30 of 2004 on October 6, 2004 in exchange for Notary Regulation colonial products, and then because of the changing times and the needs of law that have not been accommodated, so that the necessary adjustment, some chapters of UUJN Number 30 Year 2004, then the enactment of Indonesian Republic Laws Number 2 Year 2014 concerning Notary (hereinafter referred UUJN), and entered into force on January 15th, 2014, wherein the arrangement also supervise the performance of the notary who made the Minister of Law and Human Rights R.I, in this case implementation oversight is monitoring by the the Supervisory Council of the Association of Notaries Indonesia, overall it is the device legislation to regulate and supervise the performance of Notary in Indonesia,            Notary is a public official should have several characteristics inherent in their duties, among others: responsibility, discipline, quality of work, morality and code of professional conduct, skills also his duty in this case related to "apprenticeship" which is one of the requirements absolute to be appointed as a Notary. Notaries are figures of human resources which runs most of the state administration in the field of civil law, so that if a country is not supported by the resources of qualified notary, then it will be one of the factors inhibiting the development of the national economy or global economic.            Law Notary Public service users, consider the deeds of Notary trust worthy and can serve as strong evidence in case of a legal dispute in court and expects to provide legal certainty guarantee for the correctness of the contents of the deed he had done, because the notary service users assume that notary much more to understand and master the field of science, so that people feel safe if desired intent will be poured right into authentic deed that made by notary who self-selected by themselves, because of the belief in the quality of science and performance.      However, there was found the case against the notary deed material legally flawed, because it is less understood material Franchise Agreement are regulated by Government Regulation Number 42 Year 2007. Therefore, the Notary has been sued under section 372 KUH Pidana KUH Perdata dan 1365. by franchise’s owner, because they feel aggrieved, then through court Surabaya with number lawsuit: 475/ PDT.G/2014/ PN.Sby dated June 10, 2014. In which case the author at present as an expert witness.            With the government's readiness to regulate and advance the performance of Notary through UUJN and implementation supervision conducted by the Supervisory Council in this case Indonesian Notaries Association (INI), aims and expected to provide improved quality of work and minimize mistakes that made by Notary, but how effectively setting U.U.J.N and Notary code of Ethics also supervision by the Board of Trustees to the quality performance of notaries? From the research, the authors obtain the evidence is less satisfactory to the performance of the Notary and concluded a few things short comings as follows:1.      Notary performance that served to open the office with work experience under 5 (five) years, is still far from satisfactory service users in certain authentic deed;2.      A number of respondent who have been contected by the auther, more then 50% less than satisfactory performance of the new Notary,even it’s harmful if used;3.      Internship for prospective notary can be seen from (2) opinions: the first for a notary public employees who have worked at the notary's office for many years of apprenticeship provisions, arrangement (2) year internship is not a problem. But for pure student graduates Master Notary that the field work everyday with a different scope of notary’s work,for example it as housewives or as employees, according the authors, that’s less enough experience and still far of good performance. Keywords: Law Notary (UUJN), Notary Code of Ethics, Performance Notary. AbstrakPemerintah Republik Indonesia dalam upayanya meningkatkan kinerja notaris di Indonesia, tercermin dengan diundangkannya Undang-Undang Jabatan Notaris (UUJN) Nomor 30 Tahun 2004 pada tanggal 06 Oktober 2004 sebagai ganti Peraturan Jabatan Notaris produk peninggalan kolonial dan kemudian karena perkembangan zaman dan kebutuhan hukum yang belum tertampung, sehingga perlu penyesuaian. Beberapa pasal UUJN Nomor 30 Tahun 2004 tersebut, kemudian diundangkannya UU Nomor 2 Tahun 2014 tentang Jabatan Notaris (selanjutnya disebut U.U.J.N), dan mulai diberlakukan sejak tanggal 15 Januari 2014, yang di dalamnya tercakup pula pengaturan pengawasan terhadap kinerja notaris yang dilakukan oleh Menteri Hukum dan HAM R.I dalam hal ini pelaksanaan pengawasannya dibantu oleh Majelis Pengawas Notaris yaitu Ikatan Notaris Indonesia, keseluruhan itu  merupakan upaya pemerintah menyiapkan perangkat undang-undang untuk mengatur dan mengawasi kinerja notaris di Indonesia,   Notaris adalah pejabat umum yang seharusnya melekat beberapa karakteristik dalam menjalankan tugasnya, antara lain: tanggung jawab, disiplin, mutu kerja, moralitas dan kode etka profesi, juga ketrampilan menjalankan tugas jabatannya yang dalam hal ini berkaitan dengan “magang kerja” yang merupakan salah satu syarat mutlak untuk diangkat sebagai notaris. Notaris adalah figur-figur sumber daya manusia yang menjalankan sebagian administrasi negara dalam bidang hukum  keperdataan, sehingga apabila suatu negara tidak didukung sumber daya notaris yang berkualitas, maka akan menjadi salah satu faktor penghambat perkembangan ekonomi nasional maupun era global.Masyarakat pengguna jasa hukum notaris, menganggap akta-akta yang dibuat di hadapan notaris dapat dipercaya dan dapat dijadikan sebagai alat bukti yang kuat apabila terjadi sengketa hukum di pengadilan dan mengharapkan akan memberikan jaminan kepastian hukum atas kebenaran isi akta yang dibuatnya, karena masyarakat pengguna jasa  notaris menganggap notaris jauh lebih mengerti dan menguasai bidang ilmunya, sehingga masyarakat merasa aman jika maksud yang dikehendaki akan dituangkan dengan benar ke dalam akta otentik yang dibuat notaris yang dipilih sendiri, karena kepercayaan akan kualitas ilmu dan kinerjanya.Namun demikian masih dijumpai kasus gugatan terhadap akta notaris yang materi aktanya cacat hukum, karena dalam kasus ini kurang dipahaminya materi Perjanjian Waralaba (Franchise) yang diatur oleh Peraturan Pemeritah Nomor 42 Tahun 2007. Sehingga Notaris tersebut digugat berdasarkan pasal 1365 KUHPerdata dan 372 KUH Pidana oleh pemilik franchise karena merasa dirugikan, melalui P.N Surabaya dengan No.Gugatan 475/PDT.G/ 2014/ PN.Sby.Tanggal 10 Juni 2014, dimana penulis di hadirkan sebagai saksi ahli.            Dengan kesiapan pemerintah untuk mengatur dan memajukan kinerja notaris melalui U.U.J.N serta pelaksanaan pengawasannya yang dilakukan oleh Majelis Pengawas, seberapa efektif pengaturan UUJN dan Kode Etik Notaris terahadap kualitas kinerja notaris? Dari hasil penelitian penulis menyimpulkan beberapa hal kekurangannya :     Kinerja notaris yang bertugas membuka kantor dengan pengalaman kerja di bawah 5 (lima) tahun, masih jauh dari memuaskan pengguna jasa dalam pembuatan akta otentik tertentu;Dari responden yang penulis hubungi, lebih dari 50 % kinerja notaris baru  kurang memuaskan, bahkan merugikan jika dipergunakan;Magang bagi calon notaris tidak berfungsi maksimal.Kata kunci: Undang-Undang Jabatan Notaris (UUJN), Kode Etik Notaris, Kinerja Notaris.

