anun: Jurnal Ilmu Hukum (KJIH), the Indonesian Journal of Autonomy Law, is an international journal dedicated to the study of autonomy law within the framework of national and international legal systems. Published thrice annually (April, August, December), KJIH provides valuable insights for scholars, policy analysts, policymakers, and practitioners. Managed by the Faculty of Law at Syiah Kuala University in Banda Aceh, Indonesia, KJIH has been fostering legal scholarship since its establishment in June 1991, with the ISSN: 0854 – 5499 and e-ISSN (Online): 2527 – 8428. In 2020, it received national accreditation (SINTA 2) from the Ministry of Research and Technology of the Republic of Indonesia and the National Research and Innovation Agency. KJIH is actively pursuing indexing in prestigious databases like Scopus, Web of Science and other global indexes. We publish in English for accessibility, not as a political statement. The Editorial Board shall not be responsible for views expressed in every article.

Policy regulations are needed in the administration of government. As the rule of law country, Indonesia has a consequence of acting based on law. But the summary of the regulation of the formation of policy regulations raises various multi-interpretations in its implementation. This raises problems, including the substance of the material that exists in the policy regulations is contrary to the laws and regulations. This study aims to find the concept of convergence of the formation of policy regulations in local laws. This is doctrinal legal research examining various laws and regulations. The research shows that there is a discourse on the convergence of the formation of policy regulations as part of regional legal provisions in an effort to protect preventive law hence officials of local government in the formation of policy regulations follow rules and guidelines that have been worded in legislations. The convergence of the formation of policy regulations at the regional level is carried out by changing the Regulation of the Minister of Home Affairs Number 80 of 2015 in connection to the Regulation of the Minister of Home Affairs Number 120 of 2018 concerning the Establishment of Regional Laws hence the laws in the form of regulations consist of regulations, Regional Representative Houses’ regulations, and regional policy regulations.

Tujuan penelitian ini adalah untuk mengkaji tentang pengaturan Air Defence Identification Zone (ADIZ) menurut hukum udara internasional, dan alasan diperlukannya ADIZ di wilayah teritorial dan Zona Ekonomi Ekslusif (ZEE) Indonesia. Kajian ini penting disebabkan keamanan suatu negara merupakan hal penting diterapkan oleh negara sebagai pelaksanaan kedaulatannya. Metode yang digunakan dalam penelitian ini adalah metode yuridis normatif yang bersifat deskriptif analitis. Hasil penelitian menunjukkan bahwa adanya Pasal 51 Piagam PBB, hukum kebiasaan internasional, dan Konvensi Penerbangan Sipil Internasional yang menjadi dasar pemberlakuan dan pengaturan ADIZ. Adanya penetapan ADIZ di wilayah territorial dan ZEE Indonesia menjadi suatu hal yang perlu dan penting sebagai sarana identifikasi dini bagi pesawat asing yang akan memasuki wilayah udara Indonesia dan sekaligus sebagai pengamanan Alur Laut Kepulauan Indonesia (ALKI). Hal tersebut ditegaskan dengan telah ditetapkannya Peraturan Pemerintah Nomor 4 Tahun 2018 tentang Pengamanan Wilayah Udara. The Important of Air Defence Identification Zone in Indonesia The purpose of this study is to examine the regulation of the Air Defense Identification Zone (ADIZ) according to international air law, and the reasons for the need for ADIZ in the territory and the Indonesian Exclusive Economic Zone (EEZ). This study is important because the security of a country is important to be applied by the state as the implementation of its sovereignty. The method used is normative juridical method which is analytical descriptive. The results showed that the existence of Article 51 of the UN Charter, customary international law and the International Civil Aviation Convention which forms the basis of ADIZ's enforcement and regulation. The establishment of ADIZ in Indonesia's territorial and EEZ becomes a necessary and important as a means of early identification for foreign aircraft that will enter Indonesian airspace and at the same time as a security for the Indonesian Archipelagic Sea Lane (ALKI). This was confirmed by the Government Regulation Number 4 of 2018 concerning Safeguarding Airspace.