Abstract

Abstract Most of Indonesia citizens as moslems and Islam tends to be the majority religion int the word. Therefore, there is a need to start applying sharia compliances in various life aspects of Indonesia citizens, espectally in trade field. One of trade activities of Indonesia UKM takes place in stall. According to that, this research has several research questions, they are; (a) what are kinds of sharia compliant contracts take place in stall, (b) how is the suitability with KHES, and (c) is these any contracts which be able to cancle each other out. This research used socio legal research method with primary data and case approach. The research results as follows; (a) these are two kinds of sharia compliant contracts which take plase in stall, (b) single contract in stall is suitable with KHES compliances, and (c) certain single contract is be able to cancle other single contract out.Keywords: Contract, Sharia, and Stall. AbstrakMasyarakat Indonesia mayoritas beragama Islam dan ada kecenderungan agama Islam menjadi agama mayoritas di dunia. Dengan demikian ada kebutuhan untuk mulai menerapkan ketentuan syariah dalam berbagai sendi kehidupan masyarakat Indonesia, khususnya dalam bidang perdagangan. Kegiatan perdagangan dalam kategori UKM di Indonesia salah satunya terjadi di warung. Rumusan masalah dalam penelitian ini adalah; (a) Jenis akad apa saja di warung yang sesuai syariah, (b) bagaimana kesesuaiannya dengan KHES, dan (c) adakah akad-akad yang saling membatalkan. Penelitian ini menggunakan metode penelitian hukum empiris (socio legal research) dengan menggunakan data primer serta pendekatan kasus. Adapun hasil penelitiannya adalah; (a) terdapat dua jenis akad sesuai syariah yang terjadi di warung, (b) akad tunggal di warung sesuai dengan ketentuan KHES, dan (c) akad tunggal tertentu dapat membatalkan akad tunggal lainnya.Kata kunci: Akad, Syariah, dan Warung.

Abstract

The research objective was to determine the Roles and Responsibilities of Land Deed Making Officials in the Implementation of Land Registration Activities as well as the responsibilities of the sub-district head as land deed maker official. While the deeds he made, the approach method used in this study was juridical normative or literature law research or legal research. Doctrinal, namely legal research by examining library materials and secondary materials, which in this case relates to the roles and responsibilities of temporary land deed-making officials in organizing land registration activities. The results of the research show that the Land Deed Authorization Officer has a very important role in assisting the Head of the Land Office to register land. And because of that, it is hoped that a Land Deed Making Official has good spirit and mentality as well as professionalism in carrying out his position serving the community in making land deeds, so that a sense of security and comfort from the community can be created and the purpose of land registration itself can be realized.