Corruption is a crime having an exstraordinary effect. The highest number of the cases is the the worst threat for people welfare as the financial loss of state meaning that the welfare will be difficult to be achieved. Thus, it is necessary to get people participation in preventing the crime. Despite the fact that the effort would not be successful to eradicate corruption in Indonesia as it is deemed as white collar crime. However, it is important to done because it is kind of social control. The higher participation of the people, the lesser the crime will be. Such effort is a part of government responsibilitu, concretely by realizing the Government Regulation Number 71, 2000 regarding the Code of Conduct of People Participation in Running Governance by rewarding them who enforce the crime. ABSTRAK: Salah satu jenis agunan yang dapat diberikan debitur kepada bank adalah tanah. Hal tersebut penting dilakukan agar penyaluran dan pengembalian kredit dapat berjalan lancar sesuai harapan. Namun kredit macet selalu tidak dapat dihindari. Salah satu langkah yang dapat ditempuh bank adalah dengan mengeksekusi obyek agunan yaitu tanah melalui hak tanggungan. Salah satu cara eksekusi hak tanggungan tersebut adalah berdasarkan ketentuan Pasal 6 Undang-Undang No. 4 Tahun 1996 tentang Hak Tanggungan Atas Tanah Beserta Benda-benda yang Berkaitan dengan Tanah (UUHT). Tulisan ini akan menelaah tentang bagaimanakah proses pelaksanaan eksekusi hak tanggungan berdasarkan ketentuan Pasal 6 UUHT. Penelitian menggunakan metode pendekatan yuridis normatif yang bersifat eksplanatoris, dan akan dianalisis dengan pendekatan kualitatif. Hasil penelitian menunjukkan bahwa eksekusi hak tanggungan berdasarkan ketentuan Pasal 6 UUHT haruslah diperjanjikan terlebih dahulu antara bank dengan debitur. Janji tersebut dituangkan dalam Akta Pemberian Hak Tangungan Atas Hak atas Tanah (APHT). Apabila telah diperjanjikan, maka bank dapat mengajukan pelaksanaan eksekusi hak tanggungan kepada KPKNL. The Settlement of Non-Performing Loans Through Parate Execution ABSTRACT: One type of collateral that can be given to the bank's borrowers is ground. This is important so that the distribution and loan repayments can run smoothly as expected. However, bad credit cannot always be avoided. One of the steps that can be taken by the executing bank is the object of the collateral is land through mortgage. One way of execution of the mortgage is based on the provisions of Article 6 of Law Number 4, 1996 on Mortgage of Land Along Objects Relating to Land (UUHT). This paper will examine how the process of the execution of the mortgage under the provisions of Article 6 UUHT. This is normative juridical approach that is both explanatory and will be analyzed by qualitative approach. The results showed that the execution Encumbrance pursuant to Article 6 UUHT must be agreed in advance between the bank and the debtor. Appointments are set forth in the Deed Granting Bond Over Land Rights (APHT). It has been agreed then the bank may apply for execution to KPKNL Mortgage.

ABSTRACT: The concept of corporate responsibility is part of social and moral responsibility for actions and business activities that menpunyai influence on certain people, communities and the environment in which it operates can be accounted for in accordance with the provisions of Article 74 of Law Number 40 Year 2007 concerning Limited Liability Companies and Law Number 32 Year 2009 on the Protection of Environmental Management, especially in Article 87 and 116. The article clearly stated that the corporation is a crime that could potentially damage the environment and causing insured losses and casualties could be criminal. This research investigates the Ombudsman recommendations as the improvement of the maladministration’s prevention and the efforts that against government agencies which do not implemented their duties. This juridical-normative research uses four kinds of approach like statute, historical, conceptual and comparative approach. The Ombuds-man’s existence after 19 years establishment can be said hasn’t fully work as that institution expectation. The responsibility to accept all complaint about maladminis-tration especially in public services just relied only by issues the recommendations about conclusions and suggestions. Ombudsman doesn’t has the authority to execute the result of their investigations, so that the rules of recommendation’s implementation are weak. The 2016-2020 period’s recommendation haven’t implemented optimal enough. Therefore, recommendations as the improvement of the maladministration’s prevention need to equalizing the perspective and detailed the implementation rules, so that a stronger legal protection about the position and also the function of its recommen-dations can be achieving prosperity.

Artikel ini bertujuan untuk mengungkap dan menganalisis implementasi pelaksanaan lelang tanah jaminan yang terikat hak tanggungan. Metode yang digunakan adalah yuridis normatif. Dengan metode tersebut ingin digambarkan hak tanggungan sebagai salah satu jenis jaminan kebendaan. Meskipun tidak dinyatakan dengan tegas, jaminan kebendaan adalah lahir dari suatu perjanjian. Undang-undang hak jaminan menentukan bahwa pada dasarnya pemberian hak tanggungan hanya dimungkinkan jika dibuat dalam bentuk perjanjian yang memenuhi syarat sahnya perjanjian. Terkait syarat sah perjanjian, pada dasarnya eksekusi dan penjualan hak atas tanah yang dibebani dengan hak tanggungan dapat dilaksanakan melalui dua cara, yakni lelang berdasarkan eksekusi parate, dan lelang berdasarkan sertifikat hak tanggungan yang mempunyai kekuatan eksekutorial. Dalam praktik umumnya dilakukan melalui parate eksekusi. Auction of Land Collateral Which Bound by Mortgage Rights This article aims to uncover and analyze the auction of land collateral that is bound by mortgage rights. This is normative juridical research, with the purpose to describe mortgage rights as a type of material collateral. Although it is not stated assertively, material collateral is a result of an agreement. The collateral law stipulates that basically granting mortgage rights is only possible if it is made in the form of an agreement that is in accordance with legal requirements. Regarding the legal terms of the agreement, basically the execution and sale of land which bound by mortgage rights can be carried out in two ways that are auction based on parate execution and auction based on a certificate of mortgage rights that has an executorial power. In practice it is generally done through parate execution.

ABSTRAK. Permasalahan terkait dengan kebijakan pemerintah Aceh khususnya bidang pendidikan menjadi layak untuk ditelaah. Merujuk pada tingkat pendidikan mempunyai kolerasi erat dengan kemiskinan. Undang-Undang tentang Pemerintahan Aceh sebagai penyangga dan landasan penting bagi eksistensi Aceh perlu aplikasikan substansinya. Namun jika teks UU hanya menjadi bahan bacaan dan terapan bagi sebagian golongan, tentunya sebagian golongan lainnya akan bereaksi akibat adanya diskriminasi. Sehingga dalam tulisan ini, education for the all harus dijadikan sebagai bahan refleksi dalam menindaklanjuti berbagai masalah yang terjadi dalam masyarakat Aceh. Education for All in the Law on Government of Aceh ABSTRACT. Problems associated with the Aceh government policies, especially in education become eligible for review. Referring to the education level has a close correlation with poverty. the Law on Government of Aceh as a buffer and an important foundation for the existence of Aceh need to apply the substance. But if the text of the Act only reading material and applied to some groups, of course, most of the other groups would react as a result of discrimination. Thus, in this paper, the education for all should be used as a material reflection of following up the various problems that occur in Acehnese society.

ABSTRACT: This article aim is to describe concerning the existency of customary rights to the land for the further named hak ulayat in the structure of the power rights acces to the land. The requirements so that it can be recognized as hak ulayat to the land based on the national agrarian law. The study in tihis article is a normative study by using analyse any kind of nasional law, research result and also the expert insight in relation to issue studied. The analyse result shows that hak ulayat in which as the Indiginous rights has position as an entity of rights to the land in Indonesia’s agrarian national law. The rights of those indigenous peopleis recognized its existency if it fulfills two requirements cumulatively are as follow: 1) that indigenous people’s rights are still available/exist, not have ever been, and 2) The application of those rights of indigenous people has to be pro- to Indonesia’s insight. The symbolization of the state recognition to rights of indigenous people is: 1) the legalization into regional law (Qanun) in Districts level; or president decree depends on the location of that indigenous right present; or in kind of related regional leader decree, 2) compensation for hak ulayat which is used for public and even personal needs/interrest. ABSTRACT: Nowadays, crime has increased very significantly. The increase is not only on its quantity but also on its quality. Punishment as the last “mean” in preventing and overcoming crime is supposed to function maximally in order to protect society from perpetrators. The function of criminal law is really influenced by characteristic of society where the law enforced. Moreover, the application of proper punishment as a mean of preventing crime is also influenced by the increase and the decrease of crime numbers and also has impact on the society welfare. Punishment towards body is a kind of punishment that is still applied by many states including Indonesia. The regulation of such crime as one of the crimes in Indonesia Indonesia legal system is really possible to prevent crime in terms of restoring national legal system to replace KUHP (Criminal Code of Indonesia) as colonial legacy that is not proper to society characteristics in Indonesia and the period.
